While today’s reces-sion is devastating toAmerica’s poor and

working peo-ple, it is alsoan opportu-nity. As presi-dential aideRahm Em-manuel fa-mously said,“A crisis is a

terrible thing to waste.” Now is thetime to fight for systemic solutionsthat meet our most urgent needs andreflect our most fundamental val-

ues. CHAM Deliverance Ministryand the Affordable Housing Net-work, in San Jose, California, havelaunched a “Letters to Obama”campaign to urge the President totake bold action to solve America’shistoric housing problem. Real eco-nomic recovery begins with provid-ing for the least of our brothers andsisters.

The stimulus plan recentlysigned by President Obama pro-vides some welcome emergencyshelter and homelessness preven-tion assistance. However, it fails toaddress America’s larger housingproblem. It provides little if anysupport for new public housing,

funding for the National AffordableHousing Trust Fund, or new Section8 vouchers. The $1 billion for theTrust Fund initially proposed is stillfar short of the need, and even ofthe original projections by TrustFund proponents. In addition, thePresident’s anti-foreclosure planleaves many details yet to beworked out, and may have limitedapplicability in Santa Clara Countybecause so many local loans exceedFreddie Mac guidelines.

Some people are hesitant tomake demands on Obama. This isbecause many feel that people on allsides are already besieging Obama. But the President himself has re-peatedly called on us to fight forwhat we need. Over and over dur-ing his campaign, he told us thatchange is not about what he or any-one else does in Washington, butrather what we do to organize thepeople in our communities.

Furthermore, the more active,well-organized, and demanding weare, the better Obama will be ableto defeat the obstructionists who aredetermined to make him fail. Pow-

erful special interests are conspiringat this very moment to strangle eco-nomic recovery, block labor lawand immigration reform, and denyuniversal health care. Just lastweek, America’s bankers pressuredObama to give them a trillion-dollarinvestment guarantee. If we fail tospeak out for what we need now, before the nation’s treasury is com-pletely looted by corporate thieves, both Obama and our hopes for abetter America will go down in de-feat.

CHAM Deliverance Ministryand the Affordable Housing Net-work are firmly committed to theproposition that housing is a humanright. We recently completed astudy of Chester Hartman’s ground-breaking book, “A Right to Hous-ing.” This book inspired us with thevision of transforming housingfrom a commodity, used for specu-lation and private profit, into whatit was originally intended to be: astructure to protect human beingsfrom the elements and ensuresafety, privacy, and a decent qualityof life for everyone.

As a first step, we are askingour friends and neighbors to sign acopy of the letter below, add per-sonal comments and, if possible, aphotograph. Change is not a specta-tor sport!

Dear President Obama,Please take action to end Amer-

ica’s affordable housing and home-lessness crisis. We need:

* More section 8 vouchers im-mediately

* Build public housing to meetthe need

* Full funding of the NationalHousing Trust Fund

* Stop foreclosures. To sign the letter or participate

in the campaign, contact us at [email protected] or 408-691-6153. Letters are available inSpanish. Letters and photos wehave already collected may beviewed at http://housingisahuman-right.blogspot.com .

Letters to Obama

Page 3: El Observador April 10

After a trillion tax-dollar bailout for Wall Street, our economy is still in the toilet, pluggedup with toxic paper worth a fraction of what workers saved from earnings for a home,a child’s college education, or a comfortable retirement. The joke about how every-

one’s 401(k) retirement fund is now a 201(k) is no joke as most investments have lost half theirvalue since 2008. The home purchase will have to wait, the college student must settle for tradeschool and a lifetime of low wages, and the retirement plan becomes a “work til you’re dead andhope it happens before uninsured long-term care is required.”

But not to worry: Treasury Secretary Geithner is planning a second trillion dollar giveaway, but this time with a string attached: a request the largess be lent out rather than used for buyingother banks or paying off old debt to foreign banks. Yes, that is what Wall Street did with our firsttrillion, they went on bank shopping sprees, paid billions in bonus gifts to themselves, and reducedtheir own corporate debt.

The public outrage over the bonus payments was met with consternation by PresidentObama, Geithner, and Congress. However, as the president’s economists stated, “The bonusesare binding contracts, we are a nation of laws, so we cannot tell Wall Street what to do (with ourmoney).” Yet days later, everyone in the Washington DC Beltway stated with equal consterna-tion, “Those autoworker union contracts must to be set aside if the industry is to be granted anymultibillion dollar loan.”

Are these two statements spoken by the same individuals contradictory? Or is there a logicthat escapes us outside the beltway? George Orwell stated it richly simple in his Animal Farmsatire, “All pigs are equal, but some pigs are more equal than others!” Similarly, all contractsmust be honored in a nation of laws, but some contracts can be shredded when they apply towage workers rather than billionaires. Wall Street and the Washington Beltway are connectedin an insidious manner, where they see eye-to-eye, feel each other’s pain, think with the samemind: “Above all, we must protect our financial system!”

But what is this “great system” that must be protected, sustained, if it has broken down sooften and has thrown 10 million out of work, 2.5 million homes into foreclosure, fails to providehealth insurance for 45 million? The system is called Free Market Capitalism, which means:barely regulated robber baron capitalism. The wealthy ruling class designed the economicsystem to benefit their ownership class, and now that the system has failed even them, they willdetermine how to fix the meltdown.

It is high time that American workers woke up to the reality many already suspect: Our so-called Democracy is in reality a Pluto-Oligarchy, defined as government by the wealthy few-where an elite class of families with great wealth are interconnected to control every aspect of thesociety. The children of the powerful are prepared, conditioned and mentored to inherit all theimportant levers of the nation to continue their “rightful elite rule.” This explains why GeorgeBush, Jr. became president.

But this time, the oligarchs at the casino called Wall Street drove the financial system intomeltdown, and the Congress and President, in panic, bail out billionaires to whom they are be-holden for their election. The claim that the financial system is so complicated that only WallStreet CEOs can fix the system is but an ever more sophisticated manipulation by the oligarchs.

How can we set our financial system in order without putting another trillion into the banks?Put that trillion into wages by employing everyone, including the 10 million who just lost their jobs.Workers pay taxes and consume goods, taxed once again-this is economic stimulus! Thereis so much valuable work that must be done to rebuild America: our cities are all in decay, weneed flood control, road repair, high speed rail, schools for the 21st century, health care for every-one. No American family should be homeless, so home foreclosures must be transformed intohousing opportunities for working families.

At the end of World War II President Roosevelt realized that a devastated Europe would onceagain be fertile ground for fascism, so he initiated the Marshall Plan to rebuild Europe, and itworked. Today our own nation needs an American Marshall Plan. There is so much workto be done that every man and woman who can work, who wants to work, who needs a job canjoin in the most worthy goal of our generation: to rebuild America!

We must all shout: NO MORE BAILOUTS for BILLIONAIRES!Bail out the American worker with a job, a home, health care and education! Δ

About Those Three Kids

Ocur

rielci

as

The story of those three kids (abrother and two sisters, I’m told)was like reading one of Aesop’s fa-bles. Three foster kids were placedunder the protection of the fostercare program only to end up in Ju-venile Hall where they stayed ƒorfive days. Their ages are 10, 11, and12, yet some public servant made adecision that it was all right to placethree related Latino siblings into Ju-venile Hall. The lower age limit ofthose detained in Juvenile Hall is12, so what are the 10, 11, and 12year olds doing there?

And there they stayed for fivedays without the benefit of a courtorder or having committed a crimeof some sort. It was only after thisimproper incarceration of three sib-lings was rediscovered that a crim-inal base was divulged. Who wasinvolved? Well there is the CountyExecutive’s Office who is responsi-ble for the administration of Juve-nile Hall after a decision by thevoters a few years ago. JuvenileHall is operated and supervised bystaff under the direct guidance ofthe Probation Department. Thesethree foster kids were to be underthe protective custody of the Fam-ily and Children’s Protective Serv-

ices division of the Social ServicesAgency. Who knows if this grouplost track of their charges? The Pre-siding Judge, after the fact, said thatall involved are re-writing their pro-tocols to prevent this from ever hap-pening again. The challenge ofhaving different service groups co-ordinating their actions does notseem to have been met in this case.

A phone call to the offices ofSupervisor David Cortese andGeorge Shirakawa, Jr. reveals thatboth reacted to knowledge aboutthis case by asking for a reportabout this unique happening. Doesanyone really think that what actu-ally happened will be reported ac-curately? Not when we considerthat several individuals from differ-ent service agencies were involved. How does one document the lack ofusing common sense and goodjudgement in this case? Did exist-ing protocols give staff guidelineson what to do in a case such as thisone? Regardless, the report will befeared because it will reveal thatsomeone made a very poor decisionor used very poor judgement whichany investigation may documentafter the fact.

The community is both very

amazed and very concerned. Howcould something like this happen tothree children who are in the pro-tective custody of a local govern-ment agency?

My suggestion is that severalletters to the Presiding Judge needto be sent. The subject needs to bethis case. The recommendationneeds to be that this case needs tobe fully examined by the CivilGrand Jury as soon as possible, be-fore those who made the decisioncan write new protocols to protecttheir backsides. The Civil GrandJury is the correct group to do thisfull investigation because it has thepower to subpoena those involvedand may receive/examine privi-leged and confidential information. All others have a conflict of inter-est. Consider that perspective whenasking for a full investigation by theCivil Grand Jury. This case is aboutthree kids who ended up beingabused by the existing system. Let’ssee if improvements can be made.

SI USTED ES UN MIEMBRO DEL GRUPO DE DEMANDANTES, ESTE AVISO CONTIENE INFORMACIÓN IMPORTANTE, COMO SU DERECHO A RECIBIR UN PAGO EN LA FORMA DESCRITA

CON MAYOR DETALLE A CONTINUACIÓN.

AVISO LEGAL

Y COMUNIDAD

By Osvaldo Castillo- El Observador

Life has not been easy for Priscilla Camacho, who is from East San Jose. She joined a gangat the age of 14, sold drugs to pay bills and

became addicted to crystal methane.“I never got to be kid,” Camacho said. She was told by her teachers that she was a piece

of garbage and will never get anywhere in life.“One of them told me that he didn’t care if I com-

pleted my homework because he was going to be get-ting paid anyway.”

Camacho was one of several community memberswho attended a community meeting on Friday, April 3rd,to ask elected officials to take action to stop East SideUnion High Schools’ dropout and crime crisis, and eco-nomic decline. The elected officials were East SideUnion High School District Trustees Manuel Herrera andEddie Garcia, and Santa Clara County Supervisor DaveCortese.

The community asked the officials to make an effortto reduce the drop out rate in East San Jose high schoolsby ten percent each year and approve funds to provideone additional mental health worker for each high schoolin the district.

“In East San Jose, 1,311 students dropped out ofhigh school last year,” reported community memberAmelida Castillo. “That is enough to fill an entire school. The students need counselors to guide them through thedifficult times in their lives.”

According to People Acting in Community Together

(PACT), San Jose lost $34 million in funds due to stu-dents who drop out of high school and end up living a lifeof crime.

Each dropout costs society itself $2.1 millionthroughout his or her lifetime.

The community also asked the officials to supportcharter schools as an alternative to low-performing largeschools in the district.

However, East Side Trustee Eddie Garcia said thatthough charter schools perform better than other schoolsin the district, they are not the answer to solving the dropout crisis in the district.

“Charter schools are small,” Garcia said. “We needto find ways to meet the needs of 26,000 students.”

As for Priscilla Camacho, she is currently attendingApollo High School and plans on attending college to be-come an electrician. She also plans on going back to visitthe teachers that told her she would not succeed in life.

“I want to show them that I succeeded against allodds,” Camacho said.

permitir otras excusas.

When the San Jose Police Department (SJPD) announced the presence of the Con-sortium for Police Leadership in Equity, Chief Rob Davis asked, “We need toknow how we are doing.” Below are some answers from the community. Some

rough public relations issues exist. Examples of rough edges follow: “Fired because of the police”On May 9th 2008, Lucy Resendez was observing the DUI checkpoint at the corner of

Story Road and White Road. She was on the sidewalk talking on the phone when a policemanlit her shoes with a flashlight, asked her for her driver’s license, and said she was under arrest. When she asked, “Why are you arresting me?” the officer handcuffed her and put her into apolice car.

Resendez received a court citation. She was charged with California Penal Code Section140 for obstructing police work. After seven court dates over 11 months her charge was re-duced to Section 415, “Disturbing the Peace” sentenced to 52 hours of community service.Other charges were dropped.

On February 2009 the California Department of Social Services sent an alert regardingthe “additional criminal history” of Lucy Resendez to her employer, BLC Regency in SanJose. Resendez was fired.

“I guess they think I looked like a criminal and now I lost my job because I was walkingaround a DUI checkpoint. Is the SJPD protecting us? Who can I count on to help me if the peo-ple we believe in aren’t going to help?” said Resendez, who has lived in San Jose for 30 yearswithout problems.

This problem has affected the Resendez family. Aaron Resendez, Lucy’s husband, is nowmaintaining his family by himself. Aaron stated: “ We need to throw out the Police Chief. Mywife is not a criminal and my family doesn’t deserve this.”

“I called 911 for help and the police arrested me instead.”On August 2nd, Carlos (name undisclosed because his case is pending) accidentally hit a

car on Senter Road and the people in the other car reacted very negatively and aggressively, threatening him with death. Carlos’ attempts to solve the problem were in vain.

Given the circumstances he left and because he was so fearful and feeling threatened hecalled 911 asking for help. When he arrived at home the police arrested him and put him in apolice car without even asking what had happened. He was charged with “Hit and Run” as wellas being “Drunk”.

“They threw my papers down because I wasn’t drunk”“My friends and I went for dinner. We left a restaurant between Capitol & McKee and we

took the exit to the freeway,” said Juan Mejia. “A police car followed me and stopped me.When the policeman asked for my car registration and insurance and didn’t find anything il-legal, he threw my papers down and told me ‘Get out of here’.”

About informing the Latino PressThe SJPD used to distribute press releases for every checkpoint that it conducts. Prior to

July 2008. El Observador received information that permitted the assignment of staff to domedia coverage. Since July 2008 the content of information has changed and the location ofcheckpoints is no longer disclosed until 2 hours before checkpoint is activated. SJPD needs todisclose complete information under embargo.

The purpose of the media is to disseminate accurate information concerning activities bypolice and the community related to the DUI/vehicular checkpoints. EO Survey

A brief EO survey of 51 individuals at random conducted on the street resulted in the ma-jority saying “I don’t trust the SJPD”.

While the SJPD allegedly treats the Latino community poorly, arresting a large number ofpeople for misdemeanors, Chief Davis asks Latinos to help solve homicide investigations. How does Chief Davis expect the help of the Latino community when most Latinos fear theSJPD? Six had good things to say; 45 were not favorable comments.

Campos expresses concernDistrict 5 Councilmember Nora Campos also expressed concern. “I’m not going to allow

others to excuse the discrepancy as a socioeconomic problem. This is why I have called for in-dependent oversight of Police practices and I expect that process to reveal solutions that willprotect the public from wrongful arrests while ensuring the safety of our officers.”

Campos added that she is troubled by the policing philosophy held by Mayor Reed that tar-gets minor crimes at a time when the Police Department is dangerously understaffed, forcingthe city to pay millions in overtime patrol costs.

According to community analyst Miguel Chacon, these types of conduct arrests don’t cre-ate a safe city when innocent people are being arrested. People suffer grave consequenceswhen they are fired from their jobs due to questionable misdemeanor convictions. Trust is lostin working with the police on crime detection. Despite the fact that the immigration status ofLatino victims is not known, even misdemeanor convictions of noncitizens can lead to denialof a green card or citizenship, potential loss of eligibility for a future federal legalization pro-gram, and even deportation. Acrowd of enthusiastic Oakland A’s fans gathered at San Jose’s City Hall to encourage MayorChuck Reed and the city council to work hard on bringing the Oakland A’s to San Jose. Theywore hats, jerseys, held signs, told stories and read poems about the Oakland A’s and how the

team’s move to San Jose would benefit everyone involved.Former San Jose mayor Janet Gray Hayes wasone of these fans.

“Bring the A’s to San Jose is a great idea because it will create jobs, which will boost our economy,” Hayessaid.

Mayor Chuck Reed is behind the idea and said he and the city council will do their best to bring the A’sto San Jose. He has made some recommendations, which include building support with local neighbor-hoods, business and labor. Analyzing opportunities and challenges of developing a stadium at the Park Av-enue and Montgomery/Autumn site, and adopting a resolution authorizing the mayor to send a letter to MajorLeague Baseball indicating that San Jose is ready to welcome and work with Major League Baseball.

According to the San Jose Redevelopment Agency, the location willuse up 14,000 parking spaces that already exist in the location, withroom to build more parking. The location will also be near Cal-Train, light rail and a soon to be built BART station.

But not all San Jose residents are thrilled about the ideaof bringing the Oakland A’s to San Jose.

One of these residents is Yolanda Reynolds.Reynolds wrote a letter to Mayor Reed and the city coun-cil expressing her concerns.

One of her concern is how the noise coming from thestadium will affect nearby neighborhood and businesses.

Another concern was the traffic impact that the stadiumwould have on San Jose highways 87,880, 101 and 680.

For now, Major League Baseball will make the final deci-sion on whether or not the A’s move to San Jose.

“We will be ready if Major League Baseball decides to look at SanJose for a possible home for the A’s,” said Mayor Reed.
