    s.9(3) A technical measure is a measure that:

    a) limits the speed or other capacity of the serviceprovided to a subscriber;

    b) prevents a subscriber from using the service to gainaccess to particular material, or limits such use;

    c) suspends the service provided to a subscriber; or

    d) limits the service provided to a subscriber in another

    way.

    s.17: Power to make provision about injunctionspreventing access to locations on the internet

    17(1)The Secretary of State may by regulations

    make provision about the granting by acourt of a blocking injunction in respect of a

    location on the internet which thecourt is satisfied has been, is being or is likelyto be used for or in connection with anactivity that infringes copyright.

    s.17(3)The Secretary of State may not make regulations under this sectionunless satisfied that:

    a) The use of the internet for activities that infringe copyright is having aserious adverse effect on businesses or consumers,

    b) Making the regulations is a proportionate way to address that effect, and

    c) Making the regulations would not prejudice national security or theprevention or detection of crime.

    s.17(4)The regulations must provide that a court may not grant an injunctionunless satisfied that the location is:

    a) A location from which a substantial amount of material has been, is being oris likely to be obtained in infringement of copyright,

    b) A location at which a substantial amount of material has been, is being or islikely to be made available in infringement of copyright, or

    c) A location which has been, is being or is likely to be used to facilitate accessto a location within paragraph (a) or (b).
