Frequently asked question Question No. 1. What is the eligibility criteria required for the appointment of agents/agencies? Answer: ELIGIBILITY CONDITION FOR BECOMING AN AGENT

1. FOR MPKBY ( Mahila Pradhan Kshetriya Bachat Yojna ) Agent (a) Any unemployed adult woman (b) She must be a person of integrity. (c) She must be an Indian citizen. (d) She must be the resident of Delhi

3. FOR PPF (Public Provident Fund ) Agent

(a) Any unemployed adult Man/ woman (b) He/She must be a person of integrity. (c) He/She must be an Indian citizen. (d) He/She must be the resident of Delhi

Any unemployed adult Man/ Woman means the applicant should not be employed in Govt., Semi Govt., and in public sector. The person working in a private sector or self employed will however be eligible. QUALIFICATION FOR SAS, MPKBY & PPF Agents

1 Minimum qualification is 12th. Pass under 10+2 scheme or Higher Secondary or its equivalent.

2 The retired persons from Govt., Semi Govt. Undertaking, Public Sector are also eligible for the SAS /PPF/MPKBY agency. 3 SAS/PPF/MPKBY agency may be given to the person who have the agency of

L.I.C/ G.I.C.

4. To the female candidates, MPKBY agency will be given first. After the successful performance of one year of MPKBY agency, she may be considered for SAS agency.

The criteria in this regards is that the MPKBY agent should open 20 accounts during the last year.

5. PPF agency may be given to the person who has one year experience of SAS agency and his business should be at least 20 lacs in the last year.

6. The person attained the age of 75 years & above will not be considered for appointment

as an agent. NOTE : THE APPOINTMENT OF NEW AGENTS UNDER SAS, MPKBY & PPF SCHEMES HAS BEEN STOPPED AS PER POLICY DECISION ADDITIONAL CONDITION FOR RENEWAL OF THE AGENCIES

(a) The SAS agent should mobilised minimum business of Rs. 5.00 lacs during the last year, failing which the agency shall not be renewed. There is no condition of minimum business for female agents.

(b) The PPF agents shall tender at least 30 applications of different subscriber during the tenure of the agency.

Question No.2. What is the procedure to find the details of the saving schemes like interest rates,

stock value, payment options etc? Answer:- The details of the savings schemes like interest, maturity value, minimum &

maximum deposit in the schemes payment options etc. can be obtained from the post offices, National Savings Institute, Govt. of India, 4 Deen Dayal Upadhyay Marg, New Delhi-2 (Phone No. 23237153), Directorate of Small Savings & Lotteries (Phone No. 23378598) and from the agents appointed by the Directorate of Small Savings.

Question No. 3. What is the procedure followed for the new appointment of small saving

agency? Answer: The person desirous for the agency (s) has to apply in the prescribed form

alongwith the Declaration Form dully attested by the Notary on stamp paper of Rs. 10/-, Residential proof duly attested by Gazetted Officer, Two conduct certificate duly issued by the two Gazetted Officer, Nomination Form, Agreement Form duly signed by the applicant before two witnesses, three passport size photographs duly attested by the Gazetted Officer, copy of educational qualification certificates, age proof and the copy of LIC/GIC agency certificate duly attested by the Gazetted Officer. The prescribed form for appointment of SAS agent is form AAS-1, for MPKBY agent is ASLAAS-1 and for PPF agent is revised form PPF A-2.. The format of forms and other document are available on the website and given after the questions. Incase of appointment of PPF agent the agreement form is not required. After receipt the

application the case is sent to the concerned Deputy Commissioner for verification of the antecedent of the applicant. If the report received from the Dy. Commissioner, the applicant is called for the signature on the Certificate of Authorities and then the case file is sent to the Director (SS & Lott.) for the approval. After obtaining the approval the applicant is asked to deposit the Security of Rs. 5,000/- & Rs. 2,000/- for SAS and MPLBY agency respectively. No. Security is required for the PPF agency. After completion of above formalities one copy of Certificate of Authority is handed over to the applicant and other copy is sent to the concerned HPO/Sub PO. by post.

Presently there is ban on the new appointment of new small savings agents.

Question No.4. What is the renewal process of the agencies of small savings? Is there a charge

for it? Answer The agent has to apply in the prescribed form alongwith the Declaration Form

dully attested by the Notary on stamp paper of Rs. 10/-, Residential proof duly attested by Gazetted Officer, Two conduct certificate duly issued by the two Gazetted Officer, Nomination Form, Agreement Form duly signed by the agent before two witnesses and the form indicating the business mobilized by the agents during last year. The prescribed form for renewal of SAS agency is form AAS-1, for MPKBY agency is ASLAAS-1 for MPKBY agency and revised form PPF A-2 is for PPF agency. The format of forms and other document are available on the website. Incase of renewal of PPF agency the agreement form is not required. The agent should apply for renewal of his agency to the Appointing Authority 45 days prior to the date of expiry of the agency failing which a penalty of Rs. 10 per day will be imposed. In case the agent apply for the renewal after the date of expiry, than the penalty will be imposed @ Rs. 20/- per day for the whole period. The SAS agent should mobilize the minimum business of Rs. 5,00,000/- during the financial year preceding the date of renewal of the agency. There is no condition of minimum business for female agents. The P.P.F. agent should canvas minimum 30 new applications (accounts) pertaining to the different subscriber during the tenure of his/her agency. There is no charge for renewal of the agency except the penalty for late applied for renewal.

Question No. 5. What is the procedure to lodge a complaint against the misbehavior of the

collection agents? Answer The procedure to lodge a complaint against the misbehavior of the agent is to

report to any of the following authority.

savings schemes, wrong interest rates applied, payment not received etc? Answer The Department Post Offices and National Savings Institute of Small Savings

have been publishing the details of schemes in the interest of savers/ depositors. Question No. 7. What is the validity period of registration of an agent and agency? Answer The validity period is maximum for 3 years and is renewed for next 3 years or

less at the discretion of the appointing authority. Question No. 8. Are the agents appointed by the agencies on a permanent basis? Answer Agents are appointed and renewed for a maximum period of 3 years.

FORM OF AGREEMENT

Cash of Government securities of Fidelity Guarantee Policy ARTICLES OF AGREEMENT made at……………………..this………………….day of…………………Two Thousand and between the President of India here in after called the “Government’ (which expression shall be deemed to include his successors and assigns wherever the context so admits or requires) of the one par : AND……………. son of …………………….by occupation………………of…………………………………… hereafter called the Agent (which expression shall include his heirs. Executors, and administrators wherever the context so admits or requires) of the other part : WHEREAS THE Government under their Small Savings issue various types of Savings Certificates for sale to the investing Public, and provides various kinds of Savings Accounts for receiving deposits from the public. AND WHEREAS the Government of N.C.T. of Delhi are desirous of appointing authorized agents with a view to improving collections in such Savings Certificates and such Savings Accounts (hereinafter referred to as the “Securities”) as the Government of India may, by a notification throw open to authorized agents for the aforesaid purpose. AND WHEREAS the Agent has agreed to act as such authorized agent on the terms and conditions hereafter appearing. **AND WHEREAS it is also one of such terms that the Agent should as security for the due fulfillment of the said contract deposit with the Appointing Authority, Government Securities of the aggregate purchase price value of Rs. 50,000/-. AND WHEREAS THE Agent has accordingly deposited with the appointing Authority/ Government Securities duly transferred to the latter of the aggregate purchase price of Rupees (50000/-) value of Rs. 5000/- particulars whereof are set out in the Schedule hereunder written.

**Not applicable to Banks, Co-operative Socieities and Government servants appointed as internal agents who are exempted from furnishing security. NOW it is hereby agreed by and between the parties hereto as follows :- 1. The Agent is hereby appointed as and Authorised Agent for effecting sales of six years National

Savings Certificates (VIII Issue) and for obtaining deposits in One/Two/Three/Five Year Post Office Time Deposits and such other schemes of savings which are hereinafter collectively referred to as “securities”, as may be introduced by the government and thrown open for securing sales and deposits through the agents subject as herein otherwise provided, the agent shall be entitled to received commission on certificates or deposits (sold and procured by him) at the rates notified by the Government from time in the Official Gazette in respect of the securities which are subject matter of this agreement.

2. The Agent shall sell the “Securities” referred to in clause (i) above in the State of Delhi. 3. The Agent shall on behalf of the Government receive from the investors moneys for investment in the

“Securities” and pass appropriate receipts for the same in the prescribed form, from the printed receipt books, which the Government shall at their own cost supply to the agent for the purpose. In no case shall the Agent accept money for which he is not able immediately to issue a proper valid receipts from the printed Receipts Books.

4. The Agent shall within the ten days from the receipt of the moneys as aforesaid deposit the same in the

Post Office(s), or such other offices as may be specified in this behalf by the Government to which he may be attached for the purpose and pending such deposit, the Agent shall hold the said moneys in trust for and on behalf of the Government.

5. The Agent shall obtain from the investors such documents or writing as may from time to time be

prescribed by the Government in regard to investment in such securities. 6. The Government shall through the Post Office(s) or other office concerned issue and deliver to the

Agent the “Securities” in the name or names of such person or persons and for such amounts as the investors shall have applied for. The Agent shall on obtaining such “Securities” deliver the same to the investor or investors in exchange for the original receipt or receipts that may have been passed to them duly discharged by the investors.

7. Subjects as herein otherwise provided the Agent shall be entitled to receive a commission at such rate or

rates as may be notified by the Government from time to time in respect of ‘securities’ investment in which is allowed through the Agent under the terms of this Agreement. The commission shall be payable on production of the receipts(s) duly discharged by the investor or investors to the Paying Authority appointed in this behalf. Save as aforesaid the Agent shall not be entitled to any other commission, remuneration or payment whatsoever for the work done under those present notwithstanding any costs, charges or expenses the Agent may incur for the purpose. No Commission shall in any event be payable to the agent on investment of Provident Fund Money, funds of Cooperative Societies including Co-operative Bank, Compensation Money paid to displaced persons in the form of any ‘Securities’ Cash Securities already pledged to Government Officials by contractor’s and other persons, court funds trust funds, funds in the Control of Government Officials or local or statutory, authorities, investments required to be made in these ‘Securities’ under any enactment or by an express order of the Government or Investment made or secured by or on behalf of persons residing abroad or such other investments as from time to time may be notified by the Government in this behalf.

8. The Agent hereby undertakes to carry out such directions and instructions as may form time to time be

issued by the Government or persons duly authorised by the Government and comply with all rules and regulations, pertaining to the issue of the “Securities” from time to time and orders or regulations issued by the Government together with any modification(s) or additions thereof and to keep himself/itself acquainted with the aforesaid rules, orders, and regulations and in particulars undertake

(a) to follow all instructions printed on the cover of the official Receipt Books issued by the

Government;

(b) never under any circumstances to exceed the amounts upto which a receipt form is valid for an investment or investments not to make any alteration in the matter printed on the receipt forms and counterfoils;

(c) to ascertain form the investor before accepting any moneys that the “Securities” for which

he/she applies will, if issued, not render his total holding of such securities of all types in excess of the limit laid down in the rules governing such securities for the time being in forece.

(d) to forthwith refund to the Government any commission that may have been paid in respect of

such securities as may have been sold to the investor or investors in excess of the limits of holdings laid down in the said rules for investment by investors otherwise received by him/it in excess of any amount due to him/it.

(e) To keep the certificates(s) of Authority and Receipt Books issued to him/it with care and in case of loss, immediately report the same to the Appointing/Issuing Authority and the Post Office(s) or other office(s) to which he/it is attached.

(f) in case of loss or any Receipt Books not to claim any commission on sales of the securities recorded therein

(g) to produce the Receipt Books(s) to the paying Authority for the purposes of checking or

payment of commission as herein provided and claim commission within four months from the date of receipt of money for investment in the “Securities” filling which such commission shall be forfeited;

(h) notwithstanding the provisions of sub-clause (g) above, to produce the Receipt Books(s) to the

checking authority for the purpose of checking whenever demanded by the said authority;

(i) to deliver the “Securities” (purchased) by the Agent on behalf of the investors without undue delay and in any cases within thirty days on the date of receipt of the money failing which the Agent shall forfeit the commission earned on the business transacted in such securities and if the same may have been paid will forthwith refund if to the Government.

(j) to carry out this Agreement faithfully and diligently and to the best of his ability to promote the

said scheme: and

(k) not to assign or otherwise transfer the benefit of this Agreement or par thereof to a third party. 9. Subject to the provision for earlier termination hereinafter contained, the period of the agency shall be

initially for three years from the date given in the preamble to this agreement and thereafter the agency may be renewed at the option of the Government for further periods not exceeding three years at a time

10. The Agency shall be liable to be terminated by the Government without notice if the work or conduct of

the Agent adversely commented upon by the supervising authorities or if he/it is, in the opinion of the Government which shall be final and binding, guilty of breach of any provision of this agreement or if he/it becomes insolvent, or the agent-organization runs into liquidation or if it is discovered that a part or the whole of the business was secured by the agent with the help or connivance of an official of the Posts and Telegraphs Department or the National Savings Organization or an official of the State Government Small Savings Department or Collectors or Tahsildars or an official of the State Bank of India or its subsidiary Bank in India. The commission earned on such business shall also be liable to forfeiture and if the commission on such business has already been paid, the agent must forthwith refund it to the Government.

11. This Agreement may be terminated by either party by giving three months notice to the other. Provided,

however, the Government shall be at liberty to terminate the agency at any time without notice and without assigning any reason for the same. The agency shall automatically stand terminated if the Government of India announces by Notifications, the abolition of the Agency System.

12. The stamp duty on this Agreement shall be payable by the Government. 13. On termination of this Agreement howsoever occasioned, the Agent shall forthwith deliver to the

Government all moneys and papers including the Certificates(s) of authority, used partially used and unused Receipt Books, documents and Securities which may have come to his possession or custody under the terms of this Agreement.

14. The Agent hereby agrees to well and sufficiently protect and keep harmless and indemnify the

Government against all manners of embezzlement, misappropriation or miss application of moneys, and the “Securities” which may from time to time during the continuance of this Agreement come into his/its possession or control or into the possession on control of the branches or individuals appointed as authorized workers at his/its request and belonging either to the Government or to the investor or investors and also against the carrying away, loss destruction or otherwise of any writings, evidence,

books or papers belonging to the Government or to any of the investors without directions and authority of the Government or person or persons duly authorized by the Government and against all cost, charges and expenses in relation thereto. The Agent shall also Indemnify fully the Government against all losses or claims that may arise on account of his/its defaults and the defaults of any of the agent-organisation’s branches or of individuals appointed as authorized workers at the agent-organisation’s request and any amounts received by him/it or the authorised workers of any agent-organisation appointed at it s request and which are not legally due to him/it and the authorized workers, and the Government shall be fully indemnified against all such losses or damages as aforesaid at any time.

15. The said amount of security of Rupees five thousand deposited as aforesaid shall be retained by

Government as security for due fulfillment and faithful performance by the Agent* of all and singular the several covenants herein contained on his/its part to be observed with full power to the said Appointing Authority for and on behalf of the Government in cases the Agent shall fail to perform fulfill, keep and observe all or any of the said conversant, conditions, or agreements on his/its part hereinbefore contained to encash the said security or any part thereof and appropriate the amount/proceeds of the security of the security or any part of such proceeds in or towards the satisfaction of the amount of all or any damages, penalties and other sums which the said Agent may have become liable to pay hereunder.

16. The Appointing Authority, the issuing Authority, the Paying Authority and the checking Authority shall

be such authorities as may be appointed from time to time by the State Governments in the matter. 17. The Agent shall pay all such due to the Government within the time hereinbefore specified. If the Agent

fails to pay such sums as shall be due to the Government from time to time within the specified period then and in such event all sums due to the Government (As to which the decision of Director Small Savings & Lotteries shall be final) shall at the option of the Government be recoverable in the same manner as an arrear of Land revenue.

AGREEMENT

ARTIFCLES OF AGREEMENT made at………………………...this………………………………day of……………………………………Two thousand………………………………..between the President of India hereinafter called the “Government” of the one pare and……………………………. (name and full address of the Individual/Institution or Organisation), hereinafter called the Agent/Agent-Organisation (which expression shall be deemed to include her/its succesors wherever the context admits or requires) of the other part. WHEREAS with a view to expanding the Small Savings Scheme the Government are desirous of appointing Organisations or institutions, individual Women of the area concerned as authorized agents under the “Mahila Pradhan Kshatriya Bachat Yojna” for canvassing are securing investments in P.O. Cumulative Time Deposite/Recurring Deposit Accounts. AND WHEREAS the Agent/Agent-Organisation has agreed to act as such authorized agent on the terms and conditions hereinafter appearing. AND WHEREAS it is one such terms and conditions that the Agent/Agent-Organisation should as security for due fulfillment, of the said contract furnish to the Appointing Authority a Savings Certificate (issued under the Government Savings Certificate Act, 1959) for Rs. 2000 (Rs. Two thousand) only duly pledged to the President of India. NOW IT IS HEREBY AGREED by and between the parties hereto as follows :- 1. The Agent/Agent-Organisation Shall-

(1) Canvass for and secure deposits in 10-year C.T.D. and 5 year Recurring Deposit Accounts in POSB in accordance with the rules governing, the two aforesaid deposit account.

The Agent-Organisation shall work the agency through not more than six/three workers (thereinafter referred to as “Authorised Workers”).

(11) make necessary entry for any amount received from the depositors under this scheme, in the printed care (F.No. ASLAAS-5) from prescribed by the Government of India and supplied to her/it.

(111) deposit the monies so received in the Post Office to which the Agent/authorized worker

is attached for making deposits under the scheme, within 5 (five) days of receipts of the monies, and pending such deposits to hold the monies in trust for and on behalf of the Government of India.

(IV) receive from the deposit accepting Post Office the Pass Book(s) covering each and every deposit made by the Agent/authorized worker and deliver the same Pass Book(s) to the depositor(s) within 10 days of receiving it from the Post Office.

(V) obtain from the depositor(s) his/her acquaintance with signature and date in the

appropriate column of the card in token of the having received the Pass Book(s).

(VI) notify immediately to the “Appointing Authority”, the District Savings Officer of the area and the local police of the area the loss of cards/certificate of Authority if such loss takes place while the documents are in the custody of the Agent/Authorised worker and to publish the loss as a public notice in at least on local newspaper at her/its cost.

(VII) follow all directions and instructions as may be issued to her/it form time to time by the

Government of India or by persons duly authorised by the Government.

(VIII) be entitled to commission only on deposits made during the period of this agreement in the following types of accounts, namely.

(a) account opened by her/it under this agreement Mahila Pradhan Kshertiya Bachat

Yojna, and. (b) accounts transferred by the “appointing authority” to her/it from another Agent/Agent

Organisation who has opened such accounts and is not in a position to discharge her/its responsibilities in terms of her/its agreement in respect of such accounts.

(IX) not be entitled to claim any commission on the deposits received in respect of any othr

account not opened by her/it, and.

(X) not assign or otherwise transfer the benefit of this agency or any part thereof to a third party.

2. The-Agent/Agent-Organisation shall be entitled to receive a commission (at such rate as may be

notified by the Government of India from time to time) on total investments received and completed according to the aforesaid terms and conditions in the P.O. Cumulative Time Deposit Accounts and P.O. Recurring Deposit Accounts from the depositor(s) residing in the area for which she/it is authorized. The commission shall be payable to her/it by the “Paying Authority” on submission of commission claim in the prescribed manner. The Agent/Agent-Organisation shall not be entitled to any other commission, remuneration or payment whatsoever for the work done under the presents except the commission as aforesaid notwithstanding any expenses she/it may incur for the purpose.

3. Subject to the provision for earlier termination hereinafter contained the period of the agency

shall be three years commencing from the date of this agreement, and thereafter the agency may, on an application being made in this behalf by the agent, be renewed at the option of the Government for further periods not exceeding three years at a time.

4. The agency would be liable to be terminated by the “Appointing Authority” without notice, if

the work or conduct of the Agent/Agent-Organisation is adversely commented upon by the supervising authorities or if she/it, in the opinion of the “Appointing Authority” which shall be final and binding, guilty of breach of any provision of this Agreement, or if she/it becomes insolvent, or runs into liquidation or it is discovered that a part or the whole of the business was secured by her/it with the help or connivance of an official of the Posts and Telegraph “Department or National savings Organisation; the commission earned on such business would also be liable to forfeiture and it the commission on such business has already been paid, the Agent/Agent-Organisation must refund it to the Government, failing which the Government shall have the right to recover the amount of such commission paid, from the Agent/Agent-Organisation as an arrears of land revenue.

5. Notwithstanding anything contained in paragraphas 3 and 4, this Agreement may be terminated by either party by giving three months notice to the other; provided, however, that the “Appointing Authority” shall be a liberty to terminate the agency at any time without any notice and without assigning any reasons for the same.

6. On termination of this Agreement, however occasioned, or as and when called for by the

“Appointing Authority” the Agent/Agent-Organistion shall be responsible for the return to the “Appointing Authority” of all the documents and papers concerning the agency. The Agent/Agent-Organisation shall indemnify the Government of India against any or all losses or plaints that may arise on account of any default of the Agent/Agent-Organisation or its authorized worker(s).

7. The terms “Appointing Authority” and ‘Supervising Authorities” used in this agreement shall

be the authorities as specified in Mahila Pradhan Kshetriya Bachat Yojna issued by National Savings Organisation and Executive instructions issued thereunder.

The renewal process of the agencies of Small Savings?.

(i) The agent has to apply in the prescribed form. For the renewal of SAS agency the form is AAS-1. for MPKBY agency is ASLAAS-1 and for PPF agency the form is Revised form PPF, A-2.

(ii) Declaration Form duly attested by the Notary on stamp paper of Rs.10/-. (iii) Residential poof duly attested by Gazetted Officer,

(iv) Two conduct certificate duly issued by the two Gazetted Officer. (v) Nomination Form. (vi) Agreement Form duly signed by the agent before two witnesses. In the case of renewal of P.P.F. agency the agreement form is not required. (vii) The form indicating the business mobilized by the agents during last year (for SAS agents only). (viii) The SAS agent should mobilize the minimum business of Rs. 5,00,000/- during the last year. There is no condition of minimum business for the female agents.

(ix) The PPF agent should canvas minimum 30 new applications (accounts) pertaining to the different subscriber during the tenure of his/her agency.

(x) The agent should apply for renewal of his agency to the Appointing Authority 45 days prior to the date of expiry of the agency failing which a penalty of Rs. 10 per day will be imposed. By order

ELIGIBILITY CONDITION FOR BECOMING AN AGENT

1. FOR MPKBY ( Mahila Pradhan Kshetriya Bachat Yojna ) Agent

(a) Any unemployed adult woman (b) She must be a person of integrity. (c) She must be an Indian citizen. (d) She must be the resident of Delhi

2, FOR SAS ( Standardised Agency System) Agent

(a) Any unemployed adult Man/ woman (b) He/She must be a person of integrity. (c) He/She must be an Indian citizen. (d) He/She must be the resident of Delhi

3. FOR PPF (Public Provident Fund ) Agent

(a) Any unemployed adult Man/ woman (b) He/She must be a person of integrity. (c) He/She must be an Indian citizen. (d) He/She must be the resident of Delhi

Any unemployed adult Man/ Woman means the applicant should not be employed in Govt., Semi Govt., and in public sector. The person working in a private sector or self employed will however be eligible. QUALIFICATION AND OTHER REQUIREMENT FOR SAS, MPKBY & PPF Agents

1 Minimum qualification is 12th. Pass under 10+2 scheme or Higher Secondary or its equivalent.

2 The retired persons from Govt., Semi Govt. Undertaking, Public Sector are also eligible for the SAS /PPF/MPKBY agency. 3 SAS/PPF/MPKBY agency may be given to the person who have the agency of L.I.C/ G.I.C.

4. To the female candidates, MPKBY agency will be given first. After the successful performance of one year of MPKBY agency, she may be considered for SAS agency.

The criteria in this regards is that the MPKBY agent should open 20 accounts during the last year.

5. PPF agency may be given to the person who has one year experience of SAS agency and his business should be at least 20 lacs in the last year.

6. The person attained the age of 75 years & above will not be considered for appoint an agent.

DOCUMENTS REQUIRED TO BE SUBMITTED ALONGWITH APPLICATION FOR APPOINTMENT AS AGENT

(I) The person has to apply in the prescribed form. For the SAS agency the form is

AAS-1. for MPKBY agency is ASLAAS-1 and for PPF agency the form is Revised form PPF, A-2.

(ii) Declaration Form duly attested by the Notary on stamp paper of Rs.10/-. (iv) Residential poof duly attested by Gazetted Officer, (v) Two conduct certificate duly issued by the two Gazetted Officer.

(vi) Nomination Form duly witnessed by two person.

(vii) Agreement Form duly signed by the agent before two witnesses. In the case of P.P.F.

agency the agreement form is not required.

(vii) Two passport size photographs duly attested by the Gazetted Officer. (viii) After the verification of antecedent of the applicant, the security of Rs. 5,000/- for SAS

agency and Rs.2000/ for MPKBY agency in the shape of NSC duly pledged in favour of the Director SS & Lott. are required.

ELIGIBILITY CONDITION FOR RENEWAL OF THE AGENCY

1. FOR MPKBY ( Mahila Pradhan Kshetriya Bachat Yojna ) Agent (a) Any unemployed adult woman (b) She must be a person of integrity. (c) She must be an Indian citizen. (d) She must be the resident of Delhi

3. FOR SAS ( Standardised Agency System) Agent

(a) Any unemployed adult Man/ woman (b) He/She must be a person of integrity. (c) He/She must be an Indian citizen. (d) He/She must be the resident of Delhi

3. FOR PPF (Public Provident Fund ) Agent

(a) Any unemployed adult Man/ woman (b) He/She must be a person of integrity. (c) He/She must be an Indian citizen. (d) He/She must be the resident of Delhi

Any unemployed adult Man/ Woman means the applicant should not be employed in Govt., Semi Govt., and in public sector. The person working in a private sector or self employed will however be eligible.

DOCUMENTS REQUIRED TO BE SUBMITTED ALONGWITH APPLICATION FOR RENEWAL OF THE AGENCIES

(i) The agent has to apply in the prescribed form. For the renewal of SAS agency the form is AAS-1. for MPKBY agency is ASLAAS-1 and for PPF agency the form is Revised form PPF, A-2.

(ii) Declaration Form duly attested by the Notary on stamp paper of Rs.10/-. (iii) Residential poof duly attested by Gazetted Officer,

(iv) Two conduct certificate duly issued by the two Gazetted Officer.

(v) Nomination Form.

(vi) Agreement Form duly signed by the agent before two witnesses. In the case of renewal of

P.P.F. agency the agreement form is not required. (vii) The form indicating the business mobilized by the agents during last year (for SAS & MPKBY agents only). (viii) The SAS agent should mobilize the minimum business of Rs. 5,00,000/- during the last year. There is no condition for female candidate.

(ix) The PPF agent should canvas minimum 30 new applications (accounts) pertaining to the different subscriber during the tenure of his/her agency.

(x) The agent should apply for renewal of his agency to the Appointing Authority 45 days prior

to the date of expiry of the agency failing which a penalty of Rs. 10 per day will be imposed. If the agent apply for the renewal after the date of expiry, the penalty @ Rs. 20/- will be imposed for the whole period.

LOSS OF CERTIFICATE OF AUTHORITY OR RECEIPT BOOK BY THE AGENT

On receipt of information of loss of Certificate of Authority or Receipt Book from the agent, the appointing Authority or the Head Post Office, as the case may be, should forthwith intimate the loss to offices with which the agent is registered for transacting security business. The loss must invariably be notified in the State Gazette at the cost of the agent in local

newspapers, besides putting up a notice on the notice board, if any. The agent shall also execute an Indemnity Bond (Annexure-21) indemnify in the Government against any loss. The stamp duty on such bond will be payable by the agent and should be based on the value of Receipt Books lost or the total value of Receipt Books permissible to the agent in the case of the loss of Certificate of Authority. CHANGE OF AGENT AND REQUEST FOR AVAILING THE FACILITY OF AGENT IN CASE OF ACCOUNT OPEND DIRECTELY As per the rule No. 5 under PPF agency Scheme, the procedure for change of agent is as under:-

(1) Where the accounts have been initially introduced through an agent depositor may seek change of agent in the following case:-

(a) in the case of death of agent who initially introduced the account. (b) in the case of termination/non –extension of agency of the agent who initially

introduced the account.

(c) change of residence of depositor either at the same station or by transfer from one station to another.

2. In all above cases request for change of agents will be sent by the depositors to

Director, Small Savings & Lott., Govt. of NCT of Delhi after the Director has given his approval to change the agent, the depositor can utilise the service of that agent. In such cases, new agent can claim commission for subsequent deposits. Where change of residence involves change of region the approval of change of agent will be given by the Director, Small Savings under whose jurisdiction account falls after the transfer.

3. The Directors in the State/Union Territories where accounts were initially opened may, at the request of depositor, permit change of agent in exceptional cases, if they are satisfied about the justification for such change. In all such cases Director will record in writing, reasons for permitting the change.

Rule No.6:- Authorised Agent (Public Provident Fund) Scheme, 1968-Revised procedure for change of agents and payment of commission in respect of accounts opened by Authorised Agents:- Under the existing instructions the commission to Public Provident Fund agents is payable only in respect of such accounts which were initially introduced and serviced by agents. It has now been decided that commission will be payable in case of such accounts also which were initially opened by the depositors directly but later on they wish to avail the services of authorized agents. The depositors will however, inform the Directorate of Small Savings, Govt. of N.C.T. of Delhi the particulars of agents whose services the depositors propose to avail.

CHANGE OF MPKBY AGENT AND REQUEST FOR AVAILING THE FACILITY OF AGENT IN THE DIRECT RECCURRING DEPOSIT ACCOUNTS As per the rule 11 under MPKBY Yojna, the investors can avail the facility of agent/ change of agent in the following circumstances where the account has been initially opened through an agent, the depositor may seek change of agent in the following cases:- a. In the case of death of the agent through whom the account was opened. b. In case of termination of the agency/non extension of the agency of the agent through whom the

account was opened. c. Change of residence of the depositor either at the same station or by transfer from one station

to another. d. A depositor who opened the account directly but now wants to avail the service of the agent. (5). In the above case request for change of agent will be sent by the depositor to the Directorate of Small Savings & Lotteries and after the Directorate given the approval to change the agent, the depositor can utilize the services of that agent. In such cases, new agent can claim commission for subsequent depositor. (6) The above procedure has been prescribed for change of agents in PPF accounts by the MOF (DEA) in their letters No. F1/3/89-NS.II dated 31.7.1989 and 16.10.1989 and will also be applicable to such cases in R.D. accounts. (page 1/c) The Accounts Officer has been authorized by the Director Small Savings & Lotteries to give the permissions to the investors for availing the facility of an agent in respect of PPF and RD accounts as per the rules mention above.

AUTHORISED AGENTS (PUBLIC PROVIDENT FUND) SCHEME- TERMS AND

CONDITIONS GOVERNING AGENCY

I General

1. Agent are appointed under the Authorized Agents (Public Provident Fund) Scheme to canvass deposits into the Public Provident Fund Scheme, 1968. 2. The Agents receive a commission of one percent from Govt. of India on the amount of initial subscription paid into a public provident fund account opened on the basis of application canvassed by them. 3. Commission at the same rate is also payable by the Govt. of India to the agents on subscriptions paid subsequently into such accounts provided that (a) the subscription are paid into such accounts during the tenure of the agency and (b) the accounts in question are not transferred to places outside the area of operation of the agents. 4. Persons desirous of taking up an agency may obtain an application form, from the office of the Joint Director, Small Savings, of State. The application form should be properly filled in neatly and legibly. The form complete in all respects should be sent to the Joint Director, Small Savings, Govt. of N.C.T. of Delhi. The applicant shall be responsible for the veracity of statements made in the application form. 5. On acceptance of an application, the applicant will be informed of the result and asked to convey acceptance of the terms and conditions governing the offer of agency. 6. The agency of an authorized agent will commence from the date of appointment and shall be valid for the period of maximum three years from that date. For renewal of agency, the agent shall make a fresh application in the prescribed form sufficiently in advance of the expiry of the term of agency i.e. 45 days prior to the date of expiry of the agency failing which a penalty of Rs. 10 per day will be imposed If the agent apply for the renewal after the date of expiry, the penalty @ Rs. 20/- will be imposed for the whole period. If the agent apply for the renewal after the date of expiry, the penalty @ Rs. 20/- will be imposed for the whole period. Such a renewal, if agreed to, shall be for a period not exceeding three years.

II Function of an Agent 1. An agent shall at all times take sustained interest in the promotion of P.P.F. Scheme and shall conduct himself with propriety and decorum and in a manner not prejudicial to the interests of the Government. He shall carry out such directions and instructions as may, from time to time, be issued to him by or on behalf of appointing authority for the purpose of fully and effectively carrying out the terms of agency. 2. An agent shall protect and keep harmless and indemnified the Governments against any loss, claim, cost, charges, expense whatsoever which the Government may have to incur on a result of the agent not conforming to the instructions contained herein or which may be issued to him from time to time. 3. An agent shall advise a subscriber to lodge his application together with the relative amounts with a deposit office i.e. Post Office, any branch of the State Bank of India or of its subsidiaries or in other authorized Banks to deposit the same. (a) He/she shall tender at least 30 applications each pertaining to a different subscriber during the tenure of his/her agency (during 3 years). (b) An agent shall in no case handle moneys of the subscribers. 4. An agent shall inscribe or impress by means of a rubber stamp at the top centre of the application form (for opening P.P.F. accounts) his/her name and the number of his/her certificate of authority. 5. The commission accruing to the agent shall be paid to him by the Post Office/ Bank at source. No claim to commission shall be entertained by the paying authority unless the application for opening public provident fund account canvassed by an agent has been made in the prescribed form bearing:- (i) the name of the agent and (ii) number of the certificate of authority of the agent and is certified as such by the deposit accepting officer. 6. No payment, in addition to the commission at the prescribed rates, is permissible for any charges or expenses incurred by an agent in connection with the agency. 7. An agent shall submit to the appointing authority six weeks before the expiry of each agency year, a report of his performance during the year and if he feels, that his performance is not satisfactory he may give valid reasons, if any, therefore.

III Termination of Agency

The agency is liable to be terminated after giving one month’s notice, if the performance of an agent is, in the opinion of the Appointing Authority, not satisfactory. Other grounds on which the appointment of an agent is also liable to be terminated are:- (a) if he is found to be a minor, or (b) if he is adjudicated insolvent; or

(c) if he is declared of unsound mind by a court of competent jurisdiction; or (d) if he is or has been within five years immediately preceding his appointment, convicted by criminal court for an offence involving moral turpitude; or (e) if in the course of any judicial proceedings it is found that he has knowingly participated in or connived at any fraud, dishonesty or mis-representation; or (f) If the appointing authority is satisfied that any statement made in the agency application form was false or misleading. 2. The provisions in this paragraph shall be without prejudice to the provisions in the next succeeding paragraph. 3. An agent may also terminate the agency at any time by giving one month’s notice to Appointing Authority. 4. In addition to what is stated in the preceding paragraph, the Appointing Authority shall have right to terminate the appointment of an agent at any time by giving him/her one month’s notice and without assigning any reason therefore.
