The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of Environmental Clearance for redevelopment of property bearing C.S. No. 1255, 1256, 1257, 1258,1260, 1261, 1262, 1263, 1264, 1265, 1308, 1309, 1310 & 1311 of Byculla, Division situated at Shaikh Burhan Kamruddin Street, Temkar Street E Ward, Mumbai, Maharashtra by M/s Mohd. Hussain Jalaluddin Nirban. The proposal was considered by the EAC in its meeting held on 9 th - 11th March, 2015. The proponent has informed that: 1. The present proposal involves redevelopment of property bearing C.S. No. 1255, 1256, 1257, 1258,1260, 1261, 1262, 1263, 1264, 1265, 1308, 1309, 1310 & 1311 of Byculla, Division situated at Shaikh Burhan Kamruddin Street, Temkar Street E Ward, Mumbai, Maharashtra. The project is located at Latitude 18° 57'47.21" N & Longitude 72° 49'52.95"E. 11. Total plot area is 1725.40 sqm, FSI area will be 14552.49 sqm and total construction area will be 30068.09 sqm. 2 nos. of buildings shall be developed - (Building 1 comprises of Ground + 1st to 5 th parking floors +6 th to 39 th residential floors and Building 2 comprises of basement (pt) + Ground +1st to 3 rd parking floors +4th to 18 th residential floors). Total Rehab residential tenements will be 206 nos. total rehab shops will be 22 nos, total sale residential tenements will be 76 nos. Height of Building-l will be 129.75 m and Height of Building 2 will be 59.49 m. 111. During construction phase approximately 100 KLD of water will be required for the construction activities. However the total requirement of the water may vary depending upon the construction activities.

2. The Ministry of Environment, Forests & Climate Change has consideredthe application. It is noted that the proposal is for grant of EnvironmentalClearance for redevelopment of property bearing C.S. No. 1255, 1256, 1257,1258,1260, 1261, 1262, 1263, 1264, 1265, 1308, 1309, 1310 & 1311 ofByculla, Division situated at Shaikh Burhan Kamruddin Street, TemkarStreet E Ward, Mumbai, Maharashtra by M/s Mohd. Hussain JalaluddinNirban.The proposal was considered by the EAC in its meeting held on 9th- 11thMarch, 2015. The proponent has informed that:

1. The present proposal involves redevelopment of property bearing C.S. 11. (i) The Project Proponent shall insure that the guidelines issued videthis Ministry's OM No. 19-2/2013-IA.III dated 09.06.2015, to befollowed for building and construction projects to ensure sustainableenvironmental management in pursuance of Notification No. 3252 (E)dated 22. 12.2014 under the EIA Notification, 2006, as applicable,are followed in this project.

IV. During operational phase, total water demand of the project is expected to be195 KLDwhich will be met by the MCGM/Recycled Water/RWH. Wastewatergenerated (181 KLD)uses will be treated in STPs of 200 KLD capacity. 162KLDof treated wastewater will be recycled (65 for flushing, 2 for gardening).About 95 KLDwill be disposed in to municipal drain. Total Sludge quantitygenerated will be 11 kg.

v. About 0.722 TPD solid wastes will be generated in the project. Thebiodegradable waste (0.428 TPD) will be processed in OWC and the non-biodegradable waste generated (0.294 TPD)will be handed over to authorizedlocal vendor.

VI. The total power requirement during construction phase is 100 kW and willbe met from BEST and total power requirement during construction phase is912 kW and will be met from BEST.

vn. Two DG sets of capacity 125 kVAand 180 kVAare proposed to be provided.V111. Rooftop rainwater of buildings will be collected in RWHtanks of total 24 cum

capacity for harvesting after filtration.IX. Parking facility for 123 four wheelers is proposed to be provided against the

requirement of 123 (according to local norms).x. Proposed energy saving measures would save about 23 % of power.

Xl. The cost of the project is Rs. 37.81 Crore.xu. Wildlife issues: It is not located within 10 km of any Eco-Sensitive areas.

X111. There is no court case pending against the project.XIV. Benefits of the project: Proposed development will provide quality and

residential accommodation to the people will also help in increase in livingstandards of the local residents.

xv. Letter received from Additional Chief Secretary, Environmental Department,Maharashtra dated 14.08.2014 that there is no case of violation asprescribed in the EIA Notification 2006.

3. The proposal was considered by the Expert Appraisal Committee (EAC)andrecommended in its 146th EAC meeting held on 9th - 11th March, 2015 forgranting Environmental Clearance. The Ministry of Environment, Forest &Climate Change hereby accords Environmental Clearance for the above-mentioned redevelopment of property bearing C.S. No. 1255, 1256, 1257,1258,1260, 1261, 1262, 1263, 1264, 1265, 1308, 1309, 1310 & 1311 ofByculla, Division situated at Shaikh Burhan Kamruddin Street, TemkarStreet E Ward, Mumbai, Maharashtra by M/s Mohd. Hussain JalaluddinNirban under the provisions of the Environment Impact Assessment Notification,2006 and amendments thereto and Circulars issued thereon and subject to thecompliance of the following specific conditions, in addition to the generalconditions mentioned below:

PARTA - SPECIFICCONDITIONS

I. Construction Phase

(ii) The Project Proponent shall obtain all necessary clearance/permission from all relevant agencies including town planningauthority before commencement of work.

(iii) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air (Prevention and Control of Pollution) Act,1981 and Water (Prevention and Control of Pollution) Act, 1974.

(iv) Total plot area is 1725.40 sqm, FSI area shall be 14552.49 sqm andtotal construction area shall be 30068.09 sqm. 2 nos. of buildingsshall be developed - (Building 1 comprises of Ground + 1st to 5thparking floors +6th to 39th residential floors and Building 2comprises of basement (pt) + Ground +lst to 3rd parking floors +4thto 18th residential floors). Total Rehab residential tenements will be206 nos. total rehab shops shall be 22 nos, total sale residentialtenements shall be 76 nos. Height of Building-1 shall be 129.75 mand Height of Building-2 shall be 59.49 m.

(v) During operational phase, total water demand of the project is 195KLD which shall be met by the MCGM/Recycled Water/RWH.Wastewater generated (181 KLD)uses shall be treated in STPs of 200KLDcapacity. Total sludge quantity generated shall be 11 kg.

(vi) About 0.722 TPD solid wastes will be generated in the project. Thebiodegradable waste (0.428 TPD) shall be processed in OWC and thenon-biodegradable waste generated (0.294 TPD) shall be handed overto authorized local vendor.

(vii) The total power requirement during construction phase is 100 kWwhich shall be met from BEST and total power requirement duringconstruction phase is 912 kW which shall be met from BEST.

(viii) Two DG sets of capacity 125 kVAand 180 kVA shall be provided. D.Gset shall be at least 6 m away from the boundary.

(ix) Rooftop rainwater of buildings shall be collected in RWH tanks oftotal 24 cum capacity for harvesting after filtration.

(x) Parking facility for 123 four wheelers shall be provided against therequirement of 123 (according to local norms).

(xi) The project proponent shall comply with the conditions of NOC/Clearance obtained from Fire Department.

(xii) All the construction shall be in accordance with the local buildingbyelaws. The Project Proponent shall obtain all necessary clearances.

(xiii) The project proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures with itsallottees, as projected, in perpetuity. This would be monitored by thedesigned Energy Conservation/ efficiency Authority in the State.

(xiv) Temporary toilets will be provided for all construction labour.

(xv) Suitable toilet fixtures for water conservation shall be provided.

(xvi) Proponent shall obtain permission for ground water withdrawal fromState Ground Water Authority.

(xvii) The rainwater harvesting plan should be incorporated by the CGWA.

(xviii)Provision shall be made for the housing of construction labour withinthe site with all necessary infrastructure and facilities such as fuel forcooking, mobile toilets, mobile STP, safe drinking water, medicalhealth care, creche etc. The housing may be in the form of temporarystructures to be removed after the completion of the project.

(xix) A First Aid Room will be provided in the project both duringconstruction and operation of the project.

(xx) All the topsoil excavated during construction activities should bestored for use in horticulture/landscape development within theproject site.

(xxi) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposedtaking the necessary precautions for general safety and healthaspects of people, only in approved sites with the approval ofcompetent authority.

(xxii) Soil and ground water samples will be tested to ascertain that there isno threat to ground water quality by leaching of heavy metals andother toxic contaminants.

(xxiii)Construction spoils, including bituminous material and otherhazardous materials, must not be allowed to contaminatewatercourses and the dump sites for such material must be securedso that they should not leach into the ground water.

(xxiv) Any hazardous waste generated during construction phase, should bedisposed off as per applicable rules and norms with necessaryapprovals of the State Pollution Control Board.

(xxv) The diesel generator sets to be used during construction phaseshould be low sulphur diesel type and should conform toEnvironment (Protection) Rules prescribed for air and noise emissionstandards.

(xxvi) The diesel required for operating DG sets shall be stored inunderground tanks and clearance from Chief Controller of Explosivesshall be taken, as applicable.

(xxvii) Vehicles hired for bringing construction material to the site should bein good condition and should have a pollution check certificate andshould conform to applicable air and noise emission standards andshould be operated only during non-peak hours.

(xxviii)Ambient noise levels should conform to residential standards bothduring day and night as per Noise Pollution (Control and Regulation)Rules, 2000. Incremental pollution loads on the ambient air andnoise quality should be closely monitored during construction phase.

(iii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management &Handling) Rules, 2000. No municipal waste should be disposed offoutside the premises.

Adequate measures should be made to reduce ambient air and noiselevel during construction phase, so as to conform to the stipulatedstandards by CPCB/ SPCB.

(xxix) Fly ash should be used as building material in the construction asper the provisions of Fly Ash Notification of September, 1999 andamended as on 27th August, 2003.

(xxx) Ready mixed concrete must be used in building construction.

(xxxi) Storm water control and its re-use as per CGWB and BIS standardsfor various applications.

(xxxii) Water demand during construction should be reduced by use of pre-mixed concrete, curing agents and other best practices referred.

(xxxiii) Permission to draw ground water shall be obtained from thecompetent Authority prior to construction/ operation of the project.

(xxxiv) Separation of grey and black water should be done by the use of dualplumbing line for separation of grey and black water.

(xxxv) Fixtures for showers, toilet flushing and drinking should be of lowflow either by use of aerators or pressure reducing devices or sensorbased control.

(xxxvi) Use of glass may be reduced by up-to 40% to reduce the electricityconsumption and load on air-conditioning. If necessary, use highquality double glass with special reflective coating in windows.

(xxxvii)Regular supervision of the above and other measures for monitoringshould be in place all through the construction phase, so as to avoiddisturbance to the surroundings.

(xxxviii)Under the provisions of Environment (Protection) Act, 1986, legalaction shall be initiated against the project proponent if it was foundthat construction of the project has been started without obtainingenvironmental clearance.

II. Operation Phase

(i) The quantity of fresh water usage, water recycling and rainwaterharvesting shall be measured and recorded to monitor the waterbalance as projected by the project proponent. The record shall besubmitted to the Regional Office, MoEF&CC along with six monthlyMonitoring reports.

(ii) The treated wastewater of 162 KLD shall be recycled and reused forflushing (65 KLD)and gardening (2 KLD) to reduce the demand offresh water as committed. About 95 KLD shall be disposed in tomunicipal drain.

(iv) The Operation and Maintenance of STP shall be made in the MoUwith STP supplier. Project Proponent shall ensure regular operationand maintenance of the STP.

(v) Parking facility with 6 m clear driveway shall be provided ascommitted.

(vi) The Project Proponent shall explore the possibilities of reusing thetreated wastewater from nearby projects.

(vii) The installation of the Sewage Treatment Plant (STP) should becertified by an independent expert and a report in this regard shouldbe submitted to the Ministry before the project is commissioned foroperation. Treated affluent emanating from STP shall be recycled/reused to the maximum extent possible. Treatment of 100% greywater by decentralized treatment should be done. Discharge ofunused treated affluent shall conform to the norms and standards ofthe State Pollution Control Board. Necessary measures should bemade to mitigate the odour problem from STP.

(viii) The solid waste generated should be properly collected andsegregated. Wet garbage should be composted and dry/inert solidwaste should be disposed off to the approved sites for land fillingafter recovering recyclable material.

(ix) Diesel power generating sets proposed as source of back-up powerfor elevators and common area illumination during operation phaseshould be of enclosed type and conform to rules made under theEnvironment (Protection) Act, 1986. The height of stack of DG setsshould be equal to the height needed for the combined capacity of allproposed DG sets. Use low sulphur diesel. The location of the DGsets may be decided with in consultation with State Pollution ControlBoard.

(x) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measured atthe boundary of the building shall be restricted to the permissiblelevels to comply with the prevalent regulations.

(xi) The green belt of the adequate width and density preferably withlocal species along the periphery of the plot shall be raised so as toprovide protection against particulates and noise.

(xii) Rain water harvesting for roof run- off and surface run- off, as plansubmitted should be implemented. Before recharging the surface runoff, pre-treatment must be done to remove suspended matter, oil andgrease. The borewell for rainwater recharging should be kept at least5 mts. above the highest ground water table.

(xiii) Energy conservation measures like installation of CFLs/TFLs for thelighting the areas outside the building should be integral part of theproject design and should be in place before project commissioning.Use CFLs and TFLs should be properly collected and disposed

off/sen t for recycling as per the prevailing guidelines / rules of theregulatory authority to avoid mercury contamination. Use of solarpanels may be done to the extent possible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayedon the website of the concerned State Pollution Control Board. TheEC letter shall also be displayed at the Regional Office, DistrictIndustries centre and Collector's Office/ Tehsildar's office for 30 days.

(ii) The funds earmarked for environmental protection measures shall bekept in separate account and shall not be diverted for other purpose.Year-wise expenditure shall be reported to this Ministry and itsconcerned Regional Office.

4. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be given fullcooperation, facilities and documents/ data by the project proponents during theirinspection. A complete set of all the documents submitted to MoEF&CC should beforwarded to the CCF, Regional office of MoEF&CC, Nagpur.

5. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

6. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection) Act,1986, to ensure effective implementation of the suggested safeguard measures ina time bound and satisfactory manner.

7. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil Aviation Department,Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall beobtained, as applicable by project proponents from the respective competentauthorities.

8. These stipulations would be enforced among others under the provisions ofWater (Prevention and Control of Pollution) Act, 1974, the Air (Prevention andcontrol of Pollution) act 1981, the Environment (Protection) Act, 1986, the PublicLiability (Insurance) Act, 1991 and EIA Notification, 2006.

9. The project proponent should advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded Environmental Clearance and copiesof clearance letters are available with the State Pollution Control Board and mayalso be seen on the website of the Ministry of Environment, Forests & ClimateChange at http://www.envfor.nic.in. The advertisement should be made withinSeven days from the date of receipt of the Clearance letter and a copy of the sameshould be forwarded to the Regional Office of this Ministry at Nagpur.

10. This Clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation v/ s. Union of India in Writ Petition (Civil)No.460 of 2004 as may be applicable to this project.

11. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section 16of the National Green Tribunal Act, 2010.

12. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and the LocalNGO, if any, from whom suggestions/ representations, if any, were received whileprocessing the proposal. The clearance letter shall also be put on the website ofthe company by the proponent.

13. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall updatethe same periodically. It shall simultaneously be sent to the Regional Office ofMoEF&CC, the respective Zonal Office of CPCB and the SPCB. The criteriapollutant levels namely; SPM, RSPM, S02, NOx (ambient levels as well as stackemissions) or critical sectoral parameters, indicated for the project shall bemonitored and displayed at a convenient location near the main gate of thecompany in the public domain.

14. The environmental statement for each financial year ending 31st March inForm-Vas is mandated to be submitted by the project proponent to the concernedState Pollution Control Board as prescribed under the Environment (Protection)Rules, 1986, as amended subsequently, shall also be put on the website of thecompany along with the status of compliance of EC conditions and shall also besent to the respective Regional Offices of MoEF&CC bye-mail.
