National Telecommunications Moot CourtCompetition - Call for VolunteersThe FCBA and The Catholic University Columbus School of Law will co-sponsor the2006 National Telecommunications Moot Court Competition to be held February3-4. This year’s competition centers on the (fictional) adoption of FederalCommunications Commission rules that require cable and DBS systems to permit sub-scribers to purchase the service provider’s family-friendly channels on a dedicated pro-gramming tier. Participating teams will analyze constitutional and administrative lawissues attendant to FCC enactment of such a family-friendly programming scheme.This year’s competition arises out of ongoing debates over whether cable and satelliteproviders should be required to offer “a la carte” channels as part of their video servicepackages, and out of the concerns some consumers have voiced over their perceivedinability to sufficiently control the content of programming their families receive. TheFCBA Moot Court Committee seeks volunteers to help prepare the problem andadminister the competition. If you have expertise with these issues, or a general will-ingness to assist in the preparation of the problem, bench brief and related tasks, yourcontribution is needed. DEAR MEMBERS :

One of our most important missions as a bar association iscontinuing legal education. This month, the FCBA’s CLE pro-gram begins in earnest, with a range of programs and activities(including CLEs on appellate litigation, transactional practiceissues and the Sunshine Act). Thanks to CLE Committee co-chairs Jennifer Manner, Genie Barton, and Frank Jazzo fortheir leadership, as well as to the substantive practice commit-tees for their planning and implementation efforts.

SOME HIGHLIGHTS:n The new Judicial Practice Committee, led by Sam Feder,

Robert Pettit, and John Rogovin, launches its first CLE program this month focusingon ”Practical Tips for Appellate Litigation and FCC Advocacy” on November 10.

n The CLE Committee’s November 29 event on “The Ongoing Debate Over the SunshineAct” represents the bar’s first in-depth look at this widely known but little understoodstatute, and will explore the concerns driving current reform efforts (as well as thepotential obstacles to change).

n On November 30, the FCBA launches its first of several new educational lunch panelprograms with “War of the Worlds,” featuring four ”think tank” and public interestgroup leaders representing diverse perspectives. Next year this series will feature lun-cheon panels of former FCC Chairmen, communications industry general counsels,State PUC Commissioners, and journalists who report on the industry. Thanks toBryan Tramont, Speakers Committee chair, for initiating this creative program.Watch for future announcements.

n Kudos to the International Telecommunications Committee, led by Paul Margie, AriFitzgerald, and Tricia Paoletta, for their work on two successful lunches and oneCLE already this fall, and to the Transactional Practice Committee – led by HowardLiberman, Paul Schwartz, and Stuart Shorenstein, for their efforts in planning twoupcoming CLEs. Finally, this coming year marks the sixth anniversary of our annual Communications Law101 program, aimed at serving the educational and training needs of new communica-tions law practitioners. Atlanta ChapterThe Atlanta Chapter had an active andsuccessful year in 2004-2005, begin-ning with a Holiday Happy Hour inDecember 2004, and continuing withtwo substantive events.

In June 2005, the Chapter held areception hosted by Duane Morris LLP,featuring a presentation by ChrisJones, Regional Director of ExternalAffairs, Verizon Wireless on the com-munications-related legislation consid-ered in the 2005 Session of theGeorgia General Assembly.

In September 2005, the Chapter spon-sored a panel discussion of the busi-ness and regulatory impact of the USSupreme Court’s Brand X decision.The program featured as panelistsDave Baker, Vice President, Law andPublic Policy, EarthLink; Pete Martin,Vice President, Regulatory andExternal Affairs, BellSouth; and ChadWachter, General Counsel, Knology.With last-minute help from BellSouth,we were able to move the venue of thisprogram so that interested attendeescould also attend the FCC’s September2005 Open Meeting which had beenmoved to Atlanta to assess theresponse of industry and governmentto Hurricane Katrina.

The Chapter plans to kick off the com-ing year with a January program toconsider the findings and recommen-dations of Georgia’s Joint House andSenate Emerging CommunicationsTechnologies Study Committee, whichare expected to be published inDecember 2005.

The Chapter also strengthened itsleadership this past year, adding twoadditional co-chairs, so our local lead-

ership team now includes DonHackney, Arnall, Golden & GregoryLLP; Ron Jackson, Sapranov &Associates, P.C.; Richard Keck, DuaneMorris LLP; and Michael Rosenthal,Director of Legal and External Affairs,SouthernLINC.

We have relied upon the Committee’smembership in developing our meet-ing agenda for this year. We startedwith a survey that was emailed toevery Committee member asking themto rank on a scale of 1 to 10 their levelof interest in a number of possiblespeakers and subjects for future brownbag lunches, meetings, and CLEs. Weheld our first organizational meetingon September 26th at Willkie Farr &Gallagher to discuss the results of thesurvey and other ideas. Thanks to sig-nificant input from those whoreturned the survey, as well as sugges-tions from attendees at that meeting,the Co-Chairs have a course of actionfor the next eight months.

Continuing a popular tradition, weplan to hold several brown bag lunch-es with government officials who havea significant influence on the cableand telecommunications industries,including guests from the Chairman’sOffice and other Commissioners’Offices, the Media Bureau, theWireline Competition Bureau, otherparts of the Commission, andCongressional staff. We also intend tohost rigorous debates on policy issuessuch as program access and new videodeployments, and to provide a forumfor discussion of legislation pendingbefore Congress that affects the mediaand telecommunications sectors.Finally, we are considering variouspossible topics for a CLE program,such as “The First Amendment andthe Electronic Media” and “Top 25Issues Every Cable Attorney ShouldKnow About.” We are open to jointsponsorship of these CLEs and meet-ings and will gladly participate inother Committees’ educational effortsthat intersect with the interests of thecable industry.

Mass Media PracticeCommitteeThe Mass Media Practice Committee isco-chaired by Ann Bobeck of NAB,Erin Dozier of FCC, Media Bureau,John S. Logan of Dow, Lohnes &Albertson PLLC, and Bob Rini of RiniCoran PC. For the 2005-2006, we arebusy planning a series of brown bagluncheons on hot regulatory topicsbefore the FCC. We kicked off theseason with “Meet the Media BureauChief” on October 17. Many thanks toDonna Gregg and her colleagues formaking our luncheon a very enlight-ening and widely attended event.

On October 30, we are hosting theFCBA’s monthly volunteer outing atMartha’s Table. For more informationcontact Erin Dozier [email protected].

Next up for November, our committeeis planning a brown bag luncheon

focusing on the FM streamlining/allo-cations proceeding. Location and timeis tentatively set for November 15 atNAB, but please check your email forfuture announcements. In Decemberwe have two events planned: First,we’ll be joining other practices in theDecember 1st CLE “Regulation in thePost-Katrina Environment.” And inmid-December the Practice will holdits annual “Meet the Trade PressLuncheon.”

Young LawyersCommitteeThe Young Lawyers Committee (YLC)is co-chaired by Jason Friedrich ofDrinker Biddle & Reath LLP andNatalie Roisman of the FCC’s MediaBureau. The YLC membership includescommunications attorneys and otherprofessionals under the age of 35 orwith fewer than eight years of practicein communications. The YLC providesopportunities for networking, socialinteraction, and professionaldevelopment that are tailored to those

new to the bar. Although YLC effortsgenerally are targeted to this population,all FCBA members are welcome at YLCevents! Unlike other FCBA committees,YLC co-chairs are elected by themembership of the YLC. Elections areheld in May and each co-chair serves astaggered two-year term. This ensuresthat the YLC has year-round continuityin its programming and outreach efforts.

Each month, the YLC hosts a brown bagluncheon focused on a substantivecommunications issue or careerdevelopment and opportunities. TheYLC draws on its membership to assistin planning and organizing these brownbag luncheons, thereby facilitating theparticipation of members other than theco-chairs and helping to identify futureleaders of the YLC and the FCBA. Sincethe YLC elections in May, the YLC hashosted four brown bag lunches. TheJune lunch featured financial analystsexplaining the impact oftelecommunications regulation oninvestors. In July, a panel of VoIP, cable,RBOC, and wireless carrierrepresentatives joined a Hill staffer indiscussing whether the informationservices/telecommunications servicesregulatory dichotomy can survive in anIP world. Like the rest of DC, the YLCtook a break in August, but returned inSeptember with a panel discussion of

The purpose of the Committee isto nurture relations with other barassociations and organizations to facil-itate the coordination of variousevents, including CLEs and brown baglunches. The Committee also seeksincreased FCBA exposure to and cross-promotional opportunities with otherorganizations.

This year the Committee is coordinat-ing a number of events, including aCLE teleseminar titled Port Blocking,Packet Discrimination and Naked DSL:A Primer on Antitrust in theBroadband/Internet Protocol World afterTrinko. The teleseminar, which is host-ed by the ABA’s Antitrust Section’sComputers and Internet Committeeand co-sponsored by our Wireless,Common Carrier and IP-basedCommunications Committees, is ten-tatively scheduled for January 2006.Stay tuned for details! Also upcomingin April 2006 is the 25th Annual LegalForum Representing Your LocalBroadcaster hosted by the ABA’sCommunications Law Forum and co-sponsored by the ABA, FCBA andNAB. In October, the YLCfocused on career development, co-sponsoring a luncheon with theDiversity Committee to welcome newlawyers and law students to thecommunications bar. The YLC also joins the DiversityCommittee in organizing careerdevelopment events for law studentsand young lawyers. In past years, theYLC and the Diversity Committee haveco-sponsored a series of career panels ateach of the area law schools, and theYLC will be involved in this effort againthis year. The YLC also is working withthe Diversity Committee to implementthe FCBA’s new mentoring initiative,which was introduced at theYLC/Diversity Committee Octoberbrown bag lunch.

This year, the YLC is working with theCLE Committee to plan Comm Law101. This program, which will be heldin early 2006, is intended to provideguidance for practitioners who are newto the communications bar. Pleasecontact one of the YLC co-chairs if youare interested in helping to organize thisevent.

In addition to brown bag luncheons andother substantive communications andcareer development events, the YLCregularly hosts happy hours to provideYLC members with an opportunity tonetwork and socialize. These happyhours are held in a variety of locationsthroughout the city to maximizeattendance, and are well attended byFCBA members, law students, and otherprospective members of the FCBA. Thisyear, the YLC hopes to co-sponsor oneor more happy hours with substantivepractice committees of the FCBA,thereby expanding opportunities forYLC members to interact with otherFCBA members and offering non-YLCmembers an opportunity to network

and socialize. You are never too youngto be a young lawyer! Practicecommittees interested in co-sponsoringa happy hour should contact one of theYLC co-chairs.

The YLC engages in fundraising andcommunity outreach efforts, often inconjunction with the FCBAFoundation. For example, the YLC isselling polo shirts embroidered with theFCBA logo to benefit the Foundation.The YLC also has worked with theFoundation to plan several events forchildren from Martha’s Table, includinga trip to a Washington Nationals gameand a visit to a pumpkin picking farm.The YLC needs volunteers to attendevents such as these! For the third year in a row, the YLCplans to actively recruit members toattend the FCBA Annual Seminar and tooffer room-sharing and ride-sharingprograms to encourage attendance byYLC members. The YLC is workingwith the Annual Seminar planningcommittee to organize activities at theAnnual Seminar and facilitateinteraction among YLC members andmore senior members of thecommunications bar.

Last, but certainly not least, the YLC’slargest single endeavor of the year is theplanning of the annual FCBA CharityAuction. The YLC, in conjunction withthe FCBA Foundation, selects thebeneficiary, organizes the event, andsolicits prizes. The 16th Annual FCBACharity Auction will be held onNovember 17, 2005. Proceeds willbenefit Kids Enjoy Exercise NowGreater D.C. (KEEN). FCC Introduces NewECFS SearchRefinement ToolThe FCC has responded to a concernraised by the FCBA Access to RecordsCommittee regarding the inundationof docketed proceedings with numer-ous brief comment filings that make itdifficult to effectively monitor FCCproceedings. The Commission hasmade available on the ECFS web pagea tool that will enable the public tosort out many of these short text mes-sages that have contributed significant-ly to the increased number of filings indocketed proceedings. The new searchtool appears as a search option in ECFSat “Block 15” and is entitled “EliminateBrief Text Comments.” By checkingthis box, your search will exclude textmessages, which will eliminate from adocket sheet any filings made throughECFS that use only the cover/commentsheet in ECFS and do not include aseparate document. It is estimated, forexample, that in an inundated docketcontaining 200,000 documents, astreamlined search using this new toolwould screen out approximately180,000 of those documents.

DC Court of Appeals AcceptsComments on Proposed Amendmentsto the DC Rules of ProfessionalConduct.

The District of Columbia Court ofAppeals has announced the opening ofthe comment period on proposedamendments to the District ofColumbia Rules of ProfessionalConduct. The Board of Governors ofthe District of Columbia Bar recom-mended the proposed amendments tothe Court of Appeals for adoption,after consideration of the report andrecommendation of the Bar’s Rules ofProfessional Conduct ReviewCommittee. The FCBA filed com-ments on the proposed rules, but therequested changes have not beenincluded in the Board of Governor’srecommendation.

McKenna’s WagonSeeking Volunteersfor November 27McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on loca-tion” to deliver food to the needy. Forthose who have volunteered, it hasbeen a wonderful experience and agreat way to help the needy in the D.C.community.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 pmin comfortable clothes and shoes.Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street,NW, in the District, near the intersec-tion of 14th and U Streets. On-streetparking is available.

Upon arrival we get assignments (someof us will distribute snacks and sand-wiches, others will serve soup), and puton aprons before we depart in the vanto 5th and New York Ave., NW (nearthe new Convention Center). We aredriven by one of our experienced vol-unteers and the trip to distributionlocation takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. The food distribu-tion is conducted in an efficient, calmand orderly fashion and many of the peo-ple we serve are quite appreciative of ourefforts. Once we serve all of the food, wedo a clean up of the immediate area.Total time for the distribution takesabout one hour and we usually return toMartha’s Table by or before 6:30 pm.

We would love to have you join us onone of our upcoming food runs whichare always on the 4th Sunday of themonth. If you are able to volunteer forone of these dates, please send an e-mail to [email protected] or [email protected].

DC Bar Pro BonoClinic The FCBA’s Young Lawyers Committeeorganizes volunteers to spend threehours once a quarter helping lowerincome individuals through a clinicsponsored by the DC Bar. We co-volun-teer with the DOJ Antitrust Division.Attorneys receive a half-houroverview/orientation beginning at 9:30am over bagels and juice. Volunteers areexpected to assist clients only duringthe time they are at the clinic.

No special legal knowledge is needed— attorneys generally need to keep aneye out for potential legal issues whileusing their common sense to solve amyriad of questions and make refer-rals to other organizations.Experienced attorneys on-site willassist FCBA attorneys and other vol-unteers with any questions. Previousattendees have described this as “themost satisfying volunteer experience

I’ve had as an attorney.”

You must either be a member of the DCBar, have an application pending to theDC bar, or be an employee of the feder-al government to provide advice. Thosewho are not DC bar members, parale-gals and law students are needed, how-ever, to provide intake and triage. Lawstudents can have the opportunity to sitin on advice sessions. Dress is casual,but respectful. Bring a pen.

How or when do they alignthemselves with commercial intereststo advance their policy views? Thepanelists will be: Ray Gifford,Progress and Freedom Foundation;Andy Schwartzman, Media AccessProject; Jeannine Kenney, ConsumersUnion; and Jerry Ellig, MercatusCenter – George Mason University.The luncheon will be held at Hogan &Hartson, LLP, 13th floor, 555 13thStreet, NW.
