Appellant vide his appeal dated' 20-06-2014, received in this office on 25-

06-2014 has averred that he was not supplied information under RTI Act by the

PIO-cum- Town & Country Planner, Divisional Town and Planning Office, Shimla

against his RTI application dated 04-03-2014.

Both the parties were called for hearing on 01-07-2014. Appellant didn't

come present. He expressed his inconvenience to attend the hearing and stated to

direct the PIO to furnish the information. Planning officer % PIO, TCP Shimla

was present with record.

Perusal of the record reveals that RTI application of the appellant was

received in the % PIO on 07-03-2014. Since the information sought pertained to

two third.parties, therefore the PIO has written to third parties to show cause

against the disclosure of information as per the RTI application on dated 14-03-

2014. PIO has also written a letter to the appellant-applicant to show public

interest in such disclosure. Whereas third parties have objected to the disclosure

but no reply ha~ been received from the appellant-applicant so far.

So in the instant case decision of the PIO has not attained finality so far. PIO

is directed to dispose of the RTI application of the appellant with a speaking order

as envisaged in the section 11of the RTI Act-2005 within seven days from receiptof this letter.

If any of the parties is not satisfied with this decision, he/she has a right to

file an appeal before the" State Information Commissioner, Himachal Pradesh,

Majitha House, Shimla-2" within thirty days of receipt of this order.

Copyof the order be suppliedfree of cost to the parties.
