wCO Adopts Amendments To HS SystemAt its 43rd Session which took place at World Customs Organisation (WCO) headquarters from 09 to 20 March 2009, the Harmonised System (HS) Committee adopted amendments to the international HS goods nomenclature in the context of the 4th review cycle.

According to the WCO these amendments were due to be submitted to the WCO Council for approval in June 2009. Environmental and social issues are a major feature of the amendments, particularly the use of the HS as the standard for classifying and coding goods of specific importance to food security and early warning data falling within the ambit of the Food Security Information for Action Programme of the UN Food and Agricultural Organisation (FAO).

Once approved by the WCO Council, all amendments, except those for which an objection has been timeously lodged with the WCO Secretariat, will enter into force for all Contracting Parties

to the HS Convention on 01 January 2012.

Implementation Paperless Release InitiativeIn a letter dated 08 June 2009 the South African Revenue Service (Sars) announced its Paperless Release Initiative which was planned to be implemented on 23 May 2009.

According to Sars, during a recent prioritisation exercise it was however agreed that the implementation of a new Customs Risk Engine should receive a higher priority as this would enable Customs to improve on the quality of stops/detentions, which in turn will have a positive impact on the paperless initiative. This was done with effect from 01 June 2009.

Sars now envisages that the paperless initiative will be ready for implementation on 04 July 2009.

Tariff Applications – Comment Due TodayThe reduction in the rate of customs duty on tubes, pipes and hoses of vulcanised rubber

(excluding hard rubber) without fittings, reinforced or otherwise combined with only metals, from 15% ad valorem to free of duty.

The reduction in the rate of customs duty on rope lights, having a casing of polymers of vinyl (chloride) with an outside diameter of 13mm or more but not exceeding 15mm, internally fitted with inter-connected lamps from 20% ad valorem to free of duty, by the creation of an additional 8-digit tariff subheading.

The increase in the rate of customs duty on spades and shovels of a maximum blade width of more than 150mm but not exceeding 200mm from free of duty to 20% ad valorem.Comment due by 03 July 2009.

Bilateral Investment Treaties Policy ReviewThe Department of Trade and Industry (the dti) has initiated a review into Bilateral Investment Treaties (BITs) entered into by South Africa from 1994 to date.

The dti has developed a draft policy review document on which comment is due by no

later than 24 July 2009.

Trade Remedy Application – Comment Due A notice appeared in the Government Gazette on the initiation of an investigation into the alleged circumvention of the provisional duties against imports of tall oil fatty acid originating in or imported from Sweden.

The application was lodged by Oleochemical Products, the sole manufacturer of the product in the Southern African Customs Union (Sacu), who indicated that the Sacu importers had shifted their sourcing to the United States of America.

All interested parties have until Monday, 06 July 2009 to provide their completed Importer, or Exporter Questionnaires.

General sales agents Express Air Services (EAS) have just been appointed general sales and service (GSSA) and cargo handling agent for Kenyan-based Astral Aviation in SA, Namibia, Zambia and Zimbabwe.

Looking at his mental map of the EAS aviation network in southern Africa, MD Garry Marshall described the link-up as “providing an important East African dot in our ‘join-up-the dots’ cartographic coverage of the continent”.

Astral is a major player in aviation in East Africa, he told FTW, operating a code-share agreement with Lufthansa Cargo and sharing its twice-weekly f lights of an MD11 freighter between Johannesburg and Nairobi.

“Astral also operates a lot of freighter f lights out of Nairobi to various destinations, including an East-West Africa connection which is a bonus for us.”

Other dots on the EAS map of sub-Saharan Africa are filled in by other client airlines.

“We cater for Air Uganda,” said Marshall, “selling its cargo space and handling its cargo for f lights to

Nairobi, Dar es Salaam, Mombasa and Juba – all places where EAS has a cargo operation.

We also outsource the cargo operation for the new carrier, Zambezi Airlines, which has started operating out of Lusaka in Zambia to a variety of destinations.”

Added to that is the regional muscle of the SA-based airline, Comair.

“All this makes us a pretty strong force in southern Africa,” said Marshall, “allowing us to tranship between our airline clients and really join up the dots around the sub-continent.”

Beware of insurance implications of non-compliance with Security 108By Alan Peat

The security of air cargo has lagged behind stringent baggage and passenger security, according to Bob Garbett, MD of Professional Risk & Asset Management and chairman of the Business Aviation Association of Southern Africa (Baasa).

“And, with 80% of air cargo worldwide landing up on passenger aircraft,” he told FTW, “this exposes a massive flaw in the armour of airline security.”

It’s really only the imposition next month of the Part 108 security regulations for air cargo that stands to help fill that gap.

“But,” said Garbett, “the two-pace-forward, three-pace-back experience with Part 108 over the past number of years has, unfortunately, contributed to an apathy that now exists in certain quarters.

“This has had the net effect of creating a wait-and-see-mindset, rather than a pro-active approach.”

The problem, as Garbett saw it, was that Part 108 had taken several years, and a great deal of time and input from the aviation industry and others, to reach the point where minister of transport,

then Jeff Radebe, announced the deadline for introduction of these measures in SA was July 1.

And it’s a deadline that you can’t get around.

If air cargo does not comply with the regulations from this date – whether regional, domestic or international – it may not be carried on any aircraft, whether scheduled or air charter, from any SA airport. This provision also demands that SA-registered aircraft may also only carry cargo from outside SA which has complied with these regulations or their equivalent.

But the “apathy” and “wait-and-see” reaction still bothers Garbett.

“It is almost a foregone conclusion that, unless there is ongoing and active stimulation of Part 108 measures, this potential complacency will set in,” he told FTW.

However, he also noted that this would be balanced by the forwarding or courier agents having to appoint specifically trained “designated officials” who are responsible to the SA Civil Aviation Authority (SACAA) to ensure that the measures are implemented and are ongoing.

“These designated officials,” Garbett added, “are also responsible for ensuring that the senders of cargo (consignors) implement and continue to apply the Part 108 security measures. The Civil Aviation Inspectorate, formed for this specific purpose, will also play a major role in the ongoing vigilance required.”

There will also be pressures from the marine insurance industry – which covers all the cargo and aircraft insurance needs.

“Liability insurance underwriters will certainly take a dim view of non compliance with these measures,” said Garbett, “which creates a real

possibility of claims being repudiated. And we should all be aware that claims involving passenger aircraft could well run to hundreds of millions of US dollars.

“The silver lining is that these measures will increase general logistics security and help to deter fraud.”

The Department of Customs and Excise has been working on a modernisation programme which they hope will vastly improve efficiency and at the same time increase revenue. It is envisaged that the first phase of this programme will be rolled out over the next two months.

Historically there have been frustrating delays at time of Customs clearance. In line with its modernisation programme, Customs will be shifting its focus to pre- and post-inspection audits which should reduce the number of inspections at time of clearance, thereby streamlining the Customs clearance procedure.

In order to facilitate the increased number of pre- and post-inspection audits, Customs will be employing approximately

one thousand auditors to carry out this task and will furthermore be utilising a new risk engine which they hope will lead to improved consistency in decision making at branch office level by removing the discretionary powers of officers in most instances.

The risk engine will be automatically updated with information for a particular client, thus forming a comprehensive, reliable and factual database free of human bias. This will, according to Customs, prevent repetitive, unnecessary stops and queries which are costly and time-consuming for both Customs and the client.

The programme also aims to eliminate manual submissions entirely. Should Customs call for documents they will be able to be

submitted via facsimile, e-mail or online through Sars’ website. This seems to indicate that manual submissions of any kind will not be permitted and clients will have to make use of the EDI facility. Vouchers of Correction as we know it are soon going to be a thing of the past. Although details are sketchy, the intention is that corrections will be done online.

Furthermore Customs is working on a single registration document for all client types, thus simplifying the current licensing and registration process greatly.

These are just a few of the things that the Department of Customs proposes to implement in the very near future in order to encourage trade across our borders and increase revenue.

There has been a tale doing the rounds, both internationally and in SA, that the Japanese sea carrier, Mitsui OSK Line (MOL), was considering “spinning off” its container division.

But MOL has no plans to quit the container business, according to Andrew Weiss, Cape Town-based marketing team leader for the line.

He suggested that we should read a release from head office which clearly states that the press reports were a result of “a misinterpretation of remarks” made by MOL financial director Yonetani in an interview with press agency, Reuters.

He did admit that the container business had been hardest hit “due to unprofitable rates and sagging volumes”, and that he expected

the overcapacity in the container market to continue for several years.

But Yonetani explained that “only diversified shipping lines which provide a wide range of services including bulkers and containers will be able to survive”. And, although MOL spinning off its container shipping division was one option, the benefit of doing so at this time would be small due to the industry's huge overcapacity.

“Obviously,” he added, “with the current downturn in the global economy and over supply of capacity in the shipping market, and being a responsible company, MOL continues to review every alternative to improve its profitability.”

“However, as I actually said, we consider that the option of a ‘spin-off’ is not a choice under the current circumstances.”

Project specialist makes SA historyThe management team at Worldline Logistics has the unusual claim to fame of having made their mark in SA history, according to director, Wayne Lewis.

In an April joint-operation with Blue Sky Logistics, the companies were the clearing agents in a massive freighting operation.

“In this,” Lewis told FTW, “we made history, by freighting a 9-axle, 720-ton Demag hydraulic crane – the largest of its kind in South

Africa. This operation was done for Sarens SA – the global heavy-lifting, projects and mobile crane hire group.”

The crane itself is 20-m in length and weighs 100-t, and it was accompanied by 32 components of all shapes and sizes – some with lengths of up to 17-m.

Said Lewis: “Planning is imperative when managing the clearing, loading, delivery and offloading of such

sensitive cargo.”This is by no means a first

for the trio of Worldline Logistics, Blue Sky Logistics and Sarens SA.

“We have managed the forwarding, clearing and delivery of many other mobile and static cranes for this company – which already offers its clients the largest 800-t crawler and 720-t hydraulic cranes in Africa,” said Lewis, who added that a lot of this equipment was being utilised for the Gautrain and the 2010 World Cup soccer stadium preparation.

Worldline is an international clearing and forwarding organisation specialising in exports and project cargo, with offices in Johannesburg and Durban.

Chetty moves upAs Transnet’s Corridor Strategy continues to take shape, Transnet Port Terminals (TPT) chief of strategy, security, safety, health, environment and quality, Mervin Chetty, has been appointed general manager of the Natal corridor (Natcor). In his new position Chetty will serve as the strategic, single point of contact for customers using Transnet’s intermodal transportation services along the route linking the Port of Durban with Gauteng.

Logistics major“The World Woof Tour

2009 is an interactive drive which aims to draw attention to the plight of impoverished dogs around the world,” said Horsfall.

The canine star of the show, Oscar, a dog of dubious parentage, has proved himself worthy of performing the ambitious and challenging role as “Top Dog” for the World

Woof Tour after he was rescued from the spectre of euthanasia in 2004 and quickly displayed true star qualities.

UPS agreed to help Oscar out on his world tour by sending 32 boxes containing leads and collars to all the organisations that Oscar and his two legged friend, Joanne Lefson, will be visiting around the world.

He is due to visit orphanages and disabled children’s homes

and take part in dozens of “Dogadoptathons” along his way – with the core purpose of getting loving homes for dogs.

• The World Woof Tour is a charitable initiative managed by Joanne Lefson of South Africa and her adopted dog Oscar. The team will be working its way up from South Africa through Africa and Europe with two cameramen who will be making a TV documentary.

Cape coast carnage!off Hout Bay, but all were subsequently recovered by Safmarine-appointed Svizer Salvage, which enlisted the aid of fishing vessels, a helicopter and a standby tug to look out for the missing boxes.

As the search continued for the remaining 18 boxes filled with timber and general cargo, Safmarine Meru berthed on Friday afternoon at Cape Town container terminal and was due to set sail the following evening.

The barge, Margaret, carrying 13 river barges from China to Rotterdam, broke her tow from the tug, Salvaliant, and was left high and dry on the rocks at Jacobsbaai, near Saldanha, with salvage attempts under way.

Smit Amandla Marine salvage crews were at Mossel Bay on Monday, ahead of clearing the badly damaged remains of an unmanned Dutch-owned barge, GTO XV11, en route from Maputo to Port Harcourt, Nigeria, when she parted company with the tug, Hako 18, and ran aground at Three Sisters Rock, west of the Knysna Heads. She was carrying a containerised cargo

of construction machinery, feared lost.

Cape Town container terminal was closed for at least 17 hours due to the atrocious weather. “It’s been a terrible week for all of us in the port in Cape Town and for Bafana Bafana (losing 1-0 to Brazil in the Soccer Confederations Cup),” said TPT planning manager, Mike Powles.

National Ports Authority pilots were prevented from bringing at least three vessels into port once swells reached six metres but harbour master Naicker says of the 34-hour port closure claimed by some that it was more like six hours. “The 34 hours may have come from a cargo working perspective but certain berths remained operational.”

Naicker, who has also served as harbour master at Richards Bay and Saldanha, said of last week’s events: “One is always worried about what is going to happen next so monitoring a situation, being proactive, is all important.”

In these days of belt-tightening it’s reassuring when there is news of another shipping service being introduced between Europe and South Africa. The newcomer in this instance is the UAL Alliance operating as Universal Africa Lines (UAL).

UAL is known particularly for its liner services between Europe and West Africa, with the company specialising mainly in the oil and gas industry, including to Angola. UAL also operates similar services between the United States Gulf region and the West African region as well as from South America.

The growing attraction of South Africa as an area with excellent logistic capability and efficient port and land-based infrastructure facilities, in addition to its location close to the West African oil-bearing regions,

is one of the determining factors in UAL’s decision to expand into South Africa, says Haakon Røstad, managing director of Universal Africa Lines.

The UAL Alliance includes Dutch-based Universal Africa Lines, HMT International Shipping & Forwarding of the

Netherlands, US-based Consolidated Steamship Agency (CSA) and the KS Oil Centre in Equatorial Guinea. These companies have combined to provide a comprehensive logistic service for Africa’s expanding oil and gas industry. The group operates a f leet of 17 modern cargo ships – most of them heavylift vessels with lift

capability of up to 250t cranes, two feeder vessels, a coaster and a couple of landing craft – the latter to serve difficult landing places in West Africa.

The group focuses largely on long-term intra-Africa trade, in particular with the oil industry, and sees South Africa as a future growth point. UAL’s ships carry a variety of general and project cargo ranging from oil rig parts and equipment to pipes, cement, containers and even refrigerated products.

The UAL Alliance is based in Rotterdam under the leadership of Roger Jungblut. In South Africa Røstad is based in Cape Town as the South African MD, with Ulrik Fischer appointed as general manager and based in Johannesburg while Durban-headquartered Seaclad Maritime will take care of all local ships agency business for UAL Alliance.
