GETTING OFF THE MARK

Cricket is a national sport that connects the people of India in a

unique way The !oard of Control for Cricket in India "#!CCI$% which

ad&inisters the 'a&e in the nation( howe)er( continues to *e &ired in

one contro)ersy after another These include serious inaction re'ardin'

*ettin' and &atch+fi,in'( frequent a&end&ents to the rules to ena*le

persons in power to perpetuate their control and pro&ote their financial

interests( per&ittin' or ena*lin' its office *earers( e&ployees and

players to do acts which clearly 'i)e rise to conflicts of interest which

ha)e no resolution &echanis&( lack of transparency and accounta*ility(

failure to pro)ide effecti)e 'rie)ance redressal &echanis&s and a 'eneral

apathy towards wron'doin' In addition( althou'h the !CCI dischar'es

pu*lic functions( its workin' is percei)ed as a closed door and *ack+roo&

affair( not accounta*le to those who are affected *y its decisions nor to

those who &atter &ost - the cricket fans

.t stake therefore are the faith( lo)e and passion for the 'a&e of

hundreds of &illions of people

The task at hand

The Supre&e Court has left us in no dou*t a*out its 'ra)e concern

a*out the place at which Indian cricket finds itself today The /cloud o)er

the workin' of the !CCI0 has left followers of the 'a&e /worried and

deeply suspicious a*out what 'oes on in the na&e of the 'a&e0 says the

Court( *efore indicatin' the way forward for a sport that is not only a

passion *ut a 'reat unifyin' force( *y adoptin' a /1ero tolerance

approach0( which can alone satisfy the cry for cleansin' It cannot also 'o

unnoticed that while re+e&phasi1in' that !CCI dischar'es pu*lic

functions( the Court has referred to the tacit concurrence and support of

the Central and State 2o)ern&ents in acti)ities which create a &onopoly

o)er cricket

The Supre&e Court appointed Co&&ittee co&prisin' of 3ustice

RM4odha( for&er Chief 3ustice of India( 3ustice .shok !han( for&er

3ud'e of the Supre&e Court and 3ustice R5Ra)eendran( for&er 3ud'e

of the Supre&e Court was &andated inter alia to e,a&ine and &ake

suita*le reco&&endations to the !CCI for refor&s in its practices and

procedures and necessary a&end&ents in the Me&orandu& of

.ssociation and Rules 6 Re'ulations on the &atters set out in Para'raph

789 of the :ud'&ent dated ;;nd 3anuary ;87<7 The Co&&ittee appointed

the President of the !CCI

The task assi'ned to the Co&&ittee is clear= reco&&end those

chan'es in the Rules and Re'ulations of !CCI that will further the

interest of the pu*lic at lar'e in the sport of cricket( i&pro)e the ethical

standards and discipline in the 'a&e( strea&line and create efficiency in

the &ana'e&ent of the !CCI( pro)ide accessi*ility and transparency(

pre)ent conflicts of interest situations and eradicate political and

co&&ercial interference and a*use and create &echanis&s for

resolution of disputes and 'rie)ances .s the Supre&e Court has

reiterated that the !CCI is carryin' out pu*lic functions - functions that

'o)ern the interests of the pu*lic - the necessary corollary is that !CCI is

su*:ect to the ri'ours of pu*lic law This would &andate that it acts in

line with the 'eneral principles of reasona*leness and fairness( and also

that it adheres to the *asic principles of accounta*ility and transparency

In carryin' out the assi'ned task( the Co&&ittee took the followin'

those the Co&&ittee interacted with( were ea'er that the 'a&e of cricket

*e 'o)erned and ad&inistered confor&in' to the hi'hest standards of

&ana'e&ent( ethics( accounta*ility and transparency worthy of the

'a&e( and that efficient decision &akin' process should *e

institutionalised Se)eral others declined to interact with the Co&&ittee

due to prior confidentiality o*li'ations to the !CCI The interactions(

responses to questionnaire and Co&&itteeJs research relatin' to sports

syste&s in 'eneral and cricket in particular( ha)e ena*led the Co&&ittee

to identify the pro*le& areas in the functionin' of !CCI

The B Me&*er Pro*e Co&&ittee headed *y 3ustice Mukul Mud'al

earlier entrusted with the task of e,a&inin' the alle'ations of *ettin'

and spot fi,in'( in their Report dated 9;;87@ su*&itted to the Supre&e

Court( &ade se)eral reco&&endations to pre)ent and to effecti)ely deal

with *ettin' and &atch>spot+fi,in' This Co&&ittee has carefully

considered the said reco&&endations and( where)er found accepta*le

and feasi*le( incorporated the& in this Report The reco&&endations of

the 3ustice Mud'al Pro*e Co&&ittee are at Appendix-" to this Report

It *eca&e clear that &any ills had *eco&e ende&ic due to the

apathy or in)ol)e&ent of those who were at the hel& of the !oard$s

ad&inistrationK that &any of these were hi'h functionaries in the Central

and State 2o)ern&ents further co&pounded the pro*le&( as did the fact

that se)eral incu&*ents had re&ained in char'e of State associations for

se)eral decades Many officials of the )arious State .ssociations hold

power without adherin' to the *asic principles of accounta*ility and

transparency *y con)ertin' the& into re'ional fiefdo&s Unfortunately(

the &ana'e&ent of other Indian sports *odies re)eals the sa&e sorry

trend

The Co&&ittee also found inequities writ lar'e at the hi'h ta*le(

with so&e States o)er+represented in )otes( tourna&ent participation

and central fundin' while others ha)e to wait in the win's for indefinite

periods until fa)oured Policies ha)e *een for&ulated and altered to suit

the needs of a few powerful indi)iduals( and coteries ha)e for&ed around

the& which has polari1ed and co&pro&ised independent leadership

.l&ost without e,ception( those who ha)e no such a'endas ha)e

re&ained quiet( their silence e&*oldenin' further &alfeasance In the

&ind of the cricketin' pu*lic( they are as &uch to *la&e

Close o*ser)ers of the 'a&e ha)e infor&ed the Co&&ittee how the

pu*lic 'ets only a s&all percenta'e of seats in &atches and how the 5IP

culture has o)ertaken a no*le pasti&e The con)enience of the )iewers in

the stadiu& 'enerally( and wo&en( children and differently a*led in

particular( are not catered to There is neither access to quality food and

water at a reasona*le price( nor adequate washroo& facilities are &ade

a)aila*le E)en in re'ard to tele)ision ri'hts( the atte&pt has *een to

&a,i&ise re)enue *y insertin' ad)ertise&ents at crucial parts of the

'a&e( and to &u11le dissentin' )oices at all le)els

Surprisin'ly( the players who are the sport$s *i''est draw are not

spared fro& the apathy of the !CCI They are treated less like assets and

&ore as the e&ployees and su*ordinates of those 'o)ernin' the 'a&e

The Co&&ittee has *een infor&ed that often( the players are left to

deter&ine the acco&&odation and transport arran'e&ents for their

fa&ilies( that requisitions for 'enuine pay&ents are not cleared and

delayed( and that counsellors and nutritionists are not included in the

support staff In the affairs of the sport that they are the dri)ers of( they

ha)e no )oice and no independence

The IP4 has o*)iously *een the &ost )isi*le( re&unerati)e and

'la&ouri1ed co&ponent of cricket in India o)er the last years( *ut with

*i' &oney and attention( there has not *een the necessary caution to

protect the sport and its players fro& the or'y of e,cess that quickly

*e'an to en)elope the e)ent .s e)ents unfolded o)er the last few years(

it was clear that unsa)oury interferences had reached the hi'hest

echelons of cricket and o)erlappin' and conflictin' interests were not

only condoned( *ut those in 'o)ernance of the !oard had &ade e,+post

facto a&end&ents to facilitate the sa&e .s persons in 'o)ernance

interfered with the &ana'e&ent of the 'a&e and the rest re&ained &ute

spectators( 'enerations of players ha)e *een forced to *uckle( &i'rate or

worse( 'i)e up

Le hasten to add a word of caution lest there *e a ne'ati)e

i&pression created a*out the !CCI Furin' our interactions( one fact

that e&er'ed unifor&ly concerned the way the &anpower of the !CCI

or'ani1es the actual 'a&e and its co&petitions across the country The

or'anisation has still &ana'ed to har)est talent and ensure that the

national tea&s perfor& re&arka*ly on the world sta'e Talented players

fro& )irtually any corner of this )ast nation are in a position to co&pete

and reach the hi'hest le)els( e)en if they co&e fro& relati)ely &odest

*ack'rounds Recent years ha)e *orne e)idence with India winnin' the

Lorld Cup in T+;8 and One Fay Internationals( while also reachin' the

top of the Test rankin's

The !CCI staff &e&*ers ha)e ensured that hundreds of &atches

alon' with &atch officials are or'ani1ed annually at all le)els( and that

updates are pro)ided so that the !CCI re&ains fully infor&ed The

&ana'e&ent of the 'a&e is also self+sufficient without any 'o)ern&ental

'rants Le notice the !CCI also conducts charity &atches for national

causes and hu&anitarian assistance is also 'i)en to the for&er cricketers

and their fa&ilies

The Co&&ittee has therefore consciously ensured that no

&easures are reco&&ended that would interfere or li&it the 'ood work

*ein' done on *ehalf of the !CCI

Inte#a$ti%ns &ith the '((Iro& the outset( the Co&&ittee has reached out to the

ad&inistration of the !CCI to offer its co&&ents and inter)entions on

the issues that were *ein' considered Meetin's were arran'ed with all

the office+*earers( and fro& the first week of .pril( the Auestionnaire

was sent to all of the& The then President Mr3a'&ohan Fal&iya and

Secretary Mr.nura' Thakur e)en sent identical responses to it Le are

'lad to note that ha)in' o*tained a *road picture fro& the Auestionnaire

a*out how the Co&&ittee intended to proceed( !CCI started takin'

so&e action( or at least &ade so&e announce&ents touchin' upon the

contents of the questions These include state&ents concernin'

co&&ittees to represent States where associations were in dispute or not

for&ed An7?N( a'ent accreditation Ans?78 6 ?7BN and conflict of

interest Ans7 - BN Unfortunately( a closer e,a&ination shows that

these &easures ca&e without any structural &odifications( and were

done &ore in an effort to assua'e the pu*licOn the B8th of Septe&*er ;87<( the Co&&ittee interacted in ew

Felhi with MrShashank Manohar( who had *een the President of the

!CCI when a&end&ents were carried out to per&it a conflict of interest(

which action was e)entually quashed *y the Hon$*le Supre&e Court On

the day of the &eetin'( MrManohar was widely tipped to *e the

consensus candidate to a'ain *e the President of the !CCI in elections to

*e held on the weekend Furin' the e,tensi)e discussions( the

Co&&ittee put to MrManohar the )arious concerns hi'hli'hted in the

Auestionnaire( particularly re'ardin' the wide+ran'in' powers of the

President( the lack of financial o)ersi'ht o)er State *odies( the lack of

transparency as far as !CCI re'ulations and processes were concerned(

the lack of a Conflict of Interest policy and the need for an O&*uds&an

MrManohar fairly conceded that these needed to *e addressed Le are

a'ain happy to note that that on *ein' elected as President of !CCI

within @ days thereafter( MrManohar( e)en without waitin' for the

Co&&ittee$s report( adopted and pro:ected the Co&&ittee$s )iews as his

road&ap for i&pro)in' the functionin' of the !CCI He also

i&ple&ented so&e of the&( ie uploadin' of the Constitution and !ye+

4aws on the !CCI we*site( creatin' a policy for Conflicts of Interest and

appoint&ent of an O&*uds&an Lhile we *elie)e that these proposals

are in the ri'ht direction( we find that they are not co&prehensi)e and

su*stanti)eThe need of the hour is not cos&etic *ut funda&ental chan'e(

which will lay the proper foundations on which the !CCI can function in

a professional and transparent &anner and will *rin' the 'a&e of cricket

*ack to its pristine for& and restore the confidence of the people It is

precisely this that the Co&&ittee has proposed

Le understand that the cricket fan is e&otionally wedded to the

'a&e( and is willin' to sacrifice &uch for a &ere taste of what cricket has

to offer The Indian fan( youn' or old( fit or differently a*led( deser)es

*etter fro& the richest cricket *ody in the world( *oth in ter&s of access

and ad&inistration Lhile &assi)e funds flow into the coffers of the

!CCI and the IP4 throu'h the sale of tele)ision and &edia ri'hts and

sponsorship deals( little co&&ensurate ad)anta'e finds its way to the

&e&*ers of pu*lic who stand in snakin' lon' queues( often una*le to

o*tain tickets( and if lucky( to stu&*le into stadia without access to *asic

a&enities This trustin' soul *elie)es in the purity of the 'a&e and his

passion dri)es his faith that all aspects of cricket are ethical and clean

The fact that forces fro& politics and *usiness see cricket ad&inistration

as a steppin' stone to reco'nition and pu*licity is irrele)ant to the

cricket fan( until he reali1es( as &any e&*ittered souls recently ha)e(

that the 'a&e is not really *ein' played on the cricket pitch The

Co&&ittee has therefore approached each issue( keepin' in )iew the

directions and o*ser)ations of the Supre&e Court and atte&pted to find

the solutions *y applyin' two tests + /Lhether this will *enefit the 'a&e

of cricket0 and /Lhat does the Indian cricket fan want0

In an effort to &ake this Report as reada*le as possi*le( the

Co&&ittee has shorn it of le'al :ar'on and unnecessary details Le ha)e

also sou'ht to &aintain the confidentiality reposed in us fro& )arious

quarters *y not referrin' to indi)iduals or institutions which ha)e shared

infor&ation or su''estions with us( and li&ited the contents of this

report to the *are &ini&u& so that the Model Me&orandu& of

.ssociation and Re'ulations &ay speak for the&sel)es alon' with the

Codes set out in the .nne,ures

.t a ti&e when the nation$s hi'hest court has *een co&pelled to

find that the 'a&e has fallen into disrepute( only e,traordinary steps will

*rin' it *ack fro& this chas& Le are conscious that so&e of our

proposals &ay e)oke )aried responses( *ut the collecti)e conscience of

this Co&&ittee is clear that tou'h &easures are called for to restore

Indian cricket to its pinnacle of 'lory Indi)idual interest will ha)e to *e

sacrificed for the sake of the institution( and no e,i'ency of con)enience

or con)ention shall stand in the way of a whole scale structural o)erhaul

The current 'o)ernance structure of the !CCI and its Me&*er

.ssociations is far fro& satisfactory and it needs to *e suita*ly

restructured Strict ter&s and tenures ha)e to *e i&posed on

ad&inistrators( o)ersi'ht and audit of &e&*er associations need to *e

carried out( professional &ana'e&ent deser)es to *e introduced in the

ad&inistration of the 'a&e( all States require an equal say in the affairs

of the !CCI( financial prudence has to *e e,ercised( independent )iews

in 2o)ernance are i&perati)e and cricketers ha)e to *e protected and

'i)en a free hand in cricketin' affairs There also ou'ht to *e an

O&*uds&an( an Ethics Officer and an Electoral Officer who can pro)ide

institutional resolution while principles of transparency and conflict of

interest need to *e infused without further delay

The report that follows is the Co&&itteeJs effort to restore Indian

cricket to its deser)ed status *y puttin' in place 'ood 'o)ernance

structures and *est practices

It was nearly ;88 years after the !ritish first *rou'ht cricket to

India that its 'o)ernin' *ody was created .t a ti&e of co&&unal

2y&khanas and the occasional tourin' tea& fro& En'land( the princely

fa&ilies and other cricket patrons ca&e to'ether to create the !oard of

Control for Cricket in India( which was re'istered as a not+for+profit

society in Madras "now Chennai% The !CCI has 'rown fro& its ori'inal

co&position of less than half a do1en pro)incial &e&*ers to ha)e fi)e

ti&es that nu&*er representin' )arious 'roups and territorial di)isions

The Structure

The !CCI at the &o&ent consists of B8 ull Me&*ers so&e of

who& do not field tea&s( while others do not represent any territory

Twenty States and one Union Territory are included and ten States and

si, Union Territories re&ain either e,cluded or disenfranchised In

addition( officially there are .ssociate and .ffiliate Me&*ers as well as

so+called uture Me&*ers

The Ser)ices Sports Control !oard( the Railways Sport Pro&otion

!oard and .ll India Uni)ersities represent particular national ser)ice

'roups( who traditionally constituted the lar'est e&ployers of Indian

sports&en *efore the ad)ent of li*eral pri)ate enterprise .part fro&

these( two Clu*s - the Cricket Clu* of India at Mu&*ai and the ational

Cricket Clu* at Dolkata also en:oy full &e&*ership of the !CCI

Problems

.n e,a&ination of the e,istin' structure re)ealed the followin'

a ot all States are represented on the !CCIOne old State "!ihar% and two new states "Chhattis'arh and

Uttarakhand% and si, orth+Eastern States "Sikki&( Manipur(

Me'halaya( a'aland( .runachal Pradesh and Mi1ora&% are

unrepresented on the !oard Of course( the &ost si'nificant

o&ission was !ihar( which( *ein' the third &ost populous State in

the nation required the cricket representati)es of its 788 &illion

populace to &i'rate to other States to ply their trade .part fro&

Tripura( the other si, sister+States of the north+east had *een

rele'ated to )arious cate'ories of &e&*ership ".ssociate( .ffiliate

and uture% which really ha)e no )oice on the !oard

* So&e States are o)er+representedMainly attri*uta*le to their historic le'acy( *oth Maharashtra and

fact( *y )irtue of CCI *ein' 'ranted full &e&*ership( Maharashtra

has 'arnered as &any as four out of the total B8 )otes on the

!oard

e Union Territories are unrepresented on the !oardE,cept for Felhi which en:oys a special position under the

Constitution as well( none of the other si, Union Territories are

ull Me&*ers of the !CCI In fact( there ha)e *een repeated

representations *y the Cricket .ssociation of Pondicherry that :ust

as Felhi( it is also a Union Territory with a Chief Minister and

ou'ht to *e &ade a ull Me&*er This issue is sub judice *efore the

Madras Hi'h Court *ut nonetheless( there see&s that so&e

artificial distinction e,ists in the e,tant rules *etween Felhi and

Puducherry

that the State is a fair unit of representation on the !CCI On a

not proper for only one or two States to ha)e &ultiple &e&*ers when all

Lhile there are se)en Union Territories( it was found that only

Felhi and Puducherry ha)e a Chief Minister and are treated as

is the fact that Felhi( apart fro& *ein' the national capital( is also a

the population of Puducherry There &ay thus *e so&e &erit for

Puducherry not i&&ediately *ein' included as a ull Me&*er( especially

when the issue is sub judice .&on' the Union Territories( it would

howe)er *e appropriate for Puducherry to *e now inducted *y the !CCI

as an .ssociate Me&*er which will retain ri'hts to field a tea& and

co&pete

effect on how the Gones are constituted The Gones would consist of

Me&*ers in such a &anner that each of the& would *e reasona*ly

Council "with a special and separate 'o)ernin' *ody for IP4( known as

indi)iduals in positions of trust( ad:udication and 'o)ernance &ust

has *een an underpinnin' of all 'o)ernance in the ci)ili1ed world In the

courts( an oft+quoted precept is /:ustice &ust not only *e done( *ut &ust

also *e seen to *e done0 Howe)er( the last few years of 'o)ernance at the

!CCI has re)ealed that there is( at *est( an e,tre&ely casual

understandin' of the concept of Conflict of Interest

In our interactions with )arious stakeholders( it *eca&e apparent

that the understandin' of the concept of Conflict of Interest *y a Player

or Official is )ery different fro& that of a le'al professional who is

attuned to conflict &echanis&s and their a)oidance on a daily *asis

Se)eral cricketers of i&pecca*le repute were surprised when queried

a*out what were o*)iously potential conflict situations( needin' to *e

con)inced that no wron'doin' was necessary for a conflict to e,ist The

Co&&ittee had to point out to the& that the )ery holdin' of a position

which could *e a*used to under&ine the inte'rity of the 'a&e renders

the occupant )ulnera*le to such a char'e

Furin' the course of the last few &onths( the Co&&ittee has co&e

to learn of se)eral instances of o*)ious conflict where contracts ha)e

*een entered into *y the !CCI( where the contractor or )endor includes

fa&ily &e&*ers of an Office !earer The fact that there was no )oluntary

disclosure &akes &atters worse( raisin' a presu&ption of wron'doin'

and su*terfu'e a'ainst the indi)iduals in question

Understanda*ly( &uch of this is left to the su*:ecti)e assess&ent of

the person concerned In consonance with the practice internationally(

either undertakin's or declarations are furnished as so&e for& of

inde&nity( or in &ore o*)ious situations( sanctions are i&posed !efore

the IP4( it could well ha)e *een ar'ued that the !CCI felt no cause to

take steps in this re'ard( *ut with its ad)ent( the conduct of the !CCI has

*een to acco&&odate the conflict rather than to pre)ent it

Unfortunately( &atters needed to reach the hi'hest court of the land

*efore the !CCI decided to take tentati)e steps towards settin' its house

in order

The seriousness of conflict of interest affectin' sport cannot *e

underesti&ated Lhile it &ay see& surprisin' to the indi)idual

ad&inistrator or player that their position could *e capa*le of such an

interpretation( it is out of a*undant caution in the interests of the game(

that its re'ulation is &andated In &ost( if not all cases( there is no

concern that the occupation of a particular post should not allow

reasona*le presu&ptions or inferences to *e drawn a*out the

ICC( IH and .C that are considered in the appendi, to this Report

would show that conflict of interest issues are central to the re'ulation of

ethical conduct in sport This is why the ad&inistration of these

principles is coupled with the appoint&ent of a responsi*le and

independent indi)idual who assists the or'anisation in the

ad&inistration of the policy

E)en as this report is *ein' prepared( two further IP4 franchises

ha)e *een added( and questions re'ardin' conflict of interest are raised(

which cannot *e satisfactorily addressed *y the policy in place

The Co&&ittee has therefore spelt out specific types of Conflict of

Interest( and applied the& to indi)iduals e&ployed with( or connected to

the !CCI E)ery Office !earer( Player( Councillor( E&ployee(

.d&inistrator( Tea& Official( U&pire or other person connected to the

!CCI( its Me&*ers or the IP4 and its ranchisees is &andated to a)oid

any act or o&ission which is( or is percei)ed to *e( likely to *rin' the

.s the 'enesis of this Co&&ittee has shown( there are se)eral disputes

that e,ist within the !CCI( *orn out of years of apathy in 'o)ernance and

'ross &is&ana'e&ent The co&pact entered into *etween the State

.ssociations on the one hand and the !CCI on the other has rarely *een

equita*le and *alanced( with the latter e,ercisin' its he'e&ony o)er the

constituents The Co&&ittee feels that as with any quasi+federal

structure( the relationship &ust *e carefully &oderated in an o*:ecti)e

&anner Thus far( it is the !oard that has *een e,ercisin' this function(

i&&ediately *eco&in' a :ud'e in its own cause The fact that certain

associations ha)e *een reco'ni1ed as the le'iti&ate representati)es of

their States has led to dis'runtle&ent and liti'ation( not least fro&

!ihar Ra:asthan tells a different tale( with the election of an apparently

unpalata*le fi'ure &akin' the entire association( and thus the State(

dis'ust of the players who are used as pawns in the political 'a&e

Such instances are &ere illustrations of a lar'er &alaise - the

a*sence of a suita*le dispute resolution process E)en an ar*itration

syste& as hitherto e,isted is insufficient( and palpa*ly inappropriate as it

often pitted two unequals a'ainst each other( with the State association

*eholden to the !oard for &atches( 'rants and re)enues The challen'es

under the auspices of the .r*itration 6 Conciliation .ct( 799? ine)ita*ly

dra''ed on in the courts with an ad)ersarial process and its attendant

*itterness( when an independent entity was the ideal option

In order to reduce the :udicial role and the *urdenin' of the courts

and to e,pedite dispute resolution( the Co&&ittee therefore

reco&&ends the appoint&ent of a retired :ud'e of the Supre&e Court or

a for&er Chief 3ustice of a Hi'h Court as the O&*uds&an of the !CCI(

to *e appointed once a year at the .nnual 2eneral Meetin' This

O&*uds&an shall( either on a reference *y the .pe, Council or on a

co&plaint *y a Me&*er>ranchisee>Gone>Players$ .ssociation> Player>

Tea& Official> .d&inistrator or suo motu "on its own%( in)esti'ate and

resol)e any dispute *etween the !oard and any of the a*o)e entities or

The &onitorin' of the principles of Conflict of Interest alon' with

the Code of !eha)iour of the !CCI and any other such rules shall *e done

*y an Ethics Officer His powers include the layin' down of additional

'uidelines or *ye+laws on ethics( the initiation of in)esti'ation or

ad:udicatory proceedin's and the award of warnin's( fines( repri&ands(

suspensions or other action as &ay *e reco&&ended to the !CCI

In addition( the !CCI and the IP4 ha)e codes of conduct and

*eha)iour for .d&inistrators( Tea& Officials( U&pires and Players *oth

on and off the field( includin' in relation to &atch fi,in'( *ettin'( non+

reportin' of suspicious approaches( dopin'( etc The approach of the

!CCI in recent years in ad&inisterin' these Codes has not *een

encoura'in'( especially when powerful fi'ures in the sport were

in)ol)ed

dealin' with IP4 in Chapter @

.s far as all non+IP4 ethics issues are concerned( the sa&e shall *e

ad&inistered and ad:udicated *y the Ethics Officer who shall *e a for&er

3ustice of a Hi'h Court to *e appointed *y the !oard

The ull Me&*er associations shall also adopt and o*ser)e all the a*o)e

ethical principles includin' those concernin' Conflict of Interest They

shall also appoint an Ethics Officer( *ut howe)er( dependin' on

workload and e,pediency( the O&*uds&an to *e appointed &ay also

dischar'e the functions of an Ethics Officer in an association

.dditionally( &ultiple States &ay ha)e a co&&on Ethics Officer for the

sake of con)enience and econo&y

:.3 The Ee$t%#a O77i$e#

The e,perience of se)eral elections at the !CCI has shown that while the

'o)ernin' law needs to *e seriously re)isited( it is not sufficient for the

process of elections to *e internally &onitored Especially with the

)arious disqualifications fro& holdin' office laid down a*o)e( there are

*ound to *e questions raised ri'ht fro& the )ery inception of the election

process

The Co&&ittee is of the )iew that whene)er elections are to *e

held( an independent authority needs to *e )ested with the powers of

scrutini1in' no&inations and clearin' the&( of drawin' up and )erifyin'

the electoral roll after identifyin' appropriate representati)es of the ull

Me&*ers( of ensurin' that no candidate falls foul of the Rules( and for

declaration of results The Electoral Officer will also *e responsi*le for

conductin' elections to the Co&&ittees under the Rules In order to

ensure co&petence and to distance the entity fro& any suspicion or *ias(

the Co&&ittee is of the )iew that a for&er Election Co&&issioner for

India *e appointed as the Electoral Officer for the !CCI( and that his or

her decision would *e final and conclusi)e

the Co&&ittee stated that )ery little of the functionin' of the !CCI is

done in a fair and transparent &anner and that those who seek 'reater

infor&ation are either re*uffed *y the !oard or won o)er *y

entice&ents Those whose professional li)elihoods depend on cricket

acknowled'e the !CCI$s total sway o)er the sport( and choose to re&ain

silent rather than upset the apple cart

E)en in re'ard to cricket co&&entary( 'a&es or'ani1ed *y the

!CCI ha)e a contractual condition that there can *e no criticis& of the

!CCI or its selection process( there*y curtailin' an e,ercise of free

speech O*:ecti)e co&&entary ou'ht to *e per&itted a*out e)erythin'

connected to the &atch( allowin' the co&&entators to e,press

the&sel)es freely and o*:ecti)ely

interruptin' the full and proper *roadcast of the 'a&e Re'ardless of the

wicket that has fallen( century ha)in' *een hit or other &o&entous

e)ent( full li*erty is 'ranted to &a,i&ise the *roadcaster$s inco&e *y

cuttin' away to a co&&ercial( there*y ro**in' sport of its &ost

attracti)e attri*ute - e&otion It is reco&&ended that all e,istin'

contracts for international Test 6 One+Fay &atches *e re)ised and new

ones ensure that only *reaks taken *y *oth tea&s for drinks( lunch and

selection and e&panel&ent of professionals in the fields of law( audit(

etc Si&ilarly( e)en as far as infrastructure contracts( &edia

en'a'e&ents( tele)ision ri'hts and equip&ent supply( no nor&s or

procedures e,ist to select or en'a'e contractors in a fair and transparent

&anner

In the li'ht of all this( the Co&&ittee proposes that clear principles

of transparency *e laid down( and the !CCI we*site and office will carry

all rules( re'ulations and office orders of the !CCI( the constitution of the

)arious co&&ittees( their resolutions( the e,penditures under )arious

heads( the reports of the O&*uds&an>.uditor>Electoral Officer>Ethics

Officer and the annual reports and *alance sheets In addition( nor&s

and procedures shall *e laid down for the en'a'e&ent of ser)ice

professionals and contractors( and there shall *e full transparency of all

tenders floated and *ids in)ited *y or on *ehalf of the !CCI The we*site

shall also ha)e links to the )arious stadia with seatin' capacities and

transparent direct ticketin' facilities

The Ri'ht to Infor&ation .ct( ;88< "#RTI .ct$% enacts that pu*lic

authorities shall &ake known the particulars of the facilities a)aila*le to

Ha)in' re'ard to the e&phasis laid *y the Hon$*le Supre&e Court that

!CCI dischar'es pu*lic functions and also the Court$s reference to

indirect appro)al of the Central and State 2o)ern&ents in acti)ities

which has created a &onopoly in the hands of the !CCI o)er cricket( the

Co&&ittee feels that the people of the country ha)e a ri'ht to know the

details a*out the !CCI$s functions and acti)ities It is therefore

reco&&ended that the le'islature &ust seriously consider *rin'in' !CCI

within the pur)iew of the RTI .ct

The Co&&ittee also *elie)es that the .uditor *e tasked not only

with a financial analysis( *ut also specifically carry out a perfor&ance

audit "Co&pliance Report% to deter&ine whether the State associations

ha)e actually e,pended their 'rants towards the de)elop&ent of the

'a&e and &ark the& on a report card which will *e utili1ed to deter&ine

the due they deser)e the followin' year This o)ersi'ht also needs to

consider the hi'h and unreasona*le e,penditures *y the !oard on

)arious heads( which would ha)e to *e li&ited and strea&lined

- that of &atch fi,in' ro& South .frica to Pakistan( instances of

players in)ol)ed in influencin' the outco&e of a 'a&e for profit has

caused se)ere da&a'e to the fa*ric of the 'a&e There ha)e *een

alle'ations in India of such nefarious acti)ities( especially when cricket

&o)ed to Shar:ah( and &ore so after the introduction of the cash+rich

IP4 This is pro*a*ly why the ICC decided to take the lead to check such

&alfeasance and instil a definite re'ulatory code a&on' players and

ad&inistrators alike

There is a funda&ental difference *etween *ettin' and

&atch>spot+fi,in' The latter interferes with the inte'rity of the 'a&e

and atte&pts to chan'e the course of the &atch It is ta&perin' the 'a&e

*y the cricket players to *enefit a few On the other hand( *ettin' is a

Corruption show that the offences are classified under Corruption(

Co&&ittee referred to therein to *e appointed *y a Co&&ittee of the

O&*uds&an( the Ethics Officer and the CEO so that there is so&e

independence in the 'rie)ance redressal process Rele)ant a&end&ents

There was a consistent )iew a&on' respondents to the queries that

&any of the ills *efallin' Indian cricket find their roots in the State

.ssociations and their lack of ad&inistration The root cause for the

pro*le& is that the !CCI is &akin' su*stantial annual 'rants re'ardin'

which there is no o)ersi'ht( and so the status quo re&ained as it was(

with little effort *y the pro)incial ad&inistrators

Therefore( it is necessary that there is unifor&ity in the

constitution and functionin' of the )arious associations "without any

office *ein' created for life%( that &e&*ership of social clu*s *e di)orced

fro& the ad&inistration of cricket which is a so&*re task( that cricketers

*e &ade &e&*ers and ha)e a say in 'o)ernance and that &ana'e&ent

which will *e &arked throu'h a detailed report card There also has to *e

an audit and independent o)ersi'ht of how resources are allocated and

spent It is necessary that all State .ssociations i&&ediately transition to

the use of ta&per+proof accountin' software which either does not

per&it alterations or which records all alterations &ade

The conflicts that arise *y holdin' office *oth at the !CCI and in

the State .ssociations ou'ht to *e *rou'ht to an end *y auto&atic

disqualifications ha)e to *e laid down that apply to those who seek office

accu&ulate sufficient funds necessary for takin' up construction of a

stadiu& The result is so&e s&aller States ha)e neither a stadiu& nor

well de)eloped cricket playin' 'rounds !CCI should therefore

&andated for the constitution of the .pe, Council of the !CCI or for any of

the IP4 as also knowled'e in the fields of le'al( accountin' and *usiness

&ana'e&ent

"c% Clearance Certificate fro& .nti+Corruption and Security Unit ".CSU%= The

applicant &ust su*&it a clearance certificate issued *y the .nti+Corruption

and Security Unit ".CSU% of the International Cricket Council "ICC% which

ensures that strict anti+corruption protocols are followed *y all

stakeholders

"d% o Cri&inal Record= The applicant will *e required to satisfy the co&&ittee

of his 'ood character and reputation( on ter&s that shall *e stipulated *y

the co&&ittee fro& ti&e to ti&e This shall include( *ut not *e li&ited to(

consideration of the .pplicantJs cri&inal record and financial history

"e% Fisclosure State&ent= The applicant shall disclose on his application and

thereafter upon request of the Co&&ittee all infor&ation rele)ant to his or

her qualifications to ser)e as a Player a'ent He>she shall also authori1e the

Co&&ittee to perfor& a *ack'round in)esti'ation

"f% on+refunda*le .pplication fee and .nnual ee= .part fro& the pay&ent of

a non+refunda*le .pplication ee( in order to retain his or her re'istration(

the Player .'ent will ha)e to pay to the !CCI an annual ad&inistrati)e fee

which shall *e deter&ined *y the Co&&ittee

"'% Ma,i&u& a'ent fee= The applicant shall furnish an undertakin' that he

shall char'e no &ore than a &a,i&u& a'ent fee of ; of the total annual
