17(1)The Secretary of State may by regulations

make provision about the granting by acourt of a blocking injunction in respect of a

location on the internet which thecourt is satisfied has been, is being or is likelyto be used for or in connection with anactivity that infringes copyright.

a) The use of the internet for activities that infringe copyright is having aserious adverse effect on businesses or consumers,

b) Making the regulations is a proportionate way to address that effect, and

Laurence Kaye is an expert lawyer in the fields of digital law, intellectual property and media law. He isrecognised in Chambers Guide to the UK Legal Profession, 2010 as a leader in the fields of MediaEntertainment & Information Technology law.
