In the case of a parent traveling with an infant or child, CDTA cannot require the eligible rider on ADA paratransit to travel with a PCA.  

However, CDTA operators are not allowed to carry infants or children on or off the vehicle. The following bullet points are intended to guide CDTA operators when children are being transported.

Infant:

An adult accompanying an infant on para-transit is responsible for the child

If the customer is in a wheelchair and is able to hold the infant safely, the infant may ride the lift while being held by the customer.

Once the customer has boarded the vehicle, the operator should ask whether the customer would like assistance transferring the infant to the seat.

If the answer is yes, the operator should ask whether there are any special instructions.

If the customer is unable to hold the infant safely and securely, a PCA or other adult must board with the infant. Operators are not allowed to carry infants on or off the vehicle.

If the infant cannot be boarded safely by either of these means, an alternative method must be found. Please contact a Supervisor for assistance.

Oxygen Tank Policy Posted 10.08.10

The ADA provides that transportation service must be provided to a rider who needs to bring along an oxygen tank.

For safety reasons, it is required that the rider is able to maintain control of the oxygen tank.

Passengers may travel with respirators, portable oxygen, and other life-support equipment, provided such transport does not violate laws or rules related to transportation of hazardous materials.

Passengers traveling with respirators, portable oxygen and other life-support equipment must follow safety procedures that ensure the protection of all passengers and transit employees.

When choosing to ride shared public transportation, it is the responsibility of the rider to select a size of oxygen tank that they can control.

The portable oxygen tank may not exceed 15 lbs. in total weight; 29 inches in height; and 4.38 inches in diameter

If the rider cannot pull an oxygen tank cart or carry or maintain control of the tank by him or herself, then the rider shall provide a Personal Care Attendant to perform those functions.

A portable oxygen tank or intravenous stand will only be transported by CDTA when it is medically necessary for the passenger.

Defective, leaking or otherwise unsafe or unfit tanks will not be allowed on the vehicle. The driver has the right to refuse to transport such equipment.

Portable oxygen tanks must be turned off when not in use; or the oxygen mask must be secured to the user’s face when in operation

The passenger may board the bus with more than one (1) portable oxygen tank, provided all tanks carried by the passenger are under the passenger’s control.

Strict adherence to all security procedures and protocols should be followed at all times: Bus operators should check their bus prior to leaving the garage, at the end of every trip and prior to parking their bus in any of our garages. Access Control including vehicle gates and access to our buildings should be strictly enforced.

EMPLOYEE STAND DOWN PROCEDURE

Occasionally, while supervisory personnel are performing their daily routines, they may observe a bus operator driving their bus in an unsafe manner.

These observations may occur during the performance of a supervisor’s regular tour assignment, a scheduled on-board observation, or while on a special duty assignment.

In all cases, when a supervisor witnesses an unsafe action by any employee operating a CDTA vehicle, the supervisor must respond to the action to ensure that it is not a repeated.

EMPLOYEE STAND DOWN PROCEDURE

In some instances the supervisor may determine that the unsafe action is a blatant disregard for the safety of our customers, our equipment, or the general public.

It is a supervisor’s responsibility to insure that our buses are operated in a safe manner, and if they determine that an operator is not driving safely they can and should take the operator out of service.

It is not only within their authority to do so; it is their responsibility.

EMPLOYEE STAND DOWN PROCEDURE

The operator will be disqualified from working again until he is counseled or completed Safety Remedial Training. Every attempt will be made to schedule a Safety Remedial within two days. Management will not reverse a supervisor’s decision for initiating a stand down. However, Management will determine what actions will follow the stand down

Some examples of when a “stand down” may be considered are:

•Multiple acts of aggressive driving (i.e. rolling stops, following too closely, failing to yield the right-of-way, imprudent speed, improper intersection approach, etc.)

•A supervisor witnesses a blatant violation of the NYS Vehicle and Traffic Law
