…or a change in the cycle?
XI Convegno internazionale in ricordo di Marco Biagi. MODENA 2013
THE TRANSNATIONAL DIMENSION OF LABOUR RELATIONS
• A NEW ORDER IN THE MAKING? • A TRANSNATIONAL ORDER IMBALANCED? • IS THE CHANGE OF A CYCLE? • ... YES !!! • THE ANNOUNCED DECAY OF EUROPEAN LABOR
LAW • The end of a model of industrial relations ?.

Towards the end of the model of labor relations… or a change in the cycle?
• The economic crisis: accelerator of the change • Nothing will turn to be the same!! • Evolution of labor relations. Basic phases (Martín Artiles)
– Wild capitalism and origin systems (1870-1914) – Between the wars and tripartism (1919-1939) – Institutionalization of labor relations(1950 - ...)
• Another transitional period to a new phase? • Are we able to definte it?

Towards the end of the model of labor relations… or a change in the cycle?
• The change of the model of labor relations. Two elements: 1.- The state framework of labor relations systems *Labor regulation, a weak balance in the EU *Abandoning of sovereignty and the political
emptiness is taken for “economic reality” 2.- The weakening of the neocorporatism as political
practice: Spain, Portugal, Greece… Troika…

Towards the end of the model of labor relations… or a change in the cycle?
• The end of the socio democratic pact • New phase with an involution character • Weight loss of labor law, is parallel to the decrease of the
“political role” of trade unions, and to the decline of this sociopolitical phenomenon for resolution of laboral conflict, that we call “neocorporatism”.
• A spanish point of view: – The Royal Decree-Law 10/2010, of urgent measures to reform
the employment market (PSOE - goverment) – The Royal Decree-Law 3/2012, of 10 february, of urgent
measures for labour market reform (PP- goverment) • The unilateral decision of the employer, Vs the collective
bargaining: THE CHANGE OF THE MODEL

Towards the end of the model of labor relations… or a change in the cycle?
• The key elements of Spanish labour reforms: 1.- Priority of the company collective bargaining *Worker’s Statute. Art. 83.1 : Collective bargaining
agreements shall have the scope of application agreed upon by the parties
* Art.84.2: The regulations of the terms in a company collective bargaining…, give precedence over any state, autonomus community or lower level sector-based collective bargaining agreement, in any case
2.- Achieving stability in collective bargaining agreements
