.:. Communications from DFES to the Office of the Minister

Generally, communication should occur through the Commissioner, Executive Manager, Office of the Commissioner or the Manager, Ministerial Services.

Where necessary, the Director Media and Corporate Communications may initiate contact with the appropriate officer to discuss actions required on DFES related items in the media.

Where necessary the Director Legal and Legislative Services may initiate contact with the appropriate officer to discuss legislative issues.

Non-routine communications should be directed through the Minister's Chief of Staff, or other officer nominated by the Minister or Chief of Staff.

For all communications of a 'strategic' policy nature where the Department has provided a response, it should be specified whether the Commissioner or nominated officer has approved the response before it is sent from DFES.

+:+ Communications from DFES to the Office of a Minister responsible for another portfolio

The Office of the Minister is to be informed of such communications where the Commissioner considers the matter is such that there is a critical or possible impact on the Minister's responsibilities or is considered of such Importance that the Office of the Minister needs to know.

+:+ Cabinet matters

All submissions for consideration by Cabinet must be directed through the Office of the Minister.

+:+ Resolution procedure for a breach of these arrangements

In the first instance, the Minister or his Chief of Staff and the Commissioner will discuss the breach and decide on any further action .

• :. Directions by staff of the Office of the Minister, to staff of DFES, by the Minister, on the manner in which they are to perform their duties

Staff of the Office of the Minister should not, otherwise than with the agreement of the Commissioner, direct an employee of DFES in relation to the manner in which that employee is to perform their duties .

ARRANGEMENTS FOR COMMUNICATIONS AND DEALINGS BETWE~ ()) /PJ't STAFF OF THE OFFICE OF THE MINISTER FOR EMERGENCY SERVICES AND STAFF OF THE OFFICE OF EMERGENCY MANAGEMENT

~ Pursuant to section 56 of the Financial Management Act 2006 the Office of Emergency Management (OEM) is a sub-department of the Department of Fire and Emergency Services (DFES).

~ Pursuant to section 56 of the Financial Management Act 2006 the Executive Director of the OEM is the Accountable Authority for the sub-department.

~ Pursuant to section 5 of the Public Sector Management Act 1994 (PSM Act) the Fire and Emergency Services (FES) Commissioner is the Employing Authority of members of the OEM. As the Employing Authority for the OEM the FES Commissioner may discuss matters contained within the PSM Act pertaining to the OEM with the Minister's Office.

~ Pursuant to section 33 of the PSM Act the FES Commissioner delegated to the Executive Director OEM all powers and duties conferred or imposed upon the FES Commissioner by Part 3 Division 3 of the Act, effective from 1 December 2016.

~ Communication between the OEM and the Minister's Office shall only relate to matters conceming:

1. administration of the Emergency Management Act 2005;

2. activities which are being carried out by the OEM on behalf of, and pertaining to the duties of, the State Emergency Management Committee (SEMC);

3. functions of the Executive Director of the OEM as the Accountable Authority for the sub-department;

4. emergency management assurance matters; and

5. emergency management recovery matters .

• :. Communications from the Office of the Minister for Emergency Services (Minister) to the OEM

All requirements should be for, and on behalf of, the Minister in relation to his responsibilities as Minister. Should this not be the case, this should be made clear at the time.

• Routine requests for information or research These will normally be directed through the Executive Director of the OEM.

• Routine media enquiries resulting from SEMC related items in the media These will normally be directed through the Executive Director of the OEM.

• Arranging a meeting with relevant OEM staff and requesting their attendance

For each piece of legislation being progressed, a drafting officer will be nominated and this officer will be responsible for dealing with all matters associated with the legislation, and for keeping the Executive Director of the OEM informed of developments.

• Requests for briefing notes All requests should be made through the Executive Director of the OEM first. Wherever practicable, the Executive Director of the OEM should sign-off the briefing note.

These will normally be directed through the Inspector or the Deputy Inspector.

• Arranging a meeting with relevant Office of the Inspector of Custodial Services employees and requesting their attendance

All requests to meet with employees of the Office must be made through the Inspector.

• Matters relating to the drafting of legislation

For each piece of legislation, a drafting officer will be nominated and this officer will be responsible for dealing with all matters associated with the legislation and for keeping the Inspector informed of developments.
