S.L.A.P.P. is an ACRONYM meaning Strategic Lawsuit AgainstPublic Participation. This ACRONYM was coined in the 1980s.

According to EnviroManiacActivists, S.L.A.P.P. is a lawsuit

that intends to censor, intimidate, and silence them with the

burden of the cost of a legal defence until they abandon their

criticism or opposition. The self-serving EnviroManiacActi-

vists have CONVENIENTLY taken the position that S.L.A.P.P. is

a form ofCENSORSHIP. This position is preferable than admit-

ting that there must be CONSEQUENCES when they concoct

FEARMONGERING, FRAUDULENT LIES, MISCONCEPTIONS, COER-CION, THREATS, DECEPTIONS, TERROR, and PARANOID CON-

SPIRACIES about pest control products.

One of the first cases in Canada to deal with S.L.A.P.P. was

Fraser v. Saanich, where the British Columbia Supreme Court

struck out the claim of a hospital director against the District of

Saanich, holding that it was a meritless action designed to si-

lence or intimidate the residents who were opposed to the

plaintiffs plan to redevelop the hospital facilities.

Following the decision in Fraser v. Saanich, the Protection of

Public Participation Act went into effect in British Columbia in

April, 2001. It was REPEALED in August 2001.

In the Province of Quebec, an antiS.L.A.P.P. bill was adopted

by the National Assembly on June 3rd

, 2009. As of now, Que-

becs amended Code of Civil Procedure is the ONLY anti

S.L.A.P.P. mechanism in force in Canada. Quebec s a LEGAL

HAVEN for radical EnvironmentalManiacActivists, allowingthem to maintain an UNRESTRAINED climate of EnviroTerror

The fact the Governments FAILED IN THEIR DUE DILIGENCE can be at-tributed to a number of factors WITHOUT making the accusationofCORRUPTION, so we thought.

CORRUPTION is the granting of favours inconsistent with offi-cial duties. The failures in this case are the failure to act,or in the case of a government office, to exercise the duty ofcare, or the mandate of their respected offices.

VEXATIOUS LITIGATION, ABUSE OF POWER, and the ABUSE OF DISCRETION,are legal terms, in hindsight, that would describe the processand subsequent municipal and provincial pesticide bans.

It is the responsibility of the industry to try and miti- gate any damages cause by false and misleading infor-

The Attorney General originally LACKED THE FORTITUDE to charge

any of the activist groups with FRAUD . . . so we gave them ahelping hand to get the process moving.

FRAUD is made up ofTWO very crucial fundamentals that need tobe proven. The first is dishonesty, and the second is dep-rivation.

We have been able to show at public meetings and in writtensubmissions to the Ontario Government that information pre-sented as fact was in reality FABRICATED by well funded activistgroups, with the intent of affecting and depriving the economicinterest of the lawn care industry.

Given the fact this issue has been based on aFRAUD may extendthe statutory limits on recovering damages created by some ofthe older bylaws. We may be able to RECOVER LOSSES, for exam-ple, in Toronto, where the municipality had the authority to en-act a bylaw, but acted based on FALSE INFORMATION.
