Assemblyman Rich Gordon (MenloPark) alongside County SupervisorsDave Cortese (Santa Clara County)

and Adrienne Tissier (San Mateo County) an-nounced the passage of Assembly Bill (AB)1288.

AB 1288 addresses financial abuses withthe senior population. At times, seniors find iteasy to trust their children or longtime friendsto help with their finances, but in the long runthey only lose. Some present themselves as fi-nancial advisors only to steal the money oftheir clients.

“Financial fraud of dependent adults is oneof the most common forms of financial abuse,”said Assemblyman Gordon. “Protecting thisvulnerable population is of the utmost impor-tance for providing future care and wellbeing.”

AB 1288 closes a loophole in the currentprobate code by expanding the scope of thePublic Guardian to include assets that are heldin financial trusts. Additionally, this bill extends

the number of days in which the PublicGuardian can take temporary possession ofproperty from 15 to 30 days.  The additional 15days will allow time for Public Guardians to lo-cate and secure assets, as well as obtain a hear-ing date for the conservatorship petition.

The financial abuse of seniors is likely to risebecause more and more people are reachingthat age.

“AB 1288 enhances current safeguards tostop financial predators from taking the houseand life savings from vulnerable people whosuffer from dementia and are unable to helpthemselves,” said Lee Pullen, Director of Agingand Adult Services in Santa Clara County.

Pullen further explained that financialabuse affects all ethnicities and help is offeredin several different languages.

AB 1288 was co-sponsored by San Mateoand Santa Clara Counties and supported bycounties and local municipalities throughoutCalifornia. This was reflected in the bill’s unani-mous support in the both State Assembly andSenate.

Buena suerte.

Many of today’s issues havetheir basis in the lack oftrust and integrity in com-

munications used at all levels of busi-ness and government. The lack of‘checks and balances’, which are trans-parent and evident, assists those whoexaggerate the truth and facts perti-nent to any issue one wants to examineor discuss. A key skill that more of usneed to know is that of asking ques-tions, which expose the truth and factsof the matter.

The scientific method of inquiry isused to establish the truth and facts. Many persons have beliefs, which arenot necessarily based on facts andtruths. What is also required is a bit ofcommon sense coupled with discipline.Often all is for naught because our self-interest intervenes in ways that under-mine ‘good efforts’. Let us not neglectthe impact of culture and religiousdogma.

Democracy is a core value in Amer-ica as a nation. What this means is thateach individual will possess a stake-holder’s interest equal to all the othersin the guidance of the community’s gov-ernance. This boils down to the conceptof one citizen: one vote.

Capitalism is another core value ofbusiness in America. In fact, capitalismdrives most enterprises, which seek anduse systems, which maximize profits. These profits are used to reward thosewho own a stake in the enterprise.Shareholders are stakeholders who arerewarded with dividends, defined as areturn on money invested when owner-ship of the stocks (or shares) involves arisk.

For both capitalism and democracyto operate successfully in society cer-tain intangible core values are required. These include honesty, integrity, fairpractices and truthful communications.Today many do not believe that these‘intangible core values’ are practiced bycorporations which use advertisementsto gain advantage in generating rev-enues.

Money may be defined as the li-cense to perform, produce and con-sume. Each individual requires enoughfor the purchase of the essentials suchas shelter, food, clothing, education, medical care, civic engagement, and en-tertainment. Today, the system of gov-ernance has been tilted to favor theacquisition of great wealth by the fewwho already are privileged, well posi-tioned and have advantages.

The challenges being faced by soci-ety today are manifold in that individu-als can no longer perform or operate inour developed socio-economic climatewithout a source of reliable funding. Inaddition, governmental agencies areformed to produce, provide, and main-tain infrastructural services which facil-itate transportation, delivery of potablewater, educational services, protectiveservices, utilities and maintenance of afairly secure peaceful environment.Taxes, licenses, and fees are the sourcesof money, which permit various dis-tricts, and jurisdictions to pay for thegoods and services produced and madeavailable to the public.

Today all this is in danger of collapsebecause a few strategically placed dog-matic individuals insist that they pay notaxes, have very little or no governance, and that their beliefs be imposed on all.

This is the basis of the gridlock inthe U.S. Congress whose elected offi-cials have been unduly influenced byspecial interests with too much moneydonated to campaign funds without anyfear of having to be publicly account-able. What is required today is that allthese elements of the American societybegin to operate with the full use of corevalues, especially honesty and integrity.Full accountability is a requirement, which enables responsibility. Too manytoday have just a bit of ‘advantage’,which spoils the ‘level competitive play-ing field’ needed by all enterprises. Forour economy to produce “a greatergood for the greatest number , manyprivileged individuals need to beginpracticing the golden rule: “Do untoothers as you would have them do untoyou with truthfulness, accountability, and integrity. As a consequence of ‘dis-honesty’ practiced at all levels of our so-ciety and governance, the people aretoday cynical and non-believers wholack the hope that things will becomebetter. Until all of us are subjected fairlyto appropriate levels of “checks andbalances which are supported andbased on core values, the present stateof greed, corruption, and mismanage-ment will continue. What a shame, be-cause all it takes is for all of us to decideto deal with each other with truthful-ness, honesty, and integrity .all theseare core values. Let’s get back to ‘corevalues’ for the sake of all by doing whatis difficult but very possible: Re-estab-lish trust, truthfulness, and integrity inall transactions.

Let’s Use Only Core Values

Shortly after mid-night, Saturday,Oct. 15, Caltrain will

remove the railroad bridgethat spans Jerrold Avenue inSan Francisco and replace itwith a modern single-spansteel bridge. The “big move”will be accomplished in onenight, before train servicebegins Saturday morning.

The only impact to pas-sengers will be at theBayshore station, where alltrains will operate on a single

track and north- and south-bound passengers will boardfrom a single platform allweekend.

In addition to the newbridge, the project also in-cludes new steel structuresand columns to support thebridge, new tracks throughthe area, new pavement onthe street under the bridgeand new sidewalks.

This week, neighbors willnotice work being done toprepare for the move.  Thecrossing gates and lights on

the adjacent freight traintracks will be temporarily re-moved, support frames willbe constructed and thecranes that will be used tomove the bridge will be mo-

bilized.Jerrold Avenue has been

temporarily closed tothrough traffic betweenRankin and Quint Streets. This temporary closure will

last until Nov. 5. The closedstreet is being used to as-semble the new bridge anddismantle the old one.

The project is necessarybecause the existing bridge

is more than 100 years oldand has reached the end ofits useful life.

Caltrain to Install New Rail Bridge

Hispanas Organ-ized for PoliticalEquality (HOPE)

commends Governor JerryBrown for his signature onvarious legislation that di-rectly impacts Latinasthroughout California. Tak-ing action to expand educa-tional and healthopportunities, GovernorBrown signed important leg-islative bills that are valuablein strengthening and ad-vancing the Latina commu-nity.

A good example is AB131, authored by Assembly-member Gil Cedillo, whichallows top students who areon the path to citizenship toapply for college financialaid. Under current law, un-documented students payresident tuition rates if they

have graduated from a Cali-fornia high school and af-firmed that they are in theprocess of applying to legal-ize their immigration status.Effective January 1, 2013, AB131 will make this limitedpool of students eligible toapply for Cal Grants andother State aid. This legisla-tion builds on AB 130, alsoauthored by Assemblymem-ber Cedillo and signed intolaw by Governor Brown ear-lier this year, which makes fi-nancial aid from privatesources available to thesame pool of students. Thetwo laws are collectivelyknown as the “CaliforniaDream Act.” SB 299, au-thored by Senator NoreenEvans, prohibits employersfrom refusing to maintainand pay for insurance cover-

age for the duration of ma-ternity leave for up to fourmonths. The bill also author-izes employers to recover in-surance premiums from theemployee if the employeefails to return from maternityleave that is not due to ahealth condition that re-quires absence from thework environment or for cir-cumstances beyond the con-trol of the employee.Another bill, SB 753, au-thored by Senator AlexPadilla, requires that the Cal-ifornia English Language De-velopment Test (CELDT) beadministered annually once55% of the instructional yearis completed. The bill alsoprohibits a student from re-taking portions of the CELDTthat measures English lan-guage skills that they have

passed. SB 753 will requirethe California Department ofEducation (CDE) to reporttest results to parents. Thesebills highlight examples ofGovernor Brown’s commit-ment to ensuring the sup-port of all communities andthe status of women. Moreimportantly, AB 130, AB 131,SB 299, and SB 753 offer Lati-nas support in their pursuitof higher education and theplanning for a family withoutthe worry of losing her em-ployment.

Governor Brown Signs MultipleLegislation in Support of Latinas

Governor JerryBrown signed Cal-ifornia Dream Act,

AB 131, on October 8, 2011.This ‘Dream Act’ will take ef-fect in 2013 when an esti-mated 5,462 undocumentedstudents can apply for, and beawarded, Cal-Grants andother financial aid (estimatedby California Student AidCommission). Currently, tu-ition is $12,192 at U.C. cam-puses; $5,472 at CSUcampuses. To be eligible theundocumented student mustmeet the following condi-tions:

* Sign an affidavit sayinghe/she is in process of acquir-ing legal status.

* Have attended a Califor-nia High School for at least 3years.

* Have maintained agrade point average (GPA) ofB if applying to a CSU campusor have a C average if apply-ing to a community college.

This controversial AB131(Cedillo, D-LA) measure, which passed the Democrat-controlled legislature on aparty-line vote in September, represents a victory for immi-grant-rights activists ahead ofthe 2012 presidential elec-tion. California is the nation’smost populous state.

It remains a chal-lenge to pass comprehensiveimmigration legislation at thefederal level, which wouldhave the effect of applying asingle standard to the nation.

Only two other states,Texas and New Mexico, allow

illegal immigrants to qualifyfor state financial aid for col-lege, according to the Na-tional Conference of StateLegislatures.

“Going to college is adream that promises intellec-tual excitement and creativethinking,” Brown said in awritten statement issued bythe California Governor’s of-fice.

“The Dream Act benefitsus all by giving top students achance to improve their livesand the lives of all of us,” hesaid.

Brown in July fulfilled acampaign promise by signinginto law a companion bill toallow illegal immigrants to re-ceive privately funded collegescholarships. Together thetwo bills have been dubbed

the “California Dream Act.”Under these new laws

those same undocumentedimmigrant students would beeligible for aid from the Uni-

versity of California, CaliforniaState university system andthe state’s 112 communitycolleges. They could alsoapply for Cal Grants, which

are cash awards based on ac-ademic performance.

The San Jose Fire Department is par-ticipating in a TV show pilot called“Plates on Fire,” produced by a Los

Angeles-based production company. Alum Rock’s Fire Station 2, is where the

pilot was recently filmed. Two teams of off-duty San Jose firefighters, Robert Herreraand Mike Tapia versus Joel Phelan and MarioCuestas, will compete in front of celebrityjudges. All the firefighters have experiencecooking, some have worked in restaurantsin New York, Los Angeles and in San Fran-cisco.

“I am excited to have the opportunity toshowcase the connection between our com-munity and the Alum Rock Station firefight-ers who together will shine a very positivelight on the City organization,” said FireChief William McDonald.

The show is based on a popular FoodNetwork show called “Chopped” but with afew twists and turns. Like in Chopped, butslightly different, the teams will be given a

basket with mystery ingredients to preparethree meals, breakfast, lunch, and dinner.Celebrity judges Vincent Pastore from “TheSopranos”, actor Stephen Baldwin and BayArea award-winning food and wine writer,Carolyn Jung, will judge the final dishes.

The pilot will also spotlight the variety ofemergency and non-emergency servicesthat the Fire Department provides to thecommunity. The winning team will beawarded a donation to the charity of theirchoice. One team will donate the money tothe Susan G. Komen for the Cure while theother team will donate it to the Brain TumorResearch Center at UCSF.

Your ability to shopwhere and whenyou want may be

boosted by Congress pass-ing legislation known as theMain Street Fairness Act.Under the bill, sales tax col-lection is applied evenly forInternet retailers and com-munity merchants alike. Theproposal modernizes thecurrent system to keep pacewith a changing market-place that includes both on-line and brick-and-mortarretailers.

Right now, all purchasesmade online are subject tothe same sales tax as thosemade in neighborhoodstores; however, when anonline retailer fails to collectthe sales tax, it falls to thebuyer to report it. This posesa confusing and unneces-sary burden on consumers.Advocates for change say asale is a sale-whether it takesplace on the Internet or at alocal store-and the samerules should apply, with cer-tain exemptions for thesmallest sellers.

What We Have Now Some economists be-

lieve the current situationthreatens economic devel-

opment in communitiesacross the country and im-pacts consumers, retailersand state governments.

The buyer has an unmettax liability that could resultin an audit and penalty.

Brick-and-mortar busi-nesses that must collect thetax are at a competitive dis-advantage to online-only re-tailers that do not. This taxloophole negatively impactslocal businesses’ bottomline and, increasingly, hasforced many of these busi-nesses to close-deprivingcommunities of the choiceand convenience they’velong enjoyed.

States are losing criticalfunding-as much as $33.7billion a year-which isneeded now more than everto close growing budgetgaps, pay down debt and fi-nance vital services such asschools, law enforcementand emergency personnel.Meanwhile, businesses andresidents face increased cor-porate, income and prop-erty taxes to make up theshortfall.

What The Act Will Do The Main Street Fairness

Act is designed to: • Give states the op-

tion to set up a simple, fairsystem to collect taxes onremote sales;

• Allow states to col-lect revenue at every pointof purchase;

• Protect the con-sumer against onerous taxliability and infringement ofprivacy.

The software and Webapplications necessary tocollect sales tax exist nowand are already in use by nu-merous retailers that chooseto follow the law.

“Brick-and-mortar storesare the backbone of thiscountry, investing in theircommunities and ensuringthe places we call home arevibrant and welcoming,”said Michael Kercheval, president and CEO of the In-ternational Council of Shop-ping Centers.

Valley native and retired NASA As-tronaut Jose Hernandez officiallylaunched his campaign for Califor-

nia’s 10th Congressional District on TuesdayOctober 11, 2011.

With his loving wife, Adela, by his side, and joined by local elected officials, Hernan-dez made his announcement to run for the10th congressional district seat. Hernandezthanked the crowd and promised to work torepresent the needs and concerns of thepeople of the 10th district. Hernandezpromised to fight through the partisanshipthat has enveloped and hampered our Con-gressional system. He promised to get the10th district back on track and help fulfill thedreams and aspirations of all its citizens.

Hernandez’s remarks:“I stand here as a candidate for Congress

with a new mission: to help make sure thatmine is not the last generation that canclaim their American dreams.

As an astronaut, I relied on thousands ofpeople to do their job. As citizens, we rely onCongress to do their job, and they are failingmiserably. This Congress puts ideologyabove service, and that is just wrong. ThisCongress risks the entire economy over par-tisanship, and that is reckless. This Congresswould rather defeat their political enemies

than put their people back to work, and thatis shameful.

My promise, if you elect me, is simpleand clear: I will serve your interests, regard-less of party, regardless of where you are onthe ladder, regardless of who you know. When I am your Congressman, I will onlyowe you. You have my word.”

Hernandez concluded his speech by say-ing, “Please join us in this campaign! Pleasejoin us in keeping the American dreamalive!”

Jose Hernandez was born in FrenchCamp, California and spent his childhood asa migrant farm worker, traveling throughoutCalifornia with his family. With his parents’encouragement, he went to The Universityof the Pacific in Stockton to study electricalengineering. After completing graduateschool, Jose worked at the Lawrence Liver-more National Laboratory, where he helpeddevelop the first full-field digital mammog-raphy imaging system. Jose then went towork for NASA at the Johnson Space Centerin Houston, where, in 2004, he was acceptedinto the astronaut training program. In2009, Jose flew as a mission specialist onSTS-128, the Space Shuttle Discovery’s mis-sion to the International Space Station.

Whether you’re looking for a way toadd a new twist to your old fa-vorites or looking for a healthier al-

ternative to mayo or ranch dressing, consider theflavorful creaminess of avocados.

Avocados are often dismissed from healthyfoods for being high in fat. A closer look at thisfruit proves that they are, in fact, high in monoun-saturated fats-otherwise known as “the goodfats.” Avocados are also rich in vitamins and min-erals, especially magnesium, folic acid, lutein andvitamins B, E and K. They also boast an impressive60 percent more potassium than a banana; arehigh in fiber (including soluble fiber), even com-pared to other fruits; and are naturally sodiumand cholesterol free.

Guacamole isn’t just for chips. It also makesa great dip with carrots and other veggies and aterrific topping for hot dogs, grilled chicken and

in this delicious twist on your grilled burgers:Guacamole Cilantro Lime CheeseburgersWholly Guacamole1/2 lime, juiced1 tsp garlic1/2 cup diced onion1/2 cup diced tomatoes2 lbs lean ground beef6 slices of Monterey Jack cheese6 hamburger buns

In a large bowl, mix together ground beefand the juice of half a lime, garlic, onion andtomatoes. Form the meat into 6 patties. Cook theburgers to the desired doneness on a preheatedgrill. Add a slice of cheese to each burger duringthe last minute of cooking. Serve on toastedbuns with a healthy dollop of Wholly Guacamole.

Warm weather fashions cancause you to focus on theshape you’re in. Re-evaluating

the way you look on the outside is a goodtime to think about what you’re doing foryour body on the inside.

Eating right and exercising-the healthysteps required to shape up-are not only goodfor you and improve the way you look, butalso do much more to improve the way youfeel. Making these changes may seem intim-idating but it doesn’t have to be hard.

According to Valerie Waters, celebritytrainer and contributor to such publicationsas Glamour, Vanity Fair, InStyle, Self and Peo-ple, a few small steps can make a big differ-ence.

Waters recently teamed up with the mak-ers of Centrum multivitamins to encourageAmericans to live a healthier life. Here are afew of her great tips to get you started:

1. Turn off the TV. While it’s fun towatch your favorite shows together, try doingsomething a little more active with your fam-ily. Play games, take a walk. To start, make onenight a no-TV night. Have fun.

2. Don’t skip meals. Skipping mealsnot only slows down your metabolism butalso causes you to eat more the next time youeat. Eat small meals throughout your day.Start your day with a nutritious breakfast.

3. Fill half your plate with fruits andvegetables. This is a good visual to live by.Seven out of 10 Americans have nutritionalgaps in their diets. In addition to eating yourfruits and vegetables, don’t forget to takeyour Centrum multivitamin to help fill thosegaps.

4. Snack smart. Pack healthy snacksbefore you leave the house so you are nottempted to make unhealthy choices.

5. Make a grown-up playdate. Insteadof meeting a friend for coffee, make a date togo for a walk together. That way, you both getexercise instead of calories.

For more of Waters’ tips on how to stay fitand healthy, visit www.facebook.com/Cen-trum.

It’s not a smart idea to skip meals. Justmake sure you eat plenty of fruits and veg-etables and take your multivitamin daily.

This year’s Left Coast Live music fes-tival was two days shorter than thelast, but the acts and venues made

up for it. Hundreds gathered to see local actsand the more recognized bands. This year, the event incorporated the local business ona friendlier level. People were able to grabsome dinner and watch a performance that

gave it that extra intimate feel. The silentdisco was also a huge hit, where festivalgo-ers listened to DJ sets with headphones anddanced the night away. The headliners in-cluded The Limosines, Orgone, and MaraHruby. Among the performers were ChicoMann and Los Rakas, EO had the pleasure ofinterviewing both.
