Dear Sri Srivastava ji,

This VIIth State Law Commission came into existence on 18-8-

2017 with my appointment and immediately undertook the task of scavenging the

obsolete and un -useful Acts of the State. Statute Law Revision deals with the

excision, pruning off of superfluities and the rejection of clearly inconsistent

enactments. The obsolete and obsolescent enactments should be repealed and the

bulk of Statute book should be reduced. All such statutes which are sleeping and

not in use but yet snaring and in force must be deleted from the Statute Book.

For the present study statutes since 1795 till 31-10-2017 have been

taken in to account. At present 2057 Acts are in force and it is proposed to repeal

1166 un-useful and dead enactments and thus 891 Acts shall remain on the

Statute Book.

I am glad to submit herewith the First Report of VIIth State Law

Commission alongwith Draft Bill of “UTTAR PRADESH REPEALING AND

AMENDING BILL 2018” with the hope that the Bill may be laid before the House

in its next Session after due scrutiny by the Legislative Department of Government

of Uttar Pradesh.

FIRST REPORT OF VII th STATE LAW

COMMISSION OF U.P.

LAW is the CROWN of the State. As the Country is known by

its Constitution, the State is known by its Laws enacted in consonance

with the Constitution. Law has always been a mirror of society. It

reflects the policies of State in administration of Justice. Times change

and we with them. And so the law must change to reflect the needs of

the changing times and conditions. Statute Law Revision is a very

important matter. There is always the need for a systematic statute law

revision. It should be undertaken at every convenient opportunity. It

involves:-

a. The definite repeal of obsolete or obsolescent enactments;

and

b. The changing of the language of the enactments so as to

bring them into line with current usage, without making

any change in the substance of enactments.

2. In the 1977-78 annual report of the Law Commission No. 92 of

England, the commission stated that :

“There are two distinct aspects of this work. One is to

facilitate the production of revised edition of the statutes of

general application by simplifying the form of those

statutes. The other is to further the objectives of statute law

reform generally by putting forward specific proposals

aimed at reducing the bulk, uncertainty and complexity of

the existing body of statute law. The guiding principles of

both aspects of the work are, in one word, simplification.

Apart from its direct and visible effects , the work is an

important ingredient in other law reform work, such as

consolidation, where research into detail statutory provision

is necessary in order to establish their relevance or practical

utility. Until this research has been done, the process of

modernizing the existing body of Statute Law cannot in

practice be carried out on the substantial scale that is

needed.”

3. Hon’ble Mr. Justice V.C.R.A.C. Crabbe, Former Justice of

Supreme Court of Justice of Ghana, in his landmark book

Legislative Drafting 1993 edition, has suggested that Statute Law

Revision should deal with:-

(a) Enactments which have ceased to be in force, that is

a. Expired enactments which, having been originally

limited to endure for a limited or specific period are not

perpetuated or kept in force by continuance. Their

purpose is spent by exclusion of time;

b. Spent enactments which are exhausted in operation by the

accomplishment of their purposes;

c. Enactments repealed in general terms, that is, repealed

by the operation of an enactment expressed only in

general terms;

d. Enactments virtually repealed, where an earlier Act is

inconsistent with, or is rendered invalid by, a later Act;

i. Superseded enactments, where a later Act effects

the same purpose as an earlier enactment by

repetition of the terms of the earlier enactment;

ii. Obsolete enactments, where the state of the things

contemplated by the enactment has ceased to exist.

It is no longer capable of being put into force

because circumstances have changed;

(b) Unnecessary enactments: here no statutory authority is

needed because of the nature of the enactment.

4. Statute Law Revision is in essence a literary exercise. It deals with the

excision of dead wood, the pruning off of superfluities and the rejection

of clearly inconsistent enactments. It saves a great deal of time and

assists in the accuracy and confidence of legal work.

5. Lord Bacon, in his Book Letters and Life (spedding) vi, proposed that

in ‘reforming and recompiling the statute law’:-

1. The government (should) discharge the books of those statutes

whereas the case by alteration of time is vanished…These may

nevertheless remain in the libraries for antiquities, but no

reprinting of them. The like of statutes long since expired and

clearly repealed; for if the repeal be doubtful, it must be so

propounded to Parliament.

2. The next is to repeal all statutes which are sleeping and not in

use but yet snaring and in force. In some of these it will

perhaps be requisite to substitute some reasonable law instead

of them, agreeable to the time; in others a simple repeal may

suffice.

3. The third, that the grievousness of the penalty of many statutes

may be mitigated, through the ordinance stand.

4. The last is the reducing of convenient statutes heaped one

upon another to one clear and uniform law.

5. Justice H.R.Khanna in Magan Lal Chhagan Lal vs. Municipal

Corporation, Bombay 1974 (2) SCC 402 has observed that “Things

are not static either in law or in life. There is a continuing process of

growth of law , and one can retard it only at the risk of alienating law

from life itself.”

6. Scavenging the Statute Book is also as important as legislating the new

Law. The legislation is the document which signifies the policies of the

Government in power and once assented to by the Head of the State

becomes the law of the land till it is modified, changed or repealed by

successive Governments through Legislature. Every Citizen is expected

to know and obey the law because, ignorance of law is no excuse. But

even the law experts and lawyers are sometimes not aware about

various laws. Even the law enforcement agencies also sometimes do

not know /understand the law. Then how can a simple, illiterate and

poor felow can be expected to know about the law which is in force.

No doubt , in the recent years, the complex language of drafting of law

has been done away but still it is not as simple to understand the law .

Therefore simplicity is one of the most important phenomenon of law.

This simplicity can be achieved only when we have limited laws, and it

requires timely revision of laws.

7. In the backdrop of aforesaid established and well recognized principles

of Statute Law Revision, the Commission has undertaken the task to

revise the existing Statutes of State Of Uttar Pradesh.

8. The concern of every state Government has been to revise the Statute

Law including repeal of obsolete enactments as well as to change the

language so as to bring them into line with current usage. In the State

of Uttar Pradesh, this exercise has been taken various times as follows:-

1. U.P. Repealing and amending Act, 1956 ( U.P. Act No. 30 of

1956) by which 5 principal Acts were repealed and 10 Acts were

amended.

2. U.P. Repealing and Amending (Second) Act, 1957 (Act No. 5 of

1957) by which 01 Principal Act was repealed and 03 Acts were

amended.

3. U.P.Repealing and Amending Act 1958 ( U.P.Act No. 42 of

1958) by which 01 Principal Act was repealed and 10 Acts were

amended.

4. U.P.Repealing Act 2004 ( U.P.Act No. 32 of 2004) by which 03

Repealing and Amending Acts were repealed.

9. At Present as on 31-10-2017 the Statute Book of State of U.P. contains

about 2057 Principal and Amending Acts. The job of the Legislature

is not only to legislate new Acts, but at the same time the enactments

which have lost their value must also be repealed so that the statute

book is cleared and the Wagon-loads of Statutes should be reduced to

Cart-loads Statutes. The Object of Repealing and Amending Acts is

not to bring any change in law but to remove enactments which have

become unnecessary. After the creation of new State of Uttaranchal, so

many Acts , which were applicable to that State, when it was the part of

Uttar Pradesh, have lost their value as the New State of Uttaranchal has

its own legislative powers having independent Legislature.

10. One more aspect needs mention. Prior to 1950, the Acts were passed

with the name of State as “United Provinces”. It is suggested that now

all the Acts which are in force in Uttar Pradesh, should be known by

the name of State, i.e. “Uttar Pradesh” Accordingly Sub-clause (1) of

Section 2 of the proposed Bill it is being provided that if short title of

any Uttar Pradesh Act which in force on the date of commencement of

this Act, comprises the words “United Provinces”, then such words

shall be substituted by the words “Uttar Pradesh”. Further care has

already been taken by sub-clause (2 ) of Section 8 of the Uttar Pradesh

General Clauses Act, 1904.

11. Previously also, efforts were made by the then State Law Commissions

recommending repeal and amendment of various existing Acts. One of

such landmark effort was made by Justice K.N.Goyal Commission by

submitting its 11th Report in October 2001 recommending repeal of 859

Acts as well as amending 116 Acts after taking in to consideration the

enactments since 1795 till 2000.

12. Again Justice V.C.Mishra Commission in its Ninth Report-2011

submitted on 16th May 2011, recommended for repealing 201 Acts

which were passed in between 2001 to 2010. In addition to it , 23

enactments which cover the areas of State of Uttarakhand were also

recommended for their repeal. 49 more enactments were sorted out for

certain amendments on the ground that the State of Uttarakhand has

separate Jurisdiction. It is unfortunate that despite of passing of such a

long time of submitting the reports, the then Governments have failed

to take any result oriented action.

13. The present State Law Commission, which came into existence on 18th

August, 2017, decided to make study de-novo and found that various

recommendations of Justice V.C.Misra Commission are overlapping

with the recommendations of Justice K.N.Goyal Commission.

14. Justice Misra Commission also recommended for repeal of various

Notifications relating to the State of Uttarakhand. The Humble

submission of this commission is that the States of Uttar Pradesh and

Uttarakhand have been re-organized by the Central Act. The

Notifications form part of delegated, subordinate or subsidiary

legislation, and are issued in exercise of powers conferred by the

Statute. The subordinate Legislation device is often used for the

extension of the Acts in respect of territory and other objects and

duration of time. Therefore said Notifications issued by the then Uttar

Pradesh Government regarding some areas of the then Uttar Pradesh,

which now forms part of State of Uttarakhand, do not require any

specific amendment or repeal because such notification do not form

the part of the Act. At present there is no dispute of boundaries in

between Uttar Pradesh and Uttarakhand. Therefore such notifications

have no force in the state of Uttarakhand, unless they have been

adopted or reiterated by the State of Uttarakhand. Further more, any

notification may be annulled, modified, extended, expunged , varied or

reversed only by subsequent Notification and certainly amendment of

the Act is not required at all. The Notifications are issued by the

Executive and not by the Legislature. Therefore Legislative action is

not required.

15. The present study is not only confined for the period since May 2011

till date but the previous recommendations have also been considered

and an effort is being made to submit a comprehensive and combined

report considering the previous recommendations because till now no

action has been taken on the aforesaid reports. Moreover, more than 6

years have further passed when the last report was submitted and much

water has flown in Ganges since then. Therefore the Statutes upto 31-

10-17 have been taken into account.

16. The present Commission is also conscious of the fact that the

Commission headed by Justice K.N.Goyal had made a comprehensive

correspondence with various concerned Departments of State and very

few had responded to it. Some of the Departments were not even

aware of the Acts, and in turn they demanded the copy of the Act from

the Commission.(para 66 to 68 of the report ). Therefore it is

suggested that a soft copy of the present report may be sent to all the

Departments of the State through the Chief Secretary inviting their

objections/suggestions with in a stipulated period and if any

objection/suggestion is not received within aforesaid period, the

Legislative Department of State may be directed to proceed in the

matter. However if any objection/suggestion is received from any

Administrative Department, it should be considered thoroughly by the

Legislative Department.

17. In preparing the list of enactments, which are proposed to be repealed

and amended, the enactments whose subject matters clearly fall within

State List or Concurrent List of Seventh Schedule of Constitution Of

India , have been mainly considered.

18. For the sake of convenience, such proposals for repeal have been

divided into Three schedules as under:

1. FIRST Schedule contains such Acts which require repeal in

Toto.

2. SECOND Schedule contains such Acts which have been

previously repealed for the particular area but are still

prevalent in other areas of State of Uttar Pradesh.

3. THIRD Schedule contains such Amending Acts which in the

opinion of the Commission, should be repealed.

19. Detailed discussion is contained in each Schedule justifying the repeal.

The Draft of UTTAR PRADESH REPEALING AND AMENDING

BILL, 2018 has also been prepared which is annexed with this report.

20. Before coming to the Draft of UTTAR PRADESH REPEALING AND

AMENDING BILL, 2018, a brief summery is required regarding each

Schedule.

FIRST SCHEDULE

21. This Schedule contains 137 Acts which are proposed to be repealed in

whole for the reason that they are obsolete and have lost their utility.

The obsolete laws are repealed by the repealing Act and in the long-

run, there is no need to keep repealing Acts on the Statute Book.

Sections 6,6-c,7,and 24 of the U.P. General Clauses Act, 1904 takes

care of consequences of such repeal. For the sake of convenience, the

relevant provisions of U.P. General Clauses Act are re-produced here

as under:-

“6. Effect of Repeal- Where any Uttar Pradesh Act repeals any

enactment hitherto made or hereafter to be made, then, unless a

different intention appears, the repeal shall not-

(a) Revive anything not in force or existing at the time at

which the repeal takes effect; or

(b) Affect the previous operation of any enactment so

repealed or anything duly done or suffered there under,

or

(c) Affect any right, privilege, obligation or liability

acquired, accrued, or incurred under any enactment so

repealed; or

(d) Affect any penalty, forfeiture or punishment incurred in

respect of any offence committed against any enactment

so repealed; or

(e) Affect any remedy, or any investigation or legal

proceeding commenced before the repealing Act shall

have come into operation in respect of any such right,

privilege, obligation, liability, penalty, forfeiture or

punishment as aforesaid;

And any such remedy may be enforced and any such

investigation or legal proceeding may be continued and

concluded, and any such penalty, forfeiture or

punishment imposed as if the repealing Act had not been

passed.”

“6-C. Repeal or Expiration of law, making textual

amendments in other laws-

(1)Except as provided by sub-section (2), where any Uttar

Pradesh Act amends the text of any Uttar Pradesh Act or

Regulation by the express omission, insertion or substitution of

any matter, and the amending enactment is subsequently

repealed, the repeal shall not affect the continuance of any such

amendment made by the enactment so repealed, and in operation

at the time of such repeal.

(2) where any such amendment of text is made by any

temporary Uttar Pradesh Act or by an Ordinance or by any law

made in exercise of the power of the State Legislature by the

President or other authority referred to in sub-clause (a) of clause

(1) or Article 357, and such Act, Ordinance or other law ceases to

operate without being re-enacted (with or without modifications),

the amendment of text made thereby shall also cease to operation.

7. Revival of repealed enactments:- In any Uttar

Pradesh Act , it shall be necessary for the purpose of reviving,

either wholly or partially, any enactment, wholly or partially

repealed, expressly to state that purpose.

24. Continuance of appointments, notifications,

orders, etc. issued under enactments repealed and

re-enacted.- Where any enactment is repealed and re-enacted

by an Uttar Pradesh Act, with or without modification, then,

unless it is otherwise expressly provided, any appointment or

statutory instrument or form, made or issued under the repealed

enactment, shall so far as it is not inconsistent with the provisions

re-enacted, continue in force, and be deemed to have been made

or issued under the provision so re-enacted, unless and until it is

superseded by any appointment, or statutory instrument or form

made or issued under the provisions so re-enacted.

22. Perusal of above provisions makes it crystal clear that repeal of any

Uttar Pradesh Act will not affect any work or action taken under the

repealed Act nor it will adversely affect any punishment or penalty

already granted and suffered . However care has been taken not to

repeal any appropriation Act despite of above provisions. The Uttar

Pradesh Acts, by which Acts passed by the Union Government have

been amended, are also not being proposed to be repealed. Accordingly

repealing Acts have also been included in this Schedule. Reasons for

repeal have been mentioned in the Third Column and the Legislative

Department is requested to examine those reasons and also consult the

Concerned Administrative Department.

23. Thus in the back drop of aforesaid provisions, the Acts which are

proposed to be repealed by First Schedule are mentioned below along

with a short reason for its repeal.

Munsifs Act, 1896 (Uttar

This Act has become obsolete. For

the last about 70 years, no such

Honorary Munsif has been

appointed. Moreover the

nomenclature of Munsifs has also

changed to Civil Judges (Junior

Division).

4. Uttar Pradesh Primary

Education Act, 1919

(Uttar Pradesh Act No. 7 of

1919)

It requires to be repealed in view

of Uttar Pradesh Basic Education

Act, 1972.

5. The Canning College Act,1922


1922)

The Lucknow University was

established in 1920. The Canning

College was thereafter merged in

the said University. The Lucknow

University Act, 1920 was itself

repealed by Uttar Pradesh State

Universities Act, 1973.

6. Uttar Pradesh District Board

Primary Education Act , 1926


1926)

This Act was supplemental to the

District Boards Act, 1922 and

after the passing of the Uttar

Pradesh Basic Education Act,

1972 there is no justification for

continuing it on the statute book.

7. Naik Girls Protection Act, 1929


1929)

In view of the Immoral Traffic

(Prevention) Act, 1956, both of

these Acts have become

unnecessary.

8. Uttar Pradesh Minor Girls

Protection Act, 1929

9. Uttar Pradesh Special Powers

Act, 1932

(UP. Act No. 14 of 1932)

This Act had been passed to

combat the freedom movement. It

is notin consonance with the

fundamental rights. Hence„ it

deserves to be repealed.

10. Uttar Pradesh Opium Smoking

Act, 1934

In view of Narcotic Drugs and

Psychotropic Substances Act,

1985, this Act deserves to be

repealed.

11. Uttar Pradesh Encumbered

The object of this Act has already

been achieved. The amendments

Control Act, 1936

The Agriculture Directorate had

informed that cultivation of cotton

is only partially done in ten

districts of the State, but no action

was being taken under this Act.

The agricultural activities

regarding cultivation of Cotton

was not likely to be affected, if

this Act is repealed.

14. Uttar Pradesh First Offenders

Probation Act, 1938

In view of the Probation of

Offenders Act 1958 passed by

Parliament and enforced in Uttar

Pradesh , this Act should be

repealed.

In view of the Juvenile Justice Act

This Act repealed certain

provisions of the Bengal

Regulation XI of 1806. There is

no need to continue this Repealing

Act on the Statute Book.

18. Uttar Pradesh Sri Badrinath

and Sri Kedarnath Temples

Act, 1939

The twin sacred Temples of Sri

Badrinath and Sri Kedarnath are

located in the new State of

Uttarakhand. Hence the Act is

being repealed so far as our State

is concerned.

19. Uttar Pradesh Stayed Arrears

of Rent (Remission) Act, 1939

This Act has become redundant

and should be repealed.

20. Uttar Pradesh Debt

Redemption Act, 1940

This Act applied to loans

advanced before 1 June 1940. The

definitions of `agriculturists' and

'tenants' contained in section 2(3)

and section 2(18) respectively are

no longer operative.

21. Uttar Pradesh Regulation of

Agricultural Credit Act,

Most of the provisions of this Act

have already been deleted by the

Uttar Pradesh Regulation of

Money Lending Act, 1976. Only a

few sections remain which are

either unimportant or are covered

It should be repealed from the

statute book of Uttar Pradesh.

This Act relating to emergency

powers should be repealed. So far

requisitioning of vehicles during

elections are concerned, section

160 of Representation of People

Rampur is now a part and parcel

of Uttar Pradesh , and hence, this

Act has become redundant.

(Control) Act, 1950

It was doubtful whether the

production or supply of Jute goods

in the State still justifies the

Consequently, letters were written

by Previous Commission to

Pramukh Sachiv, Industries

Department as well as to Director,

Agriculture. The former did not

respond while the latter informed

the Commission that he was not

aware about the Jute Control Act.

By letter dated 03-08-01, the

Small Industries -Department has

informed that the post of Jute

Controller does not exist. Hence it

is being repealed.

36. Uttar Pradesh Local Authorities

Government to recover expenses of Census work from

the Local Authorities. It is doubt full that till now State

Government has recovered any such amount. Moreover,

the Local Authorities normally demand money from the

State Government to meet out their expenses. The matter

of Census is now covered by Entry 69 of Seventh

Schedule. Therefore this Act is unnecessary and should

be repealed.

SECOND SCHEDULE

24. Prior to Independence, various Regulations and Acts were promulgated

by the then Rulers regarding particular areas like Benares, Oudh,

Bundelkhand, Agra and other areas of the then United Provinces. Now

all these areas are the part of Uttar Pradesh and are now governed by

the General Law of Uttar Pradesh except any special Legislation passed

by the Uttar Pradesh Legislature. In this Schedule, such Regulations

and Acts have been taken which stood repealed in some areas but are

still continuing in other areas.

25. List 1 of Third Schedule of U.P.Zamindari abolition and land Reforms

Act, 1950 (Uttar Pradesh Act 1 of 1951) had repealed 20 Acts for those

areas where the Zamindaari was abolished. At present the Zamindari

has been abolished throughout the State. Therefore the partly repealed

Acts should be repealed in whole. Moreover, now the Uttar Pradesh

Revenue Code, 2006 has also been enacted and has come into force by

Uttar Pradesh Act 8 of 2012. Therefore such 20 Acts which were partly

repealed, should be repealed in whole.

26. U. P. Municipalities Act, 1916 which is now Uttar Pradesh Municipal

Corporations Act, 1959 had repealed the following Acts:-

1. U. P. Municipalities Act, 1916,

2. U. P. Town Areas Act, 1914,

3. U. P.Town Improvement Act, 1919,

4. U. P. Town Improvement (Appeals) Act, 1920,

5. Uttar Pradesh Town Improvement (Adaptation ) Act, 1948,

6. U.P. District Boards Act, 1922,

7. U.P. Local Bodies (Appointment of Administrators) Act, 1953,

8. Cawnpore Urban Areas Development Act, 1945

27. The above mentioned Acts were repealed by U.P. Municipal

Corporation Act, 1959 in the city areas only. However U.P.Town

Areas Act, 1914 has been repealed by U.P.Act No. 12 of 1994. In the

same way U.P.Town Improvement (adaptation) Act, 1948 has been

repealed by U.P.Act No. 29 of 1966. The U.P.District Board Act, 1922

has been repealed by U.P.Act No. 33 of 1961. Cawnpore Urban Areas

Development Act , 1945 has also been repealed and question does not

arise to repeal U.P.Municipalities Act, 1916 for the reason that it has

already been repealed. In the result following Acts remained for

repeal:-

2. U. P. Town Improvement (Appeals) Act, 1920,

3. U.P. Local Bodies (Appointment of Administrators) Act,

1953,

28. Subsequently in the year 1965, U.P.Avas evam Vikas Parishad Act,

1965 (U.P.Act 1 of 1966) was enacted which repealed U. P.Town

Improvement Act, 1919, U. P. Town Improvement (Appeals) Act,

1920, and Uttar Pradesh Town Improvement (Adaptation ) Act, 1948,

in the areas where U.P.Avas evam Vikas Parishad Act 1965 was

enforced. Therefore in the Second Schedule it is proposed to repeal

aforesaid U. P.Town Improvement Act, 1919, U. P. Town

Improvement (Appeals) Act, 1920, and Uttar Pradesh Town

Improvement (Adaptation ) Act, 1948,. It is also worth mention that

the U. P. Town Improvement (Appeals) Act, 1920, is Central

enactment but after the commencement of Constitution of India, this

subject falls within the legislative competence of State Government.

Accordingly 22 enactments are proposed to be repealed by Second

Schedule. Such Acts form part of the proposed Bill therefore there is

no need to repeat them here.

THIRD SCHEDULE

29. In the opinion of the Commission, the amending Acts need not to be

retained on the Statute Book . There are two types of amendments:

textual and non-textual amendments. A non-textual amendment has a

separate identity. It does not become part of the Act it purports to

amend yet it alters that Act. A Textual amendment amends an existing

Act by specifically stating:-

(a) The section where the amendments are to be made, and

how the amendments should be made; or

(b) Substituting a completely new section or subsection for the

existing section or subsection as it will read after the

necessary amendments have been made.

30. It is constitutional principle that a Legislature cannot fetter the hands of

a subsequent Legislature. An Act passed in one session can be repealed

by an Act passed in subsequent session. As far as Amending Acts are

concerned, the amendment takes effect on the date of enforcement of

the amending Act and it forms part of the Principle Act. If the

Legislature wants to undo the said amendment, a subsequent amending

Act is required. Mere repeal of the amending Act will not undo the

previous amendments. Section 6 of the Uttar Pradesh General Clauses

Act, 1904 makes it clear that Where any Uttar Pradesh Act repeals any

enactment hitherto made or hereafter to be made, then, unless a

different intention appears, the repeal shall not Revive any thing not in

force or existing at the time at which the repeal takes effect; or Affect

the previous operation of any enactment so repealed or anything duly

done or suffered there under, or Affect any right, privilege, obligation

or liability acquired, accrued, or incurred under any enactment so

repealed; or Affect any penalty, forfeiture or punishment incurred in

respect of any offence committed against any enactment so repealed; or

Affect any remedy, or any investigation or legal proceeding

commenced before the repealing Act shall have come into operation in

respect of any such right, privilege, obligation, liability, penalty,

forfeiture or punishment as aforesaid; and any such remedy may be

enforced and any such investigation or legal proceeding may be

continued and concluded, and any such penalty, forfeiture or

punishment imposed as if the repealing Act had not been passed.

31. Section 6-C of the Uttar Pradesh General Clauses Act, 1904 further

clarifies the position stating that where any Uttar Pradesh Act amends

the text of any Uttar Pradesh Act or Regulation by the express

omission, insertion or substitution of any matter, and the amending

enactment is subsequently repealed, the repeal shall not affect the

continuance of any such amendment made by the enactment so

repealed, and in operation at the time of such repeal.

32. In view of the above legal provision and legal protection, it is proposed

to repeal around 1007 amending Acts. It is also worth while to

mention that the Parliament in the past has also repealed various

Amending Acts. Other States have also taken this task and have

repealed various amending Acts.

33. The administrative department of the proposed Bill is the Legislative

Department of Government of U.P. and the present Bill is within

legislative competence of the State Legislature and in the opinion of

the Commission, prior assent of President or Governor is also not

required although it might have been taken for the Principle Act. The

Legislative Department may invite suggestions/objections from the

concerned administrative departments .

34. Commission would like to suggest that each Administrative

Department of the Government should have up-to-date amended copy

of enactments pertaining to their department and they should also have

the relevant Rules, Regulations, Notifications and other statutory

papers which will not only help in their day to day working but also

help in curving out the litigation.Much assistance has been taken from

UTTAR PRADESH REPEALING AND AMENDING BILL 2018

A

BILL

to repeal certain enactments and to amend

certain other enactments.

It is hereby enacted in the Sixty-ninth Year of

the Republic of India as follows :-

Short title and

commencement

1 (1) This Act may be called the Uttar

Pradesh Repealing and Amending Act, 2018.

(2) It shall come into force at once.

Substitution of

words "Uttar

Pradesh" In short

title

2 (1) Where the short title of any Uttar

Pradesh Act, in force on the date of

commencement of this Act, comprises the

words 'United Provinces', such words shall be

substituted by the words 'Uttar Pradesh.'

(2) All references to any such Uttar

Pradesh Act in any other law or statutory

instrument shall be deemed to be references to

the Act called by the short title as amended by

sub-section (1).

Repeal of Certain

enactments

3. Subject to the provisions of sections 6, 6-

C, 7 and 8 of the Uttar Pradesh General Clauses

Act, 1904, the enactments specified in the First

Schedule, the Second Schedule and the Third

Schedule are hereby repealed.

Savings 4. The repeal by this Act of any enactment

shall not affect any other enactment in which

the repealed enactment has been applied

,incorporated or referred to;

and this Act shall not affect the validity, invalidity, effect or consequences of

anything already done or suffered, or any right, title, obligation or liability already

acquired, accrued or incurred, or any remedy or proceedings in respect thereof or any

release or discharge of or from any debt, penalty, obligation, liability, claim or demand,

or any indemnity already granted or the proof of any past acts or things;

nor shall this Act affect any principle or rule of law, or established jurisdiction,

form or course of pleading, practice or procedure, or existing usage, custom, privilege,

restriction, exemption, office or appointment, notwithstanding that the same respectively

may have been in any manner affirmed, recognized or derived by, in or from any

enactment hereby repealed;

nor shall the repeal by this Act of any enactment revive or restore any jurisdiction,

office, custom, liability, right, title, privilege, restriction, exemption, usage, practice,

procedure or other matter or thing now existing or in force.
