From Jan. 17 to Jan. 21, I attendedthe Presidential Youth InauguralConference in Washington, D.C. I

had a great time there, and I made newfriends from all over the country. Although thedays started for us at 6 a.m. and we didn’t getinto bed until about 1 a.m., it was still a lot offun. Each day, we went to the University ofMaryland to listen to prominent keynotespeakers such as Former Secretary of Stateand Chairman of the Joint Chiefs of Staff Gen-eral Colin Powell and Vice President Al Gore.

On Sunday, we went to the National Mallto watch the Presidential Inaugural OpeningCelebration, where some of the biggestnames in entertainment spoke and performed.

On Inauguration Day, I witnessed the In-auguration from the middle of the NationalMall. I had such a great time, even though itwas 18 degrees and there were literally mil-lions of people in attendance. There were somany people there that I couldn’t see theground beneath my feet. It was fantastic, feel-ing the excitement, togetherness and patrioticenergy emanating from everyone. Rev. RickWarren delivered the opening invocation. Withhim, we all recited the Lord’s Prayer. I can’tsay that I’ve ever said the Lord’s Prayer withso many people at one time in a single place. The millions of voices simultaneously recitingthis prayer mutedly thundered throughout thecity. To me, this was a very poignant moment.

Everyone, including my group of newfriends, was very moved by PresidentObama’s inaugural speech. He spoke aboutthe crises that we now approach, including awar, a weakened economy, jobs and homesbeing lost, businesses closing, the high priceof health care, and the irresponsible use of re-sources that threaten our planet. He recog-nized these problems, and said that althoughthey will not be solved overnight, they will bemet. He said that his election into office is thepeople’s choice for hope over fear and thechoice of unity of purpose. He reaffirmed thegreatness of the nation, and what our fore-bears had to endure and sacrifice in order toget our country to where it is.

What this inauguration means to me, asa young Mexican-American woman aspiringfor a position of leadership, is that the doors

are really open. This does not mean that theobstacles for a minority are not there; it simplymeans that it is possible to get around thoseobstacles through hard work, perseverance, and learning to relate with other people of dif-ferent cultures and backgrounds. PresidentObama has proven that the opportunity toachieve one’s dreams actually exists. So Imust learn how to effectively use the re-sources around me, create alliances with in-fluential people, and fight to be seen andheard. Never, ever give up for what is just andright. This election has shown all Americansthat the people’s voice really does matter.President Obama is a prime example of whata collective voice can do. He has shown uswhat we can do when we have a commonpurpose.Δ

It’s a good thing, looking back with20:20 vision, the American employeeand Congress was intuitively against

the effort by the former Bush Administrationto ‘privatize’ the Social Security Administra-tion and its entitlement programs. Can youimagine what the SSA would do if its fundswere backed up by devalued stocks, bonds, and the many derivatives which the financialinstitutions devised as a method of makinghighly leveraged investments? In too manycases the current market value is 35 percentbelow what it was before the collapse of sev-eral financial institutions (Lehmann Brothers, banks and Wall Street).

Today another situation exists whichneeds your full examination. Any and all re-tirement accounts, especially your 401K-re-tirement account. Recently Congresssuspended the required minimum distribu-tion (RMD) for 2009. There is a real need tolook at the current value of any 401K-retire-ment fund you were planning to rely uponduring your golden years after retirement.

One individual, upon checking her 401Kfunds, was very shocked to learn that it haddevalued by $50,000. As a consequenceshe had to defer retirement in order to rebuildthe value of that 401K-retirement fund to anew balance that would yield $2,500 permonth retirement income. Another person, who had already retired, sadly learned thathis retirement funds were now at 50 percent

of their former value. These retirement fundsno longer provided enough retirementmonthly income. This projection required thisindividual to completely change his retire-ment plans. Unfortunately, this individual hasno opportunity to rebuild the body of his re-tirement fund.

Congress has responded through re-cent legislation to rectify the negative impactof the current market’s severe downturn. Itwas and is unfair to require seniors, age 70.5or older, to take RMD’s when the value oftheir retirement fund is down 35 percent ormore. The RMD is based on the value dur-ing the prior year 2007. RMD’s were beingtaken from funds that had devalued 35 per-cent during 2008, which would further reducethe balance left in that particular retirementfund. Now retired individuals may defer their2009 RMD withdrawal because it has beenwaived by recent federal legislation. Each in-dividual case is unique so the only universaladvice, which may be useful, is to check outany and all retirement funds to determinewhat their value may be today.

It is better to know than to remain unin-formed. Today no one can afford blissful ig-norance.

In the past many workers earned theircompany pension plans; however, today 67percent of workers have 401K retirementplans and no company pension plan. Thisshift means that the company has less risk

and responsibility, while the individual as-sumed more risk and personal responsibil-ity. According to a report in the New YorkTimes the aggregated loss of value of manyhousehold retirement funds exceeded twotrillion dollars. No one projects this recessionbas bottomed out yet, so further loss of valueis very possible.

This serious situation requires that Con-gress and President Obama make a com-prehensive overview of all retirement plansand enact appropriate corrective policy. Many will have to change their plans to retireand keep on working into their golden years.Several good ideas must be incorporatedinto law and regulation in order to permit in-dividuals to have more personal control andinvolvement. This would make it more diffi-cult for some unethical and irresponsible cor-porate executives to siphon retirementescrow monies to other uses and shift the re-sponsibility of making good on required re-tirement funds to the National RetirementGuarantee Fund, which we all contribute toas taxpayers.

Today it is wise to trust your retirementadministrator, but check things out person-ally and do it sooner rather than later. Ulti-mately it is up to the individual to exercisepersonal responsibility and involvement. Δ

The New Year’s shot in the back by a BART police officer that killed 22-year-old Oscar Grant re- ignited judgments that some police seek any provocation tobeat, arrest-even kill-marginalized youth and people of color.

“Too many cops are out-of-control cowboys inflicting street punishment on thosethey think need an attitude adjustment,” the words of a 23-year-old Latino studying tobe a special ed teacher. He is just what our community needs: enthusiastic, educatedyoung adults committed to educate the next generation of Americans. He related thathe’s seen police behaving badly-cursing, threatening, beating, and arresting Latino youthand adults all his life. “I hate that I fear cops, but I have seen too much to trust them-even if I needed one, I wouldn’t call them.”

Our city manager, mayor and council, but especially Chief Davis: please note thisstatement from a young adult who any parent would be proud to call their son. He stateshe does not hate police officers, but believes them to be in his words, “armed thugs”rather than peace officers.

As a former gang prevention social worker, I worked with San Jose police all of myprofessional life. I regularly called on officers to investigate family violence, transportabused women and children to shelters, to co-lead workshops on gang violence. I at-tended training retreats with police officers, and after hours we drank beer and playedpool at a country tavern. I have friends and family members in law enforcement. Policeare the same as civilians, only more so. They can be well tempered, moral, kind-hearted,professional and sometimes great at de-escalating potentially violent situations. Andlike all of us, under stressful situations, police officers can react inappropriately.

However, unlike most of us, police are trained to knock down, restrain, and inflictgreat pain upon a person. With their weapons, they can break bones, crack skulls, rup-ture organs, taser and shoot to kill. Officers’ training and field manual prescribes whenand how to use force. Supervision and appropriate consequences are critical to ensureforce occurs only when necessary. Yet critical supervision is not always effective to en-sure public safety under color of authority.

Command and Internal Affairs units have a disturbing record of protecting police of-ficers. These problems are not endemic to San Jose. In 1995 twelve San Francisco of-ficers beat, kicked, and pepper sprayed Aaron Williams, leaving him in a pool of blood,as he died 30 minutes later. Officer Marc Anaya’s boot print imprinted on Williams’cheek. Anaya previously served in Oakland, where he shot a man nine times, reload-ing his weapon to shoot again. Some may recall Oakland’s infamous “Riders,” policewho beat and framed (planting drugs) on dozens of African-American young men whoflunked their “attitude test” of failing to show proper respect for them. Their training of-ficer, Frank “Choker” Vasquez, lived up to his proud nickname. An FBI investigationforced the Riders’ prosecution, reversing 100 convictions, and a $10m civil settlement.

Oakland’s present Chief of Internal Affairs, Ed Poulson, was suspended last weekafter revelations that nine years ago, during the Riders’ reign of injustice, he beat a sus-pect, kicking him in the ribs. A month later, pneumonia caused by a collapsed lungpierced by broken ribs, led to death. Poulson ordered subordinate officers to lie aboutthe beating. Some did, others reported the beating. Internal Affairs called for his firing, but he was only suspended for two weeks. When he was to be appointed Chief of In-ternal Affairs last year, officers with knowledge of the beating and his interference withthat investigation warned the present chief, to no avail, so they alerted the FBI, whichled to the suspension. This week the Oakland Police Chief announced his resignation.

Last week San Jose police officer Joseph Paolini tasered a woman outside a down-town club. When her husband came to her aid and/or to confront the officer, he shot him.We cannot pre- judge the behavior of the woman, her husband or the officer. However, the expected pattern of human behavior is that any husband, family member, adult malewould likely come to the aid of a woman being tasered. Certainly some inebriated indi-viduals do behave badly, but must they be tasered or shot? Was anyone’s life in dan-ger that a taser and a gun needed to be discharged? How do we hold ourprotectors accountable and responsible? Who can protect us from our protec-tors? Δ

SAN JOSÉ, Calif. - The San José/Evergreen CommunityCollege District’s chapter of the Latina Leadership Network(LLN), in partnership with the Chicana/Latina Foundation,

will be hosting a scholarship workshop at San José City College(SJCC) on Friday, January 30 from 10 a.m. to 12 p.m. in the StudentCenter, Room 202 (Community Room).

This interactive, hands-on presentation will help attendees, in-cluding students and their parents, learn to negotiate the sometimes-complicated scholarship process, from locating the scholarships towriting essays and attending interviews.

“The LLN hosted this event last spring and it was very well at-tended-standing room only,” says Cristina Marsh, LLN Region 1 rep-resentative. “The students and parents who attended gave verypositive reviews and were certain to make good use of the informa-tion they acquired.”

“Our LLN chapter is one of the very best in the state as far as per-forming community outreach,” says Josie Gutiérrez, a founding mem-ber of the SJECCD LLN chapter. “Sometimes teachers andcounselors are simply too busy to share all of the information stu-dents need to make good choices in applying for scholarships or fi-nancial aid. This workshop is a good first step for students already incollege or high school seniors and their families who want to learnmore about their options for funding their child’s postsecondary ed-ucation.”

“I am proud that SJCC will be hosting this important workshop,”says SJCC President Dr. Michael Burke. “The students will comeaway with a wealth of information and will also discover how muchSJCC has to offer them.”

Seating to the January 30 workshop is limited. Please R.S.V.P. toJosie Gutiérrez at [email protected].

If the police officers involvedin the killing of Oscar Granton New Year’s Day had

known they’d be caught on video andlater charged for their actions, theymight have thought twice about theiractions.

Now the Bay Area and variousUC campuses throughout the statehave come together in mass to ensurethat justice is served.

“At one of our first rallies on Jan.7, the police officer who shot OscarGrant was not even facing charges,”exclaimed Ronald Cruz, BerkeleyLaw student and organizer with theCoalition to Defend Affirmative Ac-tion, Integration, and ImmigrantRights and Fight for Equality By Any

Means Necessary (BAMN), “it wasclear that he was going to get awaywith it. We want to make sure that weget justice and convictions.”

Universities such as University ofCalifornia Berkeley, Santa Barbara,Los Angeles, Riverside and SantaCruz demanded during their proteststhat:

* All the killer cops be jailed* End BART’s and District Attor-

ney Orloff’s cover-up-open an inde-

pendent public investigation of themurder

* Disarm the BART police, andkeep the BART police out of Oakland

* Drop all the charges againstprotesters

“If there was no video, therewould be a very different narrative,”said Raj Jayadev, Director at SiliconValley De-Bug. “All we would haveheard is that there was a struggle, aman attacked a police officer and thepolice officer had to shoot.

“The younger generation is verymedia savvy and police now knowthat they could be a youtube star forall the wrong reasons. That’s going toact as a monitoring system,” addedJayadev.

“The BART police carried out aconcerted policy to brutalize the blackand Latino youth on the platform andexecute Oscar Grant. They are allguilty,” said Cruz.

The unity of those demandingjustice in this trial will be at everycourt hearing, said Cruz.

“We’re drawing a line inthe sand againstracist police brutalityand murder. The ral-lies are peaceful, butat the same time, noorganization can con-

trol the rage of the people if justice isnot met.”

Jayadev summed up the impor-tance of this case by explaining, “Ihope this tragedy, and the court pro-ceedings, will mark a shift in the waypolice departments are held account-able and monitored because the dan-ger, of course, is that every one of usis a potential Oscar Grant. Until thepolice realize that they are not abovethe law, we’re all in danger I think.

“At the time the country is talk-ing about hope and change, yet we’restill seeing dead bodies of young menof color from what seems to be a bla-tant lack of concern by law enforce-ment.”

Además, competirá el próximo 22 defebrero por el Oscar en la Categoría deDocumental con “The Betrayal”, “En-counters at the End of the World”, “Thegarden” y “Man on wire”.
