1. THAT staff be directed to prepare a funding application to the Transport Canada Rail Safety Improvement Program, for 14 major railway crossing upgrades, at an estimated cost of $1 .1M, as detailed in Report No. ENG 066-2016;
2. THAT staff be directed to improve the 13 minor railway crossings, at an estimated cost of $16,500, from funding identified in the 2017 Capital budget;
3. THAT staff include the upgrade of eight railway crossings, in the urban area, to whistle cessation standards, at an estimated cost of $1.8M in the 2017-2021 Financial Plan, as detailed· in Report No. ENG 066-2016; and
4. THAT the Mayor and Corporate Officer be authorized to execute all documents related to this matter.
SUMMARY OF THE ISSUE
The rail companies and road authorities are responsible for bringing all railway crossings into compliance with the Grade Crossing Regulations (GCR) and Grade Crossing Standards (GCS) within seven years from November 2014. Each of the 52 public at-grade railway crossings in Abbotsford was assessed against the GCR/GCS general requirements. This report deals with the results of this assessment, financial considerations and grant funding opportunities.
BACKGROUND
Railway companies, road authorities (provinces, municipalities, band and council) and private crossing owners are each responsible for managing railway crossing safety in Canada. After national consultation with these stakeholders, Transport Canada introduced GCR which are result based. This means they contain options for bringing a consistent level of safety to each railway crossing in Canada. They will take full effect over a seven year period from date of regulations (November 2014). The regulations incorporate standards based on the best engineering practices known today and makes them law.
In order to prepare a plan for compliance with the GCR the 52 railway crossings in Abbotsford (Attachment "A"), that are under the City's jurisdiction (private crossings excluded), were assessed by Opus International Consultants (Canada) Limited (Opus). The assessment considered existing conditions and gauged these conditions against prescriptive railway crossing and whistle cessation guidelines from Transport Canada. A supplemental safety assessment was completed and a Class D estimate prepared to bring the railway crossings into compliance. Seniority at each crossing was determined with proposed cost sharing.

Required Railway Crossing Improvements to Meet Regulations
The detailed list of required improvements is included in the Opus summary report.
In summary, of the 52 public railway crossings in Abbotsford, 11 crossings are fully compliant, 27 crossings require improvements, at cost to the City estimated at $1,126,500, and 14 crossings require improvements by the rail companies at no cost to the City as outlined in Opus' report. Of the 27 railway crossings, 14 are eligible for the GCR grant program for $1 .1 M. The remaining 13 are not eligible for a grant, but will be funded from the capital budget at $16,500.
Desirable Railway Crossing Improvements (Whistle Cessation)
Federal rules require all trains to whistle when they approach a grade level crossing. Municipalities may work with rail companies to install alternate safety measures at these crossings to eliminate the need for routine train whistling. These may include the installation of either flashing lights and bells or flashing lights, bells and gates, at cost to the municipality (if requested by the municipality). It is important to note that even if a whistle cessation agreement is obtained at a particular location, rail companies will always retain the overriding authority to sound the train whistle at the sole discretion of the conductor.
Of the 52 railway crossings, 19 have whistle cessation standards in place. If the City considered upgrading the remaining 33 railway crossings, it would cost $7.4M to $7.BM. Southern Railway of BC Ltd. will upgrade four of these railway crossings in 2016 to meet the whistle cessation requirements. Of the remaining 29 railway crossings, eight are located within the urbanized area and the cost to upgrade them is estimated at $1 .BM. It is recommended to upgrade the eight locations in order to further improve safety and quality of life by limiting whistling noise in the urban areas. These whistle cessation upgrades are over and above what is required to meet the GCR and would not be eligible under the grant program; although, staff feels that this would support the Official Community Plan (OCP) and Council's Strategic Plan objectives as the City grows and develops.
Federal Funding
Federal grant funding (up to 80% of eligible cost) is currently available through Transport Canada's Infrastructure, Technology and Research component of its Rail Safety Program ($55M over three years) . The railway crossing upgrades, listed in the Opus report to bring the crossings in Abbotsford into regulatory compliance, are eligible projects for funding. Subject to Council's approval, applications will be prepared for 14 crossings totaling $1.11M. The list is included as Attachment "C". A funding application for each of the 14 railway crossings must be submitted to Transport Canada no later than December 23, 2016.
Where the cost of upgrades, per crossing, is less than $1 ,000 or considered maintenance, it will not be included in the funding application. This will affect 13 railway crossings at an estimated cost of $16,500.

FINANCIAL PLAN IMPLICATION
The City's approved 2017-2021 Financial Plan includes $500,000 for Rail Crossing Upgrade Program in 2017 and $600,000 per year for years 2018 to 2021 . The total cost to the City to upgrade the 35 (27 GCR requirement and 8 upgrade to whistle cessation) railway crossings is estimated at $2.9M.

IMPACTS ON COUNCIL POLICIES, STRATEGIC PLAN AND/OR COUNCIL DIRECTION
Addressing the railway crossing upgrades supports the four cornerstones of the City's 2015-2018 Strategic Plan as follows:
• Vibrant Economy - we understand the impact we have on others and invest in building relationships that facilitate alignment by maintaining movement of goods and services throughout the region.
• Complete Community - supports a multidisciplinary approach to public safety and we capitalize on opportunities around transportation in and through the City. The goal of the new Grade Crossing Regulation is to save lives by improving railway crossing surfaces, sightlines, roadway and railway signs, traffic signals and warning systems.
• Fiscal Discipline - we understand how important it is to take a long-term view on maintain and upgrading our City assets. By applying for a federal grant, we are actively managing our City finances.
• Organizational Alignment - we support the efficient and effective delivery of our City services by working with senior governments and the railway companies.
SUBSTANTIATION OF RECOMMENDATION
The ~ity is required to bring all the public railway crossings within its municipal boundary in compliance with the new Grade Crossing Regulation within the next five years. The Opus railway crossing assessment established that the City is required to upgrade 27 of the 52 railway crossings at an estimated cost of $1 , 126,500. It is recommended to first apply for a federal funding grant before proceeding as any work started prior to funding approval is not eligible. The railway crossing upgrades can be completed within the next three years.
It is also recommended that the City upgrade eight railway crossings in the urbanized area to whistle cessation standards at a cost of $1 .8M in the five-year capital plan, as this would support the OCP objectives and Council 's Strategic Plan as the City grows and develops.

1 Introduction
Opus International Consultants (Canada) Limited (Opus) was engaged by the City of Abbotsford (the
City) to conduct railway crossing assessments and whistle cessation studies for at-grade rail crossings
throughout Abbotsford. The City aims to comply with Transport Canada’s updated Grade Crossing
Standards (CGS) and Grade Crossing Regulations (CGR).
The assignment involved the assessment of 52 at-grade rail crossings in Abbotsford and the
identification of requirements for each crossing to comply with the safety standards and anti-whistling
requirements. Individual reports were requested for each of the 52 at-grade rail crossings as well as a
summary report which is presented herein.
2 Assessment Process
Opus completed assessments of all 52 public at-grade rail crossings in Abbotsford, based on the GCS
and GCR. A supplementary safety assessment was also conducted at each location to identify optional
improvements the City could make to improve the safety of the rail crossing.
Site visits were completed during the day and nighttime at each rail crossing by two members of the
project team on July 5-7 and August 2-5, 2016. Vehicle traffic data was either provided by the City or
collected by a sub-consultant at each location. The senior party at each rail crossing was provided by
the City for most crossings with the remaining coming from the railway companies. High level costs
were developed for improvements required to meet the GCS and GCR as well as for optional whistle
cessation.
A proposed cost sharing regime was developed for each rail crossing based on historical precedence
between the three railway companies (Southern Railway of British Columbia (SRY), Canadian Pacific
Railway (CPR), and Canadian National Railway (CN)).
3 Improvement Summary
The following sub-sections address the proposed improvements and their estimated costs. Appendix A
provides a detailed listing of the required improvements and requirements for whistle cessation at
each location.
3.1 Cost Sharing Assumptions
The cost-sharing for the required upgrades is based on the GCR, Seniority, and historical precedence.
For SRY crossings, under normal circumstances, it is proposed that the Junior party will pay for capital
upgrades (crossing surface and upkeep of the railway crossing sign and sign post) to meet the GCR and
GCS.
For CPR crossings, it is assumed that the Junior party will pay for all upgrades (capital upgrades, signs
and signals) to meet the GCR and GCS. Formal agreements will be required with CPR to confirm actual
cost sharing based on federal guidelines as outlined in the GCR and GCS.

For CN crossings, it is assumed that the Junior party will pay for capital upgrades to meet the GCR and
GCS and that CN will pay for items related to the upkeep of the railway crossing sign and sign post.
At all locations, maintenance activities, such as clearing vegetation to increase sightline distances is the
responsibility of the landowner (City or rail companies) on which the vegetation is growing. Costs for
optional crossing safety devices, such as bells, whistles, and gates; will be borne by the initiating
proponent, regardless of Seniority, unless previous agreements exist.
3.2 Required Improvements
A listing of the common required improvements and their unit costs are shown in the table below. In
instances where a concrete crossing is being provided, it is assumed full replacement is required.

In total, 41 of the 52 crossings require improvements of some kind. The City is responsible for funding
upgrades at 27 crossings for a total of $1,126,500. The costs for each of the railway companies amount
to $132,500 (SRY) at 21 crossings, $21,350 (CPR) at 6 crossings, and $116,200 (CN) at 4 crossings.
3.3 Requirements for Whistle Cessation
Whistling is considered a nuisance issue (noise) as opposed to a safety issue. Therefore whistle
cessation is not a requirement of the GCR/GCS.
The requirements for whistle cessation depend on the railway design speed the number of tracks, and
whether the crossing is used by vehicles or only by pedestrians/cyclists. For crossings which allow
vehicle use, either Flashing Lights and Bells, or Flashing Lights, Bells and Gates are required for
whistle cessation. More details of whistle cessation requirements can be found in Appendix D of the
GCS. Note that whistle cessation is not a requirement of the new regulations/standards. A listing of the
required improvements for whistle cessation and their unit costs are shown in the table below.

19 of the 52 locations assessed meet the requirements for whistle cessation. The 19 locations are
predominantly located on the CPR and CN rail lines. It would cost $7,470,000 to $7,750,000 to
upgrade the remaining 33 locations to qualify for whistle cessation.
There are 16 crossing locations within the City’s Urban Development Boundary. The table below
indicates which crossings are in an urban area and the required costs to upgrade to qualify for whistle
cessation. Crossings without costs ($-) do not require improvements specifically for whistle cessation.

The total cost to upgrade the 16 crossings within the City’s Urban Development Boundary is between
$1,520,000 and $1,800,000, depending on whether gates can be installed on the existing
infrastructure at location 24.

Locations 18 and 31 were removed from the project since they are private crossings.
4 Conclusions
Each of the 52 public at-grade rail crossings in Abbotsford were assessed against the GCR/GCS general
requirements and the GCS whistle cessation requirements. A supplemental safety assessment was
completed at each location to identify additional measures which could improve the safety of the
crossing.
The Class D estimated costs to comply with the GCR/GCS amount to $1,126,500 for the City, $132,600
for SRY, $21,350 for CPR and $116,200 for CN. Nineteen locations currently qualify for whistle
cessation and it would cost an additional $7,470,000 to $7,750,000 to upgrade the remaining 33
locations to qualify for whistle cessation. Cost estimates were not developed for the supplemental
safety improvements.
Federal grant opportunities are available for required safety improvements at rail crossings. The main
grant opportunity currently available is the Rail Safety Improvement Program (Infrastructure,
Technology and Research component). The deadline for applications is December 23, 2016.
