Not tbo least importau sign of

The frequency with which BobbOroker and bis henchmen refuseto answer questions put by tboMazot investigating coramittoe ontbo ground of j. "Tbat's a personalmatter," indicates that many im-

A QUKSTIONAIILK ItF.COHU.

The Hawaiian Qovornment isnow on record with resprct to tbeSeptember elections. It maiutainsthat this is not a matter of suflicieat import to request instructionsfrom tbe Washington authorise;that the. municipal law as express-ed in tbe Constitution of tbo He-publ-

ic

of Hawaii must bo followol; that further consultation withWaBhiugtonautboritics is usolessBad the Newlands Resolution ifr

e'ear on tbo point. If the Hawaiian Government is

ia duty bound to carry out tbo lawf jund iu the. Constitution of thfRepublic ofHawaii without furtberquestioning of tbo Frcsidout, if itis under tbo obligations of an oatho? office under tbo American lawt) make no changes in require-ments of the constitution, whatright has it to demand that thevoters of tbo Hawaiian Republic, who have inot taken tbo oath pre-

vious to annexation, shall bo re-

quired to take a now oatht'jo text or title of whichis not found in tbo constitution ofthe Republic uf Hawaii, the Now-land- s

Resolutions or any of theinstructions received by tlio localgovernment from Washington ?

Tbe Hawaiian Government as-

sumed tbo authority to change theoath required of eleotorB by virtueof an articlo iu tbo Hawaiian Cou-B'ifuti-

readiugo folltwi:"Until otherwUo providd by

law the president, with tbu upproval of tho Cabinet, shall havopower to make ruleB and regula-tions not iticomistent herewith, for administering tbo oaths andholding ttloctions provided for bythis constitution,"

Acting under its assumed poworto "make rules and regulations""for administciing tbe oaths andholding tbo elections," tbe Ha-

waiian Government has changedtbo wording and interpretation oft'le constitution of Hawaii. Tbeoccasion for this is tbe annoxatiou of Hawaii to the UnitedStates and tbo assumed uecesbityfor mooting tbo ohangod conditions.

AVhon it comoj to a discussionof tho advisability of Inkling tbeSoptombor oJeclions and spendingtho poop'o'n money ueedlo-sly- , theHawaiian Govornmont assumesthat the folio sing passage in tho

''JW'1 'j

Newlands Resolution which isnil tbo American law tbo territorybap, bns no beoriDg oa tho sub-

ject:

Until Congress shall providofor tho government of such islands,mi tuo civil, uuiciai anu mili-tary powers exorcised by thoofficers of tbo existing gov-ernment in said islands shall bovested in such person or ptrsonsand shall bo oxorciscd in such amanner as tho President of tboUnited States shall diroct."

The Hawaiian Govornmontthen turns to this part of tho New-land- s

Resolution:

"Tho municipal legislation ofthe Hawaiian Islands not onaotcdfor tho fulfillment of tbo treatiesso extinguished, and not incon-sistent with this joint resolution, nor contrary to tbo Constitutionof tbo United Stitos, nor to anytreaty of tbo United StatcB, shallremain in forco until tbo Cou-gre- BB

of tbo United States shallotborwiso detcrmino."

By virtuo of this section of thoresolution, the Hawaiian Govorn-mont maintains that it cannotconsider any proposition lookingto the suspension of theelection law, that tbo gov-

ornmont and tbo pooplo aroforced to hold tho olection whe-trio- r

they want it or not.

Hera wo havo a local govern-ment that maintains its right toobango tbo constitution of tho Re-

public ouo day, and tho next dayclaims that it can do nothing toeavo tho peoplo'a monoy becausetho NowlandB Resolution com-

mands that municipal laws shallremain without obango till Con-

gress shall otherwise dotormino. If Arlich 79 of the Constitution

of tho Ropublio couplod with tbeResolution, empowers tbo Ha-

waiian Exccutivo to manipulatetbo oath, which is as much a partof tho municipal law as the arti-

cles defining tho duties of legislators or officers of tbo Ropublio, thou Articlo 79 of tho constitutioncoupled with tho Newlauds Resolution certainly empowers theHawaiian Executive to make anynumber of changes in tho "rulesand regulations" affecting "holding elections."

Tbo attitudo of tho govornmontin refusinc to contemplato tbosuspension of tbo olection laws isnot consistent, and its refusalto seek information from Wash-ington domonstratos tho govern-ment's indifference to tho interestsof tbo peoplo of Hawaii.

With this record tbo HawaiianGovornmout approaches tho September elections. On this recordwill tbo Hawaiian Government bojudged as to its desiro to considerthe best interests of tho pooplo ofHawaii in their effort to obtainfrom Congress an Amorioan territorial law.

PAVING KING TANU

Washington, May C No fur-ther advices havo reached thoStato Department from Samoaand it is that none willnow bo hud until the eastern mailarrives, about five days timo.

Tho commission is due at Apianoxt Wednesday and tho depart-ment's information is that there isno clanger of further outbreakmeanwhile Thoro is nothing intho reports tothodepartment tend-in- g

to sustain tbo statement thatUnited States Consul Osborn hasantagonized tho British and Am-ericans in Apia oponly adheringto tho German position.

Eeauoctiocr tho ronortod refusalof tbo consul to pay the salary ofKing Tanu, although nothing isknown of tho details, the disposi-tion ia to approve of this actionin tbo mattor. It is not knownhero officially that Mr. Osborn isacting in any such capacity, aspresident of tho municipal coun-cil, but in viow of tho withdrawalof tho Gorman official, Dr. Raffol, who ocoupied that position untilrecently, it is not improbable thattho duties of tho place may havoclovojved on tho American consul. In viow of tho questionable legal-ity of the provisional govornmont,it is boliovod that Mr. Osbornwould scarcely bo jueti6od in as-

suming tho risk of making pay-ments upon tho salary of theKing whoso titlo is called intoquestion by Germany.

In tho finals of tho ladies' doubles in tho tennis tournamont yea- -

toruay atternoon, Miss Hoffmanand Miss Scott won against Mrs.Gunn and Miss Hart. Tho matohwas an extremely oxoiting onethroughout. The wholo fivo setsworo ployed.
