  • Items on the Agenda

    Members of the public wishing to appear before the Board concerning an item which is on the agenda must fill out one of the cards provided and present the card to the Board Clerk. There are three opportunities for public comment during regular meetings. First, the public may comment on any item on the agenda during a period at the beginning of meetings, with a total comment period of ten minutes and individual comments limited to two minutes. This comment period may be extended by Board vote. Second, prior to each Board vote, the public will be invited to speak directly to the issue being voted upon. Third, any member of the public may make a lengthier presentation on agenda items, provided that a request for such a presentation is made in writing in advance of the meeting. Permission to make such presentations, and their length, is at the discretion of the Board Chair.

    Information to the Audience

    The Board members receive the complete agenda along with background material that they study individually before action is taken at the meeting. Any member of the Board may remove items from the consent agenda at the time of the meeting.

    AGENDA ITEM Public Hearing to consider adopting the Southeast, Southwest and Central Neighborhood Revitalization Plans, and establishing the Southeast, Southwest and Central Neighborhood Revitalization areas. SUMMARY RECOMMENDATION City staff recommends adopting the Southeast, Southwest and Central Neighborhood Revitalization Plans, and establishing the Southeast, Southwest and Central Neighborhood Revitalization areas; and authorize the Mayor to sign the Neighborhood Revitalization Plan Interlocal Agreement. BACKGROUND This item was on your December 12, 2019 agenda at which time the Commission set a public hearing for January 23, 2020 at 5:30 PM to consider adopting the Southeast, Southwest and Central Neighborhood Revitalization Plans. BUDGET IMPACT The purpose of this program is to promote the revitalization of specific identified areas through rehabilitation, conservation or redevelopment by providing tax incentives in the form of a property tax rebate based on a percentage of the increased value of the improved property as shown below: Type of Construction Years 1-5 Years 6-10 New Structure up to 100% up to 50% Rehabilitation, alteration or addition up to 100% up to 50% Rehabilitation of structure on Kansas Historical Register up to 100% up to 100%

    Depending on the type of improvement, after a five or ten year period, a portion or all of the increased value generates additional revenue to the taxing entities. SUGGESTED MOTION After conclusion of the public hearing: “I move to adopt an ordinance adopting the Southeast, Southwest and Central Revitalization Plans; and establishing the Southeast, Southwest and Central Revitalization Areas as presented; and authorize the Mayor to sign the Neighborhood Revitalization Plan Interlocal Agreement.     WHEREAS, the City of Independence, Kansas, may pursuant to K. S. A. 12-

    17, 114 et seq. adopt a plan to assist in the rehabilitation, conservation or

    redevelopment of certain designated structure( s) in an area within the City of

    Indedpendence, Kansas, which meets the conditions provided in said law; and

    WHEREAS, the City of Independence, Kansas, seeks to exercise the authority

    provided in K. S. A. 12- 17, 114 et seq. in order to rehabilitate, conserve or

    redevelop certain designated structure( s) in the City.

    NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of

    Independence, Kansas, in accordance with K. S. A. 12- 17, 114 et seq. the

    following notice is hereby given:

    NOTICE

    The City Commission will consider the adoption of Neighborhood Revitalization

    Plan( s), pursuant to K. S. A. 12- 17, 114 et seq. at a public hearing in the

    Veterans Room at Memorial Hall, 410 North Pennsylvania Avenue,

    Independence, Kansas, on January 23, 2020 at 5:30 PM.

    The proposed Neighborhood Revitalization Plan( s) and a description of the

    boundaries of the proposed Neighborhood Revitalization Area( s) are available for

    inspection during the hours of 8: 30 a. m. to 5: 00 p. m., Monday through Friday,

    in the office of the City Clerk, City Hall, 811 W. Laurel Street, Independence,

    Kansas.

    At the conclusion of the hearing, the City Commission will consider findings

    necessary for the adoption of the proposed Neighborhood Revitalization Plan( s)

    and the establishment of the proposed Neighborhood Revitalization Area( s), all

    as provided for in K. S. A. 12- 17, 114 et seq.

    BE IT FURTHER RESOLVED that the City Clerk shall cause a copy of this

    resolution to be delivered to the other taxing entities within Montgomery County,

    AN ORDINANCE ADOPTING THE SOUTHEAST, SOUTHWEST AND CENTRAL NEIGHBORHOOD REVITALIZATION PLANS; AND DESIGNATING THE SOUTHEAST, SOUTHWEST AND CENTRAL NEIGHBORHOOD REVITALIZATION AREAS WHEREAS, the City Commission of the City of Independence, Kansas, pursuant to the

    authority provided in K.S.A. 12-17, 114 et seq. wishes to adopt the Southeast, Southwest and Central Neighborhood Revitalization Plans to assist the revitalization of certain designated structures in areas in the City of Independence, Kansas; and

    WHEREAS, the City Commission of the City of Independence, Kansas, pursuant to

    public notice did hold a public hearing on January 23, 2020, to hear and consider public comment on the Southeast, Southwest and Central Neighborhood Revitalization Plans.

    NOW, THEREFORE, BE IT ORDAINED: SECTION 1 Neighborhood Revitalization Plans. That the City Commission does

    hereby adopt the Southeast, Southwest and Central Neighborhood Revitalization Plans, attached herein, labeled Exhibit A and incorporated by reference as if fully set forth herein.

    SECTION 2 Designation of Neighborhood Revitalization Areas. That the City

    Commission hereby designates the real property described in Part 1-Attachment A of the Southeast, Southwest and Central Neighborhood Revitalization Plans as the Neighborhood Revitalization Areas, finds that

    The area has deteriorating structures which may endanger life or property

    by fire and other causes and the area substantially impairs or arrests the sound growth of the municipality and constitutes an economic or social liability and is detrimental to the public health, safety or welfare in its present condition and use.

    SECTION 3 That this ordinance shall be in full force and effect upon publication in the

    T his plan is intended to promote the revitalization of des ignated s tructure(s ) in an area in the

    C ity of Independence, K ans as , through the rehabilitation, cons ervation or redevelopment in

    order to protect the public health, s afety or welfare of the res idents of the C ity. More

    s pecifically, a tax rebate incentive will be available for improvements to des ignated

    s tructure(s ) in the area.

    In accordance with the provis ions of K .S .A. 12-17,114 et s eq., the C ity C ommis s ion has held

    a . O nly one tax rebate application per project may be s ubmitted. T he rebate will be bas ed only upon the increas ed as s es s ed value attributed to the eligible improvement.

    F or purpos es of calculating the increas e in the as s es s ed value, a bas e value s hall firs t

    be es tablis hed by calculating the average his torical as s es s ed value of the parcel for

    the three tax years immediately preceding the application for rebate. T he increas e in

    the as s es s ed value s hall be the difference between the bas e value es tablis hed in this

    manner and the as s es s ed value after the eligible improvement is cons tructed.

    b. C ons truction of an improvement mus t have commenced on or after _________________, 2020, the effective date of enactment of the tax rebate program.

    c. An application for rebate together with a $25 application fee payable to Montgomery C ounty Apprais er mus t be filed within s ixty (60) days of the is s uance of a building

    permit.

    d. T he as s es s ed value increas e will be determined by the res ulting clas s ification of the improvement. T he minimum increas e in as s es s ed value due to the eligible

    improvement will be 5% for res idential property and 5% for commercial property as

    determined by the Montgomery C ounty Apprais er. T his as s es s ed value increas e will be

    determined the firs t full year of eligibility after completion and will be us ed throughout

    the years of eligibility.

    e. T his program is limited to real property. P ers onal property taxes are not eligible for rebate.

    f. F or purpos es of determining initial eligibility for participation in the Neighborhood R evitalization P lan, any taxpayer that is delinquent on a real es tate tax payment or

    s pecial as s es s ment payment on any property located in Montgomery C ounty, K ans as ,

    s hall not be eligible to participate in the plan. After becoming eligible for participation,

    any taxpayer that is delinquent in payment of real es tate taxes or s pecial as s es s ments

    on any property owned by the taxpayer in Montgomery C ounty, K ans as , s hall not be

    eligible for the tax rebate under the plan for that tax year only. Any rebate los t for a

    s pecific year due to a delinquent payment cannot be retroactively res tored. If a

    taxpayer cures the delinquency, the taxpayer s hall be eligible for tax rebates under the

    plan in future years . T he rebate plan is for a 10-year term. L os s of eligibility for any

    year s hall not caus e the term of the plan to be extended. T he taxpayer may only be

    reins tated into the rebate program one time and mus t pay a reapplication fee as s et

    by the C ounty. A reins tatement fee of $100 will be paid by the taxpayer before

    becoming eligible after delinquency is cured.

    g. Any taxpayer that is not delinquent on any real es tate tax payment, pers onal property tax payment, or s pecial as s es s ment payment on any property located in Montgomery

    C ounty, K ans as , and failed to file an application for rebate, will be eligible to receive

    the rebate if the application is filed within 6 months of the is s uance of a building

    permit and the county apprais er can verify the increas ed value.

    h. R ebates are limited to the applicant only and are not trans ferable or as s ignable to s ubs equent property owners . Upon the s ale, trans fer, or other conveyance of any

    property otherwis e eligible for participation in the program, the property s hall become

    ineligible for any additional or further rebates . E xception - an applicant who is a bona

    fide commercial developer s hall be entitled to trans fer or as s ign s uch applicant’s

    eligibility to participate in the program to the firs t buyer, trans feree, or grantee of a

    commercial property. Upon a s ubs equent s ale, trans fer, or conveyance of s uch

    property, the property s hall become ineligible for any additional or further rebates .

    i. Any new, as well as the exis ting improvements on the property mus t conform with a ll other codes , rules , and regulations in effect at the time the improvements are made,

    and for the length of the rebate, or the rebate may be terminated.

    P a rt 9 - Applica tion P rocedure

    a. O btain an application for tax rebate from the C ity B uilding O fficia l whether a building permit is required or not.

    b. F ile completed and s igned application with the C ity C lerk, together with the $25 application fee payable to Montgomery C ounty Apprais er, within 60 days following

    is s uance of the building permit, or if a building permit is not required within 60 days of

    s tarting the improvements .

    c. T he C ity C lerk will forward the application to the Montgomery C ounty Apprais er’s O ffice for determination of the exis ting as s es s ed valuation of the property.

    d. T he B uilding O fficial will monitor the project to ens ure that a ll applicable city codes are met.

    e. Upon completion of cons truction, the C ity C lerk will notify the C ounty Apprais er that the project is ready for ins pection.

    f. Upon determination by the Apprais er’s office that the improvements meet the percentage tes t for rebate and by the C lerk’s office that the taxes and as s es s ments on

    property owned by the applicant are not delinquent, the C ity C lerk will certify that the

    project and application does or does not meet the requirements for a tax rebate and

    will notify the applicant.

    g. T he tax rebate, les s a five percent (5% ) adminis trative fee bas ed on the rebate amount, will be made to the property owner within a thirty (30) day period following

    the date of tax dis tribution by the C ounty. T he adminis trative fee will be retained by

    Montgomery C ounty.

    T he propos ed project will be reviewed bas ed on the criteria defined in P art 7 and a

    completed application as defined in P art 8.
