If the double rates plan clears the lawyers it’s almost certain to sail through council, with Crs Doug Thompson, Ingrid Waltham, Dave Coggin, Rachel Pemberton, Andrew Sullivan and Josh Wilson expressing support. Cr Sam Wainwright wouldn’t commit but says it sounds ok. Crs Bill Massie, David Hume, Tim Grey-Smith, Rob Fittock and Jon Strachan did not respond by deadline. FREMANTLE’S landmark Esplanade hotel has a new owner.
Marylyn New has sold the heritage-listed building to property developer Primewest for $88.5 million, two years after it went on the market.
The 300-room hotel joins Primewest’s $1.6 billion portfolio just three months after the Esplanade came back on to the market after the collapse of a $90 million deal sale to Singaporean group Ascendas.

ANDREW SULLIVAN says Labor’s plan for an ocean pool at Bather’s Beach is nothing more than an “election stunt” and won’t stop swimmers being eaten by sharks.
This week opposition leader Mark McGowan promised to build a pool between Fishing Boat Harbour and the Round House, if Labor is elected to government on March 9.
But Cr Sullivan – the local state Greens candidate and a local city councillor—says the major parties are simply trying to outbid each other in pretending to deal with the “great shark issue”.

Mr Bond says the short supply of new hotel accommodation in WA at the height of a continuing boom means Primewest’s investors are well positioned to enjoy strong future cash fl ows.
Primewest promotes a 17.6 per cent “internal rate of return” per annum to Esplanade investors. Bank deposits are off ering around 4–5 per cent.

He says the pool isn’t a priority and Mr McGowan has fl uff ed it anyway by proposing to build it in the wrong place.
But Labor candidate Simone McGurk reckons the location is perfect.
“It’s close to Fishing Boat Harbour and existing amenities—we will have to
build up those amenities, but I think it’s a great idea and a great spot,” she told the Herald

“I think this could increase the use by school groups and people with disabilities, meaning a broader group of people will be using the ocean.”
Local architect Sam Martin, says people will use the new pool regardless of where it is built.
“People walking through the West End will commercially activate the West End, which has a been a huge problem for successive councils,” he told the Herald.
“And if we wait for the overall masterplan of the area there goes 20 years.”

FREMANTLE city council’s blueprint for redeveloping Kings Square has been slammed by both the Fremantle Society and former deputy mayor John Dowson.
The society’s submission, prepared by former city councillor Henty Farrar, describes the Kings Square business plan as riddled with “inaccuracies” and “seriously fl awed”.
The business plan has the council teaming up with developer Sirona Capital—the owner of the soon-to-be-vacant Myer building—in a $220 million joint venture to transform Kings Square and its surrounds. The council promises cafes and restaurants, commercial and retail space, apartments, a new library and a swanky hotel.
To pay its share the council proposes selling the Queensgate building and multi-storey car park and the old Spicers site
at the corner of Queen and Henderson Street.
Society president Roel Loopers says the business plan fails to disclose the “true nature of the deal” between the council and Sirona and doesn’t outline benefi ts to ratepayers. He says it’s full of “inaccuracies, misrepresentations and errors”.
“The overall impression is that the document has been prepared by the benefi ciary of a land transaction,” he says. “There is no justifi cation presented for the sale of the city’s highest-earning property asset.
“There is no indication that the business plan as drafted has been subject to review by independent legal and commercial expert advisors.”
Mr Dowson, a former society president, submitted a revised, shorter submission after his original—which took three weeks to prepare—was lost by council staff .
He says guidelines in the plan have “serious fl aws” and fail to properly account for heritage.
“The urban design guidelines begin with a principle which states that the heritage values of the area must be maintained and complemented, but by the end of the document, it is obvious the heritage values have been in large part ignored,” he wrote.
“This has serious ramifi cations for future resulting development and how it respects the heritage of the area and builds on it rather than overwhelming or diminishing it.”
Mr Dowson accuses the council of kow-towing to developers rather than doing what is best for the “delicate heritage scales of Kings Square”.
“By not going out to public tender, council has repeated the undemocratic course of action it took with Fremantle Markets, when it decided to appoint the Murdochs as lease holders, despite hundreds of aggrieved market stall tenants and members of the public repeatedly turning up in distress at council meetings to voice their concerns.”

“We get so caught up in our own lives, it’s so important to think of others,” she says.
Ms Patzelt was born in Poland, raised in Germany and moved to Perth 10 years ago.
Now she lives in Hilton, working as a massage therapist.
She says the skydive is her
way of preparing to jump into the unknown and to empower herself before setting out on a life-changing journey in April.

Bizarre BradIT’S the parking, stupid! Reading Fremantle mayor Brad Pettitt’s bizarre remedy of charging double rates to Fremantle shop landlords whose premises happen to be empty (Herald, January 5, 2013), I feel as a retail consumer I must respond.
I suggest Fremantle’s proliferation of empty shops is the council’s own doing and it should have a long, hard look in the mirror. Apart from Fremantle’s drab footpaths, etc, and bad lighting, the main reason for way above average shop closures is greedy Fremantle council’s parking meters.
Why should consumers pay for the privilege of spending hard-earned money when the suburbs’ parking is free? I challenge Dr Pettitt and Fremantle council to nominate a week where parking will be free.
I USED to be a regular visitor to the cappuccino strip but I hadn’t been for a while so decided to grab a bite to eat last Tuesday afternoon.
My partner and I had a beer each, a plate of very average pasta each and three slices of “fresh” bread (to share). Total cost—$78.
Add parking of $3 to take it to more than $40 a head (for pasta, a beer and not very fresh bread) and you can see why I won’t be back in a hurry. Not even Freo’s supposed high rents (Herald, January 5, 2013) can justify these prices.

The organiser of the second Calling All Ukuleles as part of the Fremantle Festival was once again not paid for her eff orts.

WHILE Australia and Sri Lanka battled it out at the
SCG on the weekend a Sri Lankan Tamil asylum seeker on a bridging visa living in Hamilton Hill, a victim of torture, died in Fremantle Hospital after attempting suicide last Thursday.
The tragic event played out as momentum grows for an apartheid-style boycott of Sri Lankan cricket, lead by former cricket writer for The Age Trevor Grant.
On the campaign Facebook site Grant explains: “The cricket team has become a propaganda unit for the Sri Lankan Government, with players constantly telling Australian people via press conferences that all is rosy back home. The truth is that this government has committed war crimes against the Tamil people and it still continues to commit horrible crimes against them.”
This truth is leaking out, in part due to the documentary Sri Lanka’s Killing Fields made by Britain’s Channel Four and screened on the ABC.
It documents how in 2009 the forces of president Mahinda Rajapakse murdered 40,000 Tamil civilians, targeted artillery at hospitals and herded hundreds of thousands into concentration camps.
Former England Captain Mike Atherton wrote in the London Times of his doubt about touring Sri Lanka after seeing how it, “...highlighted the systematic killing, torture and sexual abuse of Tamil prisoners of war and civilians”.
How “trophy footage” of soldiers carrying out summary executions and mutilating corpses passed censors I don’t know, but it’s a reality that every Australian needs to understand.
The orgy of violence in 2009 marked neither the beginning nor the end of the misery that’s been heaped on the Tamils. Virulent anti-Tamil chauvinism became the ideological crutch of mainstream Sinhalese politics with independence in 1948.
Tamils of Indian origin were stripped of their right to vote, even though they had lived in the country for generations.

Tamil politicians who’d advocated a separate state were expelled from parliament. Plus the regular state-sponsored anti-Tamil riots in which thousands were killed, raped or had their houses razed. By the 1980s a generation of young Tamils abandoned peaceful protest and took up the gun.
While the government eventually crushed armed resistance, the cause of the war has not gone away. The Tamil north and east remain under military rule with one soldier for every fi ve civilians and international agencies are refused access.
Hundreds of thousands remain unaccounted for and many are prevented from returning to their homes, farms and business; living as internal refugees. The government is transplanting Sinhalese settlers into the Tamil areas in order to wipe the Tamil nation off the map. This meets the legal defi nition of genocide.
Plenty of victims come from the majority Sinhalese community too. On average one dissident per week is plucked off the streets and never seen again. Thirty-nine journalists have been murdered or “disappeared” in
the past eight years.Yet our government and
opposition claim there’s no reason for Sri Lankans to seek asylum, that they should be sent back without even testing their claims. They want to help the Sri Lankan navy to stop people from fl eeing in the fi rst place. How did such a wilfully dishonest and immoral position take hold?
Australia is not alone in turning a blind eye to Sri Lankan government human rights abuses for strategic and business reasons. But the mad mantra about “stopping the boats” has lifted it to whole new level.
Australian policy will not stop people fl eeing, but it does require us to pretend that they have no reason to fl ee. Genocide denial is the result.
That’s why we were right to protest Rajapakse at CHOGM and Julia Gillard was wrong to shake his hand. He needs to be isolated and given no credibility.
Canada will not attend CHOGM 2013 in Colombo unless the atrocities of 2009 are addressed. Australia should do the same and embrace the cricket boycott. As Grant says, “there can be no normal sport in an abnormal society”.
Only peace and freedom will stop the fl ow of refugees from Sri Lanka. Australia needs to help that cause, not undermine it.

THE announcement by Fremantle’s mayor that the city will consider charging
doubling rates for property owners who keep their city premises empty rather than decrease rents, highlights once again the troubling matter of vacant premises in the city’s central area. Fremantle’s current CBD vacancy rate stands at about 15 per cent.
It is a puzzling conundrum that while shops are still emptying at an alarming rate around Australia and many parts of the world, Perth city is reported as leading the country (even “the world”!) with a 10 per cent increase in retail trade. But this is against a shop vacancy level of 10.8 per cent, the highest of any capital city in the country. It seems those still in business may have profi ted at the expense of others, partly due to a decrease in competition.
If that trend contains a logical thread, the more shops that close, the better for those surviving. That’s a frail hypothesis and not sustainable, when put against the requirement for variety, choice and competition in any shopping precinct. It seems more obvious that the common WA syndrome is in force: too many retailers for a small population too widely dispersed or, put obliquely, too low a population density.
What also comes to light is that high concentrations of retail survive best: big is better. Along with Perth city, major shopping centres are managing well, but again at a cost to others; smaller centres and suburban traders provide

the counter-balance with their empty shop-fronts. Polarisation is a thread in metropolitan area retail and Sunday trading has exaggerated that. And then, turnover statistics are at best only a general guide when not all factors, increasing population and prices for instance, are factored in.
Would imposing a targeted diff erential rate cause landlords to reduce rents and tenant their shops, or is this just a distraction? If that is the stick, is there a carrot? Would council then reduce
rates if landlords complied; what if they didn’t, what if they did and still kept the doors closed—and are there tenants to be had anyway? Rewarding may be better if they reform, while forcing them to upgrade their premises.
In England, business rates are not payable on properties for the fi rst three months they are unoccupied, six in some cases, to provide an incentive to bring empty property back into use. Additionally, a business rates deferral scheme provides the option of spreading the increase in the 2012-13 bill over three years to help businesses manage cash fl ow during the downturn.
Suburban Melbourne council Moreland has introduced a local law that requires property owners or occupiers to maintain properties and
prevent them from becoming unsightly. They have a diff erential rate for vacant land and unoccupied buildings, to encourage proper management, targeted directly at landowners who allow sites to deteriorate.
What will Fremantle council decide; is its proposition possible? Last word on all this from WA local government minister John Castrilli: “If a diff erential rate is imposed, all land within that zoning or use must be rated on the same rate in the dollar, which would mean all shops within that zoning—both open and closed—would be aff ected. A distinction can only be made if the land is vacant (ie, no building is erected).”

“THEY know what’s happening,” Fremantle social worker Chris Doyle says, counting down towards the WA coroner’s inquest into her sister Erin Berg’s suicide in Mexico fi ve years ago.
“The kids were very little when it happened. Their mum was sick and she got the wrong treatment. They get that, they saw it.”
Berg’s four children, now aged 12, 11, 10 and fi ve, play in the park next to the Zephyr cafe in East Fremantle. Nearby is the spot where they’d sprinkled teaspoons of their mother’s ashes into the Swan River where they’d used to play.
The rest of her ashes were stitched into a teddy bear that her former partner Norman Berg pulls out of the back seat of his car.
“She lives on their beds, they take turns having her,” Mr Berg says in his fi rst interview with the Herald since Berg, suff ering post-natal depression after the birth of their fourth child, took her own life on May 10, 2008.
“She comes on outings. When they are ready to let her go, they will.”
The family plans to use the coroner’s fi ndings and medical records obtained under FOI as part of a negligence claim against the WA health department and treating clinics, Alma Street and King Edward Hospital, for knowing about Berg’s planned suicide and doing nothing to stop it.
“We’re entering the fi fth year since Erin’s suicide so we are all hoping this inquest may bring more closure for us personally, and for mental health services to learn and change practices that led to such an avoidable and horrifi c outcome for Erin,” Mrs Doyle says.
The social worker with 20 years’ experience says her 39-year-old sister, formerly an occupational therapist at Graylands hospital, had been released from Alma Street just weeks before carrying out her suicide plan in Mexico.
Her youngest child had been born the previous March and 11 months later, on Valentine’s Day 2008, Berg was admitted
to King Edward Hospital as an involuntary patient.
It was there her detailed suicide plan was discovered by staff , who
found a passport application, travellers’ cheques, an itinerary to Mexico and an overdue library slip for a book by right-to-die campaigner Philip Nitschke.
According to medical records, Berg was confronted with the material and King Edward staff tried to contact the Department of Foreign Aff airs and Trade. There appears to have been no follow-up to that initial failed call.
By April 2, Berg’s status as an involuntary patient was overturned by the Medical Health Review Board, which the family claims had ignored warning signs before releasing her on a community treatment order under Alma Street’s care.
“Erin got in touch with Alma Street and asked them for permission to go
away because she would breach her community order if she missed a visit,” Ms Doyle says. “They said yes.
“As an emergency department social worker, if I had this evidence I would be onto DFAT straight away and report it as a high risk. They knew the risk because King Edward knew.
“It breaks my heart when you view her records and see how many ways they could have shut this down.”
Berg was found unconscious in a hotel room in Tijuana and died 10 days later in hospital, with her sisters by her side.
Family members have fl own in from the eastern states and taken time off work to attend the coroner’s inquest.
“Personally, it’s going to be a prick of a week,” Ms Doyle says. The family has hired a Melbourne barrister to ask questions at the inquiry from February 25, which ends March 1, the sixth birthday of Erin and Norman’s youngest daughter.
“I hope this is the last time I have to think in detail about what happened,” Ms Doyle says. “It will be annoying. But we have a barrister who will be able to ask the hard questions.”

MELVILLE city council is dumping garbage including socks, cans, plastics, dirt and logs on the historic lower Heathcote foreshore reserve.
More than a decade ago locals campaigned to save the site from subdivision, and they fear the land’s neglect since then is payback from a grumpy council, which had supported the development plans.
The land, which sits between the South of Perth yacht club and Heathcote in Applecross, is owned by the WA government but its management is vested with the council. Real estate in the area is amongst the most expensive in the country per square metre.
While the upper ridge of Heathcote has been magnifi cently transformed, the lower land sits unused, with weeds rampant and garbage piling up, and the council using it to store mounds of green waste and street sweepings.
Local Corinne O’Hehir discovered six piles there in the weeks before Christmas.
“If you look at how they’ve treated this oval over the past two years, it’s incredibly bad,” she says.
“The state of the lower oval... doesn’t look good for council.”

A CHILD climbing a neighbour’s tree has scored a family one strike in a three-strikes-and-you’re-evicted clause in their WA housing department home.
Anna Copeland from Murdoch University’s law school cites it as one example of how last year’s change to the Residential Tenancy Act is being used in a way the Barnett minority Liberal government may not have intended when cracking down on disruptive public housing tenants.

Local MP Janet Woollard says, “this is really just a slap in the face for local residents and the wider Alfred Cove community”.
“The local community worked hard for more than 10 years to save this parkland. We had to overcome strong pressure to develop the land for high-density luxury housing.
“I think it is shameful that the land is being used as a dumping ground.”
There are now talks underway between the council, the WA government and the National Trust to develop the
site into public open space with gardens, a lake, and paths. The plan is supported by both Dr Woollard and her Liberal rival Dean Nalder.
Council acting CEO Marten Tieleman told the Herald, “at this time, the practice (dumping waste) has ceased”, but as of this week the piles were still there. He says, “on occasion road sweepings were temporarily located at the site before being removed”. He didn’t answer why the land was considered a suitable dumping ground in the fi rst place.
Heathcote dump anger
Service are joining forces to represent tenants who they fear are being hard-done by.
Ms Copeland says since the three-strikes policy’s introduction, people have been made homeless without getting a fair hearing.
“We heard the story about a child that climbed a nearby neighbour’s tree and that was considered a strike,” she told the Herald.
“We are not saying the department of housing doesn’t ever have the right to evict, but we want the people to have a fair hearing and know all the details levelled against them.
“We want to ensure the government’s disruptive behaviour management policy
for social housing operates in a fair and legal manner. At the moment this is not the case.”
She says another concern is how the department and the courts interpret “vicarious responsibility” under the Act.
“If there is a burglary in the house, the tenant gets a strike,” she says.
“A person is lawfully on the tenant’s premise if they are invited, but if a guest begins to behave in ways that are not acceptable, such as assaulting the tenant, they cease to be lawfully on the property.
“Yet the idea of vicarious responsibility is being used for anything that happens on the property—and that’s not valid in law.”

APPARENTLY Le Whaf dining—where a machine transforms
food into breathable vapour—is the latest fad in Europe. Crack for foodies.
Well, those crazy euro-cats can keep their meal-in-mist because breathing in food must be a poor substitute to delighting in the real thing.
White Gum Valley’s Lumos Cafe had been a bit hit and miss at fi rst with its food, but the place now continually serves up quality, contemporary Australian fare.
Many of the dishes can be tweaked to become gluten-free, dairy-free, vegetarian or even vegan.
Nestled amongst shops on Minilya Avenue, the eatery is light and breezy, if a little pokey on the inside. The new deck out the front is a hit with the locals who’ve adopted the place as their home away from home.
The menu off ers a delectable array, from the nibble-size oven-baked fi eld mushrooms with roasted butternut pumpkin, grilled haloumi, drizzled with basil pesto to something more substantial, such as crispy-skin Tasmania salmon with royal blue potato rosti, wilted spinach, cherry tomatoes and home-made hollandaise.
As it was breakfast I couldn’t go past the Lumos universe ($22). It comes with free-range eggs, bacon, chipolatas, hash

browns, grilled tomato, beaked beans, mushrooms and spinach.
The last time I’d ordered a fry up was when Kevin Rudd was PM. I’ve certainly missed one of them (tip: it’s not one KRudd).
As any big brekky afi cionado will concede, runny eggs are the “sauce” that brings the whole dish together. These were slightly runny but not gooey and had a great texture and consistency.
Some folk don’t like the inclusion of beans but I think they anchor the meal.
And just a splattering of fried mushrooms and spinach is a nice inclusion because it off ers a meatless pause from chipolatas
and bacon.Despite the ingredient list
reading like a Russian novel, there’s no chance of leaving any behind—the bread mops up drips with decorum.
My eating companion, who always shakes her head at my carnivorous ways, demurely chose the vege big breakfast ($20). Basically the same as mine, with bacon replaced with avocado and no chipolata.
She loved the stodgy beans and the mouthwatering mushrooms, hash browns and bright red tomatoes were full of fl avour.

IT took a brush with death and quite a lot of gentle nagging
by partner Margie Zoetelief to convince photographer Jeremy Dixon to hold his fi rst exhibition—at the age of 60.
Diagnosed with oesophageal cancer in March 2011 he faced months in hospital and extensive chemotherapy before being give the all-clear.
With a return to health and a renewed enthusiasm for life and craft, work began on Point of View—so titled because it’s the world seen “out of my eyes”, says Dixon (who is also a Herald snapper).
But it wouldn’t have happened without the, “love of my life” he’s quick to add.
“[She] is the driving force behind the exhibition…this wouldn’t have happened without her…I wouldn’t have survived without Margie,” an uncharacteristically emotional Dixon told the Herald.
Never without his Canon he’s been shooting WA and the eastern states for 30 years.But despite a stellar career and a collection of awards, including the prestigious AIPP Illustrative Photographer of the Year award, the photos remained hidden in a hard disk, unseen by any but a few who might visit his fl oating home Moonshine, moored at the Fremantle Sailing Club.
“I lacked confi dence in my own view,” Dixon says.
“I don’t have a problem with

taking the shots…it’s the editing process I have a problem with.”
With more than 5000 photos and ever-rising, it was time to give them an airing, Ms Zoetelief says.
‘I said ‘you are not sharing them with anybody, you are locking them away’.”
The exhibition space is in an unlikely “gallery”—it’s the waiting room of Dixon’s doctor, Clive Lacey at the Cockburn Medical Centre.
Opened four years ago the good doc realised he had a number of “non-exhibiting” artists on his patient list, and, with blank walls to fi ll, off ered them free of charge.
“I had the idea of setting up an exhibition of local artists,” Dr Lacey told the Herald.
With thousands of images to choose from Dixon went for those which soothe the spirit.
“We were mindful of what we were putting in a waiting room…we wanted peaceful shots.”
The exhibition is a mix of photographs from as far afi eld as the Kimberley and as close to home as Fishing Boat Harbour and the Cockburn light house.
Some have been given a “painterly” eff ect using a mix of over- and under-exposure and an oil painting-eff ect plug-in.
The exhibition has been one of the most popular to date, Dr Lacey says.“[With a] continuous stream of positive feedback and admiration…since they’ve been on the wall.”
The exhibition is open to the public, but visitors are asked to be mindful it’s also a doctor’s waiting room.

In an effort to gain some negotiable advantage over a seller, property buyers are inclined to criticise, fi nd fault and
voice objections before committing. This strategy is fl awed because an experienced agent immediately recognises such comments as buying signals and the reasons why a buyer justifi es their purchase conditions is not relevant to either the agent or the seller.
I’ve said before that buyers ought to voice positive elements about their property of choice leaving the sole condition for negotiation one of affordability. That way, buyers have a greater chance at securing the property at their price.
This approach can benefi t the buyer and is enhanced when buying at auction. Not only are the terms and conditions of the sale the same for all parties, they are pre-determined sometimes by negotiation with the sellers prior to auction. It is also by far the fairest and most transparent way to buy. At auction, buyers are able to see other buyers actively bidding unlike a sale by private treaty whereby each offer is normally treated confi dentially.
The auctioneer can (on the vendor’s behalf) bid only up to the reserve price and being required to announce it as a vendor bid, any buyer’s bid below the reserve is really just an offer that the seller will not accept. In this way, any vendor bid is simply a counter offer.
Also, unlike selling by Private Treaty at a declared “For Sale” price, sellers usually set
the auction reserve price at their “lowest price for cash” availing buyers (in the absence of competing purchasers) an opportunity to secure the property at that price because the vendor (through the auctioneer) can no longer bid beyond the reserve. Granted, competition between buyers beyond the reserve can result in a better result for the seller.
Yet buyers remain nervous about buying at auction. Probably the public nature of it requires some extroverted confi dence and for the inexperienced, the spectacle of it can be a distraction but if you are organised and attend with a buying limit set, an auction is often the best chance to buy at the best possible market price.
My advice is to listen carefully, try not to rush and be prepared to bid in small increments if the auctioneer will allow it. Usually, the auctioneer will announce that the reserve has been passed and after that point if you are not the last bid, the property will be sold to someone else.
Make sure you check the terms and conditions of the auction sale prior to attending (10% deposits and 30 days settlements are not the norm nowadays) and bring along your cheque book.
Buying At Auction
Lots in the new land release Mayor Rise are now selling. Acton Fremantle launched the fi rst stage on 8 December at their offi ces in East Fremantle to much interest from buyers, with some even camping out at Acton’s offi ces overnight to secure the block of their choice.
“We were somewhat concerned with such interest that we would have competing buyers for the same blocks, reported project manager Glenn O’Connor Smith. “We were very relieved to report on the day that everyone were
able to purchase their fi rst or second choice of block. Six blocks were sold in the fi rst 20 minutes and another sold later, making the total 7 sales from the 19 available on the fi rst release,” he said.

One of his last students was Rudolf Koelman, who will be touring Australia in a series of concerts to pay tribute to his teacher.
Koelman is a regular to our shores and a violin virtuoso is his own right.
He’s the former concertmaster of the Royal Concertgebouw Orchestra; Professor of violin at the Zurich University of the Arts; winner of the Edison Award 2010 and
a renowned soloist, who is frequently asked to perform around the world.
During this tour the favourites of the master will resound and masterclasses and workshops will be added to most of the concerts
“To me it is a tribute to a great master,” Koelman says. He will perform at Government House Ballroom January 27 and Fremantle Town Hall January 28.
