By the time you read this article we will be roughly half way through the first quarter of 2010.
As I write this, though, we are barely into the new year, so I’ll take this op-portunity to wish each and every one of you a healthy, happy and prosperous new year. I hope your holidays were filled with family and friends, and you all ate too much like I did. That’s what the holidays are all about! Now that the new year is at hand, it’s time to get back to work in earnest. Before we blast off into 2010, let’s take a brief look back at 2009 to keep everything in perspec-tive. 2009 was a tumultuous year. Let’s hope that 2010 provides more stability. 2009 was a year that brought a lot of change to our nation, our state and to a lesser extent, to the LAPELS board. The year started with a new president taking residence in the White House, with a promise of hope and change. The economy in most of the country was in bad shape and continuing to drift toward the worse. Home foreclosures and repossessions were at an all time high. The credit crisis had a firm grip on available capital. The oil and gas industry that Louisiana’s economy is heavily dependent upon was in similar shape. With lower commodity prices, tight capital for drilling, and a new administration in DC that was the least oil-energy-friendly in years, Louisiana had the worst drilling rig count on record. Governor Bobby Jindal took steps to reduce the budget as a result of the lost income to the state. The LAPELS board saw an increase in comity applications for registration in Louisiana in 2009. Although unemployment rates were high in parts of the nation, perhaps our job market here in Louisiana was more stable and undoubtedly attracted some of these professionals.
Louisiana continues to feel the effects of the economic slump. You have read about, and many of you are directly involved with, the continuing efforts of the Jindal administration to reduce funding to governmental agencies and higher education so that Louisiana government can reduce spending to match expected income. Although the LAPELS board is a state governmental entity, the funding for this board is self generated through the application and professional registration fees of the registrants of the board. We receive no direct state funding. Rest assured that your LAPELS board is a frugal manager of our finances. We have and continue to be prudently ‘living within our means’. 2010 will bring with it some change to the LAPELS board. My tenure on the board is nearing its end. A ‘changing of the guard’ will occur at our March board meeting, whereby Mr. Mark Jusselin and Mr. Rhaoul Guillaume will split time for the next year as Chairman and Vice-Chair of the board. It has been an honor for me to lead the efforts of the Board these past twelve months. I feel we’ve made some positive changes and are in a better position to serve our registrants, and “to safeguard life, health and property and to promote the public welfare”, as is our charge. This is the last article I write as Chairman and I want to take this opportunity to express my gratitude to the dedicated professionals I have served with during my tenure. The commitment of time, energy and passion exhibited by board members has always been an inspiration to me. I like to think that I have contributed in some small way. I am very optimistic that 2010 will be a great year for Louisiana and for the
LAPELS board. How can we not be optimistic? LAPELS continues to receive applications from excellent young candidates seeking professional registration, the economy and economic forecast is improving, job markets are stable and of course the New Orleans Saints are in the NFL playoffs. Who knows, by the time you read this they may even be Super Bowl Champs!

The Board continues to investigate alleged violations of the laws and rules which regulate the practice of engineering and land surveying in Louisiana. Substantiated violations result in disciplinary or enforcement action being taken either through a Consent Order or by Board Decision following a formal hearing at which the respondent is adjudged guilty of one or more violations. Below is a summary of the disciplinary/enforcement actions taken by the Board since the previous issue of the Journal.
MINIMUM STANDARDS VIOLATIONS:
William J. Bodin, Jr., P.E., P.L.S., a licensed engineer (PE-8193) and land surveyor (PLS-4253), was subject to disciplinary action by the Board for failing to comply with the Board’s minimum standards for property boundary surveys in violation of La. R.S. 37:698(A)(6), to wit LAC Title 46:LXI§2907(C) and (G)(3), (4), (7) and (16). In 2005 Mr. Bodin prepared, signed, sealed and issued a survey plat for property located in Louisiana in which (a) monuments were not set and/or referenced on interior lot corners, (b) there was no curve data, (c) there were no interior lot bearings, (d) the right-of-way width for a street was not specified, (e) there was no basis of bearings or reference to an established line on the ground, and (f) there was no certification indicating compliance with the appropriate class of survey or the minimum standards. In 2006 Mr. Bodin prepared, signed, sealed and issued a revised survey plat for property located in Louisiana in which (a) monuments were not set and/or referenced on interior lot corners, (b) there was no basis of bearings or reference to an established line on the ground, and (c) there was no certification indicating compliance with the appropriate class of survey or the minimum standards. Mr. Bodin has entered into a Consent Order with the Board, wherein he admitted to violations of the above statute and rules and agreed to pay a fine of $1,500; to pay administrative costs of $1,238.42; to correct all minimum standards violations in the referenced survey plats, provide the corrected survey plat to the Board for review, re-submit the corrected survey plat to the appropriate parish authorities for signature, record the corrected survey plat in the public records, provide the corrected survey plat to his client, and provide satisfactory evidence of the accomplishment of these requirements to the Board; to successfully complete the Board’s online
Louisiana Minimum Standards Examination; to the suspension of his professional land surveyor’s license for six months, with said suspension being stayed based upon his compliance with all other terms of the Consent Order; and to the publication of the Consent Order on the Board’s website, the printing of a summary of this matter by name in this publication, and the reporting of this matter by name to NCEES.
