This document represents the arrangement on Current Operational Procedures for Boarding
and Inspecting Vessels Suspected of Illicit Traffic in Narcotic Drugs and Psychotropic
Substances between the Peruvian National Maritime Authority (Peruvian Coast Guard

The United States of America and the Republic of Peru are parties to the United Nations
Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances (hereafter,
the 1988 Convention). As reflected in Article 17(9) of the 1988 Convention, bilateral
agreements or operational arrangements can be arranged to carry out, or to enhance the
effectiveness of, cooperation between Parties to the 1988 Convention to suppress illicit
traffic by sea.
When a United States Coast Guard or Naval vessel or aircraft detects a vessel displaying or
claiming Peruvian nationality or registry and such vessel behaves suspiciously or information
is received about it being engaged in illicit trafficking, it is the Participants' intent that such
United States Coast Guard or Naval vessel or aircraft report the detection of the suspect
vessel to the headquarters of the Eleventh U.S. Coast Guard District.
- The Participants intend that the Commander of the Eleventh U.S. Coast Guard
District send a fax to the Peruvian Coast Guard General Director through the numbers
and/or e-mail addresses set forth as a result of signing these procedures, requesting
confirmation of the registration of the suspect vessel using the form provided in Annex 1.
- The Participants intend that the Peruvian Coast Guard General Director respond
to the request for confirmation of vessel registry using the form attached hereto as Annex 2
by faxing the completed form to the contact point of the Eleventh U.S. Coast Guard District
set forth as a result of signing these procedures.
- If the vessel registration is confirmed, the Participants intend that the
representative of the Eleventh U.S. Coast Guard District submit the form attached hereto as
Annex 3 to request authorization to board and inspect the vessel and, if evidence of illicit
trafficking is discovered, detain the suspect vessel and persons on board. The Participants
intend that the representative of the Eleventh U.S. Coast Guard District include all available
information regarding the basis for suspecting the subject vessel of being engaged in illicit
trafficking in the form attached as Annex 3.
- Upon receipt of the form in Annex 3, the Participants intend that the Peruvian
Coast Guard General Director may grant the authorization for United States Coast Guard to
board and inspect the vessel with the form attached as Annex 4. It is the Participants' intent
that responses to any requests submitted via the form attached as Annex 3 be submitted not
later than 2 hours following receipt of the request.
- The Participants intend that the Commander of the Eleventh U.S. Coast Guard
District report the final results of the boarding to the Peruvian Coast Guard General Director
via the form attached as Annex 5.
- The Participants intend that all unforeseen situations under these Procedures
should be resolved in accordance with the 1988 Convention and international law. The
Participants intend these Procedures to be available upon signature by both Participants.
Either Participant may, however, suspend or cease cooperation under these Procedures
unilaterally at any time, and should endeavor to provide written notification to the other
Participant six months in advance.
Nothing in these Procedures is intended to create binding obligations under national or
international law.

El presente documento representa el acuerdo sobre Procedimientos Operatives Actuates
para la abordaje e inspection de Embarcaciones Sospechosas de Trafico llfcito de
Estupefacientes y Sustancias Sicotrdpicas entre la Autoridad Maritima Nacional (Direccidn
General de Capitanias y Guardacostas del Peru) y el Guardacostas de los Estados Unidos
(en adelante, los Participantes).
Los Estados Unidos de America y la Repiiblica del Peru son partes firmantes de la
Convention de las Naciones Unidas contra el Trafico Ilicito de Estupefacientes y Sustancias
Sicotropicas (en adelante, la Convention de 1988). Segun lo estipulado en el articuio 17(9)
de la Convencidn de 1988, se puede llegara acuerdos bilaterales y disposiciones operativas
para llevar a cabo o perfeccionar la efectividad de cooperation entre las partes firmantes de
la Convencion de 1988 para eliminar el trafico ilicito por mar.
Cuando una nave o aeronave del Guardacostas de los Estados Unidos detecte una
embarcacion que muestre o afirme ser de nacionalidad peruana o tenga registro peruano y
dicha embarcacidn demuestre conductas sospechosas o se reciba informacion de estar
involucrada en trafico ilicito, los Participantes determinan que la nave o aeronave del
Guardacostas de los Estados Unidos informe la detection de la embarcacidn sospechosa a
la oficina central del Distrito Once del Guardacostas de los Estados Unidos.
- Los participantes determinan que el Comandante del Distrito Once del
Guardacostas de los Estados Unidos enviara un fax al Director General de Capitanias y
Guardacostas del Peru a traves de los numeros y/o correos electrdnicos determinados
como resultado de la firma de estos Procedimientos, solicitando informacion de registro de
la embarcacidn sospechosa y utilizando el formulario proporcionado en el Anexo 1.
- Los participantes determinan que el Director General de Capitanias y
Guardacostas del Peru respondera la solicitud de confirmation de registro de embarcacidn
utilizando el formulario del Anexo 2 adjunto al presente, y enviara el formulario llenado vfa
fax al punto de contacto del Distrito Once del Guardacostas de los Estados Unidos,
determinado como resultado de la firma de estos Procedimientos.
- De confimnarse que la embarcacion se encuentra registrada, los Participantes
determinan que el representante del Distrito Once del Guardacostas de los Estados Unidos

presente el formulario adjunto como Anexo 3 a efecto de solicitar autorizacion de abordaje e
inspeccidn de la embarcacidn y, de encontrarse evidencia de trafico ilicito, detener la
embarcacidn y a las personas sospechosas que se encuentren a bordo. Los Participantes
determinan que el representante del Distrito Once del Guardacostas de los Estados Unidos
incluya en el formulario adjunto como Anexo 3 toda la informacion disponible sobre los
motives que hacen sospechar que dicha embarcacion este involucrada en trafico ilicito.
- Una vez recibido el formulario del Anexo 3, los Participantes determinan que el
Director General de Capitanias y Guardacostas del Peru podra otorgar la autorizacion para
que el Guardacostas de los Estados Unidos de abordaje e inspection de la embarcacidn
con el formulario adjunto como Anexo 4. Los Participantes establecen que las respuestas a
cualquier solicitud presentada mediante el formato adjunto como Anexo 3 seran remitidas a
mas tardar 2 horas despues de su reception.
- Los participantes determinan que el Comandante del Distrito Once del
Guardacostas de los Estados Unidos informe los resultados finales de la abordaje presente
presentada mediante el formato adjunto como Anexo 5 al Director General de Capitanias y
Guardacostas del Peru.
- Los Participantes determinan que todas las situaciones imprevistas segun estos
Procedimientos deberan ser resueltas conforme a la Convention de 1988 y al derecho
international. Los Participantes declaran que estos Procedimientos cobran vigencia a
partir de la firma de ambos Participantes. No obstante, cualquiera de los Participantes
podra suspender o cesar la cooperacidn segun estos Procedimientos de manera unilateral
en cualquier momento, y procurara notificar por escrito al otro participate con seis meses
de antelacidn.
Nada en estos Procedimientos tiene el proposito de crear obligaciones legates en relation
con las legislaciones nacional e international.

La intervention debe llevarla a cabo una embarcacion o aeronave oficial que se
encuentre en servicio para el Gobierno de los Estados Unidos. Solo se puede hacer
uso de la fuerza si no existe otra manera de resolver la situation, y dicha fuerza
debe ser proportional al proposito para el que se la usa y debe ser limitada a la
minima cantidad razonable necesaria bajo las circunstancias en cuestion. Cualquier
uso de fuerza debe ser precedido de la advertencia correspondiente, a menos que
sea en defensa personal, y en cumplimiento de las normas y practices aceptadas
internacionalmente;
• The interdiction must be carried out by an official vessel or aircraft in the service of
the United States Government. Force may be used only if there is no other way to
resolve the situation, and such force must be proportionate to the purposes for which
it is used and limited to the minimum amount reasonably necessary under the
circumstances in question. Any use of force must be preceded by the appropriate
warning, unless it is used in self-defense, and under internationally accepted nonvs
and practices;
• El Guardacostas de los Estados Unidos tiene la intention de proporcionar recurso en
forma efectiva y oportuna por cualquier dario o perdida que pudiera causar como
resultado de esta operation de intervencidn, ya sea a las personas, la embarcacion
o la propiedad a bordo;
• The United States Coast Guard intends to provide effective and timely recourse in
respect of any claims for damage or loss that it may cause, as a result of the
interdiction operation, to any persons, to the vessel, or to the property on board;
• El Guardacostas de los Estados Unidos tiene la intention de proporcionar a la
Direction General de Capitanias y Guardacostas del Peru informes periodicos
actualizados de la operation de intervention mientras esta se este llevando a cabo,
asi como los resultados de la misma;
• The United States Coast Guard intends to provide the Peruvian Coast Guard
General Director with regular updates throughout the interdiction operation and of its
results;
• Teniendo en cuenta que la operation se esta llevando a cabo bajo jurisdiction
peruana y sus leyes aplicables, si se prueba la participation en el trafico ilicito de
drogas, la tripulacion, los pasajeros, la embarcacion, la propiedad a bordo, cualquier
tipo de droga, evidencia y otras pruebas que se encuentren deben, una vez que se
haya completado la intervention, entregarse en su totalidad a las autoridades
peruanas correspondientes en el lugar establecido por esta Autoridad segun
coordination previa. Los Estados Unidos pueden solicitar una muestra
representativa de cualquier droga de contrabando con propositos de investigation.
0 Bearing in mind that the operation is carried out in accordance with Peruvian
jurisdiction and applicable law, if their involvement in illicit drug trafficking is
confirmed, the crew and passengers, the vessel, the property on board, any drugs,
items of evidence and other proof found must, once the interdiction is completed, be
turned over in their entirety to the appropriate Peruvian authorities at the location
established by this Authority on the basis of prior coordination. The United States
may request a representative sample of any drug contraband for investigation
purposes.
