PART 1—PRELIMINARY

Citation and commencement

1. (1) These Regulations may be cited as the Engine Drivers and Boiler AttendantsCertification Regulations.

(2) These Regulations shall take effect on and from the first day of July 1958.

(3) * * * * *

Definitions

2. (1) In these Regulations, unless the contrary intention appears:(a) ‘‘Apprentice’’ and ‘‘trainee apprentice’’ have the meanings respectively assigned

to them by the Industrial Arbitration Act 1940 as amended by subsequent Acts.

‘‘Apprenticeship’’ means employment as an apprentice or trainee apprentice.

‘‘Approved trade’’ means the trade of mechanical fitter or such other trade as theAuthority may for the time being accept as being equivalent, for the purposes ofthese Regulations, to that trade.

‘‘Boiler and Pressure Vessel Regulations’’ means the Boiler and Pressure VesselRegulations made under the Act and published in Government Gazette No. 94 of22nd September 1944 as subsequently amended.

‘‘Certificate’’ means certificate of competency or service granted and issuedpursuant to these Regulations.

‘‘engine of first class requirements’’ means engine to which a certificate of the firstclass is appropriate but to which a certificate of the second class is not appropriate.

‘‘engine of second class requirements’’ means engine to which a certificate of thesecond class is appropriate.

‘‘The Act’’ means the Factories, Shops and Industries Act 1962.

‘‘Traction engine’’ means any vehicle, other than a locomotive, propelled by steamgenerated on the vehicle, and includes a road roller so propelled.

(b) Other terms and expressions have the meanings assigned to them by Part 2 of theAct.

(2) These Regulations shall apply to all boilers and to the following engines (whether suchboilers and such engines are in factories or not):

Stationary steam engines, including steam turbines, and stationary internalcombustion engines.

Traction engines.

Provided that these Regulations shall not apply to—(a) any engine or boiler of a crane or hoist, as defined by the Construction Safety Act

1912.(b) any stationary steam engine the area of the cylinder or the combined area of the

cylinders of which is less than 0.075 square metre;(c) any steam turbine of less than 150 kilowatts; or(d) any boiler having a heating surface not exceeding 2 square metres.

PART 3—CERTIFICATES

Types of certificates

4. (1) The Authority may, subject to the provisions of these Regulations, grant and issuethe following certificates:

(a) Certificates of competency of the following designations and certificates of serviceof the corresponding designations:Steam engine driver’s certificate of competency (first class).Steam engine driver’s certificate of competency (second class).Locomotive engine driver’s certificate of competency (steam locomotives).Locomotive engine driver’s certificate of competency (internal combustion engined

locomotives).Locomotive engine driver’s certificate of competency (electric locomotives).Traction engine driver’s certificate of competency.Internal combustion engine driver’s certificate of competency (first class unrestricted).

Internal combustion engine driver’s certificate of competency (first class restricted).Internal combustion engine driver’s certificate of competency (second class—gas and

surface ignition engines).Internal combustion engine driver’s certificate of competency (second

class—compression ignition engines).(b) Boiler attendant’s certificate of competency.

(2) (a) The Authority may, without examination, grant and issue such certificate of serviceas engine driver as the Authority considers appropriate to any person who within one yearafter the commencement of these Regulations makes application therefor and who satisfiesthe Authority by documentary or other evidence that by virtue of his service as an enginedriver before such commencement he is competent to be employed as and to act in thecapacity of engine driver of a class or type of engine to which these Regulations apply.

(b) The Authority may, without examination, grant and issue a locomotive engine driver’scertificate of service (electric locomotives) to any person who before the first day ofSeptember 1960 makes application therefor and who satisfies the Authority by documentaryor other evidence that by virtue of his service as an engine driver before the first day ofMarch 1960 he is competent to be employed as and to act in the capacity of an enginedriver of electric locomotives.

(3) The Authority may, without examination, and notwithstanding any other provision ofthese Regulations, grant and issue such certificate of competency as the Authority considersappropriate to any person who is the holder of an engineer’s, engine driver’s or boilerattendant’s certificate of competency granted after examination by any duly constitutedauthority (whether in New South Wales or elsewhere) which the Authority may approve. Thegranting of any such certificate may be by the endorsement or notation of the originalcertificate.

Where any person being the holder of an engineer’s, engine driver’s or boiler attendant’scertificate which appears to have been granted to him by a duly constituted authority makesapplication to the Authority for the granting of a certificate pursuant to this paragraph, theAuthority may, pending the consideration of such application, grant and issue to him aninterim certificate of competency in respect of such class or type of engine or boiler andhaving currency for such period as the Authority may determine: Provided that on the finaldetermination of the application the period of currency of such certificate shall, if it has notpreviously expired, be deemed to have expired. Any interim certificate so issued may,notwithstanding any other provision of these Regulations, be cancelled or suspended by theAuthority for any reason it deems proper.

(4) Notwithstanding any other provision of these Regulations, where the Authority is notsatisfied that an applicant for a certificate is competent to be employed as or to act in thecapacity of an engine driver or boiler attendant of all engines or boilers of the class or typeto which such certificate would be appropriate but is satisfied that he is competent to be

employed as or to act in the capacity of an engine driver or boiler attendant of some lessextensive class or type of such engines or boilers, the Authority may grant and issue to theapplicant a certificate restricted to that less extensive class or type of engines or boilers.Such certificate shall bear a notation setting forth the class or type of engines or boilers towhich it is restricted. Where the holder of a certificate which is so restricted applies to theAuthority for the removal or variation of such restriction and satisfies the Authority, byexamination or otherwise, that since the issue of the certificate he has acquired further orother experience, the Authority may remove such restriction, or may vary it in such manneras it deems proper in the circumstances. An application made pursuant to this paragraphshall be in or to the effect of Form E 8 contained in the Second Schedule to theseRegulations.

(5) A boiler attendant’s certificate of competency issued pursuant to the Boiler andPressure Vessel Regulations and in force immediately before the commencement of theseRegulations shall, notwithstanding the rescission of the Boiler and Pressure VesselRegulations or of any part thereof whether before or after such commencement, be deemedfor the purposes of these Regulations to be a boiler attendant’s certificate of competencygranted and issued pursuant to these Regulations and:

(a) if such certificate was issued in respect of all boilers, to be appropriate to all boilers;(b) if such certificate was issued in respect of a class or type of boiler, to be appropriate

to that class or type of boilers;(c) if such certificate was issued in respect of all boilers other than boilers of a class or

type specified therein, to be appropriate to all boilers other than boilers of the classor type so specified.

(6) Where by these Regulations a certificate of competency of any designation is expressedto be appropriate to a class or type of engine or boiler, each such certificate, and eachcertificate of service of the corresponding designation, shall be appropriate to that class ortype of engine or boiler only: Provided that notwithstanding any other provision of theseRegulations an interim certificate granted pursuant to paragraph (3) of this Regulation shallbe appropriate only to the class or type of engine or boiler in respect of which it is grantedand a certificate restricted in accordance with paragraph (4) of this Regulation shall beappropriate only to the class or type of engine or boiler to which it is for the time beingrestricted.

Granting and issue of certificates

5. (1) Except as otherwise provided by these Regulations, certificates of competency shallbe granted by the Authority only after examination in the subjects prescribed by theseRegulations.

(2) Examinations for certificates of competency shall be under the supervision of aninspector authorised in that behalf by the Authority and shall be held at such places and atsuch times as may, from time to time, be determined by the Authority.

(3) Upon an applicant passing the prescribed examination, the Authority, being satisfied ofhis fitness in all other respects, may grant and issue to him the appropriate certificate ofcompetency.

(4) Except as otherwise provided by these Regulations, before the Authority grants to anyapplicant a certificate the applicant shall satisfy the Authority:

(a) as to his sobriety, ability and general good conduct;(b) that his experience as an engine driver or boiler attendant is in accordance with, or

equivalent to, the requirements of these Regulations for the certificate applied for;(c) that he is able to write a legible hand and that his knowledge of the English language

is sufficient to enable him to perform the duties required of a holder of the certificateapplied for;

(d) that he is not subject to deafness, defective sight or other physical infirmity whichwould render him unfit to perform efficiently his duties as the holder of the certificateapplied for. In this connection the Authority may require the applicant to produce a

medical certificate signed by a legally qualified medical practitioner; and(e) that he is not under the minimum age nor over the maximum age prescribed by these

Regulations for the holder of the certificate sought. In this connection the Authoritymay require the applicant to produce documentary proof of age.

Provided that where an applicant for a certificate of competency is over the maximum ageprescribed by these Regulations the Authority may allow him to sit for the examination, andmay grant such certificate, where he has produced evidence satisfactory to the Authority thathe has had the requisite experience before attaining such age.

(5) An applicant for a certificate of competency shall produce original testimonials orcertificates signed by his employer and, if the Authority so requires, by an engine driverwhom he has been assisting or by the principal of an educational institution, approved bythe Authority, where he has been receiving instruction, and such documents shall specifyclearly:

(a) the class of engine or boiler he has attended or assisted to attend;(b) the size and number of cylinders of the engine or the heating surface of the boiler;

and(c) * * * * *

Where an applicant is unable, for any sufficient reason, to produce the aforesaidtestimonials or certificates the Authority may accept such other evidence of his having theexperience required by these Regulations as the Authority may consider sufficient.

(6) The Authority may refuse to issue a certificate to any person who in its opinion is nota fit and proper person to hold such certificate.

(7) (a) An application for a certificate shall be in or to the effect of Form E1, E2, E3, E5 orE6, as the case may require, contained in the Second Schedule to these Regulations, andshall be accompanied by the application fee prescribed by the First Schedule to theseRegulations together with the other certificates or documents required by these Regulationsto be furnished.

(b) An application for the granting of a certificate pursuant to paragraph (3) of Regulation4 of these Regulations shall be verified by statutory declaration.

(8) A certificate shall, subject to paragraphs (3) and (4) of Regulation 4 of theseRegulations, be in or to the effect of the appropriate form contained in the Third Scheduleto these Regulations.

(9) A person to whom a certificate in or to the effect of a form contained in the ThirdSchedule to these Regulations has been issued shall, on receiving such certificate, forthwithsign the same with his usual signature in the space provided thereon for such signature anduntil he does so shall not be deemed to be the holder of such certificate.

Cancellation and suspension of certificates

6. (1) The Minister may, upon the report of the Authority that the holder of a certificate hasbeen guilty of a breach of these Regulations or has been guilty of any misconduct in respectof his duties or has developed any symptom of epilepsy or any other defect or infirmity likelyto render him unfit to be trusted to perform efficiently his duties as an engine driver or boilerattendant, cancel such certificate or suspend it for such period as the Minister may think fit.

(2) Where the Authority recommends the cancellation or suspension of a certificate, it mayat the same time or at any later time suspend such certificate pending consideration by theMinister of such recommendation.

(3) Where the Authority is satisfied that a certificate has been improperly obtained, theAuthority may cancel or suspend such certificate.

(4) Where a certificate has been cancelled or suspended:(a) the Authority shall notify verbally or in writing the holder of the certificate of such

cancellation or suspension; and(b) the holder of the certificate shall forthwith, if the Authority or a member thereof or an

inspector so requires verbally or in writing, and in any case within seven days fromthe date when such holder is notified of the cancellation or suspension, deliver suchcertificate to the Authority.

Statements of particulars

7. Where the Authority is satisfied that a certificate has been lost, destroyed or mutilated,it may issue to the holder, on application being made by him, a statement of the particularscontained in such certificate. Such statement may be in the form of a duplicate certificateduly certified by the Authority as being a true copy of the original certificate.

An application for the issue of such a statement shall be in or to the effect of Form E7contained in the Second Schedule to these Regulations, shall be accompanied by theapplication fee prescribed by the First Schedule to these Regulations, and shall be verifiedby statutory declaration.

Steam engine driver’s certificate of competency (first class)

8. (1) A steam engine driver’s certificate of competency (first class) shall be appropriateto all stationary steam engines (including steam turbines) and boilers to which theseRegulations apply.

(2) An applicant for a steam engine driver’s certificate of competency (first class) shallproduce evidence satisfactory to the Authority that at the date of examination he is not underthe age of 21 years nor over the age of 60 years and also that either:

(a) he has been the holder of a steam engine driver’s certificate of competency orservice (second class) or of a certificate of competency granted by any dulyconstituted and recognised authority which, in the opinion of the Authority, isequivalent thereto, for a period of not less than twelve months and during that period:

(i) has been in charge, for not less than 600 hours, of a steam engine ofsecond class requirements, of which the area of the cylinder or thecombined area of the cylinders exceeded 0.3 square metre; or

(ii) has been in charge, for not less than 600 hours, of a steam turbine of notless than 370 kilowatts; or

(iii) has been in charge, for not less than six months, of a steam engine ofsecond class requirements and has also assisted, for at least a further 300hours during a period of six months, to drive a steam engine of first classrequirements; or

(b) that he has been the holder of a steam engine driver’s certificate of competency orservice (second class) for a period of not less than twelve months and during thatperiod has assisted to drive a steam engine of first class requirements for at leasttwelve hours in each of at least 52 weeks; or

(c) that since the completion of his apprenticeship in an approved trade he has for notless than three months been employed in the making, repairing or installing of steamengines and has for not less than eighty hours assisted to operate a steam engineof first class requirements or of second class requirements; or

(d) that he has had such training in mechanical engineering, including the operation ofsteam machinery, for a period of not less than five years as the Authority mayconsider sufficient.

(3) An applicant for a steam engine driver’s certificate of competency (first class) must passan examination and satisfy the Authority that he:

(a) has a sufficient knowledge of arithmetic, mensuration and simple machines to enablehim to solve elementary practical questions in respect of engines, boilers andcapacities of bunkers and tanks; and

(b) has a satisfactory knowledge of all common types of boilers used for land purposes,their fittings and construction; the causes, effects and usual remedies for incrustationand corrosion; the safe operation and correct methods of firing boilers, and the

correct action to be taken in case of accident to a boiler; and(c) has a satisfactory knowledge of steam engines including steam turbines and is able

to make simple sketches and describe the different parts of such engines and theirfunction; is able to explain the use and the setting of the valve operating mechanismof steam engines; and is able to describe the use of auxiliary appliances used withmodern steam plant, such as condensers and pumps.

Steam engine driver’s certificate of competency (second class)

9. (1) A steam engine driver’s certificate of competency (second class) shall be appropriateto all stationary steam engines the area of cylinder or combined area of cylinders of whichdoes not exceed 0.5 square metre and to all steam turbines not exceeding 550 kilowattscapacity.

(2) An applicant for a steam engine driver’s certificate of competency (second class) shallproduce evidence satisfactory to the Authority that at the date of examination he is not underthe age of twenty years nor over the age of sixty years, and also that either:

(a) he has for a period of not less than twelve months been the holder of a certificateappropriate to all boilers, or of a certificate of competency as boiler attendant issuedin respect of all boilers under the Boiler and Pressure Vessel Regulations; and

(i) has been in charge, for not less than three months, of a steam engine ofwhich the area of the cylinder or the combined area of the cylinders wasnot less than 0.05 square metre, or of a steam turbine of not less than 110kilowatts, and has also, for not less than 300 hours during a further periodof six months, assisted to drive a steam engine of first class requirementsor of second class requirements; or

(ii) has assisted to drive an engine of first class requirements or of secondclass requirements for at least twelve hours in each of not less thanfifty-two weeks; or that

(b) he has served at least four years’ apprenticeship in an approved trade and has beenemployed for at least three months in the making, repairing and installing of steamengines and has also for not less than 120 hours assisted to operate a steam engineof first class requirements or of second class requirements; or

(c) he has had such other training in mechanical engineering, including the operation ofsteam machinery, for a period of not less than four years as the Authority mayconsider sufficient.

(3) An applicant for a steam engine driver’s certificate of competency (second class) mustpass an examination and satisfy the Authority that he:

(a) has a knowledge of arithmetic sufficient to enable him to calculate simple plane areasand to solve elementary problems relating to boilers and engines; and

(b) is conversant with the working parts of steam engines including steam turbines,pumps and boilers in general use including the running of same, and is able toexplain how to detect defects and state what action is necessary in the ordinaryemergencies that may arise in the control and operation of engines, pumps andboilers to which an engine driver’s certificate of competency (second class) isappropriate.

Locomotive engine driver’s certificates of competency

10. (1) A locomotive engine driver’s certificate of competency (steam locomotives) shallbe appropriate to:

(a) all steam locomotives to which these Regulations apply;(b) all engines to which a steam engine driver’s certificate of competency (second class)

is appropriate; and(c) boilers of the locomotive type.

(2) A locomotive engine driver’s certificate of competency (internal combustion engined

locomotives) shall be appropriate to:(a) all internal combustion engined locomotives, and(b) all engines to which an internal combustion engine driver’s certificate of competency

(second class—compression ignition engines) is appropriate.

(2A) A locomotive engine driver’s certificate of competency (electric locomotives) shall beappropriate to all electric locomotives.

(3) (a) An applicant for a locomotive engine driver’s certificate of competency (steamlocomotives) shall produce evidence satisfactory to the Authority that he is at the date ofexamination not under the age of 21 years nor over the age of sixty years and that:

(i) he is the holder of a certificate appropriate to boilers of the locomotivetype, and

(ii) he has had not less than 600 hours’ experience during any period oftwelve months assisting to drive a steam locomotive, and

(iii) he has a thorough knowledge of the traffic rules applying to privatelyowned locomotives travelling on any part of the New South WalesGovernment Railway system and to the private railway system in which heis to be employed.

(b) The applicant must pass an examination and satisfy the Authority that:(i) he has a satisfactory knowledge of the function of the different parts of

steam locomotives, and of how temporary repairs could be effected incase of derangement to such a locomotive or its boiler; and

(ii) he is familiar with the operation of braking systems used on steamlocomotives; and

(iii) he has a satisfactory knowledge of all subjects relating to steam enginesincluded in the examination for the steam engine driver’s certificate ofcompetency (second class).

(4) (a) An applicant for a locomotive engine driver’s certificate (internal combustion enginedlocomotives) shall produce evidence satisfactory to the Authority that he is at the date ofexamination not under the age of twenty-one years nor over the age of sixty years, and that:

(i) he has had not less than 600 hours’ experience during any period oftwelve months assisting to drive an internal combustion enginedlocomotive; and

(ii) he has a thorough knowledge of the traffic rules applying to privatelyowned locomotives travelling on any part of the New South WalesGovernment Railway system and to the private railway system in which heis to be employed.

(b) The applicant must pass an examination and satisfy the Authority that:(i) he has a satisfactory knowledge of the functions of the different parts of

internal combustion engined locomotives, and of how temporary repairscould be effected in case of derangement of such a locomotive or itsengine; and

(ii) he is familiar with the operation of braking systems used on locomotives;and

(iii) he has a satisfactory knowledge of all subjects included in the examinationfor internal combustion engine driver’s certificate of competency (secondclass—compression ignition engines).

(5) (a) An applicant for a locomotive engine driver’s certificate of competency (electriclocomotives) shall produce evidence satisfactory to the Authority that he is at the date of theexamination not under the age of twenty-one years nor over the age of sixty years, and that:

(i) he has had not less than 300 hours’ experience during any period oftwelve months assisting to drive an electric locomotive; and

(ii) he has a thorough knowledge of the traffic rules applying to privatelyowned locomotives travelling on any part of the New South Wales

Government Railways system and to the private railway system in whichhe is to be employed.

(b) The applicant must pass an examination and satisfy the Authority that:(i) he has a satisfactory knowledge of the functions of the different parts of

the electric control mechanism and switchgear of electric locomotives, andof how temporary repairs could be effected in case of derangement ofsuch a locomotive; and

(ii) he is familiar with the operation of braking systems used on electriclocomotives.

Traction engine driver’s certificate of competency

11. (1) A traction engine driver’s certificate of competency shall be appropriate to alltraction engines to which these Regulations apply, and to the boilers thereof.

(2) (a) An applicant for a traction engine driver’s certificate of competency shall produceevidence satisfactory to the Authority that he is at the date of examination not under the ageof twenty years nor over the age of sixty years, and that:

(i) he is the holder of a certificate appropriate to boilers of the locomotivetype; and

(ii) while the holder of such certificate he has had not less than 100 hours’experience assisting to drive a traction engine; and

(iii) he has a thorough knowledge of the rules of the road and the conditionsunder which traction engines are allowed to travel on public roads.

(b) The applicant must pass an examination and satisfy the Authority that he has asatisfactory knowledge of the functions of the different parts of a traction engine, and of howtemporary repairs could be effected in case of derangement to a traction engine or its boiler.

Internal combustion engine driver’s certificates of competency (first class)

12. (1) An internal combustion engine driver’s certificate of competency (first classunrestricted) shall be appropriate to all stationary internal combustion engines to which theseRegulations apply.

(2) An applicant for an internal combustion engine driver’s certificate of competency (firstclass unrestricted) shall produce evidence satisfactory to the Authority that at the date ofexamination he is not under the age of twenty-one years nor over the age of sixty years andalso that either:

(a) he has been the holder of an internal combustion engine driver’s certificate (secondclass—gas and surface ignition engines) for a period of not less than twelve monthsand during that period has been:

(i) in charge, for at least 600 hours, of a compression ignition engine ofsecond class requirements of which the area of the cylinder or thecombined area of the cylinders exceeded 0.3 square metre; or

(ii) in charge of a compression ignition engine of second class requirementsfor six months and has also assisted to drive a compression ignitionengine of first class requirements for a further period of 300 hours duringa period of six months; or

(iii) assisting to drive a compression ignition engine of first class requirementsfor at least twelve hours in each of not less than fifty-two weeks; or

(b) since the completion of his apprenticeship in an approved trade he has for not lessthan three months been employed in the making, repairing or installing of internalcombustion engines and has for not less than eighty hours assisted to operate acompression ignition and surface ignition engine of first class requirements or ofsecond class requirements; or

(c) he has had such training in mechanical engineering, including the operation ofinternal combustion engines, for a period of five years as the Authority may consider

sufficient.

(3) An applicant for an internal combustion engine driver’s certificate of competency (firstclass unrestricted) must pass an examination and satisfy the Authority that he:

(a) has a sufficient knowledge of arithmetic, mensuration and simple machines to enablehim to solve elementary practical questions in respect of internal combustion enginesand capacities of oil tanks;

(b) has a satisfactory knowledge of the types of internal combustion engines in commonuse, the methods of ignition, timing, principles and operation of suction gas plants,fuel, starting, lubrication and cooling systems and the principles and operation ofmulti-stage air compressors; and

(c) has a satisfactory knowledge of the correct method of starting and stopping varioustypes of internal combustion engines, and of the running of such engines.

(4) An internal combustion engine driver’s certificate of competency (first class restricted)shall be appropriate to all stationary compression ignition engines to which these Regulationsapply.

(5) An applicant for an internal combustion engine driver’s certificate of competency (firstclass restricted) shall produce evidence satisfactory to the Authority that at the date ofexamination he is not under the age of twenty-one years nor over the age of sixty years andalso that either:

(a) he has been the holder of a certificate appropriate to internal combustioncompression ignition engines of second class requirements for a period of not lessthan twelve months and during that period has been:

(i) in charge, for at least 600 hours, of a compression ignition engine ofsecond class requirements of which the area of the cylinder or thecombined area of the cylinders exceeded 0.3 square metre; or

(ii) in charge of a compression ignition engine of second class requirementsfor six months and has also assisted to drive a compression ignitionengine of first class requirements for a further period of 300 hours duringa period of six months; or

(iii) assisting to drive a compression ignition engine of first class requirementsfor a period of at least twelve hours in each of not less than fifty-twoweeks; or

(b) since the completion of his apprenticeship in an approved trade he has for not lessthan three months been employed in the making, repairing or installing of internalcombustion engines and has for not less than eighty hours assisted to operate acompression ignition engine of first class requirements or of second classrequirements; or

(6) An applicant for an internal combustion engine driver’s certificate of competency (firstclass restricted) must pass an examination and satisfy the Authority that he:

(a) has a sufficient knowledge of arithmetic, mensuration and simple machines to enablehim to solve elementary practical questions in respect of internal combustion enginesand capacities of oil tanks;

(b) has a satisfactory knowledge of the types of compression ignition engines in commonuse and the principles of operation, fuel and starting systems, valve timing, coolingand lubrication, and the principle and operation of multi-stage air compressors; and

(c) has a satisfactory knowledge of the correct method of starting and stoppingcompression ignition engines and the running of such engines.

Internal combustion engine driver’s certificates of competency (second class)

13. (1) An internal combustion engine driver’s certificate of competency (second

class—gas and surface ignition engines) shall be appropriate to all stationary gas andsurface ignition engines to which these Regulations apply and to all stationary compressionignition engines of second class requirements.

(2) An applicant for an internal combustion engine driver’s certificate of competency(second class—gas and surface ignition engines) shall produce evidence satisfactory to theAuthority that at the date of examination he is not under the age of eighteen years nor overthe age of sixty years and also that either:

(a) he has, for not less than 600 hours during a period of nine months, assisted to drivea gas or surface ignition engine of which the area of the cylinder or the combinedareas of the cylinders exceeded 0.075 square metre; or

(b) he has, for not less than 520 hours during a period of six months, been in charge ofa gas or surface ignition engine of which the area of the cylinder or the combinedarea of the cylinders was not less than 0.05 square metre and not more than 0.075square metre, and has also during a further period of three months assisted for notless than 100 hours to drive an internal combustion engine of which the area of thecylinder or the combined area of the cylinders exceeded 0.095 square metre; or

(c) he has, for not less than 400 hours during a period of six months, assisted to drivea gas or surface ignition engine of which the area of the cylinder or the combinedarea of the cylinders exceeded 0.075 square metre, and has also, during a furtherperiod of three months, assisted for not less than 200 hours to drive a compressionignition engine of which the area of the cylinder or the combined area of the cylindersexceeded 0.05 square metre; or

(d) he has served at least four years’ apprenticeship in an approved trade and has beenemployed for at least three months in the making, repairing or installing of internalcombustion engines and also has for not less than 120 hours assisted to operate asurface ignition engine the area of cylinder or combined area of cylinders of whichis not less than 0.075 square metre; or

(e) he has had such training in mechanical engineering, including the operation ofsurface ignition engines, for a period of five years as the Authority may considersufficient.

(3) An applicant for an internal combustion engine driver’s certificate of competency(second class—gas and surface ignition engines) must pass an examination and satisfy theAuthority that he:

(a) has a sufficient knowledge of arithmetic to enable him to calculate simple plane areasand to solve elementary problems relating to internal combustion engines; and

(b) is conversant with the working parts of internal combustion engines and suction gasplants in general use including the running of same, and is able to explain how todetect faults and state what action is necessary in the ordinary emergencies that mayarise in the control and operation of engines and plant to which such a certificate isappropriate.

(4) An internal combustion engine driver’s certificate of competency (secondclass—compression ignition engines) shall be appropriate to all stationary compressionignition engines the area of cylinder or combined area of cylinders of which does not exceed0.42 square metre.

(5) An applicant for an internal combustion engine driver’s certificate of competency(second class—compression ignition engines) shall produce evidence satisfactory to theAuthority that at the date of examination he is not under the age of eighteen years nor overthe age of sixty years and also that either:

(a) he has for not less than 300 hours during a period of four months been in charge ofa compression ignition engine of which the area of the cylinder or the combined areaof the cylinders exceeded 0.05 square metre, and has also, during a further periodof two months, assisted for not less than 100 hours to drive a compression ignitionengine of first class requirements or of second class requirements; or

(b) he has assisted to drive a compression ignition engine of second class requirementsfor not less than 500 hours during a period of six months; or

(c) he has served at least four years’ apprenticeship in an approved trade and has beenemployed for at least three months in the making, repairing or installing of internalcombustion engines and has for not less than 120 hours assisted to operate acompression ignition engine of first class requirements or of second classrequirements; or

(d) he has had such training in mechanical engineering, including the operation ofcompression ignition engines, for a period of five years as the Authority may considersufficient.

(6) An applicant for an internal combustion engine driver’s certificate of competency(second class—compression ignition engines) must pass an examination and satisfy theAuthority that he:

(a) has a sufficient knowledge of arithmetic to enable him to calculate simple plane areasand to solve elementary problems relating to internal combustion engines; and

(b) is conversant with the working parts of compression ignition engines in general useand is able to explain how to detect faults and state what action is necessary inordinary emergencies that may arise in the control and operation of engines to whichsuch certificate is appropriate.

14, 15. * * * * *

Boiler attendant’s certificate of competency

16. (1) A boiler attendant’s certificate of competency shall be appropriate to all boilers towhich these Regulations apply.

(2) An applicant for a boiler attendant’s certificate of competency shall produce evidencesatisfactory to the Authority that he is, at the date of examination, not under the age ofeighteen years nor over the age of sixty years and also that either:

(a) he has assisted in the operation of a boiler for not less than 300 hours during anyperiod of six months; or

(b) he has assisted in the operation of a boiler for not less than 200 hours during anyperiod of six months and in addition has satisfactorily completed a course of practicalinstruction in the operation of boilers at a trade, technical or other training schoolapproved by the Authority.

(3) An applicant for a boiler attendant’s certificate of competency must pass an examinationand satisfy the Authority that:

(a) he has a competent knowledge of the various types of boilers in common use andtheir fittings, mountings and accessories;

(b) he thoroughly understands the safe operation of boilers and the preparation of aboiler for inspection;

(c) he is familiar with the various correct methods of firing boilers; and(d) he understands the correct action to be taken in case of accident to a boiler.

PART 4—PENALTIES AND GENERAL

Offences

17. (1) Except as otherwise provided by this Part of these Regulations:(a) after the expiration of a period of one year from the date of commencement of these

Regulations, no person shall be employed as or act in the capacity of an enginedriver of any class or type of engine to which these Regulations apply, other than anelectric locomotive, unless he is the holder of a certificate which is appropriate to thatclass or type of engine;

(a1) after the 31st day of August 1960, no person shall be employed as or act in thecapacity of an engine driver of an electric locomotive unless he is the holder of acertificate appropriate to electric locomotives;

(b) no person shall be employed as or act in the capacity of a boiler attendant of anyclass or type of boiler to which these Regulations apply unless he is the holder of acertificate which is appropriate to that class or type of boiler.

Maximum penalty: 25 penalty units.

(2) Where a person is employed as an engine driver or boiler attendant contrary to theprovisions of this Regulation, any person knowingly so employing him shall be guilty of abreach of these Regulations.

Maximum penalty: 100 penalty units in the case of a corporation or 50 penalty units in anyother case.

(3) For the purposes of this Part of these Regulations, the ‘‘holder’’ of a certificate means,subject to paragraph (9) of Regulation 5 of these Regulations, the person to whom suchcertificate has been granted and issued: Provided that a person whose certificate has beencancelled or is for the time being suspended or the period of whose certificate, being aninterim certificate, has expired shall be deemed not to be the holder of such certificate.

(4) The provisions of paragraph (1) of this Regulation shall not apply to:(a) the driving of an engine or attendance upon a boiler for the purpose only of tests or

trials, or in the course of an examination conducted for the purposes of theseRegulations;

(b) the driving of an engine or attendance upon a boiler by any person who is the holderof a permit issued by the Chief Inspector authorising him to act as a driver of thatengine or as a boiler attendant of that boiler during a period specified in such permit,where such period has not elapsed; or

(c) attendance upon a boiler by a person who immediately before the commencementof these Regulations was the holder of a permit issued pursuant to Regulation 73 ofthe Boiler and Pressure Vessel Regulations, where the period stated in such permithas not elapsed.

Exemptions

18. The Chief Inspector, may, by certificate in writing under his hand, exempt the driver ofany engine or the attendant of any boiler from any or all of the provisions of theseRegulations where he is satisfied that such provisions cannot reasonably be applied to thedriver of such engine or class or type of engine or to the attendant of such boiler or classor type of boiler, as the case may be.

Limitation of work

19. The Chief Inspector, may, by notice under his hand given to the driver of any engineor engines or to his employer, or both to such driver and to such employer, prohibit theperformance by such driver of such work, additional to the driving of that engine or of thoseengines, as may be specified in the notice, and every person to whom such notice is givenshall comply with the terms thereof.

Duties of certificate holders

20. (1) The holder of an engine driver’s certificate shall carry out his duties of enginedriving in such a manner as to ensure the safe operation of the engine or engines.

Maximum penalty: 25 penalty units.

(2) The holder of a certificate shall when acting in the capacity of boiler attendant carry outhis duties of firing and/or controlling the feed water in such manner as to ensure the safeoperation of the boiler. In this connection he shall test the glass water gauges at least oncein every shift to *enure their correct functioning.

Maximum penalty: 25 penalty units.

(3) The holder of a certificate shall, when so required by an inspector at any reasonabletime, produce such certificate for examination by such inspector. The holder shall be deemedto have complied with this Regulation if he produces as aforesaid to the Inspector astatement issued to him pursuant to Regulation 7 of these Regulations. In this Regulation‘‘certificate’’ includes a permit issued pursuant to Regulation 17 of these Regulations.

Maximum penalty: 10 penalty units.

False statements

21. Any person who knowingly makes any false representations in connection with theissue of any certificate, or of any permit referred to in Regulation 17 of these Regulations,or forges or falsifies any certificate or any such permit, or makes use of any certificate or ofany such permit knowing it to be forged or falsified shall be guilty of a breach of theseRegulations.

Maximum penalty: 25 penalty units.

Prescribed qualifications for certificates of competency issued after thecommencement of the Occupational Health and Safety (Certificates of Competency)Regulation 1996

22. (1) This clause applies to all certificates of competency issued under these Regulationsafter the commencement of the Occupational Health and Safety (Certificates of Competency)Regulation 1996 and has effect despite any other provision of these Regulations.

(2) The qualification for a certificate of competency in respect of any activity for which sucha certificate is required by these Regulations is a certificate of competency in force underthe Occupational Health and Safety (Certificates of Competency) Regulation 1996 in relationto work of the kind involved in the carrying out of that activity.

Exemption from requirements of these Regulations for holders of certificates ofcompetency issued under the Occupational Health and Safety (Certificates ofCompetency) Regulation 1996

23. A person does not commit an offence under Regulation 17 in relation to any activityreferred to in paragraph (1) of that Regulation if the person carrying out that activity is theholder of a certificate of competency in force under the Occupational Health and Safety(Certificates of Competency) Regulation 1996 in relation to work of the kind involved in thecarrying out of that activity.

FIRST SCHEDULE—FEES

1. The application fee payable under Regulation 5 (7) for a certificate of competencyis $60.Where the applicant for a certificate of competency has previously paid the

appropriate fee, but has failed to attend for examination for a reason satisfactoryto the Authority, no fee is payable.

2. The fee to be paid for:(a) a certificate of service;(b) a certificate under Regulation 4 (3) (unless the applicant is the holder

of an interim certificate of competency); or(c) an interim certificate of competency under Regulation 4 (3),

is $30.
