Transitional provisions
1. Construction products which have been placed on the market in accordance with
Directive 89/106/EEC before 1 July 2013 shall be deemed to comply with this
Regulation.
2. Manufacturers may draw up a declaration of performance on the basis of
a certificate of conformity or a declaration of conformity, which has been issued
before 1 July 2013 in accordance with Directive 89/106/EEC.EN 4.4.2011 Official

Amending Annex III to Regulation No 305/2011 on the model to be used
for drawing up a declaration of performance on construction products
Article 4 of Regulation 305/2011 obligates manufacturers of construction products to draw up a declaration of performance when construction product, that is covered by a harmonizedstandard or conforms to a European Technical Assessment issued for that product, is placed on market.
According to Article 6 of Regulation 305/2011, that declaration should be drawn up using the model set out in Annex III to that Regulation.
Technical details necessary to implement the system of
assessment and verification of constancy of performance
are included in relevant harmonized standards.
Harmonized standards refer to the intended use of
construction products which include and define the
methods and criteria for assessing the performance of
construction products in relation to their essential
characteristics.
