Revise 10 CFR Part 21 for full conformity with the EnergyReorganization Act of 1974, As Amended, Section 206,Noncompliance.

(1) The staff revised and issued for public commentNUREG-1022, "Event Reporting Guidelines: 10 CFR 50.72and 50.73, Revision 3," in a Federal Register (FR) Noticepublished October 13, 2011. The discussion pertaining toPart 21 was removed.

Target Completion Date: Unchanged-Issue revisedguidance by December 31, 2012.

The staff issued a Commissioners' Assistants (CA) note,"Clarification of Staff Position on Part 21 ReportingRequirements," dated September 19, 2011. The CA notecommunicated the staffs position to ensure full conformitywith the Energy Reorganization Act (ERA) of 1974, asamended, Section 206, "Noncompliance." The Office of theGeneral Counsel (OGC) reviewed the CA note and offeredno legal objection.

Target Completion Date: The CA note was issuedSeptember 19, 2011. Closure of the item will be based onOIG review and acceptance of the item.

(2) Interim guidance was developed communicating thestaff's position detailed in the CA note. The staffdocumented its position in a draft regulatory issue summary(RIS) however, subsequently decided to focus staffresources on the development on the Part 21 regulatorybasis. The rulemaking effort will more clearly articulate thestaffs position by revising 10 CFR Part 21 to full conformitywith ERA Section 206.

On July 5 and 12, 2012, discussions were held with the OIGon the staff's proposal to shift resources to the ongoingrulemaking effort to meet Recommendation 1.

(4) The Office of New Reactors (NRO) continues to workwith other offices on 10 CFR Part 21 rulemaking. Therulemaking will clarify 10 CFR Part 21 language and preventinterpretations that could potentially allow less than fullconformity with ERA Section 206. The staffs effort to issuea Commission paper outlining the rulemaking activities hasbeen completed. The staff issued SECY-1 1-0135, "StaffPlans to Develop the Regulatory Basis for Clarifying theRequirements in Title 10 of the Code of Federal RegulationsPart 21, 'Reporting of Defects and Noncompliance,"' datedSeptember 29, 2011.

Target Completion Date: SECY-11-0135 was issued onSeptember 29, 2011. Closure of the item will be based onOIG review and acceptance of the item.

OIG Analysis: On December 6, 2012, OIG obtained clarification from theagency that NRC anticipates finalizing the rulemaking torevise 10 CFR Part 21 for full conformity with the EnergyReorganization Act of 1974, As Amended, Section 206,Noncompliance, no later than December 2014. Thisclarification and the proposed corrective actions described in

Expedite publication of interim guidance that specifiesrequirements for Part 21 reporting in accordance with theEnergy Reorganization Act of 1974, as amended, Section206, Noncompliance.

The staff issued a CA note, "Clarification of Staff Position onPart 21 Reporting Requirements," dated September 19,2011. The CA note communicated the staff's position toensure full conformity with ERA, Section 206. The OGCreviewed and concurred on the CA note.

Issuance of the draft regulatory bases for the 10 CFR Part21 rulemaking effort will serve as the staff's communicationmechanism to stakeholders. The normal rulemaking effortdoes not require release of the draft regulatory bases thisearly in the process. Early release will provide stakeholdersadditional time to develop and implement actions to addressthe staff's position.

Target Completion Date: Changed-The draft regulatorybases are in concurrence. The staff has tentativelyscheduled a public meeting to present the draft regulatorybases to stakeholders on December 5, 2012.

OIG Analysis: On December 6, 2012, OIG obtained clarification from theagency on the actions planned to issue interim guidance viaa public meeting and by publication of a regulatory basisdocument that specifies the basis for proposed futurechanges to Part 21 reporting in accordance with the EnergyReorganization Act of 1974, As Amended, Section 206, andNoncompliance. The agency reiterated that a form of interimguidance was earlier promulgated via the 2011 and 2012NRC Regulatory Information Conferences, and that the slidepresentations from those presentations are publicallyavailable via the agency Web site and serve as guidance.As part of its ongoing communication efforts to industry, theagency confirmed that NRC staff will communicate the Part21 regulatory basis to stakeholders during a public meetingon January 24, 2013, and either schedule more publicmeetings, or finalize the regulatory basis and publish it in theFederal Register. OIG noted that publication of a regulatorybasis document does not provide guidance butcommunicates the proposed basis for future rulemaking.The regulatory basis document states that its purpose is topromote early stakeholder feedback and does not state thatit provides interim guidance for Part 21.

The agency also provided a copy of the regulatory basisdocument that will be communicated. OIG verified that itmore clearly articulates the staffs position on revising 10CFR Part 21 to full conformity with ERA Section 206, thoughit does not in and of itself constitute guidance. The agencystated that it will also provide to OIG for review thepresentation materials to be used to inform stakeholders.

OIG recognizes that because rulemaking is not expected tobe final until December 2014, agency staff will periodicallyprovide stakeholders with communications throughout therulemaking process and will issue additional guidance thatfurther specifies requirements for Part 21 reporting inaccordance with the Energy Reorganization Act

As noted above, while the regulatory basis document doesnot constitute interim guidance, the proposed correctiveaction to communicate the staff position on Part 21 reportingrequirements is an action that assists in meeting the intent ofthe recommendation. This recommendation will be closedupon staff completion and OIG review of any additionalguidance that specifies Part 21 reporting requirements, untilsuch time that the agency's actions in response toRecommendation 1 are met.

Correct the sections of NUREG-1 022, Event ReportingGuidelines 10 CFR 50.72 and 50.73, October 2000, that arein conflict with the Energy Reorganization Act of 1974, asAmended, Section 206, Noncompliance and 10 CFR Part21.

The staff revised and issued for public comment NUREG-1022, "Event Reporting Guidelines: 10 CFR 50.72 and50.73, Revision 3," in an FR notice (76 FR 63564; October13, 2011). On February 2, 2012, the staff met with theNuclear Energy Institute and stakeholders to discuss thepublic comments. The staff is currently working onresolution of the comments. The discussion pertaining to 10CFR Part 21 has been removed.

In parallel, and in accordance with Recommendation 2, thestaff will coordinate the rulemaking effort to ensure that clearand proper guidance is communicated and issued to theindustry to avoid ambiguity in reporting requirements.

Target Completion Date: Unchanged-Issue revisedguidance by December 31, 2012.

The proposed corrective action meets the intent of therecommendation. This recommendation will be closed uponstaff completion and OIG review of the final revised versionof NUREG 1022 that includes the corrected sections that arein conflict with the Energy Reorganization Act of 1974, asAmended, Section 206, Noncompliance.

Incorporate Inspection Procedure 36100, Inspection of10 CFR Parts 21 and 10 CFR 50.55(e) Programs for ReportingDefects and Noncompliance into the NRC Baseline InspectionProgram.

The staff revised IP 71152, "Problem Identification andResolution," issued in December 2011, to better identifyinstances in which licensees may not be appropriatelyidentifying 10 CFR Part 21 issues. As discussed below, thestaff will add additional guidance to IP 71152 for the routineevaluation of potential 10 CFR Part 21 issues.

SECY-99-007, "Recommendations for Reactor OversightProcess Improvements," dated January 8, 1999, which definesthe baseline inspection program as the set of risk informedinspectable areas that, together with performance indicators,provide sufficient information to assess licensee performancewithin cornerstones, and to detect trends in performance. It isthe minimum inspection performed at all operating nuclearpower plants.

As to the specific recommendation in Recommendation 5, IP36100 is a programmatic inspection that evaluates whetherlicensees, suppliers, or applicants for combined licenses havean established program to effectively implement therequirements of 10 CFR Part 21. Since the IP is not risk-informed, it is not appropriate be directly incorporated into thebaseline inspection program. However, if there appears to be aprogrammatic breakdown with the licensee's 10 CFR Part 21program, regional management can supplement the baselineinspection program with IP 36100 in accordance withInspection Manual Chapter (IMC)-2515, Light Water ReactorInspection Program-Operations Phase," dated September 24,2009.

For the reasons above, the staff elected to enhance IP 71152,which is risk-informed, to include inspection samples involvingdefects and nonconforming conditions as follows:

Defects and Nonconformance Defects andconconforming materials, parts, or components maypresent a substantial safety hazard. Inspectors shouldconsider using an annual followup sample to inspectdefects or non conforming conditions for compliance with10 CFR 50, Appendix B and 10 CFR 21. Inspectors mayrefer to IP 36100, "10 CFR Part 21 Inspections atNuclear Power Reactors" and IP 38703, "CommercialGrade Dedication," for additional guidance.

This guidance does not require each annual inspection toinclude a sample, but it allows the inspectors flexibility to selectsamples in accordance with IP 71152, Section 03.06. Thissection provides guidance on selecting samples based onperformance attributes of specific licensees and the safetysignificance of the attributes.

To address the OIG's most recent concern the staff will furtherenhance IP 71152, Section 02.01, to specifically state that theinspector's routine (daily) screening of problem identificationand resolution issues include an assessment of whether thelicensee should perform an evaluation in accordance with 10CFR Part 21 of any identified defects or nonconformances.This will ensure that the inspectors are evaluating potential 10CFR Part 21 issues on a continual basis. The enhancementswill be complete by December 31, 2012.

Target Completion Date: A revision to IP 71152 was issuedDecember 5, 2011. Closure of the item will be based on OIGreview and acceptance of the item.

OIG Analysis: The agency's proposed action meets the intent of therecommendation. This recommendation will be closed whenthe agency incorporates requirements to inspect licenseereporting of Part 21 defects into the appropriate inspectionprocedure.

Additional Instructions to Action Offices/Regions on Responding toOIG Requests for Status Updates for OIG Report Recommendations

The action Offices/Region should provide a memorandum addressed to the AssistantInspector General for Audits (ALGA) signed by the Office Director or RegionalAdministrator. The response should provide the status of each recommendation in theassociated OIG audit report.

The memorandum should provide updated status for the OIG report recommendationsby the date specified. An extension will not be granted since the memorandum isrequesting a status of the recommendation(s), not the completion of therecommendation(s).

Please ensure the updated status memorandum addresses all "resolved" and"unresolved" recommendations and include for each recommendation separately:

(a) the recommendation by number, repeating its text verbatim,(b) a response that describes under each recommendation the action(s) needed for

closure,(c) the target completion date for the action(s), and(d) the identification of the current point-of-contact.

When appropriate, ensure applicable document(s) to support OIG closure ofrecommendation(s) are attached as Enclosures and/or provide an ADAMS accessionnumber with viewer rights. Be sure to include the audit number, for example:OIG-1 1-A-01, and task number(s) to the case reference field in the ADAMS profile.

Forward the memorandum to OIG via email, as described in the Special Instructions orRemarks in the associated action item ticket.
