COMMUNITY DEVELOPMENT OBJECTIVES

Municipalities Planning Code and various loca1 goals and obj ectives.The adoption and enforcement of these regulatioi.s is intend6d toprovid.e the municipality with procedures-which will assist in directingits growth and developnent in accordance with local needs and desires.

Pertinent 1ocal goals which these regulations are intended tobring to fruition relate to such factors is land use, populationdensity, streets and traffic and other comrnunity tacirities andutilities, generally as defined in the Forty.trout,.gorough.Master p1an.

More specifically, it is intended to:1. create-a pattgrn of land uses which are compatible and

harnonious, where a suitable environment nai be createdfor residential, commericaL and industrial functions.The protection of our present and future residential areasis a_prime concern; as well as the reservation and pro-tection of lands which are considered desirable and^suitable for comnerical and ind.ustrial uses, but not thoseindustrial uses which will ernit nuisances r^riich would havean adverse affect on any part of the Corununity.

2. Maintain a density of population which can feasibly bes,erved by the streets and other public facilitieswhich presently exist or can be ieasonablv providedby the rnunicipality

3. Direct the types of development and the intensity ofdevelopment in strch a mannbr as will not place aitunreasonabl'e burden on the capacity of 1otal streetsand other public facilities.

4. Preserve and characterl lppearance and integrity of thecommunity in keeping with the present pattein airdcharacter of developrnent.

5. Encourage_ the growth and development of the Municipality in-cluding-the expansion of commerical and manufacturingactivities.

2.330 Division of Lot or_larcel in Single Ownership

Where a zone boundary line divides a 1ot orparcel in singLe ownership at the time of thepassage of this Ordinance, any use authorizedor permitted in either zone may be extended adistance not to exceed fifty (50) feet beyondthe boundary of the zone in which such use isauthorized or perrnitted.

DEGREE OF RESTRICTIVENESS

The phrase "more restrlctive usesrr as enployed in thisOrdinance shall mean the following:

Those uses perrnitted in a P-f Zone are the mostrestrictive.

All other uses are less restrictive in the orderthey are permitted in the Zones in the sequenceshown: R-f, C-1, M-1,

ltihere a use is specifically enumerated in a lessrestrictive zorLe, such use sha11 not be permittedin a more restrictive zorLe unless it is specificallyenumerated as a permitted use therein.

2.500 LIMITATION OF LAND USE

Except as provided in this Ordinance, no building or partthe.reof or other structure sha11 be erected, aitered,ad.<led to or enLarged, nor sha11 any land, builditrgsrstructures or premises be used, designed or intended tobe used. for any. purpose other than the uses hereinafterlisted as perrnitted in the zone in which such buildingor premises are located.

CLASSIFICATION OF ANNEXED LANDS

PERFORMANCE STANDARDS

6.100 GENERAL APPLICATION

Perrnitted and special uses enumerated in the ttcrr and rrMrl

Districts, and uses accessoxy thereto, are subject to thefollowing performance standards and procedures. ZONING HEARING BOARD

8.100 ORGANIZATION AND PROCEDURE

Pursuant to the provisions of the Pennsylvania Muni-cipal.ity Planning Code, Article fX, a Zoning HearingBoard is hereby established.

8.150 Soard! s Functions

8.151 Special Exceptions. The Board shal1 hear and@ special exceptions inaccordance with the standards and criteriaset forth herein. In granting a special ex-ception, the board nay attach such reasonableconditions and safeguards, in addition tothose expressed in.the ordinance, as it naydeem necessary to implement the purposes ofthis zoning ordinance.

8.152 .Unified Appeals. 8.153 Challenge to the Validity of any Ordinance or-
