CHARLES SUMNER AVERY has disclaimed that he is the father of the minor child by admitting to signing a false paternity affi davit in Pontotoc County District Court case FD-2004- 182, and was not ordered to pay child support on the minor child. b. CHARLES SUMNER AVERY has never exer cised custody or visitation of JEREMIAH ZACHARY SPENCER ALEXANDER. He has abandoned JEREMIAH ZACHARY SPENCER ALEXANDER as defi ned in Section 6-401.2 of the Chickasaw Code, meaning that CHARLES SUM- NER AVERY has failed, for a period of six (6) consecutive months, to main- tain a significant parental relationship with the minor child through visitation or communication in which incidental or token visits or communications are not considered significant. c. Also, for a period of the last the twelve (12) consecutive months out of the last fourteen (14) months immediately preceding the fi ling of the Petition for Adoption, CHARLES SUMNER AVERY has willfully failed, refused or neglected to contribute to the support of the child within his available means through contribu- tions of fi nancial support for physical necessities such as food, clothing and shelter, or by performing labor or other services for and at the request of the person having custody. And, therefore, your consent to the adoption is not necessary , and that Petitioners are proper parties to adopt.
