19. Lump sum Incentive for acquiring higher qualifications: - A lump sum incentive in replacement of increment-based incentive has been introduced for acquiring higher qualification useful in the discharge of higher official work. The following are the scales of incentive admissible on acquiring the prescribed qualification:-

(2) The quantum of lump sum, one-time incentive shall be based on qualification without any relation to increment or level/grade of the officer

(3) If the Central Government employees and Civilian employees of Ministry of Defence acquire the higher qualification by taking study leave or sponsored by the Government, they are not eligible for the incentive.

(4) The incentive is admissible only for higher qualification acquired after induction into service.

(5) The incentive is not admissible for the qualifications which are laid down as essential or desirable in the Recruitment Rules for the posts.

20. Foreign Allowances: The member of the Force while serving in Bhutan, Myanmar, Afghanistan and Tajikistan or any other Foreign country are entitled to draw Foreign Allowances at the rates as specified by the Government in granting such foreign allowance with effect from dates as specified in the Govt orders and its subsequent amendments issued from time to time subject to the condition that the conditions specified in the Government orders are fulfilled.

21. Concession admissible to GREF Personnel in Kashmir Valley regarding House Rent Allowance: GREF Employees posted to Kashmir Valley have an option to move their families to a selected place of their choice in India (out side the place of posting) and HRA as for Class ‘A’ city is admissible to employees exercising such option. Such employees will also be eligible for drawing of normal HRA as well, at place of posting provided departmental arrangements are not made for their stay. The drawal of HRA shall be governed as per orders/extension received from DOP&T from time to time.

22. Gallantry Award – Monetary Allowance

(a) Journey by Air: The recipients, irrespective of rank are entitled to travel by air from the nearest Air Port to Delhi and back.

(b) Journey By Rail: The recipients will be entitled to travel by the highest class available on the Railway Line or the class by which the journey is actually performed, whichever is less. If the journey between the places connected by Rail is performed by road, only the actual expenses restricted to Rail Fare admissible will be allowed.

(c) Journey by Road: The recipients performing journeys by road either by private vehicle or taxi between places not connected by Rail will be entitled to road mileage at the rates notified by the concerned Directorate of Transport for Taxis for one full Taxi.

(II) Entitlement for expenditure during journey by Road:-

(a) Daily Allowance: The recipients irrespective of rank travelling by Rail will be entitled Rs 60/- as incidental expenditure for each day of journey.

(b) Out of Pocket Allowance: Each recipient whether coming from outside or residing in Delhi will be allowed a total amount of Rs 330/- or out of Pocket expenses for his entire period of stay.

(c) Boarding and lodging in Delhi: Arrangements for Boarding and lodging of the recipients will be made the Govt for four days, unless they choose to make their own arrangements. The arrangements may be made at any place where hotel expenses do not exceed those of a three star hotel. The period of day of Investiture Ceremony, the day preceding the day of rehearsal and the day following the day of Investiture.

(d) The travelling allowances etc. will be claimed and paid by the Projects/Units concerned.

23. Group Insurance Scheme, 1980

24. Leave Encashment/Accumulation: Earned leave can be accumulated upto 300 days (including the number of days for which encashment has been allowed alongwith LTC). Leave encashment is the cash equivalent of leave salary for the period of leave not availed by the individual.

25. Children’s Educational Assistance (CEA):- Applicable to all Central Government Servants without any pay limit. CEA is admissible to the Children between the age-limits of 5 and 20 years; but admissible in respect of a child up to the end of the academic session even if he completes 20 years half-way through the academic session. Not admissible for a child for more than two academic years in the same class. This allowance is admissible upto the end of the academic year, in respect of personnel who die, retire, discharge, dismissed etc.

Note: (a) Rs 100/- per month per child for Class I to XII.

(b) CEA is admissible when a Govt servant is compelled to send his child/children to a school away from that station at which he is posted and or residing owing to the absence of a School of the requisite standard at that station.

(c) CEA is admissible when the nearest school of the requisite standard is so situated that there is no convenient train or bus service to take the child from his residence near time of the opening of the school and bring him back not too long after the school is closed; and the train/bus journey takes more than an hour.

(d) CEA is admissible for three children for those born upto 31 Dec 1987 and for two children only those born after 31 Dec 1987.

27 Hostel Subsidy:- Hostel Subsidy @ Rs 300/- per month per child is admissible upto 10 + 2 stage, where the pattern of 10+2+3 exists and up to Higher Secondary/Senior Secondary Stage in other places, whether the Children Study in Kendriya Vidhyalaya or any other recognized School.

Note: (a) Not admissible for a child to whom CEA is drawn.

28. TA on Transfer:-

Transfer TA comprises of the following elements:-

(a) A composite transfer grant equal to one month’s Basic Pay plus Dearness Pay; (Not admissible if no change of residence is involved even where the distance between the two station is more than 20 Kms)

(b) Actual fares for self and family for journey by rail/steamer/air

(c) Road mileage for journey by road between places not connected by rail

(d) Cost of transportation of personnel effects from residence to residence; and

(e) Cost of transportation of conveyance passed by the employee. Note: (a) Admissible only if the transfer is in the public interest and not

at one’s own request.

(b) Officials transferred after completion of full tenure as prescribed from time to time to the place of their choice will be entitled for TA and transit.

(c) Composite transfer grant equal to one third of basic pay is admissible for transfer between two stations within a short distance not more than 20 Km.

(d) Basic pay includes DP, in case change of residence is involved.

Note :(a) In case of personal effects move by road between places connected by rail, personal can claim the actual expenditure on transportation of personal effects by road or the amount admissible by tariff rates and an additional amount of not more than 25% by thereof which ever is less.

30. Regulation of journeys by private air lines while availing Leave Travel Concessions:-

(a) Officers entitled to air travel by National Carrier under existing orders may be permitted to travel by Private Airlines also while availing LTC.

(b) While availing LTC, the air journeys by non-entitled Officers (both by National and Private Airlines) between places connected by train may be allowed, provided the re-imbursement of the fare would be restricted to the entitled class by rail other than Rajdhani/Shatabdi Express

31. Air Travel by Government Servants during Official Visit within India : Government servant can travel by Private Airlines during Official Visit.

32. CSD Facility: GREF Personnel are authorised to draw Canteen Facilities including liquor from URC.

33. Leave :-

(a) Earned Leave : 30 days EL for each completed year of service.

(b) Half Pay Leave : 20 days HPL for each completed year of service

(c) Extra Ordinary Leave : The EOL granted in one occasion shall not exceed maximum 5 years for all kinds of leave. No separate limit for EOL. No leave salary is admissible.

(d) Special Disability Leave : Admissible to all employees who are disabled by any injury or illness incurred in the performance of his duties. The leave will be allowed to the extent certified by AMA subject to maximum of 24 months. Leave salary for the first 120 days equal to leave salary on

EL. For the period after 120 days equal to leave salary on HPL.

(e) Hospital Leave : Hospital Leave is granted to the following employees while under medical treatment in a hospital or otherwise for illness or injury directly due to risks incurred in the course of official duties :-

(i) Group ‘C’ employees whose duties involve handling of dangerous machinery, explosive materials, poisonous drugs and the like, or performance of hazardous tasks.

(ii) Group ‘D’ staff.

Hospital Leave may be granted for such period as the authority granting the leave may consider it necessary. The leave can be combined with any kind of leave but the total period so combined should not exceed 28 months. Leave salary for the first 120 days equal to leave salary on EL. For the period after 120 days, equal to leave salary on HPL.

(f) Commuted Leave: Commuted Leave can be taken with medical certificate upto a maximum of half the amount of HPL due to an employee.

(g) Leave Not Due: Leave Not Due is granted when the employees has no HPL on his credit on production of

Medical Certificate. The amount of LND shall be limited to the HPL, the employee is likely to earn subsequently and a maximum of 360 days in the entire service. Leave salary for LND will be half of the amount of Leave Salary.

(h) Maternity Leave: Maternity Leave is admissible to female employees during pregnancy, miscarriage and abortion. 135 days for pregnancy. 45 days for miscarriage & abortion in the entire service. Leave salary for maternity leave is equal to the pay last drawn before going on leave.

(j) Paternity Leave: 15 days leave is admissible to male employees during the confinement of his wife ie upto 15 days before or upto six months from the date of delivery of the child. Leave salary is equals to the last drawn before proceeding on leave.

(k) Study Leave: Study Leave is admissible for employees pursuing higher studies or specialised training in a professional or technical subject having a direct and close connection with his sphere of duties. The employees must have satisfactorily completed probation and rendered at least 5 years regular service. Employees who are due to retire on superannuation within 3 years from the expected return after study leave are not eligible. Maximum 12 months at a time and 24 months in all during entire career. Leave salary is admissible as applicable on EL.

(l) Casual Leave: 12 days while posted in the Field Units and working six days in a week or where no working hours are prescribed. 08 days to GREF Officers/Subordinates posted in Headquarter DGBR.

34. Joining Time:

Same Station: One day is admissible on transfer to join a new post within the same station.

One Station to Another : (i) One day is admissible if change of residence is not involved (ii) If change of residence is involved, joining time will be admissible with reference to the distance between the old and new station by direct route and ordinary mode(s) of travel, as given below :-

35. Leave Travel Concession:

(a) LTC to Home Town: Admissible to all employees irrespective of the distance involved. Admissible once in a block of two calendar years. An employee (including un-married) having his family at his home town can avail of this concession for himself alone every year instead of having it for both self and family once in two years.

(b) LTC to Any Place in India: This concession is admissible in lieu of one of the two journeys to home town in a block of four years. The current block is 2006- 2009.

36. Additional Leave Travel Concession: Free Rail Pass has been granted to the members of GREF once in a calendar year in the event of death, serious illness or marriage of a member of the family subject to the condition that 50% rail fare is to be borne by the individual concerned in the entitled class and in accordance with similar terms and conditions as applicable to CPMFs.

37. Advances: (Refer GFR and Compendium on Advances)

(a) Festival Advance (Interest Free): Rs 1,500/- is admissible to non-gazetted employees whose basic pay plus + DP + SI does not exceed Rs 12450/- pm. Admissible only once in a financial year and should be recovered not more than 10 equal instalments.

(b) Scooter/Motor Cycle Advance (Interest bearing): Employees drawing pay (Basic Pay + SI + NPA) of Rs 6900/- pm or more are eligible. This condition can be relaxed by sanctioning authority in deserving cases. Amount of advance is Rs. 30,000/- or 4 months pay or anticipated price of motor cycle/scooter which ever is least on first occasion. On second

and subsequent occasion Rs 24,000/- or 3 month’s pay or anticipated price of motor cycle/scooter which ever is least. Repayment will be done in maximum 70 monthly instalments.

(c) Personal Computer Advance (Interest bearing): Officers drawing basic pay + DP + NPA + SI of Rs 15,750/- pm or more are eligible for grant of the advance. This may be relaxed by the Secretary to the Ministry/Department in deserving cases. Rs 80,000/- on the first occasion and Rs 75,000/- on second or

subsequent occasion or the anticipated price of the computer. Repayments will be done in not more than 150

monthly instalments.

(d) Motor Car Advance (Interest bearing): Officers drawing Basic Pay + DP + NPA + SI increment of Rs 15,750/- pm or more

are eligible for the grant the advance. This may be relaxed by the Secretary to the Ministry/Department in deserving cases. Rs 1, 80,000/- on the first occasion or eight months basic pay plus DP plus NPA plus SI or the price of the car to be purchased, whichever is the least. On the second/ subsequent occasions, restricted to Rs 1, 60,000/- or eight months basic pay or the price of the car to be

purchased

(e) House Building Advance(Interest bearing)( Refer Swamy’s House Building Advance Rules) : All permanent officials with at least 10 years’ continuous service are eligible for the purpose of acquiring a plot and constructing a house thereon, enlarging living accommodation in an existing house, purchase of house/flat, repayment of a loan taken from Govt/ Private source for house construction. The amount of advance admissible is 34 times of the Basic Pay+DP+NPA+SI of the official or Rs 7.50 lakhs or cost of the house or repaying capacity, whichever is least. Only one advance is admissible during the entire service. The entire amount of advance together with interest is repayable in 20 years, 180 monthly instalments

for principal and 60 instalments for interest.

(f) Advance from GPF (Refer GPF (CS) Rules): Advance can be taken for the purposes of illness, education of family members, obligatory expenses, purchasing consumer durables and cost of legal proceedings. Amount of advance permissible is 3 months Pay+DP or half the amount at credit, which ever is less and recoverable in not more than 24 equal monthly instalments.

(g) Withdrawal from GPF (Refer GPF(CS)Rules) : Withdrawals can be taken for the purposes of cost of education of the subscriber or any child of the subscriber, obligatory expenses, illness, purchasing consumer durables, building

or acquiring a suitable house, repayment of outstanding housing loan, purchasing a house site, renovating ancestral house etc. Normally, one half of the amount at credit or six months’ pay plus DP, whichever is less. 90% of balance at credit

can be sanctioned at the discretion of the sanctioning authority.

38. Concessions when posted to North Eastern Region : Allowances and facilities have been extended for employees of GREF Serving in the States, Union Territories of North Eastern Region on the same terms and conditions, as have been laid down in Min of Finance (Department of Expenditure) OM No 20014/3/83-EIV dated 14-12-1983 read with OM No 20014/16/86/E.II (B) dated 1-12-1988 and 11/2/97-E-II (B) dated 22-7-1998.

PART-II

TERMINAL BENEFITS FOR GREF PERSONNEL ON RETIREMENT

General

1. (i) Entitlements. An individual on retirement from service and NOK of the individual on death of her husband after retirement is entitled to one or more of the following terminal benefits :-

(a) Retiring Pension

(b) Commutation of pension

(c) Retirement Gratuity

(d) Invalid Pension / Gratuity

(e) Disability Pension

(f) Family pension to NOK

(g) Final Settlement of GPF

(h) Pensioner’s Identity Card

(j) Leave Encashment

(l) Retention of Accommodation

(ii) However, GREF personnel appointed on or after 01 Jan 2004 will be eligible for new Pension Scheme. Entitlements mentioned at (i) (g) to (n) shall remain applicable to them.

2. Retiring Pension – Qualifying Service . Retiring pension is granted on completing a minimum qualifying service of 20 years. The

weightage element is an inbuilt factor of the pension and it is meant to compensate comparatively yearly retiring age. Maximum pension is applicable if actual service (qualifying service) or actual service including weightage is 33 years. For lesser service, pension is correspondingly depressed. Weightage is not taken into account to make up 20 years of service. For less than 20 but more than 10 years of service, Retiring Gratuity may be admissible. A retiring pension shall be granted :-

(a) to a Govt servant who retires, or is retired, in advance of the age of compulsory retirement in accordance with the provision of Rule 48 or 48-A of CCS (Pension) Rule 1972 or Rule 56 of the Fundamental Rules or Article 459 of the Civil Service Regulations; and

(b) to a Govt servant who, on being declared surplus, opts for voluntary retirement in accordance with the provisions of rule

29 of these rules.

3. Voluntary Retirement. At any time after completing twenty years’ qualifying service, individual may retire from service with pensionary benefits by giving notice of not less than three months in writing to the appointing authority.

The notice of voluntary retirement given under sub rule (1) of Rule 48A of CCS (Pension) Rules 1972 shall require acceptance by the appointing authority.

Provided that where the appointing authy does not refuse to grant the permission for retirement before expiry of the period specified in the said notice, the retirement shall become effective from the date of expiry of the said period.

A Government servant referred to above may made a request in writing to the appointing authority to accept notice of voluntary retirement of less than three months giving reason therefore :

On receipt of a request, the appointing Authy subject to the provisions of sub-rule (2), may consider such request for the curtailment of the period of notice of three months on merits and if it is satisfied that the curtailment of the period of notice will not cause any administrative inconvenience, the appointing Authy may relax the requirement of notice of three months on the condition that the Government servant shall not apply for commutation of a part of his pension before expiry of the period of notice of three months.

A Government servant, who has elected to retire under this rule and has given the necessary notice to that effect to the appointing Authy, shall be precluded from withdrawing his notice except with the specific approval of such authority.

Provided that the request for withdrawal shall be made before the intended date of his retirement.

The pension and retirement gratuity of the Government servant retiring under this rule shall be based on the emoluments as defined under Rule 33 and 34 and the increase not exceeding five years in his qualifying service shall not entitled him to any notional fixation of pay for purpose of calculating pension and gratuity.

The rule shall not apply to a Government servant who

(a) retires under rule 29, or

(b) retires from Govt service for being absorbed permanently in an autonomous body or a public sector undertaking to which he is on deputation at the time of seeking voluntary retirement.

4. Calculation of Pension . It is calculated @ 50% of average emoluments drawn during last ten months of service. Emoluments for calculation of pension have been defined as Basic Pay plus DP and Non-Practicing Allowance (where applicable). Formula for calculation of Retiring Pension with qualifying service of 20 years or more is :-

5. Commutation of Pension. A maximum of 40% of pension can be commuted. The commuted value of pension is calculated on the basis of an indvl’s age of next birth day, which falls after the date of retirement. Format of application is appended at Appendix ‘B’.

Application. The specimen for application for retiring pension is at Appendix ‘C’. It is to be sent by the individual concerned to the audit authy through his unit at least 3 months in advance of his retirement. Concerned audit authy transmit the same to PCDA (P) Allahabad, for issuing Pension Payment Order to the banker with a copy to the individual.

6. Restoration of Commuted portion of Pension. As per Govt of India decision No. 2 below Rule 9, pensioners who have commuted a portion of their pension and on 01 Apr 1985 or thereafter have completed or will complete 15 years from their respective date of retirement will have their commuted portion of pension restored.

The pensioner is required to apply in the proforma appended as Appendix ‘D’ to the pension disbursing authority/bank/post office who will restore the commuted portion of pension.

7. Disabled GREF personnel Invalided/Boarded out from

service

It has been decided by the Govt of India, vide Govt of India, Ministry of Personnel, Public grievances and pension (DOPT) OM No. 13015/3/2002-Estt (L) dated 19 Jan 2004 that personnel who have been declared permanently incapacitated shall not be discharged on invalidation.

8. Disability Pension (EOP Rules)

These rules shall apply to all persons paid from Civil Estimates other than those to whom the Workmen’s Compensation Act 1923 applies.

This Rule is not applicable to GREF personnel except Clerical Staff since compensation under WCA-1923 is payable for disability and no GREF personnel will be invalided out from service as per Govt of India, Min of Personnel, Public Grievances and Pension (DOPT) OM No. 13015/3/2002-Estt (L) dated 19 Jan 2004.

Percentage of Disability

Percentage loss of earning capacity (percentage disability) is being assessed by competent medical authorities based on list of injuries annexed at Part I & II of Schedule I of CCS (EOP) Rule.

Disability pension payable under ibid rules are as under:-

Pension equal to retiring pension and gratuity to which the employee would have been entitled on the basis of his pay on the date of invalidation but counting service upto the date of which he would have retired in normal course and disability element equal in amount to normal family pension subject to the condition that the aggregate of the service and disability element shall not be less than 80% of the pay last drawn, for 100% disability. For lower percentage of disability, the disability element shall be proportionately lower as at present.

4. Death or disability arising as a result of attack by or action against extremists, anti social elements etc. Example extremists acts, exploding mines, kidnapping by extremists, battle inoculation etc.

Pension equal to retiring pension and gratuity to which the employee would have been entitled on the basis of his pay on the date of invalidation but counting service upto the date of which he would have retired in normal course and disability element equal in amount to normal family pension subject to the condition that the aggregate of the service and disability element shall not exceed the pay last drawn, for 100% disability. For lower percentage of disability, the disability element shall be proportionately lower as at present.

9. Service Gratuity. No pension is admissible to a permanent employee who retires before completion of 10 years’ qualifying service. Instead, a lump sum payment known as Service Gratuity at the rate of half-month’s emoluments for every completed six-monthly period of

qualifying service is admitted. `Emoluments’ means Basic pay, DP, Stagnation increment, Non-practicing allowance, if any.

This gratuity is in addition to retirement gratuity admissible to those who have completed 5 years’ qualifying service.

10. Retirement Gratuity. Permanent GREF personnel who have put in a minimum of 5 years qualifying service are eligible for Retirement Gratuity at the rate of one fourth of the emoluments last drawn for every six months of completed service, subject to a maximum of sixteen and half times of emoluments, or Rs. 3.5 lakhs whichever is less. A uniform weightage of 5 years is added to actual qualifying service subject to the total not exceeding 33 years of service. Emoluments means Pay, Rank Pay and NPA (where applicable).

Application. No separate application is required (See Annx-I to Appendix `C’).

Action to be taken

11. Superannuation Retirement. Superannuation retirement should be afternoon of last day of the month in which individual completing 60 years of age according to FR 56 and amendment No. 7 dated 01.01.1999 to Rule 35 of CCS (Pension Compilation).

No specific notice or orders are necessary for superannuation retirement on due date.

12. Entitlement on superannuation / Voluntary retirement and Action required to be taken by the HQ/ Unit concerned.

Concerned unit/Fmn will publish his DO part-II at least 8 months in advance regarding his superannuation retirement. After publishing DO part II Pension and commutation papers to be prepared and forwarded to PCDA (P) Allahabad at least 6 months in advance through audit channel so that his PPO will be issued by PCDA (P) Allahabad before / on the date of his superannuation. In case of Voluntary retirement, concerned unit/Fmn will publish his DO Part-II immediately on receipt sanction of voluntary retirement and papers to be prepared and forwarded to PCDA (P) Allahabad through audit channel immediately so that his PPO will be issued by PCDA (P) Allahabad well in time.(c) Initiation of Final GPF claim to PAO (GREF). The GP Fund claim has to be initiated 3 months in advance alongwith following documents to PAO (GREF) :-

(i) Contingent bill duly affixed with revenue stamp worth Rs. 1/-(ii) No demand certificate duly verified by concerned

audit authy.

(iii) Last 5 years withdrawals certificate (for part final withdrawal and ty advance) duly verified by concerned audit authy.

(iv) GPF discontinuation certificate (DO II for discontinuation of GPF for last 3 months to be published).

(v) Copy of DO Part II notifying casualty regarding retirement as well as discontinuation of GPF subscription.

(vi) Copy of last QSA alongwith statement of subscription thereafter till retirement.

(d) CGEGIS. The claim should be submitted to PAO (GREF) (alongwith GP Fund claim) three months before the date of retirement. The insurance cover is available upto the last day of employment. The amount becomes payable on the first

working day after the retirement. The following documents are required to be submitted alongwith the claim to PAO

(GREF) :-

(i) Appendix `H’ (Pre-receipted bill) duly affixed with revenue stamp worth Rs. 1/-.

(ii) Relevant bio-data of the individual i.e; date of initial joining the scheme, any promotion/ changes of group “D”, “C” , “B”, “A” after initial joining should be given and signed by OC /Cdr/CE (concerned unit/HQ).

(iii) No demand certificate duly verified by the concerned audit authorities.

(iv) Sanction of competent authority

(v) DO Part II regarding superannuation / voluntary retirement.

(e) Submission of final P&A and Encashment of EL claim to PAO (GREF). The following documents are required for finalization of P&A and encashment of EL. This claim is to be initiated on the next working day of the date of superannuation / voluntary retirement.

(i) No demand certificate

(ii) Sy bill for encashment of EL

(iii) DO II regarding Superannuation / Voluntary

retirement

(iv) Sanction of competent authy for encashment of EL

(v) Leave credit certificate duly verified by concerned audit authy.

(vi) DO II regarding encashment of EL

13. Commercial Employment after retirement Group `A’ & `B’ Officers.

Commercial Employment means an employment in any capacity including that of an agent under a company, co-operative society, firm or individual engaged in trading, commercial, industrial, financial or professional business and includes also a directorship of such company and partnership of such firm, but does not include employment under a body corporate, wholly or substantially owned or controlled by the Central government or a State Government.

If a pensioner who immediately before his retirement was a member of Central Service Group `A’ wishes to accept any commercial employment before the expiry of two years from the date of his retirement, he shall obtain the previous sanction of the Government to such acceptance (by submitting an application in Form 25 appended at Appendix ‘J’ ).

Provided that a Government servant who was permitted by the Government to take up a particular form of commercial employment during his leave preparatory to retirement or during refused leave shall not be required to obtain subsequent permission for his continuance in such employment after retirement.

Retired Group `B’ Officers need not get prior sanction of the govt. They should intimate the Office they served last before retirement if they take up any commercial employment within two years of their retirement. The intimation should contain information as to whether or not they have had any official dealing while in Govt service, with the private employer, with whom they are taking up the employment. GID 6 below Rule 10 CCS (Pension) Rules, 1972.

Retired engineers of Gazetted rank and other Gazetted Officers employed as engineering administrators who seek commercial employment as Contractors in connection with Government works or as employees of such Contractors within two years of their retirement should obtain prior permission.

14. Employment after retirement under a Government outside India

If a pensioner, who immediately before his retirement was a member of Central Service Group `A’, wishes to accept any employment under any government outside India, he shall obtain the previous permission of the Central Govt for such acceptance and no pension shall be payable to a pensioner who accepts such an employment without proper permission in respect of any period for which he is so employed or such longer period as the Govt may direct.

Requests for permission to accept the aforesaid employment after retirement under a Govt outside India shall be considered by the Ministry / Department under which the Offr concerned served last prior to his retirement and a decision taken in consultation with the Ministry of external affairs.

15. Notice period for Temporary employees seeking discharge from Service :-

The services of a temporary Government Servant may be terminated at any time by a notice of one month on either side by the Government servant or the Appointing Authority. The Appointing Authority has also the option to pay the Government servant his pay and allowances for the period of one month or for the period by which such notice falls short of one month and terminate his services immediately. On the other hand, the Government servant has no such option, but has necessarily to give one month’s notice under Rule 5 of CCS (TS) Rules 1965.

Heads of Departments may review cases of termination or re-open such cases and order :-

(i) confirming the action taken by the appointing authority or

(ii) withdrawing the notice; or

(iii) reinstating the employee in service or

(iv) making such other order in the case as it may consider

proper.

Terminal Gratuity is payable at the prescribed slab rates as given below :-

½ a month’s pay for each completed year of service.

10 years and above One month’s pay for each completed year of service subject to a maximum of Rs. 15,000/- or 15 months pay, whichever is less.

16. Notice period for Permanent employees seeking discharge from Service :-

A Government servant shall give a notice in writing to the Appointing Authority at least three months before the date on which he wishes to retire and the appointing authority may also give a notice in writing to a Govt servant at least three months before the date on

which he is required to retire in the public interest or three months pay and allowances in lieu of such notice.

A permanent Government servant may make a request in writing to the appointing authority to accept notice of less than three months giving reasons therefore,

On receipt of request the Appointing authority may consider such request for the curtailment of the period of notice of three months on merits and if it is satisfied that the curtailment of the period of notice will not cause any administrative inconvenience, the Appointing Authority may relax the requirement of notice of three months.

If the Govt servant has completed 20 years of qualifying service, he will be eligible for pensionary benefits as per CCS (Pension) Rules, 1972. 17. Resignation

Resignation should be clear and un-conditional. It should be submitted to the Appointing authority in respect of the service or post in question who is competent to accept it.

Resignation will generally be accepted straightaway with certain exceptions.

In all cases of acceptance of resignation, prior vigilance clearance from the Competent Authority is mandatory and this clearance should be accorded expeditiously.

Resignation becomes effective not merely when it is accepted by the authority concerned but only when the Officer is actually relieved of his duties.

A Govt Servant quitting service on resignation will not be entitled to for any pension, gratuity or terminal benefits. He will however, be paid suo moto, cash equivalent to the extent of half of earned leave at his credit on the date of cessation of service, subject to a maximum of 150 days including the number of days of EL for which encashment was availed alongwith LTC.

When a Govt servant applies for post in the same or another department through proper channel and on selection he is asked to resign the previous post for administrative reasons –

(a) the resignation will be treated as a “technical formality”

(b) the benefit of past service, if otherwise admissible under the rules, will be allowed for purpose of fixation of pay in the new post

(c) leave at credit will be carried forward; and

(d) the past service will be counted for pension to the same extent it would, but for the resignation

18. Identity Card. The Identity card will be issued to retired GREF personnel as a matter of privilege for the services rendered in GREF and is meant to establish their identity as retired GREF person whenever they visit GREF units/Fmns, CSD Canteen or to any Govt Depts.

All GREF personnel retired/retiring on superannuation, voluntary retirements are eligible. Those who are removed / dismissed/ retired

under CCS (CC&A) Rules, 1965 or resign from service are not eligible for issue of retired personnel Identity Card. Identity Card will be issued only through the unit of the individual. It implies that without surrendering the GREF service Identity Card, a Retired personnel Identity card will not be issued.

19. Issue of Discharge book & Duplicate Discharge book. Printed Discharge book is being issued to GREF personnel proceeding on retirement. This document containing brief history of service and an important document as far as a pensioner is concerned. Therefore, the discharge Certificate will be kept safely and be secured from all type of losses or damages. In case of loss / theft / fire of original discharge certificate, the pensioner will lodge an FIR with nearby police station. It is noticed by GREF Records from reasons quoted for the loss in the applications that no proper care is taken to safe guard the discharge certificate issued.

Duplicate discharge certificates will not be issued in place of lost one as a routine but only in exceptional cases. The individual should therefore, ensure the safe custody of the certificate in his own interest.

20. Medical Entitlement. All Central Government pensioners (except Railways) and widow of Central Government pensioners, getting family pension are eligible for CGHS Scheme.

Conditions

(i) The employee should reside in the area of operation of the Scheme

(ii) Pensioners residing anywhere may get registered in any dispensary

(iii) A family photograph of size 6.5 cm x 5 cm should be affixed to the CGHS token card and got attested by the department.

In case of CGHS beneficiary falling sick outside CGHS area, treatment is allowed under CS (MA) Rules 1944 in Govt Hospital/referral hospitals/ Recognized hospitals.

21. CGHS Contribution by Pensioners/family Pensioners .

(a) Pensioners/Family pensioners have the option to pay contribution based on pay last drawn by the pensioner/deceased employee or their pension or family pension. Original pension (before commutation) including PEG portion but excluding dearness relief shall be the basis for determining rate of contribution.

(b) Pensioners/Family pensioners are required to pay their contributions in advance for a period of one year either from January to December or July to June.

(c) Pensioners who are on extension of service or re-employed shall pay normal contribution as in the case of serving employees and avail all facilities.

(d) Pensioners can avail CGHS facility for life-time, on a permanent CGHS card in following cases :-

(i) By paying 10 years contribution, in one lump sum at the time of retirement.

(ii) By paying lump sum contribution for the remaining period out of 10 years, (where contribution has been paid for certain period),or

(iii) When he has already paid yearly contributions for 10 years (and over), no further contribution is required.

22. Medical Allowance for Pensioners/family Pensioners not availing CGHS Facility.

Pensioners/family pensioners residing in areas not covered by CGHS (or corresponding health schemes of other Ministries/Departments), shall be granted a fixed medical allowance @ Rs. 100/- PM wef 01 Dec 1997, for meeting expenditure on day-to-day medical expenses that do not require hospitalization. Pensioners living in CGHS covered cities, but whose place of residence is not served by CGHS (or any corresponding Health Scheme of the Ministry/Department) shall also be entitled for Medical allowance @ Rs. 100/- PM on furnishing an undertaking that a certificate from the authorities of CGHS (or concerned Ministry/Department) to that effect. Medical allowance is not payable if the pensioners/family pensioners are residing in areas where CGHS facility exists.

Existing pensioners as well as future retirees shall have one-time option to avail of medical facilities under CGHS (or other similar scheme of their respective Ministry/ Department) or to claim fixed medical allowance of Rs. 100/- PM If he opts for medical allowance, CGHS card will be restricted for only indoor treatment. Form of option is placed at Appendix ‘K’.

The beneficiaries of ex-gratia pension/re-employed pensioners/employed family pensioners are not entitled to medical allowance. If the family pension is shared by two widows, same criteria for medical allowance is to be adopted as is adopted in the case of dearness relief. If any pensioner received two pensions, only single medical allowance is admissible and if a pensioner received both military and civil pensions, medical allowance is admissible for only one pension provided he does not avail medical facilities either from civil or military organizations.

Migrant pensioners from Kashmir Valley, drawing their pension at Delhi as temporary measure have the option to either avail CGHS facilities (on payment of prescribed contribution) or drawn fixed medical allowance of Rs. 100/-PM

Travel Concessions

23. Traveling & Baggage Allowance. The person proceeding on retirement / release, besides Composite Transfer grant is entitled to free Conveyance including free conveyance of baggage for self and members of the family, personnel conveyance from the last duty station to their permanent home address as recorded in official documents or to the place where they and their families are to settle down permanently even if it is other than their declared home town in India. Similar facilities are available to the widow / family in case of death while in service.

Miscellaneous

24. CSD Canteen Facilities. Ex GREF personnel are authorized to draw Canteen facilities including liquor as per sanction given by Army HQ QMG Branch Canteen Service letter NO. 96018/Q/DDGCS dated 22-07-1998.

Widows of GREF subordinates, who are in receipt of family pension from GREF will also be eligible to avail above facilities from CSD Canteens.

25. Canteen Card. Ex GREF personnel can opt to avail canteen facilities from any one of the CSD Canteens being run either by an Army/Air Force/ Navy or GREF Unit/fmn. For this purpose they will submit an application as per prescribed proforma placed at Appendix ‘L’ to the following authorities, alongwith their discharge certificate (duly affixed with their photographs) in original and two copies of their joint photographs with spouse.

(a) Concerned Station / Area HQ – in case they want the facilities from a CSD Canteen run by an Army, Air Force unit / Formation.

(b) GREF Unit/formation from whose CSD Canteen they wish to avail the facilities.

26. Benefits of Awards. The Chakra Series awards carry following benefits :-

Kirti Chakra . A monetary grant of Rs. 1050/- pm is given to the awardee or his family for life. In addition, awardees / widow of posthumous awardees alongwith companion are entitled for First Class / AC2 Tier Complimentary Card pass

facility. The monetary allowance being granted through Corrigendum PPO by PCDA (Pension) in respect of posthumous awardees, for which concerned unit will take up the case with PCDA (P) Allahabad alongwith copy of Gazette Notification.

Shaurya Chakra. A monetary grant of Rs. 750/- pm is given to the awardee or his NOK for life. In addition, awardees / widow of posthumous awardees alongwith companion are entitled for First Class / AC2 Tier Complimentary Card pass facility. The monetary allowance being granted through Corrigendum PPO by PCDA (Pension) in respect of posthumous awardees, for which concerned unit will take up the case with PCDA (P) Allahabad alongwith copy of Gazette Notification.

The Railway complementary cards are issued by Divisional Railway Manager and Headquarters Office of Indian Railways.

The pass will be issued by the Office of the Divisional Railway manager and Headquarters Office of the Railways on receipt of application on plain paper from the recipient of the Gallantry Awards or the widow of the posthumous winner of Gallantry giving the following details alongwith two recent photographs of the awardees or widow of posthumous awardees as the case may be :-

(a) Name of the recipient of Gallantry Award (in block letters)(b) Residential Address

(c) Attested photo copy of the citation / Gazette Notification of the Gallantry Award.

27. Marriage/Birth of Children after retirement. As and when a pensioner marries or re-marries after retirement, he shall intimate the event to the Head of Office who processed his pension papers at the time of his retirement in the proforma appended at Appendix ‘M’. He shall also furnish alongwith his application, an attested copy of the marriage certificate from Registrar / Gram Panchayat / District Magistrate in respect of his post - retirement marriage.

When the pensioner does not have any child or children from his previous marriage, if any, the post-retrial spouse shall be eligible for full family pension. Where the pensioner has any eligible child or children from another wife, who is not alive, the family pension to the post retrial spouse and the child / children from the previous marriage will be authorized in terms of Clause (b) of Sub Rule 7 of Rule 54 of CCS (Pension) Rules, 1972.

As far as children, including those born after retirement, are concerned, a fresh PPO will be issued as and when the turn of each child for receipt of family pension is reached as at present.Authy :- GID 16 below Rule 54

PART III

ENTITLEMENTS AFTER DEATH OF GREF PERSONNEL

Death in Service

1. In case the death of a GREF person takes place while serving in the Unit, the OC Unit is duty bound to send the intimation of death to his NOK by the fastest means i.e. telegram, telephone, speed-post etc. (as per facilities available). It would be desirable that all GREF person leave the complete up-dated address and the telephone No. of their NOK’s with their OsC Units. A confirmation regarding cremation of the dead body at Unit location or Home town will be obtained from the NOKs with the condition that expenditure on transportation of dead body will be borne by them.

Dead bodies of GREF personnel who get killed in border / line of control (LOC) operations/ counter insurgency (CI) operations can be transported to the home town of the deceased at Govt expense by the fastest means including by air, if so desired by the NOK. There is no provision for conveyance of dead bodies of GREF personnel getting killed / died in other circumstances while serving with unit, to their home town, at Govt expense.

Where the death takes place while the individual is on leave in the care of his family, it would be the duty of NOK to send the intimation of his death to the OC Unit by fastest means. In such an event it will also be the duty of NOK to obtain death certificate of the individual and send it to the OC Unit under registered AD cover or through a special messenger if possible.

Physical Casualty

2. Physical casualties are those which occur in non operation areas where there is no fighting. Such casualties fall into the following categories :-

(i) Died or killed

(ii) Seriously or Dangerously ill

(iii) Ill

(iv) Wounded or injured (included self inflicted)

(v) Missing

Battle Casualty

3. Battle casualties are those sustained in action against enemy forces. These casualties consists the following:-

(i) Killed in action

(ii) Died or wounded or injured (other than self inflicted)

(iii) Wounded or injured (other than self inflicted)

(iv) Missing

(v) Prisoner of War

The procedure for reporting casualties have been incorporated at Chapter 4 of ROI Compendium 1998.Special Messenger to Home Town

4. In all death cases, the OC Unit is required to send a special messenger to the home town of the NOK to carry out the following tasks:-

(i) Carry bank draft on account of Immediate Relief, BRSRF and GREF Benevolent Fund for handing over to the NOK.

(ii) Hand over personal belongings of the deceased person which may be lying in the Unit.

(iii) Hand over ashes of the deceased person, if cremated at unit location.

(iv) Carry documents for obtaining signature of the NOK on pension and other terminal dues.

The NOK are advised to co-operate with the Units and return all the papers duly signed by them through the special messenger. Complete details of bank/Treasury from where the NOK intends to draw pension should be furnished in the documents. The special messenger should not be un-duly delayed which will affect the payment of dues within the time frame.

Death Terminal benefits

5. (a) Immediate Relief

A sum of Rs.8000/- Rupees eight thousand only) is payable to the NOK immediately on the intimation of death, out of Regimental Fund of the Unit. The amount is subsequently recovered out of death cum- retirement-gratuity (DCRG)

(b) Border Roads Special Relief Fund

(i) A sum of Rs.6000/- (Rupees six thousand only) is payable to the NOK of the deceased to whom Workman Compensation nor pension is admissible.

(ii) A sum of Rs.2500/- (Rupees two thousand five hundred only) is payable to the NOK of the deceased to whom neither Workman Compensation nor pension is admissible.

(c) GREF Benevolent Fund

Following grant is payable to the NOKs of GREF subordinates on intimation of death. The amount is initially paid by the Units from their Regimental Funds and later recouped from GREF Records.

(i) A sum of Rs.12000/- (Rupees twelve thousand only) to those who would not be entitled to Workman Compensation for the death.

(ii) A sum of Rs.8000/- (Rupees eight thousand only) to those who would be entitled to Workman Compensation for the death.

(d) Final Settlement GPF

Balance amount lying in the credit of the deceased GREF person is payable to the NOK or person(s) nominated by the deceased GREF person.

(e) Deposit Linked Insurance Scheme (DLI)

An amount equal to the average balance in the GP Fund account during the last three years immediately preceding the death of a GREF person who has put in at least five years service at the time of death, is payable to the NOK subject the conditions that the balance at the credit of such subscriber shall not at any time during the three years preceding the month of death have fallen below the limits of :-

(i) Rs.25000/- in the case of a subscriber holding a post in the scale of pay, the maximum of which is Rs.12000/- or more.

(ii) Rs.15000/- in the case of a subscriber holding a post in the scale of pay, the maximum of which is Rs.9000/- or more but less than Rs.12000/-.

(iii) Rs.10000/- in the case of a subscriber holding a post in the scale of pay, the maximum of which is Rs.3500/- or more but less than Rs.9000/-.

(iv) Rs.6000/- in the case of a subscriber holding a post in the scale of pay, the maximum of which is Rs.3500/-

(a) The maximum amount payable under the DLI scheme shall not exceed Rs.60000/-

(b) The subscriber has put in at least 5 years service at the time of his/her death.

Rule 33-B of CCS (GPF) Rules 1960.

(f) Encashment of Earned Leave

The NOK is entitled to receive an amount towards encashment of earned leave to the extent of basic pay plus DP plus DA for the number of days of earned leave standing at the credit of the deceased GREF person at the time of his death subject to maximum of 300 days.

(g) Final Settlement of Pay and Allces

After the death of a GREF person, his IRLA is closed by PAO (GREF) and the net pay and allces due to him, if any are worked out and are payable to the NOK. In case, the closing of IRLA results into a debit balance the debit balance is recoverable from other dues.

(h) Final TA/DA, Composite Transfer Grant and Luggage Charges

In case the NOK of the deceased is residing with the GREF person at the time of his death at duty place, she along with other family members are entitled to the following transfer incidentals:-

(i) Composite Transfer Grant at the rate of one month’s basic pay plus DP of the deceased GREF person

(ii) Transportation of personal effects to the home town at the following rates:-

(a) 6000 Kgs by goods train for posts in the scale of pay Rs. 8000/- and above.

(b) 3000 Kgs by goods train for the posts in the scale of pay Rs. 6500/- to Rs. 7999/-.

(c) 1500 Kgs by goods train for the posts in the scale of pay Rs. 3350/- to Rs. 64999/-.

(d) 1000 Kgs by goods train for the posts in the scale of pay below Rs. 3350/-

(iii) Traveling allowance from the home town to the place of posting of GREF person is admissible to the NOK or one member of the family to attend funeral if the death takes place in unit.

(j) Central Government Employees Group Insurance Scheme

The following lump sum grant from the Scheme will be payable to the NOK or other members of the family as per nomination made by the deceased GREF person :-

(i) Group A Gazetted employees = Rs.1,20,000.00

(ii) Group B Non-Gazetted = Rs. 60,000.00employees (wef 01 Jan 2007)

(iii) Group C employees = Rs. 30,000.00

(iv) Group D employees = Rs. 15,000.00

In addition to the insurance amount as above, the family is also entitled to the share of saving element of the Scheme. The rates of the saving element are decided by the Govt on a year to year basis.

(k) Group personnel Accident Insurance Scheme

A sum of Rs. 1,00,000.0 (Rupees one lakh only) is payable to the NOK of the deceased if the death is due to an accident subject to the contribution of premium made by the deceased while in service on year to year basis.

(l) Compensation under Workmen’s Compensation Act 1923

If the deceased GREF person was a “workman” in terms of the definition in the Workmen’s Compensation Act and his death had occurred in an accident during his course of employment with GREF or due an occupational disease listed in the Act, in that case the NOK is entitled to receive a compensation under the Act. The amount of compensation which ranges from Rs. 2.5 lakhs to Rs. 4.5 lakhs is worked out based on the pay of the deceased person and his age at the time of death.

6. The family of a deceased GREF person is entitled to family pension @ 30% of his basic pay last drawn subject to a minimum of Rs. 1,275/- pm ( Rs. 1913/- wef 01.04.2004) per month. In addition, dearness relief as notified by the Govt from time to time is also admissible.

Rule 54 (2) of CCS (Pension) Rules, 1972.

Enhanced rate of family pension

7. Where a Govt servant, who is not governed by Workmen’s Compensation Act 1923, dies while in service, after having rendered not less than 7 years continuous service, the rate of family pension payable to the family shall be equal to 50% of the pay last drawn or twice the rate family pension admissible, whichever is less. Enhanced rate of family pension will be payable for a period of 7 years from the date of death or 65 years of age of the deceased, whichever is less.(67 years in case of superannuation age 60 years)

If Governed by WCA 1923, dies while in service, rate of family pension payable shall be 50% of last pay drawn or 1.½ times of family pension admissible, whichever is less.

Rule 54 (3) (a) & (b) of CCS (Pension) Rules 1972

Granting Provisional Family pension for 6 months by Chief Engineers Projects :-

8. The Chief Engineer Projects have been authorized to sanction provisional family pension for the first six months after death, which will be remitted to the NOK by the OC unit. After expiry of 6 months period, the family pension is sanctioned by Principal CDA (Pension) Office, Allahabad and payable through a pension payment order (PPO) issued by Principal CDA (Pension) Office Allahabad. The OC unit is required to get the final family pension sanctioned from the Office of PCDA (Pension Allahabad before the expiry of six months period so that there is no time gap in the payment of pension to the NOK.

Rules 54 (3) of CCS (Pension) Rules, 1972.

Eligible member for family pension

9. Family for the purpose of family pension means

(i) Wife in the case of male Govt servant or husband in the case of female Govt servant.

(ii) Son(s), unmarried daughter (s) including legally adopted son/daughter), all below the age of 25 years or upto the date of his/her marriage whichever is earlier.

(a) Widowed/divorced daughter (s) upto the date of re-marriage / death irrespective of age.

(iii) Parents who were wholly dependent on the Govt servant when he / she was alive, provided the deceased employee had left behind neither a widow nor a child.

(iv) The income criteria for dependency will be that their earnings is not more than Rs. 2,550/- pm.

Rule 54 (14) of CCS (Pension) Rules, 1972.

Grant of family pension to handicapped children

10. If the son or daughter of a Govt servant is suffering from any disorder or disability of mind (including mentally retarded) or is physically crippled or disabled so as to render him or her unable to earn a living even after attaining the age of 25 years, the family pension shall be payable to such son or daughter for life.

A daughter shall become ineligible for family pension under above provision from the date she gets married.

Family pension to such a son or daughter shall be stopped if he or she starts earning his / her livelihood.

As and when the disability manifests itself in a child which makes him / her unable to earn his / her living, the fact should be brought to the notice of the HOO duly supported by a Medical Certificate from a Medical Officer, not below the rank of a Civil Surgeon. This may be indicated in Form 3 by the HOO. As and when the claim for family pension arises, the legal guardian of the child should make an application supported by a fresh medical certificate from a Medical Officer, not below the rank of Civil Surgeon, that the child still suffers from the disability.

Grant of ordinary family pension to widow divorced daughter

11. Where the deceased is survived by a widow and also an eligible child from a deceased/divorced wife, the child will be paid the share of the family pension which its mother would have received had she been alive / not divorced. On the share ceasing to be payable to the child, it will be paid to the surviving widow.

12. When there are more than one widow, the family pension will be allowed in equal shares. On the death of a widow, her share becomes payable to her eligible child/children. If such widow leaves no eligible child, her share of pension will be payable to the other widow in full.

However, as per Govt of India decision No. 13 below Rule 54, second wife not entitled to the family pension as a legally wedded wife under the Hindu Marriage Act.

Re-marriage of a widow

13. Family pension is payable to a widow up to the date of death or remarriage, whichever is earlier.

Rule 54 (6) (i)

Extra Ordinary Family Pension

14. If an employee sustains injuries, diseases or dies and the injury , disease or death is attributable to Govt service, he / his family becomes eligible for the grant of an award under the CCS (Extra Ordinary Pension) Rules, 1939, which are applicable to employees except to those to whom the Workmen’s Compensation Act, 1923 applies.

The family pension payable under this Rule is 60% of basic pay + DP subject to a minimum of Rs. 2,500/- pm. Where the deceased was holding a pensionable post. If deceased was not holding a pensionable post, family pension will be 40% of basic pay subject to minimum of Rs. 1,650/-.

If the deceased employee has left neither a widow nor a child, the family pension may be granted to the dependent parents, brother / unmarried sisters in that order at 1.½ the rate admissible to the widow.

If a widow of an employee who re-marries her deceased husband’s brother and continues to live a communal life with, or contribute to the support of other dependents of the deceased shall not be disqualified for the grant of EOP, otherwise admissible to her. Rule 12-A

15. These orders apply to all Central Govt servants who are governed by the CCS (EOP) Rules. These orders also apply to Govt servants governed by WCA-1923, subject to certain conditions.

Central Govt employees are eligible for this award when they sustain disability or death in the circumstances specified below :-

(i) Death or disability attributable to acts of violence by terrorists, anti- social elements etc, whether in their performance of duties or otherwise. bomb blast in public places or transport and indiscriminate shooting incidents in public etc.

(ii) Death or disability arising as a result of (a) attack by or during action against extremists, anti social elements etc. (b) Enemy action in international war or border skirmishes and war like situation including cases which are attributable to (1) extremist acts, exploding mines etc while on way to an operational area, (2) kidnapping by extremists (3). battle inoculation as part of

training exercises with live ammunition.

The amount of family pension will be equal to the pay last drawn + DP+ DA admissible from time to time by the deceased employee and is payable to the widow for life or until her re-marriage or death whichever is earlier. In the event of re-marriage of the widow, the family pension will be allowed at the rates of family pension and subject to the conditions laid down for family pension under CCS (Pension) rules, 1972 from the date following the date of her re-marriage.

If the employee is not survived by widow but is survived by child/children only, all children together shall be eligible for family pension at the rate of 60% of basic pay subject to a minimum of Rs. 2,500/- pm.

When the employee dies as bachelor or as a widower without a child/children, dependent pension will be admissible to parents without reference to pecuniary circumstances, at the rate of 75% of pay last drawn if both parents are alive and at the rate of 60% if only one of them is alive.

Employees governed by WCA-1923 is eligible for the award. If the benefits under these orders are more than the compensation payable under WC Act, no separate compensation will be paid under the WC Act.

If however, the sum admissible under these orders is less than the amount payable as compensation, they will have a right to receive an amount equal to the difference.

Ex-Gratia Payment

16. NOKs of GREF personnel who die as a result of action against armed hostilities/terrorists/extremists /terrorists or other anti social elements such as dacoits or smugglers etc. are entitled to get an ex-gratia payment of Rs. 2.00 lakhs in each case from Govt. of India.

Death Gratuity

17. Death Gratuity is payable to the nominee (s) / eligible member (s) of the family of the deceased employee as per the nomination made by the GREF person in the following rates. The Death Gratuity will be sanctioned by the Chief Engineer Project and paid with the first installment of provisional family pension to the NOK :-

Length of Service Death Gratuity payable to family

(i) Less than one year 2 times of emoluments

(ii) One year or more, but less than 5 years

6 times of emoluments

(iii) 5 years or more, but less than 20 years

12 times of emoluments

(iv) 20 years or more Half of emoluments for every completed six monthly period of qualifying service subject maximum of 33 times of emoluments or 3.50 lakhs, whichever is less.

18. When an employee dies within 5 years after retirement, and the total amount actually received by him on account of pension (or service gratuity), dearness relief on pension, retirement gratuity, commutation amount, is less than 12 times the “emoluments” drawn at the time of retirement, the deficiency is granted to his nominee or his family. This is residuary Gratuity.

Rule 50 (2) of CCS (Pension) Rules, 1972

Release of family pension in respect of missing GREF employees

19. If an employee is missing and his whereabouts are not known, his family can be paid the retirement benefits. For this purpose the family should lodge an FIR with the police station concerned and obtain a report that the employee has not been traced after all efforts had been made. These documents alongwith indemnity bond, affidavit & consent be submitted to unit concerned for obtaining Govt sanction for presumption of death of the missing employee and payment of terminal benefits.

Release of family pension in respect of missing GREF pensioners

20. In the case of missing pensioners, the family pension at the rates indicated in the PPO will be payable and may be authorized by the PCDA (P) after obtaining requisite documents from NOK as provided in Govt. of India Department of Pension & PW OM No.1/17/86-P&PW dated 29 Aug 1986. Also refer GID No.9 and 12 below Rule 54 of CCS (Pension) Rules 1972.

Compassionate appointment

21. The scheme of Compassionate appointment as applicable to Central Govt employees is applicable to dependants of GREF employees who die in harness. In the event of death, the DD forms are sent to NOK of deceased person by Commander GREF Centre for completion and return to GREF Centre, Pune. The case is scrutinized by a Board of Officers and processed further only if the family is left below the laid down poverty line i.e. not having income more than Rs.1767.20 per month for a family of 5 members and fulfills other conditions laid down by the Govt from time to time.

Medical Facilities

22. The family of the deceased GREF person is entitled to CGHS facilities in case the family resides at the stations where such facility is available. However, if no CGHS facility is available at the family’s place of residence, medical allowance at the rate of Rs.100/- pm shall be entitled to the NOK for this purpose. A one time option to either avail the medical facilities under CGHS or to claim fixed medical allowance will have to be exercised at the time of preparing application of family pension.

Conditions

(a) The employee should reside in the area of operation of the

(b) Pensioners residing anywhere may get registered in any dispensary

(c) A family photograph of size 6.5 cm x 5 cm should be affixed to the CGHS token card and got attested by the department.

In case of CGHS beneficiary falling sick outside CGHS area, treatment is allowed under CS (MA) Rules 1944 in Govt Hospital/referral hospitals/ Recognized hospitals.

CGHS Contribution by Pensioners/family Pensioners

(a) Pensioners/Family pensioners have the option to pay contribution based on pay last drawn by the pensioner/deceased employee or their pension or family

pension. Original pension ( before commutation) including PEG portion but excluding dearness relief

shall be the basis for determining rate of contribution.

(b) Pensioners/Family pensioners are required to pay their contributions in advance for a period of one year

either from January to December or July to June.

(c) Pensioners who are on extension of service or re-employed shall pay normal contribution as in the case of serving employees and avail all facilities.

(d) Pensioners can avail CGHS facility for life-time, on a permanent CGHS card in following cases :-

(i) By paying 10 years contribution, in one lump sum at the time of retirement.

(ii) By paying lump sum contribution for the remaining period out of 10 years, (where contribution has been paid for certain period), or

(iii) When he has already paid yearly contributions for 10 years (and over), no further contribution is required.

Medical Allowance for Pensioners/family Pensioners not availing CGHS Facility.

Pensioners/family pensioners residing in areas not covered by CGHS (or corresponding health schemes of other Ministries/Departments), shall be granted a fixed medical allowance @ Rs. 100/- PM wef 01 Dec 1997, for meeting expenditure on day-to-day medical expenses that do not require hospitalization. Pensioners living in CGHS covered cities, but whose place of residence is not served by CGHS (or any corresponding Health Scheme of the Ministry/Department) shall also be entitled for Medical allowance @ Rs. 100/- PM on furnishing an undertaking and a certificate from the authorities of CGHS (or concerned Ministry/Department) to that effect.

Medical allowance is not payable if the pensioners/family pensioners are residing in areas where CGHS facility exists.

Existing pensioners as well as future retirees shall have one-time option to avail of medical facilities under CGHS (or other similar scheme of their respective Ministry/Department) or to claim fixed medical allowance of Rs. 100/- PM If he opts for medical allowance, CGHS card will be restricted for only indoor treatment.

The beneficiaries of ex-gratia pension/re-employed pensioners/employed family pensioners are not entitled to medical allowance. If the family pension is shared by two widows, same criteria for medical allowance is to be adopted as is adopted in the case of dearness relief. If any pensioner received two pensions, only single medical allowance is admissible and if a pensioner received both military and civil pensions, medical allowance is admissible for only one pension provided he does not avail medical facilities either from civil or military organizations.

Migrant pensioners from Kashmir Valley, drawing their pension at Delhi as temporary measure have the option to either avail CGHS facilities (on payment of prescribed contribution) or drawn fixed medical allowance of Rs. 100/-PM

CSD Canteen Facilities

23. In case death of a GREF person takes place while in service or after retirement, his wife or dependants can apply for issue of Canteen Card through an application as per specimen given at Appendix ‘L’ along with their Pension Payment Order and two copies of photographs to the concerned Station/Area HQ in case they want the facilities from CSD canteen run by any Army/Navy/Air Force Unit/formation and to GREF Unit/formation last served in case they wish to avail the facility from CSD Canteen run by GREF Unit.

Widows and parents of deceased unmarried GREF pers are also entitled to draw IMFL from Ex CSD Canteen as per 50% of husband’s deceased entitlement.

Grant from State Governments

24. Cases for such grants are being taken up by the Projects with concerned State Govts. As and when the Ex-Gratia sanctioned by the State Govt., the same will be remitted to the NOKs accordingly.
