Illinois Governor (Democrat), 1932-1940; lawyer, and Cook County Probate Court Judge, 1914-
1931, from Chicago. Horner, Illinois’ first Jewish Governor, governed the state during the depression
of the 1930s, serving as President Roosevelt’s representative supporting the New Deal. A protégé of
former Chicago Mayor Anton Cermak, Horner was noted for fighting the Chicago machine politics
of Edward J. Kelly and Patrick A. Nash. Horner spent his final year in office battling failing health
and his Lieutenant Governor John Stelle in a struggle for control of the state and the Democratic
Party. An Abraham Lincoln enthusiast, Horner amassed a large collection of Lincolniana which was
given to the Illinois State Historical Library. A lifelong single man, he died in office on October 6,
1940.
Correspondence, legal papers, financial records, campaign material, department files, subject files,
published material, scrapbooks, clippings and memorabilia. The collection covers Horner’s
gubernatorial years and his tenure in the Probate Court. Topics include campaigns, the Great
Depression, corrections, social welfare and relief, aeronautics, agriculture, Abraham Lincoln, Jewish
culture, Masons, floods, strikes, and probate. A few bound volumes concern Horner’s early legal
career.

Biographical Sketch
Henry Horner was born Henry Levy on November 30, 1878, on Chicago’s South Side. The third son
of Solomon Abraham Levy and Dilah Horner Levy, Henry Levy’s name was changed to Henry
Horner when his parents divorced five years after Henry’s birth. His mother resumed using her
maiden name and changed her children’s names as well. Henry’s mother Dilah was the daughter of
Henry Horner, Chicago’s first grocer and founder of Henry Horner and Company; and Hannah
Dernburg Horner, a recent German immigrant. After the Chicago fire of 1871 wiped out the Horner
grocery store, the first Henry Horner never fully recovered from the shock. He died in 1878 and
Dilah and her sons moved in with Hannah. Dilah was charged with running the home while Hannah
continued to operate the family grocery business.
Henry attended public schools in Chicago and Chicago Manual Training School. He attended the
University of Chicago and graduated from Chicago-Kent College of Law in 1898. Henry and Frank
A. Whitney entered into a partnership, practicing as Whitney and Horner until 1905. It was Whitney
who was responsible for peaking Horner’s interest in Abraham Lincoln. Whitney’s father had been a
friend of Lincoln’s and was author of Life on the Circuit with Lincoln, about the years they practiced
law in the 8th judicial circuit. Whitney’s father’s interest in Abraham Lincoln rubbed off on Horner,
and he began to amass a collection of Lincolniana that would eventually be second in size only to the
Library of Congress. The collection (approximately 6000 items) was willed to the Illinois State
Historical Library and became the basis for their Lincoln Collection.
From 1905 to 1914 Horner was a member of the firm Whitman and Horner. He had also been an active
participant in Chicago’s Democratic politics, learning the process of precinct politics from Michael
(Hinky Dink) Kenna and the like. Horner involved himself in the German social clubs of
the city, but was also astute enough to befriend the Irish as well. In 1911 Horner served as chairman
of the Committee on Plan and Procedure for the convention called by Mayor Carter H. Harrison to
reform the system of city government. Horner led the examination of conflicting government
jurisdiction, and tax and social welfare problems.
In 1914 Horner was elected probate judge in Cook County, a position he held until 1931, being re-
elected three times. Horner instituted the “Horner Plan” in which veterans’ estates were handled
without legal costs to the beneficiaries. The Horner Plan helped immensely with Horner’s popularity.
Horner also served on the Lincoln Highway Commission and the Commission for the Perpetuation of
Lincoln Memorials throughout the state, owing to his now noted interest in Abraham Lincoln.
In 1931 Horner resigned his judgeship to run for governor of Illinois sponsored by the Mayor of
Chicago, Anton J. Cermak. The 1932 Democratic primary pitted Horner against Chicago Irish hero,
Michael J. Igoe and the state Democratic Party chairman Bruce A. Campbell of Belleville. With
Cermak’s support, Horner won the primary and went on to defeat the Republican candidate, former
Governor Len Small. Franklin Roosevelt’s victory sweep in the 1932 national election was certainly
an added factor in Horner’s favor.
Soon after Horner’s election Cermak was killed in Miami, Florida, by an assassin’s bullet meant for
Roosevelt. This left Horner to lead the Illinois Democratic Party, battling with Chicago’s new
Mayor, Edward J. Kelly and Patrick A. Nash – the “Kelly-Nash Machine” of Chicago politics.
Illinois politics had always been a struggle between downstate and Chicago factions, and the
governor generally needed to have the support of Chicago politicos in order to be effective.

Horner however, declined to be controlled by the “Kelly-Nash Machine”. They feuded over off-track
betting and state regulation of liquor sales. Horner and the machine also disagreed on choosing
candidates for state offices. Kelly backed Dr. Herman N. Bundesen for the Democratic nomination
for governor in 1936, and a costly ($3 million) mud-slinging campaign ensued, with Horner the
victor. Horner went on to win the general election against C. Wayland Brooks. In 1938 Horner
backed Scott W. Lucas for the Democratic nomination for U.S. Senator against Kelly’s choice of
Michael J. Igoe. Lucas won the nomination and the election. The constant struggle within the party
was a strain on Horner, and his health failed after the 1938 elections.
Horner’s gubernatorial years were marked with struggle. He was governor during some of the most
trying years the state had ever known. The Great Depression was at its worst during Horner’s
administration and he had to fight against a reactionary legislature which contested any economic or
social reforms of the New Deal. Dairy farmers staged milk strikes and hungry people marched on the
State Capitol in search of relief. Bank closures and floods also wreaked havoc throughout the state.
Mine labor unrest continued to be bloody and uncontrollable.
Horner repealed prohibition and tried unsuccessfully to put liquor sales under state regulation. He
instituted a major revision to the revenue system, abolishing an inadequate property tax, replacing it
with a sales tax. This gained him the appellation “High Tax Henry”. Under Horner’s administration
state aid to schools increased, the old age pensions and unemployment insurance was instituted,
building programs for state institutions were established, and public health services improved.
Horner tried, but failed, to settle mine union warfare.
In the fall of 1938 Horner became ill. He spent some three weeks in a Chicago hotel, and then five
months in Florida recuperating. His lieutenant governor, John H. Stelle was left in charge as acting
governor. Because Horner disliked and distrusted Stelle, a four person advisory group of Horner’s
closest allies was established to advise Stelle. The four advisors were Sam L. Nudleman, director of
finance; Charles K. Schwartz, chairman of the state tax commission; F. Lynden Smith, director of the
state department of public works and buildings; and James Slattery, chairman of the commerce
commission. In April of 1939 Horner returned to Illinois and directed affairs from his bedroom in the
executive mansion. After spending the summer months in Chicago and returning to Springfield for
the fall legislative session, Horner decided he was too ill to run for a third term. The ensuing power
struggle for control of the Democratic Party and the different factions vying for the nomination for
the governor’s office were trying. At one point Stelle proclaimed himself governor citing Horner’s
illness, but the proclamation was ignored. Horner’s distrust for Stelle impelled him to refuse to step
down. Finally, however, Horner’s health intervened and he died in Chicago on October 6, 1940.
Horner was a sensitive man. The party squabbles and the ugliness involved in politics were hard to
bear. He was known to love children and enjoyed going to the movies. Single all his life, he lived by
himself in an apartment in Chicago with a parrot named Shut-up, once his mother died in 1921.
When he occupied the executive mansion he had several dogs as companions. Horner was a great
believer in air travel, and he flew all over the state to perform his official duties.

Horner was the first Cook County native to be elected governor. He was the first Jewish governor
and the second to die in office. He was a member of many clubs and organizations including; the
American, Illinois and Chicago Bar Associations; the Chicago Geographic Society; the Lincoln
Centennial Association; the Art Institute of Chicago; the Chicago Historical Society; the Masons;
and the Law, City, Chicago Literary, Mid-Day, Standard, Iroquois, Covenant, Collegiate, Illinois
Athletic, Lake Shore Country, Wayfarers and Caxton Clubs. He was a member of several Jewish
synagogues.

Scope and Content
The Henry Horner Papers, 1899-1940 consists of 159.67 linear feet of correspondence, legal papers,
financial records, campaign material, department files, subject files, published materials and
clippings housed in 333 manuscript boxes and 1 archival box. Twelve linear feet of oversize bound
volumes are also part of the collection. The Henry Horner Papers concern Horner’s eight years as
Governor of the State of Illinois, 1932-1940; and his tenure as judge of the probate court of Cook
County, 1914-1931. Material from his legal practice and some personal material in scrapbooks are
also included.
The collection is arranged into six series: I: Gubernatorial Papers, ca. 1932-1940; II: Probate Court
Papers, ca. 1914-1931; III: Vouchers, Canceled Checks and Miscellaneous, ca. 1924-1940;
IV: Memorabilia; V: Oversize Bound Volumes, 1899-1932; and VI: Oversize Manuscripts.
Series I: Gubernatorial Papers, ca. 1932-1940 (Boxes 1-306) is organized into four files: 1.
Political Files; 2. Departmental Files; 3. Correspondence Files, and 4. Subject Files.
The Political Files (Boxes1-31) consist of campaign material from the 1932, 1936, and 1938 elections.
This file includes correspondence, speeches, reports, publications, news releases, memoranda,
itineraries, appointment books, campaign literature and biographical information. There are several
folders of correspondence, some of which are arranged by county. In addition, political letters are
scattered throughout the files. Horner’s campaign speeches are included as well as typescripts of
speeches by Edward J. Barrett, Herman N. Bundesen, Bruce Campbell, Thomas J. Courtney, Michael
L. Igoe, Edward J. Kelly, Scott W. Lucas, Richards J. Lyons, John C. Martin., Adolph J. Sabath,
Thomas F. Sinnett, James M. Slattery, Len Small, Alfred E. Smith and Thomas A. Snell. There are
special reports on Republican Party activities, affiliation of Chicago ethnic groups and political
coercion of WPA employees. The file closes with several boxes of biographical material and
congratulatory messages.
The Department Files (Boxes 32-81), consist of correspondence, reports, publications and other
papers dealing with the operation of state departments, boards and commissions. The files are
arranged alphabetically by department name (excepting the placement of the Illinois Department of
Registration and Education, which ends the named department file) followed by a file of letters
referred to other departments. Within each department file the correspondence with the director of
the department is generally placed first followed by subject files. Included in this file are records for
the departments of Agriculture, Commerce, Conservation, Finance, Health, Insurance, Labor, Mines
and Minerals, Public Welfare, Public Works and Buildings, Relief and Unemployment, Waterways
and Registration and Education. There are also records for numerous boards and commissions,
Military Affairs and the University of Illinois.
The Correspondence File (Boxes 82-231) comprises the largest portion of the Horner Papers. This
file has been subdivided by the origin or the nature of the correspondence: 1. Correspondence-
Downstate; 2. Correspondence-Cook County; 3. Correspondence-Out of State; 4. Correspondence-
Personal; 5. Correspondence-Subjects; and 6. Invitations.

Correspondence-Downstate (Boxes 81-135) includes letters from the general constituency
from all Illinois counties except Cook County. The letters are sorted by county and
alphabetically arranged by correspondent name. Separate folders are sometimes provided for
prominent individuals or organizations, or for those from whom a large amount of
correspondence has been received. There are separate folders for Roy H. Porter, Wilbur H.

Scope and Content
The Subject Files (Boxes 231-306), consists of letters, copies of speeches, published material,
clippings, memorabilia, pictures and miscellaneous papers. Some of the major topics include
aeronautics, agriculture, American Legion, annual messages, Century of Progress, Anton J. Cermak,
charity, Chicago, crime, dedications, Democratic Party, Jews, Abraham Lincoln, Masons, the
Nationals Guard, politics, prohibition, radio, relief, Franklin Roosevelt and the Illinois State Fair.
Special item is a copper letter written to Horner (Box 140)
Series II: Probate Court Papers, ca. 1914-1931 (Boxes 307-313), includes legal papers, reports,
opinions, notes on procedure and material relating to specific cases Horner dealt with while serving
as probate court judge in Cook County for over fifteen years. Clippings and congratulatory messages
from the 1914 election for the judgeship removed from scrapbooks are included. Other clippings,
scrapbooks, volumes of probate court case notes and scrapbooks of correspondence and other
material from this time period are included in the oversize bound volumes.
Series III: Vouchers, Canceled Checks and Miscellaneous, ca. 1924-1940 (Boxes 314-333),
consists of executive mansion vouchers, check book stubs and canceled checks, clippings and a box
of miscellaneous items. The executive mansion vouchers are filed chronologically, and those of the
58th, 59th and 60th General Assemblies are also noted by voucher number in the container list.
Several boxes of unsorted vouchers are also included. Two boxes of unarranged check book stubs are
from Horner’s personal account. Five boxes of unarranged envelopes of canceled personal checks
include some bank statements, some statements from the Department of Finance and material
relating to Governor Horner’s special account. A box of miscellaneous material includes
correspondence and an appraisal of the estate of Henry Horner. Two boxes of clippings complete
this file.
Series IV: Memorabilia (Box 334) consists of special items such as an invitation to a banquet for
His Excellency, Guglielmo Marconi; a booklet of “The Old Kentucky Home” with a souvenir of
flower/tree; invitation to the White House; ticket to the Golden Gate Bridge Opening Ceremonies;
souvenir set of wooden nickels from the Festival of the States in St. Petersburg; dedication bridge
ticket to Mark Twain Memorial Bridge, 1936; a penny squashed from the World’s Fair, 1936; a
postcard signed by Jack Dempsey; and different types of ribbons and cards.
Series V: Oversize Bound Volumes, 1899-1932 (Oversize Bound Volumes, 1-39) cover Horner’s
political, professional and personal life prior to his tenure as governor. The volumes include a letter
press book from the firm of Whitney and Horner, financial records and attorney’s dockets from
Horner’s early legal career, an abstract book, case notes, scrapbooks, and two family Bibles. The
scrapbooks include mounted clippings, letters, mementos, campaign literature, congratulatory
messages and photographs. The period of his probate judgeship is most fully represented with
scrapbooks of clippings and correspondence, and volumes of case notes. A scrapbook of campaign
literature of Horner’s 1932 gubernatorial campaign is the only bound volume included that concerns
his governorship. A scrapbook concerning the death of Horner’s mother, Dilah Horner is included.
Series VI: Oversize Manuscripts, 1918-1940 (Oversize Drawer 49) consists of commissions as
Cook County Probate Judge; resolutions, proclamations, invitations, calendars and newspapers
(partial). The time period covers aspects of his being a probate judge and governor of Illinois.
