Quality TimeNew for 2012: Quality Time, a special quarterly section
focusing on lifestyle and life balance. Quality Time ventures beyond timekeeping and the to-do list to talk about personal
time and personal fulfillment. It speaks to younger lawyers, to women lawyers and to all lawyers on-the-go seeking to
make the most of their leisure and family time. Topics include travel and diversions, family and friends, active interests and
more leisurely ones, the latest fashions and life’s passions and, ultimately, body, mind and spirit.

BE A PART OF THINGSWhether it’s Rotary, Kiwanis Club or
the Chamber of Commerce, being a cog
in civic and charitable organizations is helpful for building
contacts and enhancing one’s reputation. “Especially in
rural areas, I think community service, being out there
and involved in the community trying to do good, is as
important as some of the high-tech things,” Williams says.
HOW TO MANAGE BENEFITS AND PAYROLL
THIS OCTOBER, BUILD YOUR BUSINESS USING THESE TIPSSpecial to Missouri Lawyers Weekly
HOLD AN EDUCATIONAL SESSIONPresenting free information at a public
event is a good way to drum up work,
says William H. Reynolds, a family law/civil litigation
solo attorney in Kansas City. “The best way there is to
build a book of business might be to put on a free semi-
nar,” he says. “That would be a good way to market your-
self outside of traditional marketing to other lawyers.”Reynolds
CAST A WIDER NETHobnobbing with attorneys may expand your clientele,
but networking should cast a wider net. Look for op-
portunities to make connections in other circles. For instance, financial
planners or pastors may be of help in referring estate cases, Reynolds
says. “If you are doing family law, remember that people often talk to a
therapist before contemplating divorce, so you might work with mental
health professionals and become a resource for them.”
MIND YOUR REPUTATIONRay Williams,
a criminal defense/DWI and
general practice solo in West
Plains, says the desire to win
shouldn’t trump your good
name. In building a cli-ent base, your reputation
is worth more than any particular case. “Word
of mouth is very impor-tant,” he says. “You’ve
got to be honest with your colleagues so you
can get the referrals.”

{Practice, Practice}The business of law made practical
1Understand the terminology.
Some lawyers remain
confused over the meaning
of “retainer.” It’s often used
colloquially to refer to an
advanced payment to be drawn
against for services, a flat fee to
cover all legal work over a period of time
or a fee to reserve a lawyer’s availability
against potential
conflicts. Chris
Stiegemeyer, director
of risk management at
The Bar Plan Mutual
Insurance Co., says
that according to the
Missouri Supreme
Court, only the last is
a true retainer. “They
discouraged use of the
word ‘retainer’ when lawyers mean money
that is going to be held in trust and billed
against,” he says. “The word ‘retainer’ has
a specific legal meaning, and to call an
advanced fee a retainer doesn’t really fit.”
2Get it ahead of time.
Lori Levine, a family law
and professional licensing
attorney with Carson &
Coil in Jefferson City, says
lawyers shouldn’t be shy
about seeking cash upfront.
Sometimes lawyers who are eager for
business are reluctant to discuss dollars
and cents, she says. “The advance fee, as
we now call it, should be set based on a
minimum amount for which you could
resolve the entire suit,” she says.
3Balance it out.
Not everyone agrees that
an attorney should ask for
everything upfront. Ed Poll,
of Venice, Calif.-based LawBiz
Management, says requesting
too much too soon can
discourage a client. An advanced payment
is just a show of good faith — nothing
more. “You are faced with competing
dynamics here,” he says. “The more
money you ask for upfront without the
client seeing the value of your work or
you putting forth any effort, the less likely
the client is going to be able to afford you
on the one hand or even want you on the
other hand.”
4Disputes mean stop
withdrawing.
Regardless of how much
you accept, both Stiegemeyer
and Poll say money cannot be
withdrawn from the client’s
trust account in the event of a
fee dispute. “Large retainers are great, but
they are not all that significant because,
even if you have money in a client trust
account, should there be a fee dispute
with the client, all they have to do is say,
‘Don’t pay out of the client trust account,’”
Poll says. “That money’s frozen. You can’t
touch that.”
5Spell out the details.
A good engagement letter
or agreement can clear up a
lot of minutiae and prevent
disputes from arising over
the use of money in a trust
account. Experts, depositions
and unusual copy fees for records that
may run hundreds of pages can quickly
increase the cost of a case, Levine says.
Does that money come from the trust
account? “You should be clear on what’s
coming out of there and what you are go-
ing to be telling the client, ‘Look, you owe
for this.’”

Missouri Lawyers AwardsA prestigious networking reception and luncheon honoring lawyers, judges and law firms selected for their outstanding accomplishments throughout the year. Nearly 250 members of the legal community join us to recognize the year’s winningest trial and appellate lawyers, law firm innovators and more, capped off with a tribute to Missouri Lawyers Weekly’s Lawyer of the Year.
Women’s Justice AwardsOne of the biggest nights of the year in the Missouri legal community, now in its 14th year. This elegant evening of networking draws a capacity crowd of 400 and culminates in an awards celebration for Missouri’s leading women professionals, including our Woman of the Year, the highest honor of the night.
Up & Coming LawyersTake a high profile at a high-energy event. Up & Coming salutes Missouri’s early-career lawyers-on the-march. This 200-attendee event draws next-generation legal stars, their friends and colleagues, the growing network of past recipients and other prominent members of the legal community.
Breakfast SeriesFrom politics to women’s issues to in-house counsel insights, our educational breakfast series provides free-wheeling discussions on a wide range of topics. These smaller-scale events offer sponsors a more personal and up-close way to market and network.
Doctor-Lawyer Confab This debut event brings together on common ground two engaging yet often warring professions—doctors and lawyers, the readers of MLM’s Missouri Medical Law Report and Missouri Lawyers Weekly. For an evening CME/CLE program we’ll assemble a panel of well-known doctors, lawyers, policymakers and scholars for an entertaining and provocative Fred Friendly-style role-playing exercise. Beforehand, we’ll host a reception with heavy appetizers and light cocktails.
