From: Residents opposed to industrial rezoning near our neighbourhood

Re: Application to rezone the property located at 6161 Otway Road (rezoning application# RZ100500, OCP amendment application# CPl00l 10)

We write to oppose the L&M Engineering application submitted on behalf of industrial companies CIF Construction and Timber West to rezone the property located near the junction of Otway Road and Cranbrook Hill Road in the Nechako River Valley (civic address 6161 Otway Road, the "Subject Property") from "Agricultural & Forestry" to "Light Industrial" (MI) and simultaneously amend the Official Community Plan.

We are residents of the Nechako River Valley who live near the Subject Property, either adjacent to it in the Cranbrook Hill neighbourhood or directly across the river from it in the North Nechako neighbourhood (the "Neighbourhoods").

The application should be denied for numerous reasons, including the following:

(1) The industrial companies CIF Construction and Timber West (the "Companies") will set up operations much closer to the Neighbourhoods than they presently are. This will result in increased noise pollution in the Neighbourhoods from manufacturing noise, heavy equipment operation, back-up beepers, and increased truck traffic on the nearby section of Otway Road. Residents already suffer from noise pollution generated by industrial companies located elsewhere on Otway Road, and we should not be subjected to additional noise even closer to our homes. The Companies' proposals to limit noise, such as conducting some operations indoors and building an earthen berm, do not guarantee that there will be no increase in noise to the Neighbourhoods. Other negative results will be increased air pollution and nighttime light pollution (from outdoor "security" lighting) in the Neighbourhoods. The net effect will be damage to the liveability of the Neighbourhoods and a commensurate reduction in property values.

(2) The site currently occupied by the Companies, 4833 Otway Road, has the industrial zoning of M7 ("Concrete & Asphalt"). When the Companies vacate the site, there will either be an expansion of asphalt and concrete industries (already a major source of noise, air, and visual pollution to the Neighbourhoods), or an addition of new industrial companies with operations that are likely to produce noise, air, and/or visual pollution. The net effect of granting the application would be that the number and/or size of industrial companies operating along Otway Road will increase. This is incompatible with the nearby residential zoning.

(3) The Subject Property is much larger than is required for the present operations of the Companies. This means that there would be space on the newly rezoned property for yet

more industrial operations. This could occur if either one of the Companies decides to lease part of the Subject Property to other industrial companies. This would further increase the number of industrial companies operating in close proximity to the Neighbourhoods.

(4) Neither one of the Companies has a compelling business reason for locating its operations at the Subject Property. They neither use raw materials from local sources (their present industrial neighbours), nor frequently sell products to these same neighbours. They do not depend on local "visibility" or passing traffic to conduct business. The Companies should locate their operations elsewhere, on land already designated "industrial," rather than trying to convert rural resource land. According to the City's Official Community Plan, the amount of "industrial" land already available is "far more than should be needed over the next 15 years." (See OCP Part A, section 2.2.)

(5) As a corollary to ( 4) above, both of the Companies conduct business largely through the movement, via trucks, of raw materials, finished goods, or machinery used to set up operations at distant sites. There is therefore no logic in locating their businesses far from the major transportation arteries into and out of the City of Prince George. The Subject Property on Otway Road is far from both Highway 97 and Highway 16, and therefore would make necessary trucking over city streets and through residential areas. This would result in unnecessary further impacts to residential areas.

(6) The proposed use covenants for the rezoned Subject Property are not nearly strict enough to protect the Neighbourhoods from future, possibly more disruptive, industries operating on the site. Leaving the " light industrial" designation under the list of acceptable "principal uses" leaves open a wide variety of industrial uses in the future, many of which would be disruptive to the Neighbourhoods. The covenants should state that the zoning will revert to "Agricultural & Forestry" if the Companies leave the Subject Property, lease any part of it, sell it, or allow any other entities to operate on it.

(7) Finally, the proposed rezoning of the subject property runs counter to the Official Community Plan (Bylaw 8383) adopted June 25, 2012, and would therefore require an amendment to the Official Community Plan (the "Plan"). The Plan states that it "establishes a framework for planning and land use in the City of Prince George," and is meant " to guide decisions on planning and land use management within the City." (See OCP Part A, sections 1.1 and 1.2.) The Plan explains, "Over many years, many decisions large and small should add up to achieve the community vision." (See OCP Part B, section 3, p. 20.) There seems little point in having drafted and adopted the Plan if it is not actually applied in situations such as this. Amending the Plan at the request of every special interest applicant is contrary to the Plan, to the essential purpose of a plan, and to visionary government.

Please deny the application to rezone the Subject Property and amend the Official Community Plan.
