TERMS AnD conDiTionSTHE NITTY GRITTY DETAILS BEHIND YOUR MAGICAL DAY.

conFiRMATion• A booking will be regarded as confirmed only upon receipt of the initial deposit along with the signed contract.• Progressive payments, based on a percentage of anticipated revenue, may be payable in accordance with the Deposit

Schedule. Note: All quotes are exclusive of any future Government Taxes and charges that may occur.• Special conditions included in individual proposals/quotations over-ride the General Terms & Conditions.FuncTion DETAiLS• Details of all arrangements must be supplied to the conference office fourteen days prior to the commencement of the

function.CATERING• All catering and function room requirements MUST be charged to your Master Account – we are unable to charge to

individual guest accounts• Final menu choices are fourteen days prior to the function.• It is the responsibility of the client to contact the Resort regarding the final number of attendees. Minimum numbers

are required in writing to the Resort, 10 working days prior to the event. The minimum numbers will be charged on the day unless final guaranteed numbers exceed this figure. Final guaranteed numbers and last minute confirmation of details are required in writing, by noon, two working days (Monday- Friday) prior to the date on which the function commences. Increases of up to 5% are acceptable after this time; any growth exceeding the 5% will be charged the negotiated delegate price plus a surcharge of 15% per person over the 5%. Should guaranteed numbers not be received, the account will be calculated on the basis of the attendee numbers indicated on the Contract.

• Serafino McLaren Vale reserves the right to provide all catering on the premises. No food or beverage may be brought into the Resort for consumption before, during or after a function.

• Quotations for functions are based on the understanding that should numbers attending your function decrease by 10% or more from the original number booked, additional charges will be incurred and the function may be moved to a more suitable room at the hotel management’s discretion.

• Serafino McLaren Vale enforces responsible service of alcohol.RooM ALLocATion/EVEnT TiMinGS• Serafino McLaren Vale reserves the right to assign an alternative room or Venue where the original room or venue is

inappropriate or unavailable due to circumstances beyond the control of the Resort.• Should attendee numbers decrease significantly from numbers advised at the time of confirmation, the Resort reserves

the right to re-allocate space to a more appropriate area.• The client agrees to commence its function at the scheduled time and agrees to have its personal members, guests

and invitees vacate the designated function space at the closing hour indicated. If the client breeches this condition, the client will be liable for extra charges incurred by the Resort (i.e. labour).

SERAFino MCLAREn VALE• No banners, signs or posters may be attached to any surface of the Resort without advance approval from the

conference office.• Serafino McLaren Vale signage must not be covered or obscured in any way.• Any loss of; or damage to the Convention Centre, Accommodation facilities or equipment caused by the organiser, their

guests or contractors before, during or after the event is the financial responsibility of the organiser.• Minimum guest requirements of 80 adult guests apply. If this requirement is not met then a minimum spend set by

Serafino McLaren Vale will apply. SEcuRiTY & conDucT• Serafino McLaren Vale requires that function organisers accept responsibility for the orderly conduct of attendees and

contractors. Should the Hotel have any reason to believe an event will adversely affect the smooth running of the Hotel’s business, its security or good reputation, it reserves the right to cancel the event.

AMEnDMEnTS• Amendments to these terms and conditions shall only be valid if made in writing and signed by Serafino McLaren

Vale management. The waiver of terms and conditions stated in contract applies to the particular occasions as documented in an amendment. This shall not be deemed a waiver of these terms and conditions for future occasions

SERAFino MCLAREn VALE• Use of any of the Accommodation or Company advertising material (logo, letterhead and images) is prohibited without

prior written authorisation from hotel management.

BASiS oF AGREEMEnT• Performance is contingent upon the ability of the Resort to complete same, and is subject to labour troubles, disputes,

strikes or picketing, accidents, government (federal, state or local) requisitions, restrictions upon travel, transportation, food, beverages, or supplies, equipment failure and other causes, whether enumerated herein or not, which are beyond the control of the Resort. In no event shall the Hotel be liable for the loss of profit or consequential damages, whether based on breach of contract, warranty or otherwise. In no event shall the Hotel’s liability be in excess of the total amount of the food and beverages contracted heretofore.

cLiEnT RESPonSiBiLiTY• Serafino McLaren Vale does not accept responsibility for loss & or damage to any goods brought to the hotel before,

during or after an event. It is the organisers’ own responsibility to arrange adequate insurance to cover such potential loss & or damage. All goods must be removed from the hotel premises or storerooms no more than 48 hours after the event.

• The organiser should ensure that all goods / packages to be delivered to the Resort are adequately marked with the name and start date of the function, the hotel contact’s name and the sender’s name and contact phone number.

• Packages to be collected after the event should be sealed and properly addressed, again with the sender’s name and contact phone number.

• The organiser is required to inform all relevant persons involved in the organisation of the event, whether colleagues or contractors, of the Resorts Terms and Conditions outlined herein.

• By completing and signing the Conference Confirmation, the conference organiser acknowledges the Hotel Terms & Conditions are understood and agreed to.

• Serafino McLaren Vale reserves the right to change the Terms & Conditions, and menus without notice.• At no time will the client commit any act or permit its employees, agents or invitees to commit any act that is illegal,

noisome, or offensive or is in breach of any statutes, by-laws, orders, regulations or other provisions having the force of the Law including but not limited to the Resorts Liquor Licence and Fire Regulations.

• Smoke machines, special balloon effects and/or pyrotechnics may not be operated without prior authority from the Conference Department. Written advice must be forwarded to the Conference & Banqueting Department ten (10) working days prior. Should the Fire Brigade respond to an alarm caused by unauthorised usage of such effects, the organiser will be liable for any charges incurred by the Resort.

• Should clients engage external contractors direct, it is the responsibility of the client to ensure that the contractors comply with the Hotel’s grooming and professional behaviour standards. Contractors who fail to do so will be asked to leave the premises.

• External audio visual and production companies are required to make contact with our Operations Manager, at least five working days prior to the start of the function. The external companies must comply with all industry guidelines and legislation and have the appropriate insurances and licences to work within the venue. For example, a qualified rigger with a valid license must complete all ceiling work.

cLEAninG SuRchARGE• When an event has created cleaning requirements that are considered in excess to the general and normal standards

a cleaning surcharge is applicable.cAncELLATion• In the event of a function cancelling, the following terms are applicable:

PERIOD cAncELLATion FEEMore than 90 days prior to the event Deposit may be refunded on the sale of the space, to the equivalent amount of revenue.

60-30 days prior to the event Cancellation fee equivalent to 50% of total estimated charges. (including food & beverage, room hire charges, audio visual and entertainment based on numbers advised at time of reservation). The deposit is forfeited.

30-8 days prior to the event Cancellation fee equivalent to 75% of total estimated charges. (including food & beverage, room hire charges, audio visual and entertainment based on numbers advised at time of reservation). The deposit is forfeited.

7 days or less prior to the event Cancellation fee (based on numbers advised at the time of reservation):100% of all food charges100% of all room charges100% of all audio visual and entertainment charges50% of all beverage chargesOther services – to be determined

• NB A change of dates or postponement of an event will be considered a cancellation and the above will apply. The new date will be considered as a new reservation and our normal deposit policies will apply.

PAYMEnT• The Contract signatory is liable for payment of all charges associated with the Conference/Function.• Full pre-payment of all charges associated with the function (food & beverage, room hire and audio visual,

entertainment etc) is required by noon, ten (10) working (Monday - Friday) days prior to commencement (based on minimum guaranteed numbers confirmed at this time). Should additional requirements be requested during any event, the authorised function signatory will need to authorise all charges before the goods and services can be supplied. A credit card, cheque or cash will then be required at the time these additional services and charges are incurred.

• Any commissions due to the licensed booking agent are to be paid by the hotel once full payment has been received by the hotel. No commissions should be withheld by the agent at any time. Any prepayments that are less commission,

• Serafino McLaren Vale has the right to terminate the contract under extreme circumstances.• Clients with approved credit arrangements agree to pay the account balance within fourteen (14) days of completion of

the function. • Payment by Credit Card may be made by completing, in full, a Credit Card Details Form. Full pre-payment will be

processed prior to the event starting • AMEX and Diners cards will incur a processing fee of 3% of the total payment cost on top of the payment being made

In the instance where a third party is responsible for the accommodation and conference/banquet charges, the following applies:• Written confirmation is required outlining what charges will be accepted on the master account (accommodation,

breakfast, phone calls, conference, additional audio visual etc).• Credit facilities may be made available to company reservations subject to receipt of a Credit Application fourteen

(14) days prior to the anticipated arrival date and approval of this application. In the instance where direct billing has been approved, payment is required within seven (7) days of receiving the invoice. In the event the client has a query regarding the

• invoice, the client must pay the balance of the sum owing by the due date and the remainder on resolution of the query. Part payments are required even if credit has been established. Alternatively full pre-payment is required ten (10) working days (Mon-Fri) in advance.

ACCEPTANCETo enable us to provide maximum service, you should indicate any requirements that have not been outlined in this agreement. By signing this contract, you agree to and understand the outlined Terms & Conditions. You also acknowledge that any previous agreements, understandings and negotiations cease to have any effect.
