The current Covenants are 26 years old.

“The Developer” is mentioned 109 times, and there is no longer a Developer. Focus of present document is on protecting the Developer’s interests.

Assessment process has changed. Discussion on common property no longer applicable.

Lakes’ ownership and maintenance for example. Other outdated issues—like large satellite dishes, and

on-street parking Current document is confusing and wordy. There is no minimum dwelling size.

Covenants Protect Our Property Value

Streamlining and updating the Covenants will make them easier to understand and help ensure compliance.

By making them more relevant, we are strengthening our home owners’ association and its ability to protect our neighborhood.

By-Laws Need to be Revised

We have restructured the document to reflect the purpose of the By-Laws, their administration and the function of Furey Plantation Property Owners Association.

Removed information already in Covenants to simplify document. The Covenants are the legal requirements for our properties.

Added option for the Furey Plantation Property Owner Board to retain non-voting “advisors.”

Streamlined the required “Committees” to two. Moved dwelling size requirements to the Covenants.

Summary

We have not suggested any radical changes.We simplified much of the wording, corrected

typos and grammatical errors.This presentation deals primarily with the changes from the old documents to the newly proposed.

PRIMARY CHANGE—Replacing “The Developer” with “The Association”

THIS DECLARATION, made this 21st day of December, 1987, by Furey Development, Inc., hereinafter called "Developer.”

THIS AMENDED and RESTATED DECLARATION is made this _____day of __________, 2______, by FUREY PLANTATION PROPERTY OWNERS' ASSOCIATION, INC., hereinafter referred to as "ASSOCIATION.”

All references and requirements for the “Developer” are deleted.

Other Changes Simplified the list of activities requiring Architectural

Control Committee approval. Detailed the process for obtaining Architectural Control

Committee approval. Inserted a minimum dwelling unit size of 2700 square feet. Changed the size of trees to be removed requiring ACC

approval from 4 to 12 inches in circumference. Increased the size of trucks permitted to be parked in

residential driveways from ½ ton to ¾ ton. Listed vehicle types permitted.

Other Changes 2

Annual assessments versus monthly assessments. Removed authorization of Furey Plantation Property

Owners’ Association Board to mortgage common property. Removed outdated provisions on ownership transfer of the

ponds or lakes. Removed provisions for restricting use of roadways, as the

roads are now public rights-of-ways. Removed provisions for transferring community property to

public and private utilities.

Other Changes 3

Limits FPPOA Board of Directors’ ability to suspend owner privileges for failure to pay assessment(s).

Changed the response time for payment of Association-required trash removal from 10 days to 30 days.

Increased FPPOA Board authorized spending level without general membership approval from $1,000 to $2,500.

Added a requirement for pet owners to clean up after their pets.

What Do We Need From You?

Any concerns you have with the changes. Indication of agreement or disagreement with

planned changes.

The documents will require some expenses for a Lawyer to review and

file. We do not want to spend the money unless the changes are

supported.

Time Spent

Your Furey Plantation Board members created a subcommittee to begin the process of new Covenant and Bylaw approval.

This Committee consists of the entire FPPOA Board and Larry Tiller.

The FPPOA Covenants and Bylaws have been studied line-by-line throughout this year in many different meetings.
