As of 2018, the minimum allowable wage is HKD 4,410 (approximately USD 560) a month. 1 Employment agencies are allowed to charge a maximum fee of ten per cent of a domestic worker’s first month’s wage for their services and may not be charged in advance. 2 The Standard Employment Contract for migrant domestic workers requires employers to provide their domestic workers with free food, or to pay a food allowance of at least HKD 1,053 (approximately USD 134) per month. 3 Domestic workers are entitled to one rest day a week; if the domestic worker is willing to work on a rest day, employers must compensate their domestic worker for working on a rest day. 4 Migrant domestic workers are entitled to at least seven days (up to a maximum of 14 days depending on length of employment) of paid annual leave a year plus 12 statutory holidays. Employers must also pay for one return ticket for their domestic worker’s place of origin for each two year contract. 6 Employers must provide migrant domestic workers with free accommodation with reasonable privacy. Sharing a room with an adult or teenager of the opposite sex, or a bed in the corridor, are considered unacceptable sleeping spaces. 7 As per the Standard Employment Contract, employers are responsible to pay for a migrant domestic worker’s medical examination fees, authentication fees by the relevant consulate, visa fee and insurance fee. 8 Employers are obliged to pay for medical treatment for their domestic workers if they are ill or suffer personal injury during their time of employment. 9 Domestic workers shall only be responsible for domestic duties such as cleaning, cooking, child minding and caring for an elderly family member. Domestic workers are not permitted to work for anyone other than their employer. 10 Both a migrant domestic worker or their employer may cancel a contract with a month’s notice. Mulai tahun 2018, upah minimum yang resmi adalah HKD 4,410 (sekitar USD 560) setiap bulan.1

Agen tenaga kerja diperbolehkan untuk membebankan biaya komisi atas jasa yang telah diberikan sebesar maksimum sepuluh persen dari gaji bulan pertama dan tidak dapat ditagih di muka.2

Dalam Kontrak Kerja Standar bagi pekerja rumah tangga migran di Daerah Administratif Khusus Hong Kong, Cina, majikan diwajibkan untuk menyediakan makanan bagi pekerja rumah tangga mereka secara cuma-cuma atau memberi uang makan paling sedikit HKD 1.053 (sekitar USD 134) per bulan.3

Pekerja rumah tangga berhak atas satu hari libur dalam seminggu; jika pekerja rumah tangga bersedia bekerja pada hari libur, majikan harus memberi kompensasi kepada pekerja rumah tangga mereka karena bekerja pada hari libur.4

Pekerja rumah tangga migran berhak atas setidaknya tujuh hari (hingga maksimum 14 hari tergantung pada masa kerja) cuti berbayar dalam setahun ditambah 12 hari libur resmi. Majikan juga harus membayar satu tiket

pulang ke tempat asal pekerja rumah tangga mereka untuk setiap dua tahun masa kontrak.6

Majikan wajib menyediakan tempat tinggal dengan privasi yang wajar bagi pekerja rumah tangga migran secara cuma-cuma. Tidak diperbole-hkan meminta pekerja rumah tangga berbagi kamar dengan orang dewasa atau remaja lawan jenis atau tidur di lorong.7

Sesuai dengan Kontrak Kerja Standar, pengusaha bertanggung jawab untuk membayar biaya pemeriksaan medis pekerja rumah tangga migran, biaya otentikasi oleh konsulat yang berwenang, biaya visa serta biaya asuransi.8

Majikan diwajibkan untuk membayar perawatan medis bagi pekerja rumah tangga mereka jika mereka sakit atau mengalami cedera selama masa kerja.9

Pekerja rumah tangga hanya bertanggung jawab atas tugas-tugas rumah tangga seperti membersihkan rumah, memasak, mengasuh anak dan merawat anggota keluarga lanjut usia. Pekerja rumah tangga tidak diizinkan bekerja untuk orang lain selain majikan mereka.10

Baik pekerja rumah tangga migran maupun majikan dapat membatalkan kontrak dengan pemberitahuan satu bulan sebelumnya. Jika majikan melewati periode pemberitahuan ini, sebagai gantinya majikan wajib memberi uang senilai satu bulan gaji.11

Majikan tidak diperbolehkan untuk memberhentikan pekerja rumah tangga jika pekerja rumah tangga tersebut hamil.12

Pekerja rumah tangga tidak dapat diberhentikan karena bergabung atau membentuk suatu serikat pekerja atau organisasi.5
