SECTION 106 & TRIBAL CONSULTATION - IMPORTANT NOTE

The 30-day response time for SHPOs and THPOs is based upon the date that they receive

an “adequately documented finding” in accordance with 36 CFR § 800.11. In other

words a claim cannot be made that consultation is complete because it has been 30-

days since a letter asking whether historic properties were present was mailed to a

SHPO/THPO. Rather if consultation is claimed to be complete because the 30-day

response time has expired, the claim has to be made based on both the date the

SHPO/THPO receives the letter, which means that several days need to be added to the

mailing date to facilitate receipt of the letter (assuming the mailing time is reliable), or the

letter is sent certified mail and a notification of receipt is obtained; and the provision of a

“good faith” finding that meets the conditions outlined below:

FINDING OF “NO HISTORIC PROPERTIES AFFECTED”

1. Description of the project (undertaking) that specifies –

a.) Federal involvement,

b.) Area of Potential Effects, including photographs, maps (to include a portion

of an identified USGS quad sheet showing the location of the project) and

drawings as necessary.

2. Description of the historic property identification process, including, as

appropriate efforts to seek information (i.e., background research, consultation,

oral history, sample field investigation and field survey).

3. The basis for determining that no historic properties are present or affected.

FINDING OF “NO ADVERSE EFFECT OR ADVERSE EFFECT”

Effect” or a Memorandum of Agreement is developed for the purpose of

mitigating adverse effects.

U.S. FISH AND WILDLIFE SERVICE IPAC – INFORMATION PLANNING AND CONSERVATION SYSTEM

IPaC is the online tool that enables you to review a proposed project site that could include

endangered and threatened species before you even begin to design at a particular site location.

This is done when you draw a shape in any area of the system map. You will even be retrieve

information about a species and its needs as well as measures you can take to help protect and

conserve the species when designing and constructing your project.

In addition, IPaC will identify USFWS Trust Resources that could also at present include:

Designated Critical Habitat Areas, and

National Wildlife Refuges

USFWS plans to include in the near future additional information such as:

Migratory Birds

Wetlands Conservation

Invasive Species

IPaC is very simple to use. All you need to do is find a location on a site map; define the area of

concern by using the drawing tools and click your mouse. It will provide you with a list of the species

found. The map even allows you to change to an AERIAL/SATELLITE VIEW, STREET VIEW or even a TOPO MAP.
