It’s outrageous that they’re now trying to derail the entire process. Failure to adopt these regulations will allow countless environmental problems to remain unchecked and increase the health and financial burdens borne by the public. For too long, oil and gas operators in Pennsylvania haveconducted their activities under outdated regulations and withvirtual impunity—factors that have helped spur ever-growingimpacts on water, air, and health.

The final draft Chapter 78 and 78a regulations from theDepartment of Environmental Protection (DEP) represent asignificant step forward in aligning the state’s oil and gasregulations with new technologies and modern-day practices.Today, both conventional and unconventional operations relyon hydraulic fracturing (fracking), use toxic chemicals andlarge volumes of water, disturb land, and generate pollutingwaste.

Both Chapter 78 and Chapter 78a are the result of over threeyears of public hearings, comment periods, and revisions—during which legislators and the industry had ample time toweigh in. It’s outrageous that they’re now trying to derail theentire process. Failure to adopt these regulations will allowcountless environmental problems to remain unchecked andincrease the health and financial burdens borne by the public.

As an owner of several tracts of land in fee and in some cases only the oil and gas rights, I am veryconcerned that the state regulations will interfere with the drilling and development of my lands.

The cost of over-regulation for the conventional oil and gas industry may result in the lessor sharingthe cost of these regulations to encourage the lessee to drill wells that are uneconomical or not worththe business risk if water replacement, plugging abandoned or orphaned wells and other costlyregulations jeopardize the lessees return on investment. The lessor’s cost sharing maybe throughreduced rental, bonuses, royalty income and other contractual conditions. In order to legally reduceroyalty income the lessor may assign part of the royalty to the lessee so that the lessor/lesseeare not out of compliance with the minimum royalty act. As a result of these overreachingregulations some properties will be more favorable to drill than others. Lessors may find that thestate regulations undermine their ability to negotiate a lease that is financially worthwhile for both thelessee and lessor. The unknown cost and delay of working with property owners to locate orphanedand abandoned wells in designated areas of review may cause lessees to abandon drilling plans,especially if a new well cannot be completed in the designated formations unless the lessee incursthe cost of plugging an abandoned and orphaned well. In addition, the state is giving surface ownersrights that may conflict with language in deeds, leases and other agreements where the oil and gas issevered from the surface. How will the state regulators compensate the lessors for loss of revenuesand property rights?

As a tax payer, the state has no right to expect property owners to allow companies to enter privatelands to look for orphaned and abandoned wells. With the downturn in drilling the state shouldeliminate jobs and use the monies to plug abandoned and orphan wells or use the state workers tolocate wells. Damaged water supplies should not be replaced at a higher quality than what existedprior to the time the damage occurred, because it is costly and will discourage drilling wells onproperties that are not close to a public water source.

The state focused on the environment and failed to use common sense on the costs and the need forregulatory change in order to protect small businesses and lessors from economic loss. We wouldhave more rights if we were an endangered species.

Since the summer of 2013, the Department of Environmental Protection (DEP) has been revising standards foroil and gas well sites. This long and transparent process has included:

Twelve public hearings and nearly 30,000 comments.Two distinct sets of regulations for conventional operations and unconventional operations.Meetings and affirmative votes by the Technical Advisory Board (TAB), Conventional Oil and

Gas Advisory Committee (COGAC), and the Environmental Quality Board.In just the last week, submission of over 3000 comments by the public to IRRC in favor of the

rules.

IRRC’s decision clearly follows this long path of comprehensive review and vetting of the proposed regulations.The public, industry, and legislators have had ample time and opportunity to weigh in. The two sets ofregulations are properly promulgated and legally sound. Given all this, continued efforts to delay Chapter 78and 78a are nothing less than an attempt to circumvent Pennsylvania’s policy and regulatory system andundermine DEP’s statutory authority.

As with all types of policymaking, in the end not everyone gets everything that they want. To make progress,compromise is sometimes necessary. From our perspective, both Chapter 78 and 78a omit critical protections,in particular with regard to waste management, noise control, and setbacks from homes and schools. We willcontinue to work to achieve these protections.

Nonetheless, Earthworks believes that the regulations before you today are a critical step forward and must beadopted. They align Pennsylvania’s regulatory framework with current oil and gas operations and technologies,which have changed dramatically in the last several years. They address in significant ways problems of wasteproduction, drilling near schools and playgrounds, spills of polluting substances, and identification ofabandoned wells.

All of these problems exist with both conventional and unconventional operations, which often differ only as amatter of scale. Consider that:

• Between 2009-2014, unconventional operators drilled about 8300 wells, while conventionaloperators drilled over 7800.

• In 2014, conventional operations accounted for over three-quarters of violations issued byDEP.

• Between 2008-2014, 60% of the investigations conducted by DEP on the migration of methaneinto drinking water supplies involved conventional operations .11]

• Chapter 78 allows conventional operators to conduct practices that are prohibited underChapter 78a for unconventional operators. Some of these can have severe environmentalimpacts, such as storage of polluting waste in open pits and use of large volumes of water withouta water management plan.

We recognize the fact that in the midst of the Marcellus Shale boom, conventional operators have seen theirproportion of oil and gas production decline. However, this is certainly not the result of overly onerousregulations—regulations that haven’t been comprehensively updated in decades. Regulatory oversight issimply part of doing business. It’s what operators sign onto when they receive permits from DEP.

After such a long time, the adoption of both sets of regulations is necessary to lessen further pollution and thehealth impacts suffered by residents across the Commonwealth. Please vote yes and advance Chapter 78 and78a.

As an owner of several tracts of land in fee and in some cases only the oil and gas rights. I am veryconcerned that the state regulations will interfere with the drilling and development of my lands.

The cost of over-regulation for the conventional oil and gas industry may result in the propertyowners/oil and gas owners sharing the cost of these regulations if the lessor wants a well and it isuneconomical or not worth the business risk for a lessee to drill with the threat of water replacementand plugging abandoned or orphaned wells through reduced lessor’s rental, bonuses, royalty incomeand other contractual conditions. As a result, these regulations and other regulations will also rendersome properties more favorable to drill than others. Property owners may find that the stateregulations undermine their ability to negotiate a lease that is financially worthwhile for both thelessee and lessor. The unknown cost and delay of working with property owners on orphaned andabandoned wells in designated areas of review from conventional wells that are proposed to befracked and not part of the Operator’s cost estimate may cause lessees to abandon drilling plans.The state is giving surface owners rights that may conflict with language in deeds, leases and otheragreements where the oil and gas is severed from the surface. How will the state regulatorscompensate the lessors for loss of revenues and property rights?

As a tax payer, the state has no right to expect property owners to allow companies to enter privatelands to look for orphaned and abandoned wells. With the downturn in drilling the state shouldeliminate jobs and use the monies to plug abandoned and orphan wells or use the state workers tolocate wells. Damaged water supplies should not be replaced at a higher quality than what existedprior to the time the damage occurred, because it is costly and will discourage drilling wells that donot have a convenient public water source.

The state focused on the environment and failed to use common sense on the costs and the need forregulatory change in order to protect small businesses and lessors from economic loss. We wouldhave more rights if we were an endangered species.

I’m tired of seeing this once beautiful state now at the top of the listof MOST POLLUTED STATES, just after Ohio. . .aren’t you? Very sad. We needto do more to protect our water, air, and soil.. .not less. We count on ourlegislators to be upstanding and protect the contmonwealth from those thatwould exploit it for their own benefit at the expense of PA residents’present and future health and safety.

Fracking has been a part of making our state much more polluted anddirectly exposing our residents to polluted air and water and soil. Thegas-drilling industry spin it differently, but if you do your homework,you won’t fall for their self-interested marketing. The pollutedenvironment and toxic wells tell the real story. There are few areas ofthe state now that remain untouched by the effects of fracking or thethreat of fracking nearby. Pennsylvania and its residents deserve betterthan to become a polluted cesspool at the top of the most-polluted lists.

Dear IRRC Members,

As an owner of several tracts of land in fee arid in some cases only the oil and gas rights, I am veryconcerned that the state regulations will interfere with the drilling and development of my lands.

The cost of over-regulation for the conventional oil and gas industry may result in the lessor sharingthe cost of these regulations to encourage the lessee to drill wells that are uneconomical or not worththe business risk if water replacement, plugging abandoned or orphaned wells and other costlyregulations jeopardize the lessees return on investment. The lessor’s cost sharing maybe throughreduced rental, bonuses, royalty income and other contractual conditions. In order to legally reduceroyalty income the lessor may assign part of the royalty to the lessee so that the lessor/lesseeare not out of compliance with the minimum royalty act. As a result of these overreachingregulations some properties will be more favorable to drill than others. Lessors may find that thestate regulations undermine their ability to negotiate a lease that is financially worthwhile for both thelessee and lessor. The unknown cost and delay of working with property owners to locate orphanedand abandoned wells in designated areas of review may cause lessees to abandon drilling plans,especially if a new well cannot be completed in the designated formations unless the lessee incursthe cost of plugging an abandoned and orphaned well. In addition, the state is giving surface ownersrights that may conflict with language in deeds, leases and other agreements where the oil and gas issevered from the surface. How will the state regulators compensate the lessors for loss of revenuesand property rights?

As a tax payer, the state has no right to expect property owners to allow companies to enter privatelands to look for orphaned and abandoned wells. With the downturn in drilling the state shouldeliminate jobs and use the monies to plug abandoned and orphan wells or use the state workers tolocate wells. Damaged water supplies should not be replaced at a higher quality than what existedprior to the time the damage occurred, because it is costly and will discourage drilling wells onproperties that are not close to a public water source.

The state focused on the environment and failed to use common sense on the costs and the need forregulatory change in order to protect small businesses and lessors from economic loss. We wouldhave more rights if we were an endangered species.
