Embedded Server Defined “Embedded Systems” means

COMPANY’S computing systemor device with an Image that (i) isdesigned for and distributed withan Embedded Application, and (ii)is not marketed or usable as ageneral purpose personalcomputing device (such as apersonal computer) or a multi-function server or a commerciallyviable substitute for one of thesesystems.

Embedded Application Defined “Embedded Application” means

industry- or task-specific softwareprograms and/or functionality withthe following attributes:

(a) It provides the primaryfunctionality of the EmbeddedSystem

(b) It is designed to meet thefunctionality requirements of thespecific industry into which theEmbedded System is marketed

(c) It offers significantfunctionality in addition to theLicensed Product Software

OEM Logistics Typical embedded development cycle = 1-3 months

1.

Download and evaluate Windows Embedded Server Product software.2. Prepare prototype and test proof of concept.

3. Contact Elbacom to determine which product SKU to use and requestCustomer License Agreement (CLA) and associated additional licensingprovisions (ALPs) for review.

4. Sign the CLA, return to Elbacom and request appropriate Windows EmbeddedServer Product OPK.

5. Design, develop and test server prototype and install the selected WindowsEmbedded Server Product and embedded application (if applicable)

6. Lock down the operating system for fixed function use (if applicable)

7. Prep and clone final image for manufacture

8. QA & Test systems

9. Activate the OS via Windows Product Activation (WPA) method or SystemLock Pre-installation (SLP) if/when OEM is eligible for SLP by shipping 100units or more in the previous twelve (12) months

10. Ship systems with required EULA and Certificate of Authentication (COA)affixed to the outside of the server enclosure.
