1.0 INTRODUCTION It is proposed to construct a residential flat building on land known as Lot 62 and Lot 63 DP 14294, 9 – 11 Alice Street, Seven Hills. McNeil Architects has requested an Access Appraisal Report with respect to the proposed residential flat building. This report has been based on architectural plans by McNeil Architects and referenced as follows;

Additional information regarding the construction of the proposed building has also been provided by representatives of McNeil Architects. No responsibility is accepted for the assessment of issues beyond the scope of the plans submitted for review or the accuracy of the information presented on the plans or provided by McNeil Architects. The level of information shown on the above plans has dictated the level of assessment of issues which has been able to be undertaken.

2.0 PURPOSE AND SCOPE OF REPORT The purpose of this report is to prepare an access appraisal report for the proposed residential flat building. The report is to be used to identify relevant access issues which can be reflected in the preparation of the plans for the development and construction approval phases of the project. Importantly compliance with the BCA¹ does not insulate against an action pursuant to the Disability Discrimination Act.

3.0 PROPOSED DEVELOPMENT

The proposed development involves the construction of an eight (8) storey residential flat building which consists of two (2) storeys of carparking and six (6) storeys of residential units. A total of thirty two (32) residential units are proposed over the six storeys.

Details of the major construction elements of the proposed building works were not available given the preliminary nature of design. The following Classifications are considered to be relevant to the application of the relevant requirements of the Building Code of Australia (2016) and the Disability (Access to Premises) Standards 2011.

Building Classifications

Class 2 — a building containing 2 or more sole-occupancy units, each being a separate dwelling. A Class 2 building is typically a block of residential flats or apartments. It is assumed for the purposes of this report that the proposed residential units are provided for long term accommodation.

Class 7 — a building which is:

(a) Class 7a — a carpark;

4.0 RELEVANT ACCESS REQUIREMENTS 4.1 Building Code of Australia (BCA) 2016 It is noted that the relevant provisions of Part D3 of the BCA apply to the proposed development. Accordingly for the purposes of this assessment the access provisions of the BCA were assessed as being relevant to the following areas of the proposed building;

Access to and though the principal pedestrian building entrance from the main points of pedestrian entry at the allotment boundary and from required accessible carparking spaces; and

Access to the entrance door of all SOU’s serviced by the proposed lift; and

One (1) type of room or space used in common by the residents (roof top area of subject building).

Details of the relevant BCA compliance requirements as they pertain to disabled access and facilities are provided in Attachment 1. Importantly the BCA provides that disabled access must be designed and constructed so as to comply with the relevant provisions of AS1428.1 – 2009.

The following should be specifically noted with respect to the provision of disabled access and facilities to the proposed building:

Where used carpet shall comply with specific requirements of the BCA. Minimum width of doors is 850mm WH and WL dimensions at relevant door openings to comply with AS 1428.1 Circulation spaces at accessible path of travel doors to comply with AS 1428.1. Minimum width of accessible path of travel is to

be1000mm. Passenger lift must comply with Clause E3.6 of the BCA

D3.5 Car Parking Minimum of 1 car parking space required based on current car parking arrangement - 4spaces are proposed. The design and construction of any accessible carpark to comply with AS/NZS 2890.6. Access to and from any disabled car parking space to other areas of the building which are required to be accessible to comply with AS1428.1. This includes access to the lift servicing the building.

Having regard to the above the following additional information is provided;

The provision of ramps/walkways is to comply with the relevant requirements of AS1428.1 (2009). This includes the provision of landings and handrails.

Circulation space compliance at accessible doorways should be reviewed in relation to compliance with AS1428.1.

The design, construction and operation of doors which form part of an accessible path of travel to and within the building are to comply with the relevant requirements of AS1428.1.

The lift servicing the proposed building is to comply with relevant requirements of Part E3 of the BCA.

4.2 Disability (Access to Premises) Standards 2011

(i) Background The purpose of the Disability (Access to Premises) Standards 2011 is to both:

provide for equitable and dignified access to new buildings and those areas of existing buildings that undergo renovation or upgrade that requires a building approval, and

provide greater certainty to those involved in the design, construction, certification and management of buildings in relation to the level of access required in the buildings covered by the Premises Standards.

One of the main objectives behind developing the Premises Standards was to develop a single set of design and construction requirements covering access to new buildings and an extension to, or modification of, an existing building. The Building Code of Australia (BCA) was also amended on 1 May 2011 to achieve consistency with the Access Code for buildings (Schedule 1 of the Premises Standards). Relevant state and territory building laws and regulations have also been amended to ensure administrative provisions, including certain exemptions and concessions of the Premises Standards, are also consistent, as far as possible.

(ii) Key Concepts of the Premises Standard

Application of Standard Clause 2.1 of the Standard provides the circumstances whereby the Standards apply being; (1) Subject to subsection (2), these Standards apply to the following: (a) a new building, to the extent that the building is: (i) a specified Class 1b building; or (ii) a Class 2 building that has accommodation available for short-term rent; or (iii) a Class 3, 5, 6, 7, 8, 9 or 10 building; (b) a new part, and any affected part, of a building, if the building is: (i) a specified Class 1b building; or (ii) a Class 2 building that: (A) is a new building; and (B) has accommodation available for short-term rent; or (iii) a Class 3, 5, 6, 7, 8, 9 or 10 building;

(c) an existing public transport building that is still in use on the target date mentioned in an item in the table in section 3.1. Application of Standard to Proposed Development

Having regard to the above it is considered that the relevant provisions of the Standard do not apply to the proposed development by virtue of (1)(a)(ii). In this regard under the Premises Standards the access requirements only apply in Class 2 buildings where one or more SOUs are made available for short-term rent as holiday units, serviced apartments, time-share facilities or the like. It is noted that the proposed development has been assessed as being for long term accommodation only. While there is no definition in the Premises Standards of what ‘short-term’ means, a reasonable interpretation would be accommodation rented out on a commercial basis for short periods that generally does not require the signing of a lease agreement. This limitation relating to the existence of short-term rented SOUs does not apply in the equivalent provisions of the BCA. In the BCA the application of access requirements to a number of specified common areas is to all new Class 2 buildings irrespective of whether or not they will contain short-term rented SOUs. Therefore the broader scope of access and facility requirements in the BCA will satisfy the requirements of the Access Code.

Details of the relevant Access Code requirements as they pertain to disabled access and facilities in relation to the proposed building are provided in Attachment 2.

Attachment 3 provides information regarding some of the specific compliance requirements provided for by the BCA.

4.3 Adaptable Housing Requirements (AS 4299 - 1995) The local authority development control plans require the provision of adaptable housing. It is noted that four (4) adaptable units are proposed as part of the proposed development. The following units are nominated as being adaptable;

Unit 607 It is noted that AS 4299 is the relevant compliance standard. Details of the relevant adaptable housing requirements, (Class C essential features), as they pertain to the proposed building are provided in Attachment 4. 4.4 Compliance Statement

On the basis of the above information I am satisfied that the proposed residential flat building can achieve compliance with the access provisions of the BCA, the Premises Standard and AS4299 (Adaptable Housing).

ATTACHMENT 3 – ACCESS & FACILITIES REQUIREMENTS a) Signage must be provided to identify;

Where a pedestrian access is not available, directional signage incorporating the international symbol of access, in accordance with AS1428.1, must be provided to direct a person to the location of the nearest accessible pedestrian entrance.

c) Principal Pedestrian Entrance

Where there is no chair rail, handrail or transom, all frameless or fully glazed doors, sidelights and any glazing capable of being mistaken for a doorway or opening must be clearly marked in accordance with AS1428.1 (2009).

e) Walkways (General)

Minimum of 1m wide

A continuous accessible path of travel and any circulation spaces shall have a slip resistant surface. The texture of the surface shall be traversable by people who use a wheelchair and those with an ambulant or sensory disability

Abutment of surfaces shall have a smooth transition. Design transition shall be 0°. Construction tolerances are 3mm vertical and 5mm provided the edges are bevelled or have a rounded edge.

Where carpets or any soft flexible materials are used o The pile height or pile thickness shall not exceed 6mm and the carpet backing thickness

shall not exceed 4mm; o Exposed edges of floor covering shall be fastened to the floor surface and shall have a

trim along the entire length of any exposed edge; and o At the leading edges, carpet trims and any soft flexible materials shall have a vertical

face no higher than 3mm or a rounded bevelled edge no higher than 5mm or above that height a gradient of 1 in 8 up to a total maximum height of 10mm.

g) Switches and General Purpose Outlets

All switches and controls on an accessible, other than general purpose outlets, shall be located not less than 900mm nor more than 1100mm above the plane of the finished floor and not less than 500mm from internal corners except where on the architrave on the latch side.
