Appellees’ Amended Motion to Recuse Justices Francis and Stoddart

I. Summary

It has come to the attention of Appellees that both Justices Francis and

Stoddart received coordinated political gifts from the Apartment Association of

Greater Dallas PAC and Texans for Lawsuit Reform PAC less than a month

before their assignment to this case becoming publicly known. Thereafter both

voted to reverse and render a judgment, based on a jury’s verdict, against an

apartment for its tort that caused harm to Appellees. It is a well-known axiom in

politics that rarely does anything happen by accident. The string of

“coincidences” in this case is simply too great to overlook and throws great doubt

on the impartiality of two of the three justices assigned to this case. For those

reasons, Appellee’s file this their Motion to Recuse Justices Francis and Stoddart

from consideration of Appellee’s Motion for En Banc Reconsideration.

II. Undisputed Facts

This case was tried to a jury verdict and a judgment was rendered against the

Appellant AVPM, Corp. for just over $1,000,000.00 of a $2,000,000.00 dollar plus

total judgment for the rape and assault of Appellees. Appellant sought appeal to

this court challenging the judgment against it.

AVPM, Corp. is a giant in the apartment industry in North Texas with at

many different apartment locations and literally thousands of renters in the DFW

Metroplex alone.

On December 29, 2017, Justice Craig Stoddard received political

contributions of $2,000.00 for the Texans for Lawsuit Reform PAC and $1,000.00

from the Apartment Association of Greater Dallas PAC.1 Justice Stoddard is one

of only two justices on this court who received political gifts by both Texans for

Lawsuit Reform PAC and from the Apartment Association of Greater Dallas PAC

on the same day during the relevant time period.

On December 31, 2017, Justice Molly Francis received political

contributions of $2,000.00 for the Texans for Lawsuit Reform PAC and $1,000.00

from the Apartment Association of Greater Dallas PAC.2 Justice Francis is only

other justice on this court who received political gifts by both Texans for Lawsuit

Reform PAC and from the Apartment Association of Greater Dallas PAC on the

same day during the relevant time period.

None of the remaining 11 justices on this court received coordinated

political gifts from both Texans for Lawsuit Reform PAC and from the Apartment

Association of Greater Dallas PAC in the months before or after this case was

assigned its’ three-judge panel. In fact, $2,000 of total contributions of $4,000.00

by the Apartment Association of Greater Dallas PAC were given to these two

justices assigned to this case in the relevant time period.3

On January 22, 2018, three weeks after the coordinated political gifts to

Justices Francis and Stoddard, the court issued notice that both Justices Francis and

Stoddard were “assigned” to this case. Neither Justice Francis or Stoddard ever

indicated the potential of any conflict at any point during or after oral arguments.

It was only after the Texas Ethics Reports were filed this summer that this

information was even available to the parties.

On July 3, 2018, Justice Francis issued the opinion in this case without

dissent, that reversed and rendered judgment against Appellee, eviscerating a

$1,000,000.00 plus judgment against AVPM Corp. based on grounds that were not

properly preserved by the Appellant in the trial court. Essentially, this court

destroyed a jury verdict based on a negligent security theory when a simple

premises defect case was pled and proven without objection in the trial court.

III. Argument

All my life I have grown up around the law. When I was a child, my father

was on a district court bench and eventually served on this very court. Long before

I went to law school, I was taught to revere the law and respect the judges doing

their very best to apply facts to the law to render justice. Since I was licensed

1992, I have consistently done so. I want desperately to believe that justices

simply apply the facts to the law to reach a conclusion, regardless of the power of

the parties involved, but I know better. It has been a rare occasion that a judgment

is rendered that is so bad that I felt compelled to even look to see what factors,

other than the facts and law, may have influenced this decision. This is simply one

of those times in which legal process was disregarded and prior case law

misinterpreted to reach a result that is so contrary to existing law and the facts of

the case, that there has to be another reason why the result was reached.

One of the things that is important in the administration of justice, is for our

citizens to have faith that regardless of status, of wealth, of political influence, of

party, of sexual orientation or any other division; that all parties will have the law

applied similarly to their case. Without that faith, then we simply have a system

where might, or political influence, makes right. The appearance that justices may

have a financial interest in the outcome of a case before them is one of those

critical things that you must guard against as the ultimate protector of all of our

rights, especially when the court takes action to disregard jury findings. The

Appellee’s constitutional right to a jury doesn’t mean much if appellate court

justices, who arguably have the appearance of a financial interest in the outcome of

a case, disregard factually supported jury findings to reach a result consistent with

the wishes of these big business PACs.

The evidence above from the Texas Ethics Commission details that two out

of three justices on the panel in this case received coordinated political gifts from

the Apartment Association of Greater Dallas PAC and the Texas for Lawsuit

Reform PAC (hereafter TLR or TLR PAC) just weeks before this case was

assigned to those judges. The evidence further shows that these two justices were

the only two that received these coordinated gifts out of 13 justices. Case

assignment within the court of appeals occurs behind a veil of secrecy. While the

case assignment process is supposed to be random, the odds of coordinated

political donations being given to only two justices and those same two justices

both being assigned to this case randomly are simply too astronomical to be by

chance alone.

The chances that the two PACs would randomly give any one justice funds

on the same day are extremely remote. These two gifts on 12/31/2017 are the only

gifts that Justice Francis reported on her ethics report since August of 2017, four

full months before, with none being reported after.4 The chances of exactly the

same thing occurring to Justice Stoddard, with the same PAC’s, in the same

amounts, again of the same date and it not being part of a coordinated strategy

defies all common sense. Giving both justices the same amount of money on the

same day is certainly evidence of a coordinated effort. The fact that a 7-figure

judgment against a large North Texas Apartment conglomerate was on appeal and

about to be assigned a judicial panel was certainly not another random occurrence.

Finally, the fact that these 2 justices were both assigned to the panel out of 13 on

this court three weeks later simply defies calculation if it was not intentional. Add

it all up and my clients have every right to feel that they did not get a fair hearing

with an unbiased panel, but rather, a panel which has the clear appearance that a

majority of the justices have a financial incentive to rule against Appellees.

This court has reason en banc to ensure that Appellees are given a full and fair

hearing. It is too easy for an entire panel of justices to be sullied by the smell of a

decision of a single three judge panel. The other 11 justices, including the justice

from the panel who did not receive the coordinated financial gift, should have an

opportunity to review this case, free of the appearance of any impropriety. For that

reason, granting the motion to recuse and reviewing this case en banc on the merits

is not only the right thing to do, it is the only way to restore the credibility of this

court in the face of a long string of statistically impossible coincidences in the

process of overturning a $1,000,000 plus jury verdict. I urge this court to grant the

motion to recuse, and to evaluate the motion for rehearing en banc.
