SUMMARY RECORD OF THE 63 RD MEETING OF STATE LEVEL EXPERT APPRAISAL COMMITTEE, CHHATTISGARH The 63 rd meeting of State Level Expert Appraisal Committee, Chhattisgarh was held on 09/09/2010 at Conference Hall, SEAC, Secretariat, 1-Tilak Nagar, Shiv Mandir Chowk, Main Road, Avanti Vihar, Raipur at 12:00 Noon. Agenda wise discussions were carried out as follows: - Agenda Item No. 1 - Discussion on the proposals submitted for reconsideration. (1) M/s Tandula Water Resources Division (Minor Irrigation Project), Village – Bohardih, Block – Dondi, Tehsil – Dalli Rajhara, District – Durg (C.G.) Executive Engineer, Water Resources Department, Durg has submitted application (Form-I) for grant of environmental clearance/ prescribing Terms of Reference (TOR) for construction of Bohardih Tank on 07/07/2009. The proposal was considered in 39 th , 41 st and 49 th meeting of SEAC, Chhattisgarh held on 22/08/2009, 23/09/2009 and 18/01/2010 respectively. Project proponent made presentation in the 52 nd meeting of SEAC, Chhattisgarh on 30/03/2010. After deliberation, the Committee then decided to ask the project proponent to submit some information/documents. Project proponent was informed accordingly vide letter dated 05/05/10. Project proponent submitted the information/documents vide letter dated 30/06/2010. The information/documents submitted by project proponent were placed in the 63 rd meeting of SEAC Chhattisgarh held on 09/09/10. It is noted that this is a miner irrigation scheme. Location of the project is near Village – Bohardih, Block – Dondi, Tehsil – Dondi, District – Durg (C.G.). Type of catchment is hilly and catchment area is 3.159 sqkm. The 63rd meeting of State Level Expert Appraisal Committee, Chhattisgarh was held on 09/09/2010 at Conference Hall, SEAC, Secretariat, 1-Tilak Nagar, Shiv Mandir Chowk, Main Road, Avanti Vihar, Raipur at 12:00 Noon. Dr. Harendra Kumar, Chairman, SEAC, Chhattisgarh chaired the meeting. The following members of SEAC were present in the meeting: -

At the outset, the Technical Officer, SEAC, Chhattisgarh welcomed the Chairman and Members of State Level Expert Appraisal Committee, Chhattisgarh. Agenda wise discussions were carried out as follows: -

Agenda Item No. 1 - Discussion on the proposals submitted for reconsideration.

(1) M/s Tandula Water Resources Division (Minor Irrigation Project), Village – Bohardih, Block – Dondi, Tehsil – Dalli Rajhara, District – Durg (C.G.)Executive Engineer, Water Resources Department, Durg has submitted application

(Form-I) for grant of environmental clearance/ prescribing Terms of Reference (TOR) for construction of Bohardih Tank on 07/07/2009.

The proposal was considered in 39th, 41st and 49th meeting of SEAC, Chhattisgarh held on 22/08/2009, 23/09/2009 and 18/01/2010 respectively. Project proponent made presentation in the 52nd meeting of SEAC, Chhattisgarh on 30/03/2010. After deliberation, the Committee then decided to ask the project proponent to submit some information/documents. Project proponent was informed accordingly vide letter dated 05/05/10. Project proponent submitted the information/documents vide letter dated 30/06/2010.

The information/documents submitted by project proponent were placed in the 63 rd

meeting of SEAC Chhattisgarh held on 09/09/10.

It is noted that this is a miner irrigation scheme. Location of the project is near Village – Bohardih, Block – Dondi, Tehsil – Dondi, District – Durg (C.G.). Type of catchment is hilly and catchment area is 3.159 sqkm. Gross command area is 368 ha. Culturable command area is 200 ha. Area proposed under irrigation is Kharif 120 ha. One village – Bohardih would be benefited from the scheme. The proposal is for construction of homogenous earthen dam, waste weir and canal system. Estimated cost of the project is Rs. 209.33 lakhs. The details of the project are follows:-

It is noted that cost benefit ratio is 01.23: 01. Total forest land required is 9.87 ha. The forest clearance case has been submitted to forest department. The estimate has been submitted to State Government for occurring of R.A.A. After sanctioning of R.A.A. the construction activities would be restarted. There are no historical and cultural monuments inside the basin. Project proponent has informed that there is no rehabilitation and resettlement. Project proponent informed that 20% of the head works has been completed. Canal work is incomplete.

After discussion, based on the consideration of the documents submitted and the presentation made by the project proponent the Committee decided to consider the project as category B-2 & recommended for grant of Environmental Clearance for the Minor Irrigation Project (construction of homogenous earthen dam, waste weir and canal system) at Village – Bohardih, Block – Dondi, Tehsil – Dalli Rajhara, District – Durg (C.G.) subject to the terms and conditions as per Annexure-I.

As project proponent has started construction works without obtaining environment clearance as per provision of Environment Impact Assessment Notification, 1994/2006, hence, Committee also recommended to take the legal action as per the provisions of Environment (Protection) Act, 1986.

SEIAA may be informed accordingly.

(2) M/s Sahegaon Lime stone mine, Village – Sahegaon, Tehsil – Dhamdha, District – Durg (C.G.)The Project proponent submitted application (Form-I and Mining Scheme) for

prescribing Terms of Reference (ToR) / Environment Clearance on 06/08/2009 for mining of lime stone. The brief of the project is as follows:-

Mining Plan/ Mining Scheme

First Scheme of Mining & Progressive Mine Closure Plan was approved by Indian Bureau of Mines, Nagpur vide letter no. DRG/LST /MPLN-29/NGP dated 04//05/2009 for maximum capacity 27,000 tonnes per year. Mining Plan was approved for maximum 50,000 tonnes per year.

The case was discussed in the 39th, 43rd, 49th and 53rd meeting of SEAC, Chhattisgarh held on 22/08/2009, 30/09/2009, 18/01/2010 and 31/03/2010 respectively. Committee then noted that the project proponent has started mining operation from 1997-98.

After discussion, the SEAC, Chhattisgarh decided to ask the project proponent to present the case before SEAC, Chhattisgarh incorporating the details as desired vide letter dated 17/09/09 along with all relevant information/documents, presently adopted EMP and proposed EMP/ToR etc.

In pursuant to the Ministry of Environment and forests, Government of India notification S.O. 3067 (E) dated 01/12/2009, the Committee also decided to ask the project proponent to submit application in revised Form-I or point wise additional information as per revised Form-I as amended by Ministry of Environment and forests, Government of India vide notification S.O. 3067 (E) dated 01/12/2009.

Accordingly, project proponent was informed vide letter dated 19/03/2010. The project proponent made presentation in the 53rd meeting of SEAC, Chhattisgarh on 31/03/2010.

The proposed project fulfills the criteria as mentioned in the Schedule of EIA Notification, 2006, hence falls under Category ‘B’. SEAC, Chhattisgarh noted that mine under consideration is located in area where mines are in cluster. These mines have cumulative impact on environment.

Based on the consideration of the documents submitted, presentation made by the project proponent and discussion held, the SEAC, Chhattisgarh decided that project should be considered as ‘B1’ category and prescribed the Terms of Reference (ToR). The Term of Reference (ToR) was issued vide letter dated 11/06/2010. Project proponent submitted the desired information vide letter dated 03/06/10.

Now, the project proponent has requested the SEAC, Chhattisgarh to reconsider the project as B2 category. The request of the project proponent was reconsidered in 63 rd

meeting of SEAC Chhattisgarh held on 09/09/2010.

After discussion Committee decided that Sub Committee of SEAC, Chhattisgarh comprising of three members should visit the site and submit the report for further consideration.

Project proponent should be intimated accordingly.

(3) M/s Jaysawal Neco Limited, Village-Manpur, Tehsil & District - Kabirdham (C.G.)Project proponent had applied to Ministry of Environment and Forests, Government

of India for Environment Clearance vide letter dated 08/08/2007 for mining of 0.078 million tonnes per annum lime stone in Manpur in mining lease area of 12.145 ha. The proposal was considered for ToR presentation during appraisal committee meeting held on 12/12/2007. The ToR was granted by MoEF on 4 th January 2008 vide letter no. J-11015/887/2007–IA.II(M). Public Hearing was held on 17/10/2008 at Primary School Bhawan, Village - Manpur, Gram Pachayat – Ranjitpur, Tehsil & Block- Sahaspur-Lohara, District - Kabirdham (C.G.).

The project being in ‘B’ Category, Ministry of Environment and Forests, Government of India, New Delhi transferred the original file to SEIAA Chhattisgarh vide

letter no. J-11015/887/2007–IA.II(M) dated 12/06/2008. Public hearing proceedings were received by SEIAA Chhattisgarh from Member Secretary, Chhattisgarh Environment Conservation Board, Raipur vide letter no. 8936/TS/CECB/2009 Raipur dated 19/01/2009. Project proponent has applied to SEIAA, Chhattisgarh for the grant of environmental clearance on 26/02/2009.

The case was considered in the 28th, 33rd, 43rd and 49th meeting of SEAC, Chhattisgarh held on 31/03/09, 30/05/2009, 30/09/2009 and 18/01/2010 respectively. Project proponent made presentation in the 43rd meeting of SEAC, Chhattisgarh held on 30/09/2009. The Project proponent submitted the additional information/documents asked during presentation vide letter dated 24/12/2009 and revised application form I vide letter dated 18/03/10.

The information/documents submitted by project proponent were placed before SEAC Chhattisgarh in the 51st meeting of SEAC Chhattisgarh, held on 27/03/2010. Project proponent has not submitted the information/documents as desired vide letter dated 14/12/2009. Committee then decided that after receipt of the requisite information / documents proposal would be considered. Project proponent was informed vide letter 20/04/2010. Project proponent has submitted the desired information vide letter dated 16/06/2010 on 08/07/2010.

The information / documents submitted by the project proponent were reconsidered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. Committee noted that information / documents submitted by the project proponent vide letter dated 16/06/2010 is incomplete especially with respect to the point no. 02 and 03 of the letter dated 20/04/2010. Project proponent has not carried out the monitoring of ambient air, noise, surface/ground water quality, soil etc. at various locations within 10 km radius. Project proponent has also not submitted name of flora and fauna and endanger species (if any) of flora and fauna in buffer zone authenticated by the competent authority. The final EIA report by the submitted project proponent does not reveal the name of authorized consultants engaged with their brief resume and nature of consultancy rendered. Committee further decided to consider the case after submission of the above information/documents.

Committee also decided that after receipt of the above information/documents, the proposal should be placed before SEAC for further consideration.

Project proponent should be intimated accordingly.

(4) M/s Mohar Reservoir Project, (Kharkhara Mohdipat Canal Project, Division, Durg) Village – Mohar/Banjaridih, Block & Tehsil – Chowki/Dondi Lohara, District – Durg (C.G.)Executive Engineer, Water Resources Department, Durg has submitted application

(Form-I) for grant of environmental clearance/ prescribing Terms of Reference (ToR) for construction of Mohar Reservoir Project on 01/08/2009. The brief of the proposal is as under:-

The proposal was discussed in 39th meeting on 22/08/2009 of SEAC, Chhattisgarh. Committee then decided to ask the project proponent to submit the requisite information/documents and present the proposal. Project proponent was present in 42nd meeting of SEAC Chhattisgarh for presentation. The project proponent came with incomplete information/documents desired vide letter dated 17/09/2009. The project proponent was not prepared for presentation and the competent authority also did not come for presentation. Hence, committee then decided to postpone the presentation. The committee asked the project proponent to submit the desired information/documents at the earliest. The project proponent then informed the Committee that the desired information/documents will be submitted shortly. The committee also decided to consider the proposal after receipt of the information/documents and request for presentation from project proponent.

The project proponent was informed accordingly vide letter dated 17/11/2009. The project proponent submitted information/documents vide letter dated 14/07/2010.

The information/documents submitted were considered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. After discussion Committee decided to ask the project proponent to present the case before SEAC Chhattisgarh incorporating the details as desired vide letter dated 17/09/09 along with relevant information/documents.

Project proponent should be intimated accordingly.

(5) M/s Hemant Kumar Sahu, Village – Nandini - Kundini, Tehsil – Dhamdha, District – Durg (C.G.)The Project proponent submitted application for prescribing Terms of Reference

(ToR) / Environment Clearance on 13/05/09 for mining of lime stone - 60,000 tonnes per year by open cast manual mining.

The case was discussed in the 34th, 38th and 45th meeting of SEAC, Chhattisgarh held on 19/06/2009, 03/08/2009 and 31/10/2009 respectively. Project proponent made presentation in the 38th meeting of SEAC, Chhattisgarh on 03/08/2009. Project proponent has submitted the information/documents vide letter dated 24/12/09. The project proponent has also submitted revised application form-I vide letter dated 26/03/10.

The information/documents submitted by project proponent were placed before SEAC Chhattisgarh in the 51st meeting of SEAC Chhattisgarh, held on 27/03/2010.

(6) M/s Vikas Agrawal, Village – Nandini - Kundini, Tehsil – Dhamdha, District – Durg (C.G.)

The case was discussed in the 34th, 38th and 45th meeting of SEAC, Chhattisgarh held on 19/06/2009, 03/08/2009 and 31/10/2009 respectively. Project proponent made presentation in the 38th meeting of SEAC, Chhattisgarh on 03/08/2009. Project proponent has submitted the information/documents vide letter dated 24/12/09. The project proponent has also submitted revised application form-I vide letter dated 26/03/10.

The information/documents submitted by project proponent were placed before SEAC Chhattisgarh in the 51st meeting of SEAC Chhattisgarh, held on 27/03/2010.

The proposed project fulfills the criteria as mentioned in the Schedule of EIA Notification, 2006, hence falls under Category ‘B’. SEAC, Chhattisgarh noted that mine under consideration is located in area where mines are in cluster. These mines have cumulative impact on environment. meeting of SEAC Chhattisgarh held on 09/09/2010.

After discussion Committee decided that Sub Committee of SEAC, Chhattisgarh comprising of three members should visit the site and submit the report for further consideration.

Project proponent should be intimated accordingly.

(7) M/s SV Power Private Limited, at Village – Renki, Tehsil – Pali, District – Korba. The Project proponent submitted application (Form-I and Pre feasibilty Report) for

prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 27/04/2010 for expansion of existing capacity by installing 2 x 150 MW coal based captive power plant i.e. from 120 MW to 420 MW at Village – Renki, Tehsil – Pali, District – Korba. Cost of the proposed project is Rs. 1520.00 Crore. The area available is 220 acres.

The proposal was considered in 57th meeting held on 14/05/2010 of SEAC, Chhattisgarh. After discussion committee decided that sub committee of SEAC, Chhattisgarh should visit the site and submit the report for further consideration. As per decision of SEAC, Chhattisgarh, Sub Committee visited the site on 15/07/2010.

The visit of the sub-committee and information/documents submitted by project proponent were discussed in 63rd meeting of SEAC, Chhattisgarh held on 09/09/2010.

After deliberation, Committee decided that project proponent should be asked to submit the following information/documents and present the case. Land procurement/purchase of land documents along with patwari khasra naksha should be submitted before presentation: -

Study of alternative sites should also be submitted so as to justify the selected site from environmental angle.

Whether the project site located in whole or in part within 10 km from the boundary of: (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas as identified by the Central Pollution Control Board from

time to time, (iii) Notified Eco-sensitive areas, (iv) inter-State boundaries? Please provide details.

Whether any forest land is involved within the proposed site? If yes, the status of forest clearance for the same should be submitted.

Site details: existing condition, land document (procurement/purchase of land and diversion of land) including permission from concerned authority.

A study area map of the core zone and 10 km area of the buffer showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines and other polluting sources, which shall also indicate the migratory corridors of fauna, if any, and the areas where endangered fauna and plants of medicinal and economic importance found in the area.

Toposheet/contour map along with the site plan of the project and project land use area statement including project operations, such as coal handling plant, power plant, building infrastructure, effluent treatment plants, raw coal, coal fines, ash stock yard, colony, greenbelt, undisturbed area, natural topographical features (such as existing roads, drains/natural water bodies if any) to be left undisturbed, proposed diversion / re-channeling of natural drainage or water courses, if any;

Details of raw coal supply sources and linkages and documents, power supply source, water supply source (with permission of State Government for water allocation), materials balance, process / flow sheet, water consumption with water balance, effluent generation, effluent treatment and reuse, fuel consumption, fuel analysis, emission sources and emission control system, fugitive emission control system, fuel storage yards, solid waste and ash/ hazardous waste handling, storage, transportation, and disposal arrangement.

Feasibility for adoption of air cooled condenser in the power generation. Noise pollution control, greenbelt development action plan. Feasibility of transportation of raw coal through rail should be explored and action

plan should be submitted accordingly. Action plan for use of ash as per notification on use of fly ash issued by Ministry of

Environment and Forests, Government of India. Total capital cost and recurring cost / annum for environment pollution control

measures. Documents regarding captive use of power. Status of proposed activity. Whether any activity started for establishment of

The proposal was discussed in 57 th meeting held on 14/05/2010 of SEAC, Chhattisgarh. After discussion Committee then decided that Sub Committee of SEAC, Chhattisgarh should visit the site and submit the report for further consideration. As per decision of SEAC, Chhattisgarh, Sub Committee visited the site on 24/07/2010.

During site visit of Sub committee the representatives of the M/s Bhilai Cement Company Private Limited also accompanied. The committee made a detailed inspection of the existing plant and the proposed Cement Manufacturing through Clinker Grinding site. Observations of the Sub Committee were as follows:-

1. Pucca road may be provided.

2. Bag house for new/existing unit.

3. Plantation map.

4. Layout with details.

The visit of the sub-committee and information/documents submitted by project proponent were discussed in 63rd meeting of SEAC, Chhattisgarh held on 09/09/2010. After detailed deliberation, the Committee decided to ask the project proponent to present the proposal with following details: -

Layout plan and area map of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines/stone crushers and other polluting nature industries (nature and capacity) etc. distance of above features from site should be clearly given.

Whether the project site located in whole or in part within 10 km from the boundary of: (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas as identified by the Central Pollution Control Board from time to time, (iii) Notified Eco-sensitive areas, (iv) inter-State boundaries? Please provide details.

The proposal was discussed in 45 th meeting held on 31/10/2009 of SEAC, Chhattisgarh. After deliberation, the Committee then decided to ask the project proponent to submit the requisite information/documents and present the case. Accordingly, project proponent was informed vide letter dated 14/12/2009. The project proponent made presentation in the 47th meeting of SEAC, Chhattisgarh on 24/12/2009. After deliberation, based on the consideration of the documents submitted and discussion held The Committee decided that to ask the project proponent to submit the some information/documents. Project proponent was informed accordingly vide letter dated 26/02/2010. Project proponent submitted the desired information/documents vide letter dated 02/08/2010. The information/documents submitted by project proponent were placed in the 63rd meeting of SEAC Chhattisgarh held on 09/09/10.

It is noted that this is a minor irrigation scheme. Location of the project is near Village – Bhendra, Block- Chhuikhadan, Tehsil – Chhuikhadan, District – Rajnandgaon. Type of catchment is partly hilly and catchment area is 43.73 sqkm. The proposal is for construction of earthen dam, two sluice, spillway and canal system. Estimated cost of the project is Rs. 1167.18 lakhs. Additional food production anticipated after completion of the project is 1800 tonnes / year. Total area under submergence shall be 98.883 ha. It is noted that cost benefit ratio is 23:01. Total forest land required is 1.983 ha. The forest clearance case has been submitted to forest department. There are no historical and cultural monuments inside the basin. Project proponent has informed that there is no rehabilitation and resettlement. Project proponent informed that 100% of the head works (dam, two sluice, spillway and waste weir) and 80% canal work has been completed.

After discussion, based on the consideration of the documents submitted and the presentation made by the project proponent the Committee decided to consider the project as category B-2 & recommended for grant of Environmental Clearance for the Minor Irrigation Project (earthen dam, two sluice, spillway and canal system) near Village – Bhendra, Block- Chhuikhadan, Tehsil – Chhuikhadan, District – Rajnandgaon (C.G.) subject to the terms and conditions as per Annexure-II.

As project proponent has started construction works without obtaining environment clearance as per provision of Environment Impact Assessment Notification, 1994/2006, hence, Committee also recommended to take the legal action as per the provisions of Environment (Protection) Act, 1986.

SEIAA may be informed accordingly.

(11) M/s Mundatola Tank Project, Tehsil –Chhuikhadan, District – Rajnandagaon (C.G.)Executive Engineer, Water Resources Department, Chhuikhadan, Tehsil-

Chhuikhadan District- Rajnandagaon has submitted application (Form-I) for prescribing Terms of Reference (TOR) /Environmental Clearance on 17/08/2009. The brief of the proposal is as under:-

(12) M/s Jaysawal Neco Industries Limited, Lain Dongri Iron Ore Deposit, Village-Barbaspur, District – Kanker (C.G.) The Project proponent submitted application (Form-I and Mining Plan) for

prescribing Terms of Reference (TOR) / Environment Clearance on 06/12/08 and 05/01/09. The Project proponent has proposed iron ore mining of 0.06 million tonnes per annum capacity.

The case was discussed in the 22nd, 26th, 43rd and 46th meeting of SEAC, Chhattisgarh held on 31/01/2009, 13/03/2009, 30/09/2009 and 30/11/2009 respectively. Project proponent made presentation in the 43rd meeting of SEAC, Chhattisgarh on 30/09/2009.

Committee then decided that a Sub Committee comprising of three members of SEAC, Chhattisgarh shall visit the site and submit the report. Accordingly, a Sub-

Committee visited the site on 08/11/2009. Project proponent submitted information/documents desired by SEAC, Chhattisgarh vide letter dated 20/11/2009. The inspection report of the sub-committee and information/documents submitted by project proponent were discussed in 46th meeting of SEAC, Chhattisgarh held on 30/11/2009.

The categorization of category ‘B’ projects or activities in to B1 or B2 lies in the purview of State level Expert Appraisal Committee (SEAC). Based on the consideration of the documents submitted and discussion held, the committee considered the proposal as ‘B1’ category and prescribed Term of Reference (TOR) vide letter dated 14/01/2010.

The letter dated 09/04/10 and enclosures received from Chhattisgarh Environment Conservation Board were discussed in the 56th meeting of SEAC Chhattisgarh held on 07/05/2010.

The Committee gone through the draft EIA/EMP report and it was noted that the base line data of the environmental parameters were collected during the month of November 2008 to January 2009 which is much before to the issue of ToR by SEAC Chhattisgarh. The Committee also noted that the collection of environmental data was started even before the submission of application. As per ToR study area should cover an area of 10 km radius around the proposed site but in the instant case, the study has been carried out covering an area 5 km radius only.

In view of the above, the committee is in the opinion that the project proponent should be advised to conduct a fresh EIA study including all the points as per the ToR issued by the SEAC Chhattisgarh.

Chhattisgarh Environment Conservation Board should be intimated accordingly.

The project proponent was reconsidered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. The letter addressed to Principal Secretary, Environment and Housing Department, Government of Chhattisgarh was reviewed in context to the matter before SEAC, Chhattisgarh. The Committee recommended to adhere with the earlier decision.

(13) M/s. R.R. Ispat Limited, Urla, Raipur (C.G.) The project proponent submitted application for prescribing TOR / Environment

Clearance on 16/04/2008 for the expansion of the rolling mill from 42,000 metric tonne per annum to 1,00,000 metric tonne per annum. The cost of the project is Rs. 22.00 crores. The case was considered in the 8th, 9th, 45th and 46th meeting of SEAC, Chhattisgarh held on 30/06/2008, 31/07/2008, 31/10/2009 and 30/11/2009 respectively. Sub Committee of SEAC previously visited the site on 19/07/2009. On visit to the industry the proponent informed the Sub Committee that the expansion work is already completed. SEIAA, Chhattisgarh in the 10th meeting, decided to ask the SEAC, Chhattisgarh to screen/scope/appraise the proposal on merit basis as per provisions of EIA notification, 2006.

Sub committee again visited the site on 15/11/2009. The inspection report of sub committee and information/documents submitted by project proponent were discussed in 46th meeting of SEAC, Chhattisgarh held on 30/11/2009. The project proponent made presentation in the 50th meeting of SEAC, Chhattisgarh on 21/01/2010.

It is noted that there are no protected areas as per Wildlife Protection Act, 1972, archaeological and defense installations, national park or sanctuary, critically polluted area identified by C.P.C.B. and interstate border within 10 km radius area. The site is located at plot no. 490/1, Urla Industrial Area, Raipur. The plot area having 0.831 ha was taken on lease from Chhattisgarh State Industrial Development Corporation on 04/09/1999. Project proponent also purchased 4.517 ha land from private land owners Total area of the project is 5.348 ha. Project proponent informed the Sub Committee that the main plant has been established on plot no. 490/1, Urla Industrial Area, Raipur and balance land is being used as stockyard, green belt development etc. This is an expansion project for expansion of

the rolling mill from 42,000 metric tonne per annum to 1,00,000 metric tonne per annum. Sub Committee found that the expansion work has already been completed. Previously oil fired re-heating furnace of capacity 15 tonne per hour was installed. This furnace was retrofitted for duel fuel firing (coal gas and oil) and capacity expansion to 22 tonne per hour. Previously 03 roughing stands and 10 intermediate stands were installed in the rolling mill. Four new stands have been installed under expansion. Coal 100 – 105 kg/tonne and furnace oil 5 liters/tonne are being used for heating the raw materials (blooms/billets). Gas holder of 150 Ncum has been installed. Presently height of stack is 34 meters. The production to achieve 1,00,000 metric tonne per annum is on two shifts basis. For duel fuel running, coal requirement is about 30 to 35 tonnes per day; where as furnace oil requirement is about 1.75 kiloliters per day. About 833 liters per hour furnace oil is required in case of 100% furnace oil firing of re-heating furnace. Height of the stack is not adequate, when 100% furnace oil firing of re-heating furnace is done. Project proponent has mentioned in the application form that Sulphur Di Oxide emission would be 80 kg per hour. The height of stack should be raised accordingly. Coal is being stored in open stock yard. About 12 to 14 tonnes per day ash and coal tar 2.0 – 2.5 kiloliters is generated. Ash is used for land filling and coal tar sold to vendors. Total water requirement after expansion is 20 kiloliters. Water is being supplied by M/s Chhattisgarh Ispat Bhumi. Closed cooling system has been adopted. The water used for cooling the mill strands is recycled. Mill scales about 6 -7 tonnes per day (2000 tonnes anually) are collected through sedimentation pit and sold. Main internal roads are pucca.

Based on the consideration of the documents submitted and discussion held, being expansion project of rolling mill with oil fired / coal gasifier fired furnace (without direct firing of coal in furnace), expansion within existing plant premises, no additional acquisition of land, no displacement / rehabilitation required, main plant established on industrial area land and no forest land involved for expansion project, the committee considered the proposal as ‘B1’ category without public consultation {as per para 7(i) III Stage (3) (i)(b) and para 7(ii)} and prescribed Term of Reference (TOR) vide letter dated 08/04/10. The project proponent submitted final EIA report and revised application form -I vide letter dated 15/04/10.

The EIA submitted by the project proponent was placed in the 58 th meeting of SEAC held on 18/06/10. Committee found that collected data of ambient air quality are very old and before the issue of ToR also project proponent has not submitted data of one complete season. After deliberation, the Committee decided to ask the project proponent to submit the some information/documents. Project proponent informed vide letter dated 22/07/10.

Project proponent submitted the desired information/documents vide letter dated 07/08/10. The information/documents submitted by project proponent were placed in the 63rd meeting of SEAC Chhattisgarh held on 09/09/10. After deliberation, the Committee decided to ask the project proponent to present the case along-with issues like site details, existing condition, land document, permission from concerned authority, power supply, water supply, materials balance, flow sheet, water source, water balance, effluent generation, treatment and reuse, emission sources and emission control systems, solid waste / hazardous waste management, DG Set and noise pollution control, greenbelt, fugitive emission, storage facility, proposed monitoring stations details along-with justification for selection, proposed EMP along-with community welfare/eco development works to be carried out and other relevant issues along-with proposed TOR/EMP.

The case was considered in the 51st and 58th meeting of SEAC, Chhattisgarh held on 27/03/10 and 18/06/10 respectively. Project proponent has submitted the desired information vide letter dated 06/05/2010. Since the project proponent do not have possession of the land identified for the proposed project, SEAC Chhattisgarh decided to ask the project proponent to submit the information regarding status of land acquisition to be certified from the land revenue Government department in case of Govt. land and agreement/lease deed papers in case of private land being acquired/proposed to be acquired at an earliest failing which the case may be referred to be de-listed. In this regard, an affidavit also is to be submitted to endorse their commitment.

The project proponent was reconsidered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. After deliberation, Committee decided that project proponent should be asked to submit the following information/documents and present the case : -

Study of alternative sites should also be submitted so as to justify the selected site from environmental angle.

Whether the project site located in whole or in part within 10 km from the boundary of: (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas as identified by the Central Pollution Control Board from time to time, (iii) Notified Eco-sensitive areas, (iv) inter-State boundaries? Please provide details.

Whether any forest land is involved within the proposed site? If yes, the status of forest clearance for the same should be submitted.

Site details: existing condition, land document (procurement/purchase of land and diversion of land) including permission from concerned authority.

A study area map of the core zone and 10 km area of the buffer showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines and other polluting sources, which shall also indicate the migratory corridors of fauna, if any, and the areas where endangered fauna and plants of medicinal and economic importance found in the area.

Toposheet/contour map along with the site plan of the project and project land use area statement including project operations, such as coal handling plant, power plant, building infrastructure, effluent treatment plants, raw coal, coal fines, ash stock yard, colony, greenbelt, undisturbed area, natural topographical features (such as existing roads, drains/natural water bodies if any) to be left undisturbed, proposed diversion / re-channeling of natural drainage or water courses, if any;

Details of raw coal supply sources and linkages and documents, power supply source, water supply source (with permission of State Government for water allocation), materials balance, process / flow sheet, water consumption with water balance, effluent generation, effluent treatment and reuse, fuel consumption, fuel analysis, emission sources and emission control system, fugitive emission control system, fuel storage yards, solid waste and ash/ hazardous waste handling, storage, transportation, and disposal arrangement.

Feasibility for adoption of air cooled condenser in the power generation. Noise pollution control, greenbelt development action plan. Feasibility of transportation of raw coal through rail should be explored and action

plan should be submitted accordingly. Action plan for use of ash as per notification on use of fly ash issued by Ministry of

Environment and Forests, Government of India.

The application submitted was considered in fifth meeting of SEAC, Chhattisgarh held on 24th May 2008. As per decision taken in fifth meeting of SEAC, Chhattisgarh, project proponent along with their consultants made the presentation before SEAC, Chhattisgarh on 28th June 2008.

The Project Proponent has proposed Integrated Infrastructure Development Centre (IIDC) at village – Kapan, District – Janjgir-Champa. The brief of the project is as follows:-

Expected Industrial Unit 93. This industrial area will be reserved for micro, small and medium scale industries. 25% of the plotable area (11.61 acres) will be reserved for SC/ST applicants.

Water Requirement Estimated at 1073.5 KLD. The water requirement is based on the probable industry potential in the proposed industrial area.

Cement bags, paints etc. – sold off to recycles.During operation phase: Centralized Solid Waste/Hazardous Waste Management would be allocated and would be disposed off as per norms. Source segregation and isolated storage would be carried out. Fire extinguisher would be installed near storage area.

Greenbelt Development CSIDC would develop 51313 m2 (12.66%) greenbelt during the construction period. Allottee will also develop greenbelt in their premises.

Management Plan for Different Environmental Parameters

1. Air Environment:During construction phase:

Dust suppression and maintenance of pollution generating equipment program.

Control program on noise generating equipment. Ambient Air Quality Monitoring program.

During operational phase: Control on air and noise pollution by individual units. Proper arrangement for traffic including parking. Monitoring program.

2. Land Environment:During construction phase:

Program for solid waste disposal. Preparation of resettlement and rehabilitation plan for

project affected persons.During operational phase:

Arrangement for hazardous waste management. Common facility for collection, treatment, recycling and

disposal.3. Water Environment:During construction phase:

Use of surface and ground water with prior permission from statutory authority.

Control program for misuse of water.During operational phase:

Conservation plan for storm water and rain water harvesting

Common Effluent Treatment Plant Proposed for treatment of industrial effluent.

The Committee then decided that after receipt of the requisite information / documents, the proposal should be submitted before SEAC, Chhattisgarh for consideration of TOR.

Project proponent has submitted the information/documents along with revised application form, land area statement, toposheet of 10 km radius, declaration for “No ‘A’ category industry” and revised layout plan vide their letter dated 10/09/08.

The information submitted was discussed in 16 th meeting of SEAC, Chhattisgarh on 23/10/08. The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water,

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’ category and prescribed the Terms of Reference (TOR). The Term of Reference (TOR) was issued vide letter dated 16/12/2008.

The case was reconsidered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. After deliberation, Committee decided that project proponent should be asked to submit the information/documents desired vide letter dated 16/12/2008.

(17) M/s Cosmos Sponge & Power Limited Village- Bhainsamuhan, Hardi and Sirouli, District- Janjgir- Champa.The Project proponent submitted application (Form-I and Pre feasibilty Report) for

prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 16/04/2010 for Super Critical Thermal Power Plant – 350 MW, at Village- Bhainsamuhan, Hardi and Sirouli, District- Janjgir- Champa. The estimated project cost of the project Rs. 1770 Crore. Area available is 257 acres.

The proposal was discussed in 57th and 61st meeting of SEAC, Chhattisgarh held on 14/05/2010 and 14/07/10 respectively. After deliberation, Committee decided that project proponent should present the case with complete official original document of procurement/purchase/diversion of land, documents regarding rail transportation, construction of anicut, details of action plan for disposal of solid waste i.e. ash and some information/documents.

Project proponent was present in 61st meeting of SEAC Chhattisgarh for presentation held on 14/07/10.

Based on the consideration of the documents submitted and presentation made by the project proponent, the Committee decided to ask the project proponent to submit the additional information like explore the possibility of coal transport from railway siding to the proposed site, and explore the possibility of using washed coal, feasibility of air cooled/ hybrid condenser in the power generation, proposal for utilization of 100% fly ash from the beginning year onwards. After deliberation, the Committee also decided to ask the project proponent to ensure permission of water drawl from Mahanadi River from the concern department before going for public hearing.

Project proponent submitted the desired information on 12/08/10. The submitted information/documents were considered by SEAC, Chhattisgarh in 63rd meeting on 09/09/2010. After deliberation, the Committee decided to ask the project proponent to present the case along with the desired information/documents mentioned during 61 st

meeting on dated 14/07/2010.

The proposed project does not fulfill the criteria as mentioned in general condition of Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’ category and prescribed the Terms of Reference (ToR) for

Project proponent was informed accordingly vide letter dated 22/07/2010. Project proponent has submitted information vide letter dated 10/08/10 received on 04/09/10. The information/documents submitted by project proponent were placed in the 63rd meeting of SEAC Chhattisgarh held on 09/09/10.

It is noted that proposal is for township project consisting of building & construction activities of 317083.1 sqm built-up area. Site is situated at village Amdi, PH no. 19, khasra nos. 33, 37, 38, 39 part, 40 part and village – Ruabandha, khasra nos. part of 01 part and 04 part, District- Durg, Chhattisgarh under Bhilai Municipal Corporation. Total land area available is 470513.11 sqm. The site is located to the south of Durg - Utai road. The township consists of two blocks, block ‘A’ to the north and block ‘B’ to the south, separated by an area of plantation. Block ‘A’ has a frontage of about 730 metres on Durg-Bhilai road. An offshoot from the Durg-Bhilai road to the south leads to block ‘B’, which has a frontage of about 570 metres along this secondary road. Block ‘B’ is bordered by a canal along its southern periphery. Block ‘A’ has a reasonably flat terrain with a gentle slope towards the east and south. Block ‘B’ has a much more defined contour with the land sloping primarily towards the south and having a difference of almost 4 meters between its highest and lowest points. The soil is a mixture of clayey gravel and morrum. High tension electric power lines pass through the south of block ‘B’, alongside the canal. The regional climate is primarily hot and dry, with winds coming in from the west - southwest directions during summer and cold winds come from northeast during winter season. This is a vacant land. No rehabilitation is required. Site is easy accessible from national and state highway and railways. There is no existing water body, canal or lake within the project site, so there is no necessary for any diversion of any water bodies. All areas surrounded by the project are residential areas. There is no industry in the close vicinity of the site. Town and Country Planning Department, Durg has sanctioned the lay out plan vide their letter no. 1156 dated 24/03/2009 for development of the township in total area of 52.2369 ha (129.08 acres). Project proponent has proposed to construct 2664 units [flats-Gulmohar- G+6 with 8 building blocks having 192 total units, Orchid - G+6 with 11 building blocks having 264 total units, Juhi - G+6 with 10 building blocks having 240 total units, EWS - G+3 with 123 building blocks having 1968 total units] and 1149 independent units (plots Lotus – 15mx25m with 106 building blocks/units, Rose – 15mx20m with 100 building blocks/units, Lily – 12.5mx20m with 117 building blocks/units,

The project will have built up area 317083.1 sqm and building ground coverage of 129309.02 sqm (27.48%). Total ground coverage under roads – 79822.70 sqm (16.97%), paved area – 21315 sqm (4.53%), utilities- 16188 sqm (3.44%), parks and play area -96890 sqm (20.59%), landscaped gardens – 43585 sqm (9.26%), peripheral green – 68955 sqm (14.66%), proposed water body – 8969 sqm (1.91%) and commercial - 5478 sqm (1.16%). Total no. of parking will be 1461 as against 1144 as per National Building Code. Permissible FAR is 1.0 and proposed FAR is 0.674. Municipal Corporation Bhilai has granted building permission vide letter no. 2250 dated 22/12/2009 for the Lotus –106 building blocks/units, Rose –100 building blocks/units, Lily –117 building blocks/units, Tulip – 97 building blocks/units, Daisy – 175 building blocks/units, Dalhia – 218 building blocks/units, Mongra – 336 building blocks/units, EWS (I) - 864 building units and EWS (II) - 1104 building units. Project proponent has not submitted building permission granted by Municipal Corporation Bhilai for flats-Gulmohar- G+6 with 8 building blocks having 192 total units, Orchid - G+6 with 11 building blocks having 264 total units, Juhi - G+6 with 10 building blocks having 240 total units. During operational phase water will be supplied by Municipal Corporation Bhilai and during construction phase water will be supplied by Public Health Engineering Department, Bhilai. Total water requirement will be 3731 cum/day and wastewater generation will be 2260 cum/day. Total treated wastewater recycled will be 840 cum/day (37.2%). Total fresh water requirement will be 2891 cum/day. Total treated wastewater discharge will be 1420 cum/day (62.8%). The wastewater will be collected through a well designed sewer network leading to sewage treatment plant. There will be two nos. of sewage treatment plant. The proposed sewage treatment plants will be based on extended aeration principle consisting of oil and grease trap, equalization cum holding tank, aeration tank, secondary clarifier followed by pressure sand filter, activated carbon filter and chlorination. The treated wastewater will be diverted in the proposed water body within the project area and reused in landscaping and car washing. The balance treated wastewater conform the prescribed standards will be discharged in to the nearby Thagda pond through nala. The Water Resources Department has issued NOC for discharge of treated effluent in to Thagda pond through nala vide letter no. 1220 dated 18/02/2009. Total solid wastes generation will be 10.5 tonnes/day. These wastes will be segregated at source for organic (biodegradable), inorganic - recyclables and inorganic non-recyclables. Three separately marked beings will be placed at each transfer stations. The organic (biodegradable) and inorganic non-recyclables wastes will be finally disposed off by Municipal Corporation, Bhillai as per Municipal Solid Wastes (Management & Handling) rules 2000. Concurrence has already been obtained vide letter no. 1447 dated 11/02/2009 in this regard. Construction waste generated will be around 1200 tonnes. Construction wastes will be disposed off in consultation with Municipal Corporation Bhilai. Recyclables construction waste like reinforcement will be sold to the vendors. Hazardous waste like discarded lube oil from DG sets will be stored in HDPE containers and finally sold to the authorized vendors. Bituminous vehicular road with footpaths furnished with street lighting and landscaped with selected plants will be provided. Adequate open parking will also be provided. Power will be supplied by Chhattisgarh State Electricity Distribution Company Limited with connected load of 11.0 MW and demand load of 7.8 MW. 10 x 160 KVA DG sets will be installed for alternate power supply. Fuel (diesel) requirement for DG sets will be 400 liter/hour. DG sets will be provided with stack height of 2.6 meter above roof of the building. DG sets shall be acoustically lined to minimize noise generation, noise level, db(A) level shall be maintained as per CPCB guidelines. Design of the storm drainage will be done considering non - scouring and non-silting velocity range of 0.60 – 1.20 m/sec. Multi outfall system will be provided for conveying storm water. Suitable rainwater harvesting system will be provided to utilize the rain water in best possible manner. Good house keeping

practices will be adopted. Energy saving electrical lighting system with electronic ballast, like CFL, LED will be used. Solar water heaters will be provided on the roof of each building. Lighting power density (LPD) will be 2.24 watt/sqft. Uses of glass in vertical fenestration area will be < 30% of wall area. In order to reduce the “U” value of roof to 0.35 W/m2K suitable insulation like roof tiles with Surki backing shall be laid on roofs. Fire fighting system will be designed in accordance with the norms. Fire consultant will be appointed for appropriate plan for management of fire hazards. Fire alarm will be provided in all strategic points. Security manager will stationed for management of any emergency/disaster situation.

During construction phase implementation of proper drainage facilities to avoid wastewater/water stagnation from possible sources, like, catch pits or sedimentation basins to restrict the breeding of mosquitoes will be provided. Proper sanitary arrangement with decentralized latrine for workers within the site shall be done within the project site. Proper water supply within the site for workers will be ensured. Proper water sprinkling to prevent fugitive dust spreading will be ensured. Fly ash brick will be used in this project. Loading and unloading of construction materials shall not be done at night. Concrete pouring and casting shall not be done at night. Construction site will be disinfected at regular intervals. Walking surfaces or boards at height will be of sound construction and provided with safety rails or belts. Protective equipment like helmets, gumboots etc. will be provided. Fire extinguishers and buckets of sand will be provided in the fire-prone area and elsewhere. Adequate emergency first aid arrangement will be provided at project site. The cost of the project is Rs. 35000.00 lacs.

Committee, after considering the proposals regarding management of land degradation, water pollution, air pollution, noise pollution, waste management, plantation, rainwater harvesting, storm water management, power requirement, energy conservation, environmental impact mitigation measures, safety measures etc. awarded “Silver” grading to the project and recommended for grant of Environmental Clearance for township project consisting of building & construction activities, subject to terms and conditions enclosed as Annexure-V.

Project proponent made presentation along with the desired information in the 26 th meeting of SEAC, Chhattisgarh on 13/03/2009. After deliberation committee decided that project proponent should be asked to submit the additional information/documents. Project proponent submitted the information on 24/04/09.Project proponent informed that :

Land acquisition document - submitted. Commitment for transportation of raw coal from SECL mines through rail in

timeframe - submitted.The proposal was reconsidered in 34th meeting on 19/06/2009 of SEAC,

Chhattisgarh. The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site.

The proposed project does not fulfill the criteria as mentioned in general condition of Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’ category and prescribed the Terms of Reference (TOR) for preparing draft EIA report for the above-mentioned project. The prescribed Terms of Reference (TOR). The Term of Reference (TOR) was issued vide letter dated 13/07/2009.

Public hearing was held on 03/04/2010. Public hearing proceedings/documents were received on 28/04/2010. Project proponent has submitted Final EIA Report along with the issues discussed in public hearing, copy of video CD of public hearing proceedings, copy of final layout plan and copy of project feasibility report vide letter dated 14/07/2010.

The case was reconsidered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. After deliberation, Committee decided that project proponent should be asked to present the case along-with above information/documents and issues like site details: existing condition, land document, permission from concerned authority, power supply, water supply, materials balance, manufacturing process / flow sheet, water source, consumption with water balance and effluent generation, treatment and reuse, fuel consumption, type of fuel, emission sources and emission control system, solid waste / hazardous waste management, DG Set and noise pollution control, greenbelt, fugitive emission, storage yards, proposed monitoring stations details along-with justification for selection, proposed EMP along-with community welfare/eco development works to be carried out and other relevant issues along-with proposed TOR/EC.

Project proponent should be intimated accordingly.

(5) M/s Phil Ispat Private Limited, Village – Dighora, Tehsil – Takhatpur, District – Bilaspur (C.G.)The project proponent submitted application (Form-I and Pre Feasibility Report) for

prescribing Terms of Reference (TOR) / Environmental Clearance on 04/08/2010 for expansion of existing sponge iron plant of capacity 2x100 TPD and proposed for Thermal Power Plant 1x 10 MW (4MW WBH + 6MW) at Village – Dighora, Tehsil – Takhatpur, District – Bilaspur (C.G.). The brief of the project is as follows:

Project proponent should be asked to submit the layout plan and area map of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines/stone crushers and other hazardous/polluting nature industries etc.

Alternative site details and aerial distance of bottling plant of HPCL and boundary of New Raipur Capital Area.

Whether the project site located in whole or in part within 10 km from the boundary of: (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas as identified by the Central Pollution Control Board from time to time, (iii) Notified Eco-sensitive areas, (iv) inter-State boundaries? Please provide details.

Water allocation letter from competent authority should be submitted. Permission from Explosive department for proposed activity should be submitted.

Committee then decided to ask the project proponent to present the case. Project proponent made presentation in the 25th meeting of SEAC, Chhattisgarh on 16/02/2009.

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 27/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site.

The proposed project fulfills the criteria as mentioned in the Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the

The Term of Reference (TOR) was issued vide letter darted 15/06/2009.

Public hearing was conducted on 26/02/2010. Public hearing proceedings/documents were received on 22/03/2010. Project proponent has submitted Final EIA Report along with the issues discussed in public hearing, copy of video CD of public hearing proceedings, copy of final layout plan and copy of project feasibility report vide letter dated 18/08/2010.

The case was reconsidered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. After deliberation, Committee decided that project proponent should be asked to present the case along-with above information/documents and issues like site details: existing condition, mining lease document, permission from concerned authority, power supply, water supply, materials balance, manufacturing process / flow sheet, water source, consumption with water balance and effluent generation, treatment and reuse, emission sources and emission control system, solid waste / hazardous waste management, noise pollution control, greenbelt, fugitive emission, proposed monitoring stations details along-with justification for selection, proposed EMP along-with community welfare/eco development works to be carried out and other relevant issues along-with proposed TOR/EC.

Alternate sites considered for this project and justification for selection of proposed site from environmental angle should be submitted.

Layout plan showing washery area, raw coal/middling/rejects/coal fines/shale storage area, parking area for vehicles engaged for loading/unloading, effluent treatment plant, raw water storage area, rainwater harvesting, structures, internal roads and greenbelt etc. should be submitted.

prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 24/11/2009 for Coal Based Power Plant – 250 MW, at Village – Jurali and Kapubehra, Tehsil – Katghora, District – Korba. Total area is 200 acres. Proposed cost - Rs. 1079.00 Crore.

The proposal was discussed in 51st meeting held on 27/03/2010 of SEAC, Chhattisgarh. Based on the consideration of the documents submitted and discussion held, the Committee decided to ask the project proponent to submit the additional information/documents.

The project proponent submitted additional information/documents vide letter dated 20/04/2010. The information/documents submitted by project proponent were placed before SEAC Chhattisgarh in the 55th meeting of SEAC Chhattisgarh, held on 28/04/2010. After deliberation, the committee decided to ask the project proponent to present the case.

It is noted that certain informations like justification of the proposed site viewing close proximity to Korba critically polluted area, comparison of proposed site with the alternative sites duly justified, informations related to land, water, transport issues need further clarifications.

Hence, the Committee decided to ask the project proponent to again present the case with the relevant Environmental issues along with the clarifications on above mentioned issues. Project proponent submitted the desired information/documents vide letter dated 06/09/10.

The submitted information/documents were considered by SEAC, Chhattisgarh in 63rd meeting on 09/09/2010. After deliberation, the Committee decided to ask the project proponent to present the case along-with issues like site details, existing condition, land document, permission from concerned authority, power supply, water supply, materials balance, top soil, over burden, rejects details, mining process / flow sheet, water source, consumption with water balance and effluent generation, treatment and reuse, emission sources and emission control systems, solid waste / hazardous waste management, DG Set and noise pollution control, greenbelt, fugitive emission, storage facility, proposed monitoring stations details along-with justification for selection, proposed EMP along-with community welfare/eco development works to be carried out and other relevant issues along-with proposed TOR.

Project proponent should be intimated accordingly.

Project proponent was present in 33rd meeting of SEAC Chhattisgarh for presentation. Project proponent informed the committee that some more time would be required for submission of information/documents. Project proponent requested the committee that the presentation should be made after compilation of the requisite information/documents. Project proponent has submitted the requisite information/documents vide its letter dated 10/11/2009. The case was reconsidered in 46 th

meeting of SEAC, Chhattisgarh held on 30/11/2009. Since, Project proponent has not submitted the land details SEAC, Chhattisgarh decided to defer the case and after submission of land documents, case would be reconsidered.

Project proponent submitted the desired information/documents vide letter dated 08/09/10. The submitted information/documents were considered by SEAC, Chhattisgarh in 63rd meeting on 09/09/2010. Since the project proponent came with incomplete information/documents related to possession of land etc., the Committee further decided to consider the case only after submission of the same.

Annexure –I

ENVIRONMENTAL CLEARANCE CONDITIONS FOR

M/S TANDULA WATER RESOURCES DIVISION (MINOR IRRIGATION PROJECT- CONSTRUCTION OF HOMOGENOUS EARTHEN DAM,

WASTE WEIR AND CANAL SYSTEM), VILLAGE – BOHARDIH, BLOCK – DONDI, TEHSIL – DALLI RAJHARA, DISTRICT – DURG (C.G.)

i) As per proposal submitted length of dam shall not exceed 900 m, maximum height of dam shall not exceed 7.8 m, length of main canal shall not exceed 1.8 km. Total area under submergence is 47.68 ha. Total culturable command area is 200 ha. The area proposed under Irrigation is 120 ha. Project proponent shall not deviate from the administrative sanction and technical sanction from the state Government for Tandula Water Resources Division (Village-Bohardih).

ii) Catchments area shall be taken care of to minimize sediment transport, eutrophication, siltation. Flora & fauna, drainage pattern of the area shall not be affected. All the mitigateve measures shall be taken for the same during construction phase and operational phase.

iii) Excavated soil shall be stacked properly and adequate arrangement shall be provide to avoid erosion of soil during rainy season.

iv) Adequate steps shall be taken to control fugitive dust emissions from various sources during construction and operation of the project. Project proponent shall provide adequate pollution control arrangement to control emission during excavation of earth material, loading-unloading of earth material and other mechanical operations during construction. Project proponent shall provide adequate air pollution control systems as per requirement for control of air pollution (if any) during operation phase.

v) Effective steps shall be taken for proper storage and disposal of solid wastes and sludges. All solid waste generated shall be disposed off safely in scientific manner during construction phase. Solid waste garbage etc. shall be disposed off properly after proper treatment.

vi) Good house keeping practices shall be adopted by the project proponent.

vii) Project proponent shall take proper action to control the noise pollution.

viii) R&R policy Government of Chhattisgarh shall be followed (if any). Adequate publicity of the compensation package of Government should be circulated in the affected villages.

ix) Project proponent shall obtain forest clearance / permissions from the concerned department before start of any activity in forest land.

x) Consolidation and compilation of the muck should be carried-out in the muck dumping sites and the dumping sites should be above high flood level.

xi) On-farm development measures like development of bunds, field channels for irrigation and drainage in the command area, improvement of the drainage with suitable strengthening measures, development of field drains, measures to improve soil fertility for command area development shall be followed by the project authority.

xii) Water user association/co-operative and involvement of the whole community for disciplined use of available waters should be formed.

xvi) Occurrence of stagnant pools/slow moving water channels during construction and operation of the project providing breeding source for vector mosquitoes and other practices, the stream should be properly canalized so that no small pools and poodles are allowed to be formed. Even after taking precaution, due to unforeseen situations, breeding of mosquito and resultant malaria or mosquito borne disease can increase. If such a situation arises, it will be the responsibility of project authorities to take all steps i.e. residual insecticidal spray in all the project area and surrounding 3 km. area keeping the range of mosquitoes in consideration.

xvii) Adequate free fuel arrangement should be made for the labour force engaged in the construction work at project cost so that indiscriminate felling of trees is prevented.

xviii) All the labourers to be engaged for construction works should be thoroughly examined by health personnel and adequately treated before issuing them work permit.

xix) Restoration of construction area including dumping site of excavated materials should be ensured by leveling, filling up of burrow pits, landscaping etc. The area should be properly treated with suitable plantation.

xx) Adequate financial provision should be made in the total budget of the project for implementation of the suggested safeguard measures.

xxi) In case of the change in the scope of the project, project would require a fresh appraisal.

xxii) This environmental clearance is being recommended from prospective and not from retrospective effect and effective from the date of issue of clearance letter, subject to condition that this environmental clearance is being issued without prejudice to the court case pending (if any) in the court of law and it does not mean that project proponent has not violated any environmental laws in the past and whatever decision of the hon’ble court is given in the future, that will be binding on the project proponent. Hence this clearance does not give immunity to the case filed (if any) against the project proponent.

i) As per proposal submitted length of dam shall not exceed 1200 m, maximum height of dam shall not exceed 15.20 m, length of canal shall not exceed 21.5 km (LBC – 9.09 km, RBC – 2.10 km and distributaries and minors – 10.32 km). Total area under submergence shall not exceed 98.883 ha. Forest land requirement shall not exceed 1.983 ha. Total culturable command area is 1782.008 ha. Total area proposed under irrigation shall be 911 ha. Project proponent shall not deviate from the administrative sanction and technical sanction from the state Government for Bhendra Tank Project.

ENVIRONMENTAL CLEARANCE CONDITIONS FOR

M/S MUNDATOLA TANK PROJECT (DAM AND SPILL CONSTRUCTION CANAL SYSTEM CONSTRUCTION), NEAR VILLAGE – MUNDATOLA,

BLOCK- CHHUIKHADAN, TEHSIL – CHHUIKHADAN, DISTRICT – RAJNANDGAON (C.G.)

i) As per proposal submitted length of dam shall not exceed 600 m, maximum height of dam shall not exceed 10.27 m, length of canal shall not exceed 2.2 km (RBC – 1.56 km and distributaries and minors – 0.66 km). Total area under submergence shall not exceed 33.61 ha. Forest land requirement shall not exceed 21.76 ha. Total culturable command area is 217.033 ha. Total area proposed under irrigation shall be 197 ha. Project proponent shall not deviate from the administrative sanction and technical sanction from the state Government for Mundatola Tank Project.

ii) Catchments area shall be taken care of to minimize sediment transport, eutrophication, siltation. Flora & fauna, drainage pattern of the area shall not be affected. All the mitigateve measures shall be taken for the same during construction phase and operational phase.

iii) Excavated soil shall be stacked properly and adequate arrangement shall be provide to avoid erosion of soil during rainy season.

iv) Adequate steps shall be taken to control fugitive dust emissions from various sources during construction and operation of the project. Project proponent shall provide adequate pollution control arrangement to control emission during excavation of earth material, loading-unloading of earth material and other mechanical operations during construction. Project proponent shall provide adequate air pollution control systems as per requirement for control of air pollution (if any) during operation phase.

v) Effective steps shall be taken for proper storage and disposal of solid wastes and sludges. All solid waste generated shall be disposed off safely in scientific manner during construction phase. Solid waste garbage etc. shall be disposed off properly after proper treatment.

vi) Good house keeping practices shall be adopted by the project proponent.

vii) Project proponent shall take proper action to control the noise pollution.

viii) R&R policy Government of Chhattisgarh shall be followed (if any). Adequate publicity of the compensation package of Government should be circulated in the affected villages.

ix) Project proponent shall obtain forest clearance / permissions from the concerned department before start of any activity in forest land.

x) Consolidation and compilation of the muck should be carried-out in the muck dumping sites and the dumping sites should be above high flood level.

xi) On-farm development measures like development of bunds, field channels for irrigation and drainage in the command area, improvement of the drainage with suitable strengthening measures, development of field drains, measures to improve soil fertility for command area development shall be followed by the project authority.

xii) Water user association/co-operative and involvement of the whole community for disciplined use of available waters should be formed.

xiii) Any other clearance from any other organization if required should be obtained.

xiv) The compensatory afforestation programme shall be carried out as per conditions imposed in forest clearance.

xv) The green belt shall be developed along the approach road, residential areas, office complex, around reservoir periphery and tank site etc.

xvi) Occurrence of stagnant pools/slow moving water channels during construction and operation of the project providing breeding source for vector mosquitoes and other practices, The stream should be properly canalized so that no small pools and poodles are allowed to be formed. Even after taking precaution, due to unforeseen situations, breeding of mosquito and resultant malaria or mosquito borne disease can increase. If such a situation arises, it will be the responsibility of project authorities to take all steps i.e. residual insecticidal spray in all the project area and surrounding 3 km. area keeping the range of mosquitoes in consideration.

xvii) Adequate free fuel arrangement should be made for the labour force engaged in the construction work at project cost so that indiscriminate felling of trees is prevented.

xviii) All the labourers to be engaged for construction works should be thoroughly examined by health personnel and adequately treated before issuing them work permit.

xix) Restoration of construction area including dumping site of excavated materials should be ensured by leveling, filling up of burrow pits, landscaping etc. The area should be properly treated with suitable plantation.

FOR 350 MW SUPER CRITICAL BASED THERMAL POWER PLANT

Source of Raw Coal: Linkage of coal/ assurance for supply of raw coal for power plant; The mode of transport/conveyance of incoming coal and outgoing ash etc.

Transportation routes showing villages, schools/colleges, residential areas etc. to be given;

The transportation of coal would be through rail and proposal along with action plan to be submitted. Coal should not be transported through roads.

Project Description: Optimization in the land requirement should be done; A brief description of the plant, the technology used and energy

conservation; All the coordinates of the plant site with toposheet; Detailed material balance, water balance, break up of fuel, break up of

water requirement as per different activities; Source of water for use in power plant, sanction of the competent authority

in the State Government; Examine close circuit system for 100% recycling and reuse of the treated

effluent or other uses such as irrigating the greenbelt within premises etc.; Examine the air cooled condensers technology for water conservation; Examine zero effluent discharge conditions ; Submission of sample test analysis of fuel used.

Description of the Environment: Study area should cover an area of 10 km radius around the proposed site; A study area map of the core zone and 10 km area of the buffer showing

major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines and other polluting sources, which shall also indicate the migratory corridors of fauna, if any, and the areas where endangered fauna and plants of medicinal and economic importance found in the area;

Contour map along with the site plan of the project and project land use area statement including land for project operations, such as coal handling plant, power plant, building infrastructure, effluent treatment plants, raw coal, coal fines, as ash silos, colony, greenbelt, undisturbed area, natural topographical features (such as existing roads, drains/natural water bodies if any) to be left undisturbed, proposed diversion / re-channeling of natural drainage or water courses, if any;

One complete season site specific meteorological data; Information regarding surface hydrology, water regime, hydrogeology and

ground water regime; Information regarding drainage pattern of the study area; Topography of study area, clearly indicating, whether the site requires any

filling? If so, details of filling, filling material, quantity of filling material required, filling material supply source and transportation etc. The filling material should be fly/bottom/pond ash of thermal power plants/industrial solid wastes;

Map showing the core zone delineating the agricultural land (irrigated and un-irrigated), uncultivable land (as defined in revenue records), forest areas (as per records), grazing land and waste land;

Land use statement of the study area well as project area; A fresh monitoring should be carried out for preparation of draft EIA report.

Collection of one complete season (non-monsoon preferably winter season 2008) primary base line data (along-with dates of monitoring) on environmental quality such as air (RPM, SPM, SOx & NOx), noise, water (surface and ground water), soil;

The monitoring be conducted as per Central Pollution Control Board’s guidelines and parameters for water testing for both ground water as per ISI and surface water as per Central Pollution Control Board guidelines;

Surface water, ground water, soil, noise and ambient air quality be monitored at-least at eight stations / locations around the proposed site. At-least one monitoring station in the upwind direction/downstream/non-impact non-polluting area as a control station;

The location of the air monitoring stations decided after taking into consideration the predominant wind direction, population zone and sensitive receptors including Reserve Forests;

Details of various facilities to be provided for the personnel involved in coal/ash transportation & handling in terms of parking, rest areas, canteen, sanitation, and effluents / pollution load from these activities;

Details of infrastructure facilities such as sanitation, fuel, restroom, canteen etc. to be provided to the labour force including casual workers during construction as well as during operation phase. Effluents / pollution load from these activities be included;

Details of workshop, if any, and treatment of workshop effluents; Occupational health issues, baseline data on the health of the population;

Environmental Impacts: Impacts of project, if any, in the land use, in particular agricultural land,

forest land, grazing land, water bodies, drainage of the area and the surroundings;

Impact of choice of the selected boiler technology for power plant and impact on air quality and waste generation (emission and effluents).

Impacts of transportation covering the entire sequence of supply, transportation, handling, transfer and storage of raw coal and ash on air quality showing in a flow chart with the specific points of fugitive emissions generation;

Impact of the project on local infrastructure of the area, such as road network. Examine whether existing roads are adequate to take care of additional load of ash transportation? Whether any additional infrastructure would need to be constructed and the agency responsible for the same with time frame?

Prediction of impact of project on different environmental components inter-alia (1) air including noise, (2) water (surface and groundwater), (3) soil, (4) flora and fauna and (5) socio-economic. Also take into account the emission from the vehicles and loading & unloading activities;

Compliance to the standards (Fugitive emission standards, effluent discharge standards, noise level standards) prescribed for power plant by Ministry of Environment and Forests, Government of India / Central Pollution Control Board / Chhattisgarh Environment Conservation Board (which ever stringent);

Ensure the particulate matter emission limited to 50 mg/Nm3; Scheme for rainwater harvesting; Details along-with action plan for development of greenbelt in minimum 33%

land area with not less than 1500 trees per ha giving details of species, width of plantation, planting schedule etc;

Details regarding sale/disposal of solid wastes / coal fine/ash from the unit to miscellaneous purchasers (if any);

Action plan for use of ash as per provisions of notification on use of fly ash. No ash dyke for storage of fly ash. High ash concentration slurry disposal system should be adopted for bottom ash only. All the fly ash generated shall be used for various beneficiary purposes as per Government of India Notification. Fly ash should not be stored in ash dyke.

Environmental Management Plan: The EIA-EMP report covering the impacts and management plan for the

project specific activities on the environment of the region, and the environmental quality – air, water, noise, land, biotic community through collection of data and information, generation of data on impacts for a rated capacity;

Detailed EMP to mitigate the adverse impacts due to project along-with item-wise cost of its implementation (capital and recurring);

Disaster Management Plan and mitigative measures for disaster prevention and control;

Risk assessment to be undertaken, based on the same, propose safeguard measures;

Details along-with action plan and year wise funds to be allocated for eco-development/community welfare works including maintenance of roads in nearby villages/areas;

Additional Study: Public Hearing details covering the notices issued in the newspaper,

proceedings/minutes of public hearing, the points raised by the general public and commitments made, in a tabular form. If the Public Hearing is in the regional language, provide an authenticated English translation of the same;

Status of litigations/court cases filed/ pending against the project (all cased including environment) and / or any direction / order passed by any hon’ble court of law against the project, if so, details thereof;

The following general points should be noted: All documents should be properly indexed, page numbered. Period/date of data collection should be clearly indicated. Authenticated English translation of all material provided in regional

languages. After the preparation of the draft (as per the generic structure prescribed in

Appendix –III of the EIA Notification, 2006) covering the above mentioned ToR issues, the project proponent shall get the Public Hearing conducted and take further necessary action for obtaining environmental clearance in accordance with the procedure prescribed under the EIA Notification, 2006.

The copy of the letter received from SEAC, Chhattisgarh on the ToR prescribed for the project should be attached as an annexure to the final EIA-EMP report. The compliance statement of ToR prescribed should also be incorporated.

The final EIA-EMP report submitted to SEIAA, Chhattisgarh must incorporate the issues in ToR and that raised in Public Hearing. The index of the final EIA-EMP report must indicate the specific chapter and page number of the EIA-EMP report wherein the specific ToR prescribed by SEAC, Chhattisgarh and the issues raised in the Public Hearing have been incorporated.

CONDITIONS OF ENVIRONMENTAL CLEARANCE FOR

TOWNSHIP (BUILDING & CONSTRUCTION) PROJECT OF 317083.1 Sqm BUILT-UP AREA

OF CHHATTISGARH HOUSING BOARD, AMDI, RUABANDHA,

DISTRICT – DURG (CG)

PART A – SPECIFIC CONDITIONS

i) This environmental clearance shall be valid for development of township consisting of construction of 1149 independent buildings such as Lotus – 15mx25m with 106 building blocks/units, Rose – 15mx20m with 100 building blocks/units, Lily – 12.5mx20m with 117 building blocks/units, Tulip – 12mx18m with 97 building blocks/units, Daisy – 10mx15m with 175 building blocks/units, Dalhia – 09mx12m with 218 building blocks/units, Mongra – 06mx12m with 336 building blocks/units, EWS (I) flats - 864 building units and EWS (II) flats - 1104 building units as per building permission granted by Municipal Corporation, Bhilai vide letter no. 2250 dated 22/12/2009. The township shall be consisting of two blocks, block ‘A’ to the north and block ‘B’ to the south, separated by an area of plantation. Block ‘A’ shall have frontage of about 730 meters on Durg-Bhilai road. An offshoot from the Durg-Bhilai road to the south shall lead to block ‘B’, which has a frontage of about 570 meters along this secondary road.

ii) The project shall not exceed the built up area 317083.1 sqm and building ground coverage of 129309.02 sqm. Ground coverage under roads shall not exceed 79822.70 sqm. Ground coverage under paved area shall not exceed 21315 sqm. Ground coverage under utilities shall not exceed 16188 sqm. FAR shall not exceed 0.674sqm.

iii) Project proponent shall obtain separate environmental clearance for the construction of proposed flats such as Gulmohar- G+6 with 8 building blocks having 192 total units, Orchid - G+6 with 11 building blocks having 264 total units, Juhi - G+6 with 10 building blocks having 240 total units and HIG Club (2162.62 sqm), MIG Club (1226.0 sqm), Community Building (276.72 sqm) and commercial area (5478 sqm) as project proponent has not submitted building permission granted by Municipal Corporation Bhilai for these.

I. Construction Phase

Facility of Labourers during Construction: -iv) Construction camp and temporary labour sheds shall be located away from the

construction site. Construction camps shall be provided for construction personnel to avoid indiscriminate settlement of construction workers and labourers.

v) Provision of drinking water, wastewater disposal, solid wastes management and primary health facilities shall be ensured for labour camps. Proper sanitation facilities shall be provided at the construction site to prevent health related problem. Domestic as well as sanitary wastes from construction camps shall be cleared regularly. Provision shall be made for mobile toilets. The safe disposal of wastewater and solid wastes generated during construction phase shall be ensured.

vi) Water usage during construction shall be optimized to avoid any wastage.vii) Adequate safely measures shall be adopted to the construction workers.viii) All the laboures to be engaged for construction works shall be screened for

health and adequately treated before issue of work permits. The contractor shall ensure periodic health check-up of construction workers. A first Aid room shall be provided in the project both during construction and operation of the project.

ix) Provision shall be made for the supply of kerosene or cooking gas /pressure cooker to the laboures during construction phase.

Environmental Management During Construction: -x) As far as practicable, re-use of debris of demolished existing

buildings/houses/structures at existing site is recommended with a special care for handling and disposal of asbestos waste, if any. Rest of waste is to be disposed at the sanitary landfill disposal site.

xi) The asbestos waste, from demolition debris, if any, shall separated and shall be disposed at Common Hazardous Wastes, Treatment and Disposal Facility.

xii) Appropriate measure like adequate drainage, embankment consolidation and slope stabilization shall be taken along the roads to avoid soil erosion. Top soils (20 cm) of the borrow pit sites shall be conserved and restored after completion of excavation. All the topsoil excavated during construction activities shall be stored for use in horticulture/landscape development within the project site. Proper erosion control and sediment control measures shall be adopted.

xiii) Earth material generated from excavation shall be reuse to the maximum possible extent as filling material during site development. The construction debris and surplus excavated material shall be disposed off by mechanical transport in suitable pre-identified dumping areas to avoid land degradation and water logging due to indiscriminate dumping. Dumping areas shall be biologically reclaimed through topsoil cover and plantation.

xiv) A soil erosion and sedimentation control plan shall be prepared prior to construction. The soil erosion, sediment control and storm water practices shall be incorporated depending upon the site characteristics to control soil erosion and loss of topsoil during construction.

xv) Disposal of muck including excavated material during construction phase shall not create any adverse effects on the neighboring communities and disposed off taking the necessary precautions for general safety and health aspects.

xvi) Low sulphur diesel type diesel generator sets should be used during construction phase. Diesel generator sets during construction phase shall have acoustic enclosures and shall conform to Environment (Protection) Rules, 1986 prescribed for air and noise emission standards. No diesel generator sets shall be used during operation phase.

xvii) All vehicles/equipments deployed during construction phase shall be ensure in good working condition and shall conform to applicable air and noise emission standards. These shall be operated only during non-peaking hours.

xviii) Ambient noise levels shall conform to residential standards both during day and night. Incremental pollution loads on the ambient air and noise quality shall be closely monitored during construction phase. Equivalent noise levels shall be ensured during construction phase and closely monitored during construction phase. Adequate measures shall be provided to maintain ambient air quality and noise levels during construction phase, so as to conform to the stipulated standards by CPCB/CECB. Fortnightly monitoring of ambient air quality (PM10, PM2.5, SO2

and NOx) shall be done. xix) The protective equipments such as earplugs etc. shall be provided to

construction personnel exposed to high noise levels. Stationary construction equipments generating noise shall be placed away from inhabited areas and silence zones. Construction activities carried out near residential area shall be

scheduled to daytime only. Only limited necessary construction shall be done during nighttime. No unloading of construction materials shall be done at night. Vehicular noise and use of horns shall be controlled through enforcement of laws and public awareness. Use of pressure horns shall be strictly prohibited. To reduce noise level, the roads shall be designed to have more rows of plantation.

xx) Construction spoils, including bituminous material and other hazardous materials including oil from construction equipments must not be allowed to contaminate watercourses and the dumpsites for such material must be secured so that they shall not leach into the ground water. If necessary, oil trap shall be installed where heavy machineries are deployed.

xxi) Proper and prior planning, sequencing and scheduling of all major construction activities shall be done. Construction material shall be stored in covered godowns / sheds. Truck carrying soil, sand and other construction materials shall be duly covered to prevent spillage and dust emission. Adequate dust suppression measures shall be undertaken to control fugitive dust emission. Regular water sprinkling for dust suppression shall be ensured.

xxii) Use of Ready-Mix concrete is recommended for this project. Water demand during construction shall be reduced by use of pre-mix concrete, curing agents and other best practices.

xxiii) Accumulation/stagnation of water shall avoid ensuring vector control.xxiv) Regular supervision of the above and other measures shall be in place all

through the construction phase so as to avoid disturbance to the surroundings.

Selection of Materials for Better Energy Efficiency: -xxv) Use of fly ash based bricks/blocks/tiles/products shall be ensured. Blended

cement with fly ash shall be used (not less than 17%). The provisions of Ministry of Environment and Forests, Government of India Notification No. 763(E) dated 14/09/1999 [as amended] regarding use of Fly ash must be complied with. Appropriate usage of other industrial wastes shall also be explored. Soil borrow area should be filled up with ash with proper compaction and covered with topsoil kept separately. Fly ash/pond ash shall be used for low- lying areas filling. In embankments / road construction etc. ash shall be utilized as per guidelines of Ministry of Environment and Forests, Government of India/ Central Pollution Control Board/ Indian Road Congress etc. concerning authorities. The use of perforated brick / hollow blocks / fly ash based lightweight aerated concrete etc. shall also be ensured so as to reduce load on natural resources.

xxvi) Construction shall conform to the requirements of local seismic regulations. The project proponent shall obtain permission for the plans and designs including structural design, standard, safety, adequacy of firefighting equipments, protection measures for lightning and specifications of all construction works from concerned authority.

xxvii) Reduce the use of glazed surface as per National Building Code 2005. Use of glass in various buildings may be reduced up to 40% to reduce the electricity consumption and load on air-conditioning. If necessary, use of high quality double glass with special reflective coating in windows should be ensured. Roof of the various buildings shall meet prescriptive requirement as per Energy Conservation Building Code by using appropriate thermal insulation material to fulfill requirement. Opaque wall shall meet prescriptive requirement as per Energy Conservation Building Code which is proposed to be mandatory for all air conditioned spaces while it is inspirational for non-air-conditioned spaces by use of appropriate thermal insulation material to fulfill requirement.

xxviii) Use of energy efficient construction materials to achieve the desired thermal comfort shall be incorporated. The desired level of roof assembling ‘U’ factor and insulation ‘R’ value must be achieved. Roof assembling ‘U’ factor for the top roof shall not exceed 0.4 Watt/sq.m/degree centigrade with appropriate modifications of

specifications and building technologies. The provisions of National Building Code 2005 shall be strictly followed.

xxix) Modern electrical power transmission & distribution system shall be installed. xxx) Street lighting shall be energy efficient. The High Pressure Sodium Vapour

(HPSV) Lamps & Compact Fluorescent Lamps (CFL) along the building network system shall be provided. High intensity, high mast lights to be installed at intersections, parking areas, vehicles stops and major pedestrian movement areas as per the specifications and guidelines prescribed by the Bureau of Indian Standards. Solar energy may be used for outdoor lighting.

xxxi) Extensive network of cellular phones and landlines shall be provided. The telephone and electric cables shall be laid in the same corridor. Adequate vertical and horizontal separation between telephone and electric cable shall be maintained.

xxxii) Reduce hard paving-onsite (open area surrounding building premises) and/or provide shade on hard paved surfaces to minimize heat island effect and imperviousness of the site.

xxxiii) All air-conditioned buildings (if any) shall follow the norms proposed in the ECBC regulations framed by the Bureau of Energy Efficiency. Use of chillers shall be CFC & HCFC free.

Water Body Conservation: -xxxiv) Improvement or rehabilitation of existing natural streams, channels / nallas

falling within premises (if any) shall be carried out without disturbing the ecological habitat.

xxxv) No untreated wastewater shall be discharge in the any water bodies under any circumstances.

xxxvi) All the construction and preparatory activities shall be carried out during dry seasons only.

Water Supply: -xxxvii) Total water requirement shall not exceed 3731 cum/day. Total fresh water

requirement shall not exceed 2891 cum/day. During operational phase water shall be supplied by Municipal Corporation Bhilai and during construction phase water shall be supplied by Public Health Engineering Department, Bhilai.

xxxviii) The water treatment plant shall be provided for treatment of water as per requirement. Appropriate arrangement shall be made for treatment and reuse of backwash water of filtration plant (if any).

xxxix) Project proponent shall provide adequate measuring arrangement at the inlet point of water uptake and at the discharge point for the measurement of water utilized in different categories to monitor the daily water consumption. Measuring arrangement for effluent generated shall also be provided.

xl) Water saving practices such as usage of water saving devices / fixtures, low flow flushing systems, sensor based fixtures, auto control walls, pressure reducing devices etc. shall be adopted.

Greening Programme: -xli) Lay out of proposed buildings and roads etc. shall be made in such a way that it

shall cause minimum disturbance to existing flora and fauna. Appropriate green belt shall be developed to compensate the habitat loss of trees for site clearing. The project proponent must obtain permission for tree cutting from competent authority as per prevailing Act/Rules. Plantation along the side of the roads and in the open spaces shall be developed to act as sinks of air pollutants. Adequate plantation programme along the roads and open spaces shall be planned. The plantation of trees shall be completed in the construction stage. The plantation programme shall be drawn to confirm the natural climate conditions. The plantations shall consist of

mixture of available indigenous, fast growing and sturdy species of trees, shrubs and herbs. Preferential plantation of flowering trees with less timber and fruit value shall be carried out. Plantation (including parks, landscaped gardens, peripheral green etc.) shall be done in at-least 33% area.

Sewage Management: -xlii) The quantity of effluent shall not exceed 2260 cum/day. As per the proposal

submitted, two nos. of sewage treatment plant of adequate capacity based on extended aeration principle consisting of oil and grease trap, equalization cum holding tank, aeration tank, secondary clarifier followed by pressure sand filter, activated carbon filter and chlorination shall be provided. The treated wastewater shall be diverted in the proposed water body within the project area and reused in landscaping and car washing etc. Minimum 840 cum/day treated wastewater shall be recycled. Project proponent shall provide adequate arrangements to recycle the treated water to the maximum possible extent. The balance treated and properly dis-infected wastewater not more than 1420 cum/day conforming the prescribed standards shall be discharged into the nearby Thagda pond through nala. Sewage collection system of adequate capacity to convey the sewage during peak hours shall be laid to collect and convey the sewage from various buildings. The augmentation of Sewage Collection System, Sewage- Pumping Station (if any) and Sewage Treatment Plant shall be ensured before the completion of the buildings.

Rain Water Harvesting Scheme: -xliii) Rainwater from open spaces shall be collected and reuse for landscaping and

other purposes. Rooftop rainwater harvesting shall be adopted for all the buildings. Every building shall have rainwater-harvesting facilities. The storm water flowing in roadside drains shall also be recycled and reused to maintain the vegetation and discharged into natural water bodies. Before recharging the surface runoff, pre treatment must be done to remove suspended matter and oil & grease.

xliv) Net imperviousness of the site shall not exceed the imperviousness factor as prescribed by the National Building Code of India, Bureau of Indian Standards, 2005.

Transport Management: -xlv) Dedicated pedestrian paths shall be provided along the roads. Appropriate

access shall be provided for physically challenged people in the pedestrian paths.xlvi) Traffic congestion near the entry and exit points from the roads adjoining the

project site must be avoided. The design of service roads and the entry and exit from the building shall conform to the norms & standards prescribed by the National Highways Authority of India / State Public Works Department.

xlvii) Permeable (porous) paving in the parking areas, and walkways & patio areas shall be used to control surface water runoff by allowing storm water to infiltrate the soil and return to ground water.

xlviii) All utility lines (electricity, telephone, cable, water supply, sewage, drainage, etc.) shall be laid below ground level. Ducts shall be provided along and across the roads to lay the utility lines. Major trunk (water/sewerage) lines are to be laid along the utility corridor.

xlix) The road drainage shall be designed to enable quick runoff of surface water and prevent water logging. The road level shall be kept at least 0.5 to 1.0 meter above the observed high flood level. The guidelines on Urban Drainage, IRC: SP-50 shall be followed. On the both sides of all roads, well –lit and smooth surfaced footpaths shall be provided. The hoardings shall be strictly prohibited along the roads.

l) All the buildings shall be provided with car parking and two wheeler parking areas. Total car parking for the residential buildings shall not be less than 1270 no. cars. Car parking in HIG Club, MIG Club and Community Building shall be for at-

least 80, 36 and 20 no. cars respectively. Adequate provision shall be made to cater the parking needs in commercial area. Parking shall be fully internalized and no public space shall be utilized. Parking spaces standards as given in ‘Manual on Norms and Standards for Environmental Clearance of Large Construction Projects’ issued by Ministry of Environment & Forests, Government of India or National Building Code shall be adapted.

Others: -li) All mandatory approvals and permissions as required shall be obtained.lii) Unskilled construction laboures shall be recruited from the local areas.

Construction materials shall be procured locally as far as possible.liii) Provisions shall be made for the integration of solar water heating system. liv) Provision of Vermi-composting for the biodegradable solid wastes as well as the

large amount of biomass that shall be available from the tree plantation shall be made.

lv) The ground water shall not be abstracted without prior permission from the competent authority in the project area.

lvi) Adequate roadside drains shall be provided along the road to facilitate its better maintenance and increase in the life of the carriageway, which shall avoid soil erosion and land degradation due to water stagnation. The roadside drains shall be provided on both sides of the road. Longitudinal and cross drainage system shall be regularly maintained. Adequate new drainage works and cross drainage structures shall be provided for smooth passage of runoff. Filling of existing natural drainage courses shall be strictly avoided. Suitable drainage at construction site and camp shall be provided to eliminate the formation of stagnant water pools.

lvii) Regular supervision of the above and other measures for monitoring shall be in place all through the construction phase, so as to avoid disturbance to the surroundings.

lviii) Under the provisions of Environment (Protection) Act, 1986, legal action shall be initiated, if the construction of the project has been started without obtaining Environmental clearance.

I. Operation Phase Sewage Treatment Plant: -lix) An independent expert shall certify the installation of the Sewage Treatment

Plants (STP) and report in this regard shall be submitted to SEIAA, Chhattisgarh before the project is commissioned. Project proponent shall operate and maintain the sewage collection / conveyance system, sewage pumping system and sewage treatment system regularly to ensure the treated effluent quality within the standards prescribed by Ministry of Environment and Forests, Government of India or prescribed by Chhattisgarh Environment Conservation Board (which ever stringent). All the effluent treatment system shall be kept in good running conditions all the time and failure (if any), shall be immediately rectified without delay, otherwise, same alternate arrangement shall be made for storage of untreated sewage until the control measures are rectified to achieve the desired efficiency. Project proponent shall install separate electric metering arrangement with time totalizer for the running of sewage treatment plants. The record (logbook) of power & chemical consumption for running the pollution control systems shall be maintained.

lx) Necessary measures shall be made to mitigate the odour problems from Sewage Treatment Plants (STP).

Ensure Energy Efficiency: -lxi) Power requirement shall not exceed 7.8 MW (with connected load of 11.0 MW).

requirement for DG sets shall not exceed 400 liter/hour during non supply hours only. DG sets shall be provided with stack height of not less than 2.6 meter above roof of the building.

lxii) The buildings shall have adequate distance among them to allow movement of fresh air and passage of natural light, air and ventilation.

lxiii) During maintenance, energy efficient electric light fittings & lamps – low power ballasts, low consumption high power luminaries, lux level limiters & timers for street lighting shall be provided. Used CFLs and TFLs shall be properly collected and disposed off/sent for recycling as per the prevailing guidelines/rules of the regulatory authority to avoid mercury contamination. A report on the energy conservation measures confirming to energy conservation norms finalized by Bureau of Energy Efficiency shall be prepared incorporating details about building materials & technology, ‘R’ value & ‘U’ factors etc.

Municipal Solid Waste/ Other Wastes: -lxiv) Total solid wastes generation shall not exceed 10.5 tonnes/day. These wastes

shall be segregated at source for organic (biodegradable), inorganic - recyclables and inorganic non-recyclables. Three separately marked beings shall be placed at each transfer stations and at appropriate distance on the roadside. The organic (biodegradable) and inorganic non-recyclables wastes shall be finally disposed off by Municipal Corporation, Bhillai. Covered dustbins / garbage collector in convenient places to collect the municipal solid wastes shall be provided. Modern trucks capable of using hydraulic lifting as well as safe covered garbage containers shall be provided for transportation.

lxv) The proponent must develop the Solid Wastes Segregation, Collection, Handling, Transportation and Disposal Scheme ensuring safe and scientific segregation, collection, handling, transportation and disposal of organic and inorganic portion. The organic waste is to be composted / 53Vermi composted at the compost plant. The sludge generated from Sewage Treatment Plant (after drying) shall be used as manure for gardening purpose. Dry solid waste and recycling of all recyclable wastes such as newspaper, aluminum cans, glass bottles, iron scrap and plastics etc. shall be ensured. All municipal solid wastes shall be segregated, collected, transported, treated and disposed as per provisions of the Municipal Solid Wastes (Management and Handling) Rules, 2000 (As amended).

lxvi) Public awareness programmes of benefit of living a clean and healthy life by proper management of solid wastes shall be organized regularly.

lxvii) All hazardous wastes (if any) shall be segregated, collected, transported, treated and disposed as per provisions of the Hazardous Materials (Management Handling and Tran boundary Movement) Rules, 2008.

lxviii) The use of hand gloves, shoes and safety dress for all waste collectors and sorters shall be enforced.

lxix) Recycling of all recyclable wastes such as newspaper, aluminium cans, glass bottles, iron scrap and plastics etc. shall be encouraged through private participation.

lxx) Necessary measures shall be made to mitigate the odour problems from solid wastes segregation, collection, handling, transportation and disposal facility.

Others: -lxxi) DG sets shall be acoustically lined to minimize noise generation, noise level,

db(A) level shall be maintained as per CPCB guidelines.lxxii) Noise shall be controlled to ensure that it does not exceed the prescribed

standards. During nighttime the noise level measured at the boundary of the building shall be restricted to the permissible levels to comply with the prevalent regulations.

lxxiii) Weep holes in the compound walls shall be provided to ensure natural drainage of rainwater in the catchments area during the monsoon period.

lxxiv) The ground water level and its quality shall be monitored regularly in consultation with Central Ground Water Authority.

PART B – GENERAL CONDITIONS lxxv) After approval of the competent authority appropriate fire fighting system shall

be adapted.lxxvi) The environmental safeguards and mitigation measures contained in the

application shall be implemented in letter and spirit.lxxvii) All the conditions, liabilities and legal provisions contained in the Environmental

Clearance shall be equally applicable to the successor management of the project in the event of the project proponent transferring the ownership, maintenance of management of the project to any other entity.

lxxviii) The project proponent shall make financial provision in the total budget of the project for implementation of the above-mentioned conditions and for suggested environmental safeguard measures. The funds earmarked for the environmental protection measures shall not be diverted for other purposes.

lxxix) Six monthly monitoring reports shall be submitted to the SEIAA, Chhattisgarh; Regional Office, Ministry of Environment and Forests, Government of India, Bhopal and Chhattisgarh Environment Conservation Board, Raipur, who shall be monitoring the implementation of environmental safeguards, shall be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents shall submit to State Level Environmental Impact Assessment Authority, Chhattisgarh.

lxxx) The responsibility of implementation of environmental safeguards rests fully on the project proponent. Project proponent shall establish an environmental management cell to carryout functions relating to environmental management under the supervision of senior executive, directly reporting to the head of organization.

lxxxi) In the case of any change(s) in the scope of the project, the project shall require a fresh appraisal by the SEIAA.

lxxxii) The issuance of this letter does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement of Central, State or Local laws or regulations.

lxxxiii) All other statutory clearances from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as applicable by project proponent. Project proponent shall obtain statutory clearances / licenses/ permissions from concerned Central Government/State Government Departments, Boards, Bodies and Corporations etc. Project proponent shall follow direction issued by Central Government/ State Government, Central Pollution Control Board/Chhattisgarh Environment Conservation Board from time to time regarding control of water & air pollution and for environmental conservation.

lxxxiv) The State Level Environmental Impact Assessment Authority, Chhattisgarh reserves the right to amend the above conditions and add additional safeguard measures subsequently, if found necessary, and to take action including revoking of the environment clearance under the provisions of the Environmental (Protection) Act. 1986, to ensure effective implementation of the suggested safeguard measures in a time-bound and satisfactory manner.
