From January 2011 Australia has a single National Consumer Protection Law; “The Australian Consumer Law” (ACL).

The ACL replaces previous consumer provisions of the Commonwealth Trade Practices Act of the Federal Government and the State and Territory Fair Trading Acts.

The ACL is all about fair products, contracts and safe and fair sales for all Australians.

The new Australian Consumer Law benefits businesses as it is one set of laws, rather than seventeen different laws and policies over various states. It is clearer for a better understanding and application by all.

A new ACL now means that suppliers of recreational services have the choice to modify, exclude or restrict their statutory obligation to render services with due care and skill in some circumstances.

How does this affect South Australians?• Previously under the Fair Trading Act 1987, South Australian recreational service participants could not

waiver the rights of the consumer. • With a new Australian Consumer Law, recreational service participants may choose to waiver some of their

rights under certain clearly defined circumstances. This requires the signing and acknowledgment of a waiver appropriate to the recreational activity.

• Consumers who do not wish to waiver their rights may not be able to participate in the recreational activity.

What will we be faced with?

We can expect to be seeing waivers like the below example (Extracted from; Fair Trading Regulations 2010) be-fore we participate in recreational activities (Note; the waiver only requires ONE of exclude, restrict or modify).

You must be eighteen years of age to be able to waiver your own rights, in SA you cannot waive the rights of a minor.

Penalties will be implied for failure to comply by the new Australian Consumer Laws, these include;• < $220, 000 for individuals• < $1.1 million for corporations

A court may find that a contract term is unfair; in this case any unfair terms in standard-form consumer contracts will be void. A standard-form consumer contract is a contract designed by one party without the input and nego-tiation of the consumer. Other aspects of the contract will still bind the parties.

Contracts are deemed unfair if;• It would cause a significant imbalance in the party’s rights and obligations arising under the contract.• It is not reasonably necessary to protect the legitimate interests of the party who would be advantaged by

the term.• It would cause detriment (whether financial or otherwise) to a party it were to be applied or relied upon.

A supplier under the new laws must guarantee;• Services will be provided with due care, skill and technique.• Services achieve the results they were told it would.

The new laws prohibit false and misleading testimonials.

The Productivity Commission estimated that this reform could provide benefits to the Australian community of between $1.5 billion and $4.5 billion a year.

Outdoor Adventure First Aid with both land and water courses on offer.

Courses satisfy the new First Aid requirements set by the State Government.

The water based course has a number of scenarios dealing with the kayak, sailing and swimming environments. The land based include cliff related scenarios.
