1. CURRENT ENVIRONMENT DESCRIPTION

1.1. CURRENT SYSTEM DESCRIPTION

1.1.1 System Overview

The Occupational Safety and Health Branch (OSHB) of the Labour Department (LD)is the Government body responsible for the fostering of safety and health atindustrial and non-industrial workplaces to ensure that risks to employee’s safetyand health are properly managed by enforcement of legislation, education andpromotion. Currently, services provided by the OSHB, which include LegislativeRequirement Enforcement, Safety Registry, Occupational Medicine and otheradministrative functions are operated manually with only a very minor portionautomated with micro-scale computer systems. Problems arise when timely andstructured information for strategic planning and public enquiry is required from themassive data which are currently maintained manually.

A computer system, the Occupational Safety and Health Management InformationSystem (OSHMIS) is proposed to provide the management with instant retrieval ofoccupational safety and health related information for strategic planning and policyformulation and also up-to-date information for the handling of public enquiries.

Current Situation

The following problems have been identified:

• Lack of timely and structured safety and health information;• Huge number of the safety profile of workplace kept manually in individual

workplace files and stored in various district offices which inhibit the OSHBfrom compiling statistical and management reports efficiently;

• Huge number of the health profile of workers and patients kept in paper fileswhich require tedious sorting and calculation of health data in analysis andstrategic planning;

• Prosecution result, the legal advice and court rulings kept in Offence RecordSystem cannot be accessible by other divisions;

• Manual indexing used for central filing of workplace files is labour intensive inmanual searching;

• Compilation of statistical reports is labour intensive and error prone;• No network infrastructure to support remote access to OSH CD-ROM reference

materials;• Inefficient network for remote access to occupational safety and health papers

and documents;

• Inefficient work processes such as allocation of accident cases and inputting ofaccident data;

• Duplication of effort in maintaining accident data in a standalone PC after theaccident data are extracted from Employees’ Compensation System Replacement;and

• Lack of system interfaces between existing computer systems in OSHB.

Business Objective

The OSHMIS has the following business objectives:

• To foster safety and health at industrial and non-industrial workplace and ensurethat risks to people’s safety and health are properly managed by legislation,education and promotion;

• To provide timely and structured information for strategic planning, policyformulation and answering public inquiries;

• To provide operational staff with an efficient search tool for searching up-to-dateoccupational safety and health records and reference materials for dischargingtheir duties more effectively and efficiently; and

• To increase the efficiency in compilation of statistical and management reports.

Business Area Served

There are two major areas of work provided by the OSHB, namely the OccupationalSafety Service and the Occupational Health Service.

a) Occupational Safety Service

The occupational safety service is provided by different divisions in the OSHB.It promotes the safe operation of equipment, safety and health of thoseworking in factories, building and engineering construction sites, catering andcargo handling establishments, and other workplaces.

b) Occupational Health Service

The Occupational Health Service is provided by three Occupational MedicineDivisions (OMD), the Occupational Hygiene (Development) Division, tworegional Occupational Hygiene Divisions and the Integrated Services Group(Occupational Health Service). Below are the main responsibilities:

• To prevent occupational diseases and to promote health at work at non-industrial workplace such as offices, hospitals, schools and clinics;

• To provide an advisory service to the government and the public onmatters concerning the health of workers and the hygiene of workplaces;and

• To help to protect workers against health hazards arising from theiremployment through training and promoting awareness of occupationalhealth.

The occupational safety and health services are provided by the following divisions,group and unit:

Advisory and Development Division

The Advisory and Development Division (ADD) is headed by the AssistantCommissioner (Occupational Safety) 1 and is subdivided into two units, namelyAdvisory Unit and Development Unit. Below are the major responsibilities of theADD:

• Supporting the Directorate in the formulation of new policies and strategies;• Advising trade organizations and workers’ unions on occupational safety matters;• Publishing guidance materials; and• Handling enquiries on safety matters.

a) Advisory Unit

The Advisory Unit (AU) is responsible for preparing and publishing safetyand health publications including bulletins, guidebooks, leaflets, posters andcodes of practice. It also provides advice on enquiries made by the public onoccupational safety and health matters, statutory requirements andenforcement standards. Below are the major responsibilities of the AU:

• To perform stock control on various publications and prepare funding forpublications by Central Administration Unit;

• To man the Safety and Health Advisory Telephone Service (SHATS) andprovide advice on enquiry made;

• To prepare monthly return on enquiry made verbally or in writing and byother means and also on the nature of the enquiry;

• To compile a list of local and overseas OSH related publications andreference materials;

• To maintain the model answers for public enquires;• To handle request for service to publish publication on safety and health

from other divisions of OSHB;• To compile progress on preparation and revision of OSH publications for

management use; and• To assist other divisions in publishing the guidance materials prepared by

them.

b) Development Unit

The Development Unit is responsible for carrying out research in support ofpolicy formulation. Their main responsibilities are:

• To carry out research in the support of policy formulation;• To draft consultation and related papers on legislative proposals;• To prepare papers, briefs, replies to questions and requests from the

Legislative Council and other public bodies;• To coordinate the preparation, drafting and revision of standing orders;

and

• To maintain the safety registers (a list of organizations).

Boilers and Pressure Vessels Division

The Boilers and Pressure Vessels Division (BPVD) is headed by the AssistantCommissioner (Occupational Safety) 2 and is responsible for enforcing the Boilersand Pressure Vessels Ordinance (Cap.56) and its subsidiary regulations to ensure thesafe use and operation of boilers and pressure vessels through promotion, inspection,accident investigation and registration of pressure equipment. It also conductsexaminations and issues certificates of competency to qualified candidates ascompetent persons for various types of boilers and pressure vessels. The divisionalso gives the Fire Services Department technical advice on the approval and initialinspections of pressurised cylinders and storage installations for compressed gases.

The Commissioner for Labour appoints qualified engineers from the private sectorto become appointed examiners. These appointed examiners, categorized into boilerinspectors and air receiver inspectors, carry out inspections and testing of anypressure equipment subject to registration and are responsible for scrutinisingdocuments on design, construction, quality of fabrication and issuing certificates offitness. Inspectors (boilers and pressure vessels) of the BPVD make spot checks onthe pressure equipment to ensure that safety standards are maintained.

Below are the main responsibilities of BPVD: 

• Registration of boilers and pressure vessels; • Carrying out spot checks on pressure equipment in work sites;• Conducting examinations and issuing certificate of competency to qualified

candidates as competent persons for various types of boiler and steam receiver; • Organising the training courses and seminars to promote awareness towards the

safe use of pressure equipment;• Promoting safe use of boilers and pressure vessels by issuing Codes of Practice

and through activities such as holding seminars and exhibitions;  and• Providing technical support to the Fire Services Department in connection with

pressure equipment covered by the Dangerous Goods Ordinance (Cap.295).

Central Administration Unit

The Central Administration Unit is responsible for allocating the file referencenumber to the field offices of the Operations Division and maintaining a centralregistry of all trade files opened. Other duties include:

• General Administration;• Financial Management;• Personnel Functions; and• Office Management.

Information and Training Division

The Information and Training Division (ITD) is headed by the AssistantCommissioner (Occupational Safety) 1 and is subdivided into three units, namelyInformation Centre, Accident Analysis Office and Training and Accreditation Unit.Below are the major responsibilities of the ITD:

• To provide information services;• To compile accident statistics and analysis;• To operate the Occupational Safety and Health Training Centre; and• To process applications for the registration of safety personnel and certification

of workers’ competency under the safety laws.

a) Information Centre

The main responsibilities are:

• To collect, develop and manage information resources and provideinformation services support to other divisions of the OSHB;

• To consolidate returns from district offices and upload the performancedata into ORS and Infopage;

• To compile statistics reports for management use;• To publish the management information via Headquarters LAN

(InfoPage);• To disseminate safety and health related information to staff of OSHB via

SHIP & SHINE;• To maintain SHIP, InfoPage, ORS and SHINE;• To maintain the library system and CD-ROM; and• To handle complaint hotline on factory & workplace and refer to the

district office for follow up actions.

b) Accident Analysis Office

The main responsibilities are:

• To conduct research and survey on occupational accidents;• To produce analytical reports on accident information;• To compile and disseminate the accident statistics to other Departments /

Divisions; and• To record and scrutinise all reports on occupational accidents via the

telephone hotline and refer cases to the field offices for follow up.

c) Training and Accreditation Unit

The Occupational Safety and Health Training Centre provides training andadvice to government departments and non-government personnel fromdifferent trades on occupational safety and health to help them reduce thenumber of occupational accidents. It organised training courses on safetylegislation and holds safety talks to industries, vocational training schools,technical institutes and government departments. The safety and healthtraining courses are free of charge. Application for enrolment must be madeby the sponsoring companies in writing. 

In addition, it also provides in-service training programmes to OSHB officersand these programmes covered a wide area of topics including specifictechnical subjects, core competency skills, computer usage and inductiontraining.

The unit is also responsible for approval and accreditation of training courses,certification of safety equipment and keeping of safety registries.

Integrated Services

The Integrated Services team consists of six Multidisciplinary Inspection (MDI)teams and three Occupational Divisional offices. The six MDI teams are chargedwith the responsibility of handling chain, complex and large organizations inselected economic activities, and major hazard installations including oil depots /petrol filling stations. The three operational divisional offices will take care ofcross-region major infra-structure construction projects, including extension to theairport and railway systems and all activities relating to the operation of the airportand railways.

The MDI teams are made up of professional officers from occupational health,hygiene and safety services. The duties of all MDI teams include:

• Identify target establishment for promotional inspection;• Identify target establishment for enforcement inspection;• Conduct accident and ill-health investigation when related accident and

occupational illness of the target establishment are reported;• Complaints investigation;• Organise special campaigns; and• Collect safety and health references and conduct comparative research on

international standards.

Legal Services Division

The Legal Services Division (LSD) is headed by the Assistant Commissioner(Occupational Safety) 2 and is responsible for instituting, processing and conductingprosecution relating to occupational safety and health offences against suspectedoffenders of the provisions of the Occupational Safety and Health Ordinance, theFactories and Industrial Undertakings Ordinance, the Boilers and Pressure Vessels

Ordinance, and their subsidiary regulations, handling matters in connection withcivil claim cases arising from occupational accidents and other related legal services.

Occupational Hygiene Division

The occupational hygienists of the Occupational Hygiene Divisions (OHD) carry outfield surveys and laboratory tests to identify and evaluate occupational healthhazards in the work environment and advise proprietors on measures to control suchhazards in their workplaces. They also set and enforce occupational hygienestandards at workplaces. Apart from actively conducting health promotion andeducational activities such as lectures / talks/ video shows, the OHS publishesvarious guidance materials on prevention of occupational diseases and control ofhealth risks at work.

Below are the major work of the OHD (Operations): 

• Providing advisory services to the public on health and hygiene aspects ofoccupational health problems such as prevention of occupational diseases inworkplaces;

• Conducting field surveys to ensure that the requirements of health and hygieneat workplaces are complied with;

• Enforcing legislation relating to occupational health and hygiene;• Organising exhibitions and delivering talks to promote the awareness of

occupational health;• Arranging proactive visits to workplaces regularly;• Issuing warning letters; Improvement Notice and Suspension Notice;• Initiating prosecutions and act as expert witness in court;• Providing advice and handling enquiries by letter, telephone, fax or in person

concerning occupational hygiene problems;• Handling referral cases from other Government Department, OSD, etc … ;• Handling complaints regarding occupational hygiene from the public;• Investigating Occupational Diseases;• Conducting promotional visits;• Investigating accidents and provide emergency call services;• Managing and calibrate the field monitoring equipment; and• Editing the occupational hygiene publications.

Below are the major work of the OHD (Development): 

• Collection, analysis, compilation and dissemination of Hazard information;• Labour legislation review, especially on parts of occupational hygiene;• Standard setting: up-dating of the reference notes for Chemicals, documentation

on the standards, liaison meeting with parties concerned;• Planning on publicity and education: preparation for exhibition, seminar, and

campaign activities teaching and drafting of educational (information) pamphletsand publications;

• Providing technical support service onInternal: asbestos analytical service (laboratory on 26/F)

Toxic gas meter calibration/checking service (laboratory on26/F)

External: drafting of guidelines for occupational hygienemonitoring/assessment.

• Carrying out epidemiological studies;• Review of document for assessment of working conditions in

industries/occupations through compilation of information available from thecase survey results;

• Advisory on prevention and control measures;• Liaison and meeting with internal and external parties on promotional or

research activities; and• Staff training and development.

Occupational Medicine Division

The medical and nursing staff of the Occupational Medicine Division (OMD) areresponsible for conducting medical examinations, investigating occupationaldiseases, health education and promotion, running an Occupational Safety andHealth Centre and two Occupational Health Clinics and, through the operation ofOccupational Medicine Units, arranging medical assessment for workers injured inoccupational accidents or have contracted prescribed occupational diseases. Theyalso conduct workplace assessments and inspections in various industries.Suspected occupational diseases will be investigated.

Below are the main responsibilities of OMD:

• Advisory and consultation service on occupational health (OH);• Promotion and educational activities on OH;• Clinical consultation service for patients with work-related illnesses;• Medical examination of radiation workers and government workers with

hazardous exposures, and also assessment of medical fitness of undergroundworkers and aviation workers;

• Workplace assessment for health hazard assessment and investigation onsuspected occupational diseases or gassing/chemical incidents;

• Conduct surveys/studies on OH;• Keep data or statistics on OH; and• Give medical advice on employees' compensation cases.

Operations Division

The Operations Division is headed by the Assistant Commissioner (OccupationalSafety) 2 and is made up of offices for non-building & engineering construction (non-BEC) and building and engineering construction (BEC).

It is responsible for outreaching services, including provision of safety and healthadvice to various workplaces and enforcement of the Occupational Safety and

Health Ordinance, the Factories and Industrial Undertakings Ordinance, and theirsubsidiary regulations by carrying out inspections to workplaces and investigation ofaccidents.

The occupational safety officers (OSO) of the Operations Division play an importantrole in inspecting workplaces (including industrial undertakings, non-industrialundertakings, and construction sites) to ensure that the requirements on safety,health and welfare are compiled with. For those factory owners and contractors(employer or occupier) suspected of violating safety regulations, Suspension Noticeand Improvement Notice would be issued. They carry out accident investigationsand give advice to employers and employees on how to reduce existing workplacehazards. They also offer free advice to owners in the planning and layout offactories and workplaces, and in-plant/in-house safety programme.

Apart from routine inspections, the OSO also conduct special inspection campaignstargeting the factories, catering establishments and construction sites.

In premises being used as a workplace, the Occupational Safety Officers can

• Seize any article he believes to be evidence of contravention of the Ordinance;• Conduct tests and examinations and take photographs of any plant or substance

found on the premises;• Take samples of substance for analysis;• Require the production for inspection records relating the safety and health of

employees;• Require the exhibition of specified notice in a workplace; and• Make copies of all or any part of records or statement.

Support Services Division

The Support Services Division (SSD) is headed by the Assistant Commissioner(Occupational Safety) 1 and is made up of the Technical Support Unit and SafetyPromotion Unit.

Below are the main responsibilities of SSD:

• To provide technical support services by conducting technical research;• To give expert advice and assistance;• To issue Codes of Practices in different technical subjects; and• To coordinate safety promotional functions and organise the safety related

conferences and events.

a) Technical Support Unit (TSU)

The TSU provides technical advice and assistance to the field officers inaccident investigation. After the field investigation, TSU officer will collectthe reference number, name and address of the workplace from the field

officers. A new investigation paper file will be opened with the workplacereference number as the reference.

For some cases, TSU may have to search technical information from the CD-ROMs of Information Centre. All relevant information will be placed in thepaper file. At the end of investigation, a technical investigation report is sentto the field office for compilation of accident report.

b) Safety Promotion Unit (SPU)

The SPU provides services to instil safety concepts to the public at large witha view to inculcating a safety culture among employers and employees andsecuring their commitment to self-regulation to bring in a safety managementapproach. They also organize and participate in various promotional activitieslike award schemes, campaigns, seminars, conferences, exhibitions, safetyquiz competitions, safety carnivals, etc. Alongside with the organization ofpromotional activities, the SPU also initiates major publicity drive topromulgate occupational safety and health messages. This include productionof TV Announcement of Public Interest (APIs), placing advertisement onpublic vehicles and transport stations and distribution of safety publications atmajor outlets that are easily and frequently accessed by the general public.

1.1.2 Hardware and Software Usage

PCs are provided for individual offices to facilitate the compilation of statisticalreports. Some are standalone PCs installed with standard office automation softwarewhile other PCs are linked up with the servers and the printers to form a local areanetwork for file sharing and printer sharing within the same office. Scanner, bar-code reader, zip drive, handwriting system and CD writer are also installed in somedivisions.

Basic office automation facilities such as cc:Mail, Microsoft Word and Excel areinstalled in each division for communication, word processing and performing officetasks. Some divisions are installed with Lotus 123, Dbase4, Wordperfect, Accessand Foxpro for maintaining occupational safety and health related records. Most ofthe PCs running under the Chinese Windows environment (Microsoft ChineseWindows 3.1, 95 & 98, Chinese Office 4.2, 95 & 97).

Cc:Mail and internet accounts are also provided for each division to communicatewithin their offices and with external parties.

For details of the hardware and software inventory, please refer to the Appendix A.

Local Area Network

The Headquarters of the OSHB is located on 13/F, 15/F & 16/F of the HarbourBuilding, 38 Pier Road, Central.

Several divisions / offices have set up their own local area network (LAN) with PCs,servers and printers linked up together to allow sharing of files, disk storage andprinters. The file servers are installed with Novell Netware 3.2 and / or 4.11 whilethe PCs are running under Windows 3.1 or Chinese Windows 95.

To access information from the SHIP, all offices have to dial up to the InformationCentre via modem to download the information to their own local PCs. Files areexchanged between Regional Headquarters using the dial up via the modem.

Only staff of the directorate grade are connected to HQ/LAN which can access theperformance data from the InfoPage.

1.5 ELEMENTARY PROCESS DESCRIPTION

Process ID: 1 Maintain Workplace

Description:

This process is to receive notification of accidents, Form 2, Form 2A, dangerousoccurrences, establishment / change of workplace and plant & equipment fromvarious information sources, such as Public, Fire Services and Police, etc.

When Operations Division and Occupational Hygiene Division receive thesenotifications, follow-up actions may be taken, e.g. workplace inspection andaccident investigation, etc. The results of the above actions are recorded in variousdocuments, e.g. inspection report and accident report.

Occupational Safety Officers and Occupational Hygienist may raise enforcementnotice to those unsatisfactory workplaces. Issuance of enforcement notices have tobe approved by senior members of the division except the Prohibition SmokingNotice.

For serious violations to the regulations, Occupational Safety Officers andOccupational Hygienist would recommend prosecution and approved by the DeputyChief Occupational Safety Officers and Senior Occupational Hygienists.

All the inspection reports, enforcement notices, prosecutions and any otherdocuments are currently filed in the workplace files.

Process ID: 2 Maintain Medical Consultation and Examination

Description:

In this process, two Occupational Medicine Division (OMD) clinics receive requestfor consultation from patients. Request for medical examination for civil servantsand workers under hazardous environments, e.g. radiation workers, are receivedfrom various government departments. OMD also receives notification ofoccupational disease from non-labour department doctors through the submission ofNotification Forms.

Doctor provides the consultation services to patients and records patients’ medicaldetails in the patients’ file. As for request for medical examinations, upon thecompletion of the medical examinations, the examination results will then be filed inthe folder for civil servants under medical surveillance. A summary of the resultswill be sent to respective departments. When notification is received from non-labour department doctors on occupationaldisease cases, the OMD doctors may follow up with the reported cases.

Process ID: 3 Maintain Training Course and Accreditation

Description:

This process is to receive course application and safety registries application. Thereare different types of safety registry application, e.g. application of registration ofsafety officers and application for protective equipment. Training center receivesthe proposed training schemes for authorization from training organizations, forexample, Construction Industry Training Authority. For course applications, clerical officers select the successful applications accordingto pre-defined selection criteria. Course application results will then be sent to theapplicants.

For applications of registration of safety officer, occupational safety officers verifythe qualifications and working experiences of the applicants. The applications arethen supported by Senior Safety Officers and Divisional Safety Officers. Deputychief safety officer will finally approve the applications. Then, clerical staff membersend the application results to the applicants.

For authorization of training scheme, occupational safety officers (OSO) willevaluate the course material, qualification of trainer, etc. Site visits are performed bythe OSO to evaluate and ensure that the trainers are qualified. The applications willbe finally authorized by Assistant Commissioner. Clerical staff will then send theapplication results to the training organization.

After completion of the training course, trainees submit the course evaluation formand receive the certification. The evaluation forms are then used to evaluate theeffectiveness of the course, collect feedback and to evaluate the trainer’sperformance.

Process ID: 4 Maintain Prosecution and Offence

Description:

Any Violation of ordinances found during inspection and investigation will berecorded by the officers of the Operations Division, Occupational Hygiene Divisionand Boilers and Pressure Vessels Division.

For Operations Division, Prosecution Sheet will be prepared by the officers and thensubmitted to DSO and DCSO for approval. When the case is approved forprosecution by the Operations Division, the Prosecution Sheet together with the T-file (temporary file) containing all the evidence for prosecution will be sent to theLegal Services Division (LSD) for conducting prosecution.

For Boiler and Pressure Vessels Division, they will inform LSD by a memo formcalled the PEM4A ‘Memo for prosecution’ after the case is approved for prosecution.The PEM4A will contain fields of factory owner, name, address, number of workers,name of inspector and date of inspection.

After the T-file is received by the LSD, summons will be drafted and inputted toCaseman. Summon must be issued within 6 months from the date of offence.Caseman is used for checking the Court hearing date. After the proceeding is completed, all the legal result such as fine, maximum fine,court decision, … etc. will be updated into the offence record. The T-file will also bereturned to the respective divisions.

Description:

This process is to handle public enquiry and compliant from the public on theoccupational safety and health matters.

For public enquiry and complaint, both verbal and written reply will be handled.The details of the public enquiry will be recorded in the register.

The details of the public complaints will be recorded in the register and referred tothe relevant office of Operations Division for investigation.

Description:

This process is about referencing of the Gazette Notice, Ordinance & Regulations,Legco Q&A, CDROM library and the reference library of the OSH-relateddocuments.

Currently, the users can download the up-to-date Gazette notice, Ordinance &Regulations and the Legco Q&A, the standing orders, standard forms / memotemplates, letters, circulars, code of practices, surveys, performance data reports,research reports, minutes of meetings, statistics and other overseas referencematerials from the SHIP and the SHINE for reference.

Users can refer to the books and journals kept in the library and the OSHinformation from the CDROM kept in the CDROM library which is now maintainedby Information Centre. There are about 75 pieces of CDROMs containinginformation on safety and health stored in the CDROM library. For theOccupational Hygiene Division, there are about 15 pieces of occupational healthrelated CDROMs.

Description:

This process is to maintain the database of Gazette Notice, Ordinance & Regulations,Legco Q&A, the CDROM library and the reference library of the OSH-relateddocuments. Currently the maintenance of the databases of Gazette Notice,Ordinance & Regulations, Legco Q&A are performed by the Development Unit ofthe Advisory and Development Division.

CDROM library is maintained by the Information Centre. There are about 75 piecesof CDROMs containing information on safety and health stored in the CDROMlibrary. For the Occupational Hygiene Division, there are about 15 pieces ofoccupational health related CDROMs. There are about 1700 books and journals kept in the library.

Currently the hard copies of the gazette notices are sent by the Information Centre tothe Development Unit of ADD. Gazette notice number, Gazette date and descriptionwill be captured. The contents of the Gazette notice will be scanned from the hardcopies.

For Ordinance & Regulations database, both English and Chinese version of theOccupational Safety and Health Ordinance, the Factories and IndustrialUndertakings Ordinance, the Boiler and Pressure Vessels Ordinance and theirsubsidiary regulations will be captured.

For the Legco Q&A database, date, honourable, subject of the questions and OS /OH type will be captured.

The up-to-date Gazette notice, Ordinance & Regulations and the Legco Q&A will beuploaded to SHIP.
