As we reflect on the firstdecade of the 21st cen-tury, we can see the ups

and downs and the tumultuous econ-omy. But we can also look to the fu-ture and see the path towardsrecovery. Despite the tumultuousness,families pulled together and did morewith less. Likewise, here at thecounty, we were still able to accom-plish a lot, despite diminished re-sources. I wanted to take a minute andreflect over some of the great thingswe put in place in 2010 to benefit theresidents of Santa Clara County,thanks to your support.

Highway 101 Corridor Im-provements

I hope you got my email fromlast month, announcing the pendingconstruction of Highway 101 at TullyRoad. If you travel Highway 101, youmay have seen the constructionequipment appearing around Tully in-terchange. I am very excited to seethis as it is the realization of almost a

decade of hard work and persever-ance. Since I was first elected in 2001,I have fought tooth and nail to up-grade this interchange. This projectwill dramatically increase motoristand pedestrian safety. Also, it willbegin to ease the traffic congestion onthis vital road. But the fight isn’t over.Just before Christmas I met with stateleaders to develop a strategy for se-curing the remaining funds to updatethe Yerba Buena and Capitol Ex-pressway interchanges. The projectsare already designed; all that isneeded now is about $31 million tocomplete the construction. This is mynumber one transportation goal and,hopefully, I’ll have good news foryou in late spring 2011 on securingthe funds. I am also working to plana celebration of the groundbreakingof the construction work. The Beginning of Change

After a year-long investigationprompted by numerous consumercomplaints, a special task force or-

ganized by the Santa Clara County District At-torney’s Office and its Bureau of Investigationexecuted search warrants at the premises ofthree Internet-based moving companies. Taskforce participants include the Federal Bureau ofInvestigation, the U.S. Department of Trans-portation, the California Public Utilities Com-mission, Santa Clara County’s Department ofWeights and Measures, the San Jose Police De-partment, the District Attorney’s Offices ofMonterey and Alameda County, and the U.S.Department of Homeland Security, Immigra-tions and Customs Enforcement.

Wayne Allen, Eran Bar, Roni Hayon,Melissa Jiminez, and Adalinda Reyna-Mendozahave been arrested for theft-related offenses inconnection with the investigation. Others arebeing sought.

The fraudulent movers offer low pricesover the Internet, but increase the charges usingvarious scams, including fraudulently“reweighing” goods and using extra packaging

materials which are billed at exorbitant rates.The movers then hold the customers’ goodshostage until those consumers pay the inflatedcharges.

Deputy District Attorney Kenneth Rosen-blatt, assigned to the Santa Clara County Dis-trict Attorney’s Office Consumer ProtectionUnit, reminds consumers to avoid bookingmoving services over the Internet or acceptingestimates over the phone. Rosenblatt offers thefollowing tip: “Do not hire any company unlessthey come to your residence and give you a de-tailed written estimate of the cost of movingyour possessions.” He also cautioned that sincethe companies investigated by the task forceused names similar to large, and legitimate,moving companies, consumers should makecertain that “what appears to be a nationwidemover is not just a fraudulent group with an in-ternet connection.”

Special Task Force Raids FraudulentInternet-Based Moving Companies

District 3 out in the communityI strongly believe in the power of communities.

In 2010, my office and I participated in dozens oflocal events put on by neighborhood associationsand community organizations to show support andhelp connect residents to county services. Also lastyear I co-sponsored the First Annual Day on theBay: A Multicultural Festival in Alviso with theSanta Clara County Parks and Recreation Depart-ment. This festival allowed residents from acrossthe county to learn about services and resourcesavailable to them as well as to enjoy free live enter-tainment, free food, free kayak rides at the AlvisoMarina and free pumpkins. My staff and I are al-ready planning this year’s events and I hope to seeyou at one of them.

A greener Santa Clara CountyIn order to ensure our community’s survival,

we must make it sustainable. With that in mind, I’vefocused a great deal of time on greening and mak-ing sustainable not only county operations but thecommunity too, including supporting the creationof a County Office of Sustainability. This office willfurther the goals of the environment, the economicstimulus and equity. To put it simply, the office willhelp the county ensure that all its residents have ahealthy place to live and a chance for good jobs.

No more young minors in Juvenile HallLast year was a significant year for social jus-

tice in Santa Clara County. After studying the issueand taking public testimony, I asked the Board ofSupervisors to approve a resolution to no longerplace any child 12 years old or younger in JuvenileHall – and the Board unanimously agreed. Childrenthis young need one-on-one, highly intensive inter-vention – and Juvenile Hall is not set up to do this.Young offenders are now being placed in highly

trained parental care-like settings, where they canreceive the attention and care needed to rehabilitateand re-enter the world. Studies show that 97% ofthese kids will not re-offend.

A cost efficient and rehabilitative criminaljustice system

In an effort to make the criminal justice systemfairer, while at the same time saving taxpayer dol-lars by easing the burden on the courts, my officehas been working with county staff on how to divertcertain low level offenses away from the judicialprocess. Such “diversion” programs have been suc-cessful in many other jurisdictions because theyallow non-violent offenders to correct their offensewhile not taking up valuable time in the courts. LastDecember, the Board approved the first diversionmethod – giving infractions (as opposed to misde-meanors) for certain low level vehicle offenses.

These are just a few of the changes that Iworked on last year. I have more ideas for this com-ing year, but I know you have many other greatideas. To that end, I led in the creation of a whistle-blower hotline for county employees and residentsto make anonymous tips and suggestions to help uscreate a more efficient and accountable county gov-ernment. The tragedy in Tucson, Arizona changedthat community because many in thatcommunity and throughout the nation are

now aware that the danger from within is great. De-spite signs of personal mental pathology which wasdefinitely antisocial, Jared had the freedom to oper-ate under the radar screen of local law enforcementand institutional authorities at local community col-leges who had cause to reject him as a student. How-ever, current law and its behavioral standards werenot violated, so therefore, Jared was not subjected toearly intervention. A large void exists between localinstitutions, local community police, the state and na-tional levels of law surveillance and authority. Itwould behoove state assemblies and national gov-ernment to meet and confer concerning the manybarriers to our ‘tradition to be free’ and the successfulsurveillance and recording of those who have the po-tential to be violently destructive.

Communities have all experienced violence in-volving guns, knives and improvised bombs. Lo-cally, in one weekend, five individuals were slain. Itis time for individuals to take note of friends and ac-quaintances who emanate those tell-tale signs of atransition from ‘normal human behavior’ (whoknows how to define that?) and extreme anti-socialbehavior.

Recently, the Secret Service released a compre-hensive study about those who attempted to assassi-nate the President of the United States. Despite theunique nature of each and every assassin already in-carcerated, the finding was that all went through avery similar and recognizable transition from “nor-mal human behavior’ to one of being a psychopathwho would solve personal issues with a destructiveaction.

Locally, some steps are being taken to deal withthese basic issues. This Saturday, January 18, 2011San Jose Mayor’s Gang Prevention Task Force willconduct a summit which will address local issues ofgang violence. San Jose is at the forefront of provid-ing resources to establish after school programs andsupport programs which engage children from afterschool until the parent comes along after havingworked all day. Many of these programs will sufferfrom the draconian budget cuts which are in the off-ing though they mitigate gang recruitment efforts.

Today, the current generation of youth is used toreceiving services which can be accessed for ‘free’simply because those who ‘benefit’ are never reallyinformed about how and who funds these services.A sense of entitlement has been generated which isunsustainable in any economy, good or bad. Whenneeded services cannot be funded through the usual

local government agencies, we expect the state andfederal levels to provide resources. The current econ-omy does not generate the tax revenues needed tofund the level of services required.

A paradigm shift is necessary. Those 30 odd bul-lets discharged in Tucson, AZ have brought to thefore that many good Samaritan are amongst us. In acrisis they respond as best they can. However, themajority of us need to begin to think about ways toprovide assistance to those who need them. This canhappen without a formal government program beingresponsible or being involved. Have we forgottenhow to sweep the sidewalks and gutters in front ofour homes (or storefronts)? Many simple jobs havebecome ‘unionized’ in a manner that denies devel-oping youth an opportunity to perform simple tasksneeded.

The biggest impediment to success in achieve-ment of public security and safety is the practice ofnot snitching when one sees wrong behavior. Manymurders are unsolved simply because the witnessesdo not step forward as witnesses willing to testify toestablish facts and truth. It is these acts of noncon-formance that undermine public safety, security anddenies justice to all. Whistle-blowers and certain wit-nesses are provided protective custody simply be-cause they did the right thing. It takes courage to dothe right thing.

Think of the human pain and suffering coupledwith the prevention of property damage that did nothappen in this community. That was when the 2 hourphoto clerk called the police’s attention to the pipebombs and automatic weaponry photographed by anindividual who was planning to conduct an incidentat a local community college..

Speaking to each other with enhanced civility isnot enough. Each of us must be the conscious stew-ard of public security and safety in the environmentwherein we personally operate daily. We must speakup when the signs of violence become apparent. Wemust learn to be as non-violent as was MahatmaGhandi, The Reverend Dr. Martin Luther King, andCésar Estrada Chavez. We all must become engagedin securing each other from discharged bullets whichdestroy the safety and serenity required for humaneactivities. We must become acquainted again withthe Ten Commandments and the universal com-mandment, which is to treat your neighbor as youwould want to be treated. Let’s stop those who dis-charge bullets by learning what it takes to do earlyprevention and intervention. Let’s establish laws andbehavior standards that permit serene peace amongstus.

Early Prevention AndIntervention Required

The HCCSV is committed topromoting and supporting busi-nesses in Silicon Valley.

We know that by creating a climate forbusiness to prosper, we also create oppor-tunities for individuals to find jobs or havejobs. This improves their lives for them-selves and their families.

We also believe that consumers benefitwhen they have a full range of competitivechoices in the marketplace for goods andservices. Consumers know best their per-sonal situation. Consumers should be al-lowed to individually choose the bestproduct or service for their specific needat the price they want to pay.

Now the City of San Jose is workingon an ordinance that would build barriersto restrict some local businesses and putjobs at risk. This proposed ordinancewould curtail personal choice and poten-tially raise cost to consumers.

The S.J. City Council is consideringplacing a development moratorium cou-pled with harsh zoning restrictions in thiscity on just one type of financial servicesretailer: The Payday Lenders.

This may hurt our community, ourcivic economy and our citizens. These re-strictions would be anti-business. Likebanks and credit unions, payday lendersare a state regulated legitimate alternativefor short-term credit. Consumers and the

competitive marketplace should be al-lowed to decide if legitimate and regulatedbusinesses should exist, not governmentofficials. These proposed restrictive ordi-nances could put certain job opportunitiesat risk.

Payday lenders along with other localbusinesses are important economic en-gines for jobs in our communities. We can-not afford to curtail opportunities or putexisting jobs at risk, especially now.

These proposed restrictive ordinanceswould limit consumer choice and could in-crease how much they have to pay for le-gitimate short-term credit in themarketplace. Payday loans may not be foreveryone, but many consumers find themto be the most practical and least costly op-tion for borrowing a small amount ofmoney for a very short period of time.

Consumers should be allowed tochoose the best product for themselveswithout unnecessary limits on their optionsand potentially higher costs.

The San Jose City Council should beworking to create a welcoming environ-ment for businesses, not closing doors.

It should be looking to foster more jobopportunities, not shutting them down. Itshould be promoting legitimate financialalternatives, not limiting choice and rais-ing costs.

A moratorium or new zoning restric-tions on a legitimate financial service busi-ness is simply the wrong policy for SanJose.

votantes (54 contra 43 por ciento) dan créditoal Presidente Barack Obama por la recu-peración, según un sondeo publicado por laUniversidad de Quinnipiac.

Nearly 30 million small businessesoperate in the United States, ac-cording to the Small Business Ad-

ministration Office of Advocacy. They employjust over half the country's private sector work-force and hire 40 percent of high tech workers,such as scientists, engineers and computerworkers.

"With 52 percent of small businesses lo-cated in homes, it is important for these busi-ness owners to protect their personal andbusiness assets properly," says Bruce Peterson,a senior vice president with Fireman's Fund In-surance Co. "Employee and family membersafety comes first in the event of fire, flood,earthquake, windstorms, or any other physicalloss."

Whether a natural disaster such as flood,hurricane, earthquake, or tornado strikes, an in-dividual loss occurs from a fire, flooding froma washing machine or a burst frozen pipe, ortheft occurs, it is important that the business cansurvive and resume normal operations. Disasterpreparedness is the key and it can be simple.

Fireman's Fund Risk Services consultantsrecommend these steps to prepare your home-based or small business to cope with any disas-ter:

Safety * Make an evacuation plan and practice

with employees and family members. * Change all smoke alarm batteries once a

year. * Be sure fire extinguishers are available

and in working order. * Keep supplies such as canned food, water,

batteries and flashlights easily accessible.

Business * Inventory items and equipment used in

the business. Video or photograph the items andkeep in a location away from the property.

* Pick an alternate location to relocate totemporarily and keep the business running.

* Be sure to back up computer records reg-ularly and store off site.

* Include provisions to cover continuing

payroll expenses in your financial plan. * Create a communication plan via e-mail,

phone and/or text messaging to get a hold ofemployees in the event of a disaster or loss.

* Contact information for all vendorsshould be kept up to date and accessible, in-cluding insurance agent and policy numbers.

* Temporary repairs may be necessary andshould be documented.

Having business insurance is another im-portant way small business owners can preparetheir companies to deal with possible disasters.Business insurance usually covers things likebusiness interruption, lost wages, lost revenueand extra expenses such as temporary rentalspace, equipment and moving expenses.

Insurance "Business insurance can mean the differ-

ence between staying in business and having toshut down after a loss," says Petersen.

It is important for business owners to dis-cuss the emergency plan with employees, andprovide training and periodic testing of theplan, according to the Institute for Business &Home Safety. Employees should be notifiedany time changes are made and a current copyof the plan should be kept where employees canrefer to it easily.

Protect your business by carrying properlimits of liability insurance. Homeowner insur-ance won't cover business liability losses. Busi-ness insurance is separate from personalinsurance. Worker's compensation, employerprofessional liability, libel and slander cover-ages, etc. must be considered to protect thebusiness owner in case of lawsuits.

Automobiles that are used for business andmay be driven by employees in the course ofemployment require a separate commercialauto insurance policy.

As Caltrain begins its budget processit faces a $30 million deficit and theprospect of drastic cuts to its serv-

ice. Under the current budget scenario, cuts could

be as severe as a reduction in service to 48 trainsthat would operate only during the weekdaycommute. All other service would be eliminatedincluding: weekday service outside the commutepeak, weekend service and service south of theSan Jose Diridon station. The schedule alsowould require the suspension of service at up toseven stations.

Caltrain is the only Bay Area transit systemwithout a permanent, dedicated funding sourcesuch as a sales tax.

Instead the railroad has relied on contribu-tions from its three partner agencies - the Cityand County of San Francisco, the San MateoCounty Transit District and the Santa Clara Val-ley Transportation Authority – to balance itsbudget.

In Fiscal Year 2011, passenger fares make uparound 44 percent of the operating budget andcontributions from the partner agencies make up34 percent.

“We are not saying that this is what we aregoing to do, or where we are going to end up,”said Executive Officer for Public Affairs Mark

Simon. “But this is where we are starting.”Caltrain currently operates 86 weekday

trains, including 22 express trains, with an aver-age ridership of 40,000. Saturday service in-cludes 36 local trains and four express trains;Sunday service includes 32 local trains and fourexpress trains.

Over the last few years, Caltrain has madeaggressive efforts to reduce costs and maintainservice.

For the last three fiscal years, salaries havebeen frozen. Employees will have taken a totalof 17 furlough days from FY09 through FY11.Jan. 1, four weekday trains during the middaywere eliminated and fares were increased 25cents for each zone. In an effort to generate ad-ditional revenue, a pilot program for weekendBaby Bullet service was introduced.

In 2011, Caltrain administrative staff costsmake up only 6.4 percent of its operating budget,below the rate at Bay Area and other comparablecommuter rail agencies.

SamTrans is expected to reduce its annualcontribution to Caltrain by approximately $4.7million. If the other partners follow suit, thebudget shortfall is expected to be $30 million.

At its Feb. 3 meeting, the Peninsula CorridorJoint Powers Board, which owns and operatesCaltrain, will be asked to call for two public hear-

ings, one on the proposed service changes andone to declare a fiscal emergency. Four commu-nity meetings will be held throughout the Cal-train service area on Feb. 17, followed by aformal public hearing on March 3. A start datefor any service changes has yet to be deter-mined.

There is growing attention among commu-

nity stakeholders to the need for a permanent,dedicated source of funding for Caltrain.

The Silicon Valley Leadership Group willhold a summit on Jan. 21 at Stanford Universityand the Friends of Caltrain, a grassroots group ofCaltrain supporters, will hold a public meetingon Jan. 29 at the SamTrans offices in San Car-los.

Pérez fue una de los cinco estudiantes quetestificaron en la segunda vista regional de la Co-misión sobre los Derechos Legales y Responsa-

bilidades de los Hispanos de la American Bar As-sociation (Colegio de Abogados de los EstadosUnidos) que tuvo lugar el jueves en San Fran-cisco.

Pérez dijo que sus planes futuros incluyencursar estudios para convertirse en abogada.Esta alumna del onceno grado, que llegó a losEstados Unidos hace dos años desde Guatemalasin saber inglés, expresó sus aspiraciones educa-cionales ante la comisión con fluidez en su re-ciente adquirido inglés.

shops are eligible for a raffled $1,000 scholar-ship.

The California Student Opportunity andAccess Program (Cal-SOAP) of San Jose, incollaboration with local colleges and schooldistricts, will host a series of 17 Cash for Col-lege workshops from January to February 2011throughout the San Jose area. High school sen-iors and college students are encourage to at-tend the workshops in order to receive FREEone-on-one assistance with the Free Applica-tion for Federal Student Aid (FAFSA). All highschool seniors who attend are entered into a raf-fle for a $1,000 scholarship (more than onescholarship may be raffled per workshop), pro-vided by the California Student Aid Commis-sion. Other prizes will also be available.

Last year, 1,197 parents and students from40 high schools participated in one of the 14workshops held across the San Jose. Eighty per-cent of the students completed their FAFSA on-site. Eighteen $1,000 scholarships wereawarded and there was a 49% increase in atten-dance from the previous year. Scholarship listsand other financial literacy resources were also

provided. The goal is to increase the Cash ForCollege workshop attendance in order to in-crease the number of financial aid recipients,considering that the state grant, known as Cal-Grant, alone can total an extra $11,124 in freeCash for College.

January.- Downtown College Prep hasreleased its first- ever “College Suc-cess Report Card,” measuring high

school students’ rates of college eligibility, en-rollment, persistence, and graduation. The re-port is believed to be the first of its kindproduced by a K-12 organization.

Nationwide, only 10% of low-income stu-dents graduate from college in 6 years com-pared to 77% for high-income students. DCPgraduates—low-income Latino students—com-plete college at 5x the rate of their peers.

“K-12 education has the responsibility toprepare low-income students of color for col-lege success and colleges have the responsibil-ity to build a path to degree attainment that isresponsive to the unique needs of first-genera-

tion college students,” says DCP co- founderand executive director, Jennifer Andaluz.

Downtown College Prep’s mission is toprepare underachieving students, who will bethe first in their family to go to college, to thriveat four-year universities. The school measuresits success on whether students graduate fromcollege. DCP was the first charter high schoolin Silicon Valley and is one of the few schoolsin California to focus explicitly on college suc-cess for low-achieving urban students. DCP hasgraduated nearly 400 students in seven gradu-ating classes. DCP opened its second school inthe north San Jose community of Alviso in Au-gust 2008. A third school will open in the eastSan Jose community of Alum Rock in Septem-ber 2011.

Gran conmoción está cau-sando dentro de la comunidadastrológica la aparición de un

nuevo signo zodiacal. Aparentemente“Ofiuco” es el signo número 13, un signoque supuestamente fue ignorado por los as-trólogos desde muy tempranas épocas. Pareceser que el Sol orbita además de las doce constela-ciones de la Vía Láctea, en otra constelación conocida como “Ophiuchus ElSerpentario”, se cree que debe ser tomado en cuenta el tránsito del Sol por laEclíptica entre el 30 de noviembre y el 17 de diciembre. Esta situación vienea cambiar por completo los designios y pronósticos astrológicos a los que yaestamos acostumbrados, pues casi la gran mayoría ya no perteneceríamos anuestro signo habitual sino al signo anterior o al posterior. Toda mi vida me hesentido orgulloso de ser nativo del signo Escorpión opina Walter Mendoza, pero parece ser quecon la nueva configuración astral, ahora resulta que soy del signo Virgo. ¿¿¿What???

Tras 10 semanas de competencia llega asu fin el torneo futbolístico “Copa 30Aniversario El Observador”. Recorde-

mos que este torneo se hizo en honor a los 30 añosque celebra la casa editora reportando historias degran interés para la comunidad latina.

El torneo que se lleva por cuarto año conse-cutivo y fue organizado por la Liga de Fútbol Pa-cífico “8” y la Fundación El Observador. Ambasorganizaciones sin fines de lucro se unieron parapromover la sana diversión y unir a vecindarios ycomunidades a través del deporte.

“Nos sentimos orgullosos de concluir este tor-

neo y de honrar con esta fiesta deportiva al perió-dico que semana a semana y sin interrupcionescubre lo que acontece en nuestras ciudad”, dijoLuis Zavala, miembro de la liga deportiva.

Por su parte el propietario y director de El Ob-servador y El Observador Foundation, Hilbert Mo-rales agradeció a la liga la motivación quedespliegan en nuestras comunidades.
