    WHEREAS, the health of the people, being of paramount importanceall efforts of public services should be directed towards the protectioand promotion of health; and

    WHEREAS, with the advance in the field of sanitation in recent yearsthere arises the need for updating and codifying our scatteresanitary laws to ensure that they are in eeping with moderstandards of sanitation and provide a handy reference and guide fo

    C"APTER 1

    GENERAL PR#ISINSSec$%o& 1.#itle #he title of this (ode is +(ode on Sanitation of th)hilippines+'

    Sec$%o& 2.&efinition of #erms Whenever any of the following wordor terms is used herein or in any rule or regulation issued under th(ode, it shall have the meaning given it in this section, as follows*

    a- (ode (ode on Sanitation of the )hilippines'

    b- &epartment #he &epartment of Health'

    c- Secretary #he Secretary of Health'

    d- Regional &irector an official who heads a Regional Healt"ffice'

    e- .ocal Health Authority an official or employee responsible fothe application of a prescribed health measure in a local politicasubdivision'

    f- Health "fficer )rovincial, (ity or Municipal Health "fficer'

    g- Engineer A Sanitary Engineer'

    h- Section any section of this code unless the term refers tother statutes which are specifically mentioned'

    Sec$%o& 3.$unctions of the &epartment of Health #he &epartmenshall have the following powers and functions*

    a- /ndertae the promotion and preservation of the health othe people and raise the health standards of individuals an

    communities throughout the )hilippines;

    b- E0tend ma0imum health services to the people in rural areaand provide medical care to those who cannot afford it by reasoof poverty;

    c- &evelop, administer and coordinate various health activitieand services which shall include public health, preventive

    curative and rehabilitative programs, medical care, health anmedical education services;

    d- /pgrade the standards of medical practice, the 1uality ohealth services and programs to assure the people of bettehealth services;

    e- Assist local health agencies in developing public healtprograms including medical care, and promote medical and publ

    health research;

    f- %ssue permits to establish and operate government anprivate hospitals, clinics, dispensaries, schools of nursingmidwifery, and other para2medical course, puericulture centersclinical laboratories and blood bans;

    g- )rescribe standard rates of fees for health, medicalaboratory, and other public health services; and

    h- )erforms such other functions as may be provided by law'

    Sec$%o& '.Authority of the Secretary %n addition to the powers anauthority of the Secretary which are provided by law, he is liewis

    empowered to promulgate rules and regulations for the propeimplementation and enforcement of the provisions of this (ode'

    Sec$%o& 5.Authority of the 3ureau of &irectors #he 3ureau &irectorshall be responsible for staff activities involving the development oplans, programs, operating standards and management techni1ues itheir respective field of assignment'

    Sec$%o& 6.Authority of the Regional &irectors #he Regional &irectorshall administer health functions in their regions, implement policiesstandards and programs involving health services; and enforce thprovisions of this (ode and the rules and regulations promulgated bthe Secretary under this (ode'

    Sec$%o& 7.Authority of the Health "fficers #he health officers shaadminister health functions in areas under their 4urisdiction an

    enforce the provisions of this (ode and the rules and regulationpromulgated by the Secretary under this (ode'

    Sec$%o& 8.Miscellaneous )rovisions

    a- %nternational treaties, agreements and conventions #hRepublic of the )hilippines recogni5es international treatiesagreements and conventions on public health' #heir provision

    may be considered parts of this (ode provided they do nocontravene the (onstitution, e0isting laws or any provision of th(ode'

    b- Rights and proceedings Any proceeding which hacommenced or any right which has accrued upon the effectivitof this (ode shall not be affected by any of its provisions

    However, matters of procedure and rights arising after the datof effectivity of this (ode shall conform to the provisions hereof'

    c- &elegation of power and assignment of duty Whenever power is granted or a duty is assigned to any public health officein this (ode, the power may be e0ercised by a deputy or agent o

    the official pursuant to law, unless it is e0pressly provideotherwise in this (ode'

    d- .anguage re1uired Any notice, report, statement or recorre1uired or authori5ed by this (ode, shall be written in English o)ilipino'

    e- Mailing of notices /nless otherwise e0pressly provided, annotice re1uired to be sent to any person by any provision of th(ode, shall be sent through the postal service' #he affidavit othe official or employee who mailed the notice is prima facievidence that the notice was sent as prescribed herein'

    f- (ondemnation and sei5ure of property When any property officially condemned or sei5ed by government authorities in thinterest of public health, the owner thereof shall not be entitle

    to compensation'g- (ommand responsibility When a duty is e0pressly vested in health officer as provided in this (ode, it shall be understood thait shall liewise be the concern of the superiors of the healtoffice under the principle of command responsibility'

    C"APTER II(ATER S)PPL*

    Sec$%o& 9.)rescribed Standards and procedures

    Standards for drining water and their bacteriological and chemicae0aminations, together with the evaluation of results, shall conform tthe criteria set by the !ational &rining Water Standards' #htreatment of water to render it safe for drining, and the disinfectioof contaminated water sources together with their distributio

    systems shall be in accordance with procedures prescribed by th&epartment'

    Sec$%o& 1+.6urisdiction of the &epartment

    #he approval of the Secretary or that of his duly authori5erepresentative is re1uired in the following cases*

    a- Sites of water sources before their construction;

    b- &elivery of water to consumers from new or recently repairewater systems;

    c- "peration of a water system after an order of closure waissued by the &epartment;

    d- )lans and specifications of water systems of subdivisions anpro4ects prior to the construction of housing units thereat; and

    e- (ertification of potability of drining water'

    Sec$%o& 11.#ypes of Water E0aminations Re1uired

    #he following e0aminations are re1uired for drining water*

    a- %nitial e0amination #he physical, chemical and bacteriologicae0aminations of water from newly constructed systems osources are re1uired before they are operated and opened fopublic use' E0amination of water for possible radio2activcontamination should also be done initially'

    b- )eriodic e0amination Water from e0isting sources is sub4ect tbacteriological e0amination as often as possible but the intervashall not be longer than si0 months, while general systemat

    chemical e0amination shall be conducted every 78 months ooftener' E0amination of water sources shall be conducted yearlfor possible radioactive contamination'

    Sec$%o& 12.E0amining .aboratories and Submission of WateSamples

    #he e0amination of drining water shall be performed only in privator government laboratories duly accredited by the &epartment' %t

    the responsibility of operators of water systems to submit taccredited laboratories water samples for e0amination in a manneand at such intervals prescribed by the &epartment'

    Sec$%o& 13."ther )rotective Measures

    #o protect drining water from contamination, the following measure

    shall be observed*

    a- Washing clothes or bathing within a radius of 89 meters fromany well or other source of drining water is prohibited'

    b- !o artesians, deep or shallow well shall be constructed withi89 meters from any source of pollution'

    c- !o radioactive sources or materials shall be stored within

    radius of 89 meters from any well or source of drining wateunless the radioactive source is ade1uately and safely encloseby proper shielding'

    d- !o person charged with the management of a public watesupply system shall permit any physical connection between itdistribution system and that of any other water supply, unless thlatter is regularly e0amined as to its 1uality by those incharge othe public supply to which the connection is made and found tbe safe and potable'

    e- #he installation of booster pump to boost water direct fromthe water distribution line of a water supply system, where lowwater pressure prevails is prohibited'

    C"APTER III

    !D ESTALIS"MENTSec$%o& 1'.Sanitary )ermit

    a- !o person or entity shall operate a food establishment fopublic patronage without securing a permit from the local healtoffice' #he term +food establishment+ as used in this chaptemeans an establishment where food or drins are manufacturedprocessed, stored, sold or served'

    Sec$%o& 15.Health (ertificates

    !o person shall be employed in any food establishment without Health (ertificate issued by the local health authority' #his certificatshall be issued only after the re1uired physical and medicae0aminations are performed and immuni5ations are administered a

    prescribed intervals'Sec$%o& 16.uality and )rotection of $ood All food must be obtainefrom sources approved by the local health authority' %n this regardthe following re1uirements are applicable*

    a- Meats, meat products and fish shall be procured from sourceunder sanitary or veterinary supervision'

    b- All meat and fish shall be properly cooed before serving'c- !o meat products, fish, vegetables and other food sourceshall be procured from sources or areas nown to have beeaffected by radioactivity as for e0ample, areas contaminated wita very large amount of radioactive fallout'

    d- Mil and fluid mil products shall be obtained from sourceapproved by the local health authority' Mil obtained from othesources must be sterili5ed, pasteuri5ed or otherwise heated'

    e- Mil shall be stored in a refrigerator' (anned or pacage milother than dry mil powders, shall be refrigerated after thcontainer has been opened'

    f- All perishable and potentially ha5ardous foods shall be storeat :9

    7' !o person shall use any room or place for or in connectiowith the preparation, storage, handling or sale of any article ofood

    a- Which is at anytime used or in direct communication wita sleeping apartment or toilet;

    b- %n which any animal is ept; or

    c- Which is or has been used for any purpose which woulbe liely to contaminate the food or to affect in4uriously itwholesomeness or cleanliness; or

    d- Which is not used e0clusively for the purpose; )rovided#hat in department stores or multi2purpose busines

    establishments, food may be manufactured, preparedcooed, stored, or sold only in the area set aside e0clusivefor said purpose and for which a sanitary permit has beeissued'

    8' !o sanitary permit shall be issued for any premises to be usefor the preparation, handling and sale of food unless it constructed in accordance with the following re1uirements*

    a- $.""RS #he $loors shall be

    i' (onstructed of concrete or other impervious and easicleaned material that is resistant to wear and corrosioand shall be ade1uately graded and drained; all anglebetween the floors and walls shall be rounded off to height of not less than @ inches ='?8 cm'- from th

    floor; orii' (onstructed of wood with dovetailed or tongue angrooved floor boards laid on a firm foundation antightly clamped together with all angles between thfloor and walls rounded off to a height of @ inches ='?cm'-; or

    iii' (onstructed in accordance with the re1uirements osub2clause i- and ii- of this clause and covered witlinoleum, smooth surfaced rubber or similar materiafi0ed to the floor with cement or suitable adhesive)rovided, #hat with the approval in writing of the loca

    authority, floors may be covered with carpets or othefloor covering in those parts of the premises where succarpets or coverings can be satisfactorily cleaned anmaintained'

    b- WA..S

    i' #he internal surface of walls shall have a smootheven, non2absorbent surface capable of being readi

    cleaned without damage to the surface and constructeof dust2proof materials;

    ii' #he walls, where sub4ect to wetting or splashing, shabe constructed of impervious, non2absorbent materiato a height of not less than = inches 8 meters- fromthe floor;

    iii' #he internal walls shall be painted in light colors otreated with such other wall finish as the healtauthority may prescribe'

    c- (E%.%!BS

    i' All ceilings or, if no ceiling is provided, the entirunder2surface of the roof shall be dust2proof anwashable'

    ii' #he ceiling or undersurface of the roof of rooms iwhich food is prepared or paced or in which utensils ohands are washed shall be smooth, non2absorbent anlight'

    i' #he general standards of illumination provided shapermit effective inspection and cleaning and shall be osufficient intensity appropriate to the purpose for whicany room or place is used;

    ii' %n rooms where food is prepared or paced or i

    which utensils or hands are washed there shall be minimum illumination intensity of 8> foot2candles; ipremises where food is consumed, there shall be minimum illumination intensity of 9 foot2candles%ntensities of illumination shall be measured at a poin@> inches =?'8> cm'- above the floor;

    iii' All lighting shall be reasonably free from glare an

    distributed so as to avoid shadows;

    iv' At other areas or woring surfaces, the illuminatioshall be of such intensity as may be re1uired by thhealth authority'

    e- CE!#%.A#%"!

    i' Centilation shall be provided which shall be effectiv

    and suitable to maintain comfortable condition;ii' #he ventilation shall be ade1uate to prevent the afrom becoming e0cessively heated, prevencondensation and the formation of e0cess moisture owalls, ceilings and for the removal of ob4ectionabodors, fumes and impurities;

    iii' %n the absence of effective natural ventilationmechanical ventilation with airflow from a clean areaand discharging in such a manner as not to create nuisance, shall be provided;

    iv' (anopies, air ducts, fans or other appliances shall bprovided as re1uired by the health authority in particulacircumstances;

    v' Effective provision shall be made for securing anmaintaining a reasonable temperature;

    #here shall be sufficient floor space to enable everperson woring thereon to carry out his duties efficient

    and to permit easy access for cleaning' Woring spacesaisles or passageways and areas to which customerhave access shall be unobstructed and sufficient tpermit movement of employees and customers withoucontamination of food by clothing or personal contact'

    g- (HA!BER""MS

    7' #here shall be provided ade1uate and suitable locers or othefacilities for the orderly storage of clothing and personabelongings of employees or persons engaged or employed in thpremises' Such facilities shall be so situated and arranged so thathere is no contamination of food by contact with clothing, anwhere the number of persons engaged or employed is four omore of either se0, there shall be provided separate changin

    rooms for each se0'h- WASH2HA!& 3AS%!S

    i' Wash2hand basins shall be installed in convenient places and anear as practicable to where the person for whose use they arprovided are woring while handling food for sale or in suclocations as may be otherwise prescribed in any particular case'

    ii' %f re1uired in writing by the local health authority an additionawash2hand basin shall be installed as near as practicable to thtoilet facilities* )rovided, that the wash2hand basins specified ithis (ode need not be installed in premises where only food isealed containers is sold* and, )rovided, further, that wash2hanbasins specified in this regulation shall be installed undespecifications of the !ational )lumbing (ode of the )hilippines'

    i' An ade1uate supply of soap, clean towels, roller towepresenting a clean surface to each user from a continuous rolletowel dispenser or other hand drying services approved by healtauthorities'

    ii' #he wash2hand basin and all hand washing facilities shall, at atimes, be maintained in good repair and in a clean condition'

    iii' All wash2hand basins shall, at all times, while the premises arbeing used, be supplied with hot and cold or tempered runninwater at a minimum temperature of 7>>

    drying device immediately before woring, or after visitinthe toilet'

    Sec$%o& 2+.Cermin (ontrol

    Cermin A group of insects or small animals such as flies, mos1uitoescocroaches, fleas, lice, bedbugs, mice, and rats which are vectors o

    diseases'

    a- Spaces where food and drins are stored, prepared anserved shall be so constructed and maintained as to e0cludvermin'

    b- All opening which connects spaces to the outer air shall beffectively protected with screen of non2corrosive wire 7?2mes

    or finer' &oor screens shall be tight2fitting'c- A vermin abatement program shall be maintained in thestablishments by their owners, operators, or administrators' they fail, neglect or refuse to maintain a vermin abatemenprograms, the local health agency will undertae the wor atheir e0pense'

    d- &uring deratting or disinfecting operations, all foodstuffsutensils, food preparation and cleaning e1uipment shall bcovered to protect them from to0ic chemical substances'

    e- Cermin control in public places shall be the responsibility othe provincial, city or municipal governments which hav4urisdiction over them'

    f- #he procedure and fre1uency of vermin abatement program

    shall be determined and approved by the local health authority'Sec$%o& 21.#oilet and Washing $acilities

    a- Ade1uate and clean toilet facilities for male and femalcustomers and personnel shall be provided in properly locateareas'

    b- #oilet rooms shall not open directly into spaces where food prepared, stored or served' Where such toilets e0ist, the doorshall be tight fitting and self2closing'

    c- Ade1uate hand2washing facilities shall be provided within oad4acent to toilet room'

    d- $acilities shall include hot and cold running water, singleservice paper or cloth towel dispenser or drying device and soaor detergent'

    Sec$%o& 22.&isposal of Refuse

    a- Refuse cans may be used in food2preparation areas foimmediate use only'

    b- Storage refuse cans, filled and empty, shall be in a designatespace separate from food2handling operations'

    c- #hese cans shall be constructed and maintained as to bvermin2proof and easily cleaned'

    d- (ans containing refuse shall be tightly covered at all timese0cept during actual use in food2handling areas'

    e- Holding bins may liewise be used, provided they arconstructed of impervious, readily2cleaned materials, and fittewith tight2fitting covers'

    f- Where refuse cans are used, a space separated from the foodhandling spaces and ad4acent to the refuse2can storage spacshall be provided for cleaning them' #his space shall be e1uippewith scrubbing2brushes, cleansing agents, steam or hot wate

    under pressure, and a hose fitted with ad4ustable no55le'

    Sec$%o& 23.E1uipment and /tensils

    a- #hey shall be so designed, fabricated and installed so thacleaning is easy and they do not pose health ha5ards'

    b- .ead2soldered containers and cadium2lined piping and fi0tureshall not be used'

    c- Surfaces that come into contact with food or drins shall bconstructed of materials that are impervious, corrosion2resistannon2to0ic, easily cleanable, durable and resistant to chipping'

    d- Sliding doors on cabinets shall be easily cleanable anremovable' Runners shall be allotted at the ends to perm

    removal of dust and debris' #he bottom shelves of open2basefi0tures shall be removable to facilitate inspection, cleaning anmaintenance'

    Sec$%o& 2'.Washing of /tensils

    a- #hey shall be scraped and pre2rinsed to remove food articles

    b- #hey shall be thoroughly cleansed in warm water at 78>?>279

    b- #he surfaces of containers and utensils, including glasses antablewares, which come in contact with food and drin shall nobe handled'

    c- &isposable cups, plates, spoons and other single2serviccontainers and utensils shall be purchased in sanitary cartons an

    stored in a clean, dry place until used' #hese articles shall be shandled on removal from the carton that the hand does notouch the surface which will be in contact with food or drin'

    d- (lean cloths, napins, spoons, towels, and other clote1uipment shall be stored in clean places designated specificalfor them' Soiled linens, including towels, aprons, and coats, shabe stored in a closed bin or locer, suitably mared'

    e- Spoons, spatulas, dippers and scopps used intermittently fodispensing fro5en desserts shall be ept in running water or iwater maintained at 7=>

    hours of the inspection or evaluation, the original of the inspectioreport shall be furnished the holder of the permit certificate, thmanager or occupier of the food establishment' Whenever ainspection form issued indicates non2compliance items relating to anparticular type of premises, the inspector shall notify the holder of th

    sanitary permit, the manager or occupier of the correction to be madand indicate a reasonable period for its compliance' %f upon reinspection after the deadline the inspector finds the correction has nobeen effected he shall forthwith report to the Health "fficer and thHealth "fficer shall revoe the sanitary permit' A copy of thinspection form and any notices served shall, in all cases, be filed anept by the local health authority and be available at all reasonabl

    time for inspection by an officer of the &epartment of Health'a- SERC%(E "$ !"#%(E Whenever an inspection or evaluatioreport form indicates non2complying items, the Health "fficer othe )rovince, Municipality or (ity may cause to be served on thholder of the permit, the manager or occupier a notice re1uirinhim, within the time stated in the notice, to tae such remediaaction as may be specified therein' %n the event within the tim

    stated in the notice, hereinafter called the first notice, the termof the first notice are not complied with, the Health "fficer macause to be served on the holder of the permit, the manager ooccupier a second notice calling on him to show cause, at a timand place stated in the notice, why the permit issued in respecof the food establishment should not be revoed'

    b- REC"(A#%"! "$ )ERM%#S After prior notice and hearing a

    provided above, the Health "fficer, if satisfied that the terms othe two notices have not been complied with or that the failure tcomply therewith is not e0cusable, shall revoe the said permit'

    c- S/MMAR S/S)E!S%"! "$ )ERM%#S Whenever th)rovincial, Municipal or (ity Health "fficer finds unsanitary ounhealthy conditions in the operation of a food establishmenwhich in his 4udgment constitute a substantial ha5ard to th

    public health, the Health "fficer may order the immediatsuspension of the permit' Any person to whom such an order issued written petition shall be afforded a hearing as soon apossible'

    d- A))EA.S #he person or panel conducting the hearing ma

    confirm, modify or reverse the decision appealed from, whicdecision shall be final'

    e- )R"#E(#%"! "$ $""& !otwithstanding the other provisionof this regulation relating to the issuance of permits, everperson who is engaged in the sale of food or in the manufacturepreparation, storage, pacing or delivery of food for sale protecsuch food from contamination'

    f- )"WER "$ E!#R Any Sanitary %nspector or duly authori5eofficer of the &epartment of Health or of the )rovincial, Municipaor (ity Health "fficer, upon presentation of proper credentiamay at all reasonable times enter any premises engaged in thmanufacture, preparation or pacing of any article of food fosale or any premises used for any of the purposes referred to ithis (ode for the purpose of inspection or any other actionecessary for administration of this (ode'

    Sec$%o& 32.Special )rovisions

    a- Broceries or +Sari2Sari+ Stores

    7' !o grocery or sari2sari store shall be established within distance of 89 meters from any source of contamination'

    8' All foods which re1uire no further cooing before they areaten shall be protected from contamination while icountries or showcases'

    b- 3aeries'

    7' &elivery trucs and carts of baery products shall alwaybe ept clean and sanitary'

    c- &airies

    7' !o dairy shall eep unhealthy or infected cows, carabaoor goats for the production of mil, or feed themunwholesome food which produces impure or unwholesommil'

    8' !o animals used for the production of mil shall b

    allowed to gra5e on land which has been contaminated bradioactivity'

    @' !o dairy shall sell unwholesome mil that has not beepreviously pasteuri5ed or otherwise sterili5ed'

    d- %ce )lants

    7' "nly potable water shall be used in the manufacture o

    ice'8' %n storing and transporting ice intended for publconsumption, precautionary measures shall be taen tprotect the ice from sources of contamination'

    e- Ambulant $ood Cendors

    7' #hese vendors shall sell only bottled food drins, biscuit

    and confectionaries'8' %t is prohibited for food vendors to sell food that re1uirethe use of utensils'

    f- "yster 3eds

    7' "ysters shall be planted and grown only in areas approveby the Secretary or his duly authori5ed representatives anin places duly licensed by the 3ureau of $isheries anA1uatic Resources'

    8' "ysters offered for sale, if not originating from approveareas, shall be confiscated and destroyed by the local healtauthority'

    g- $ish Mareting Areas

    7' "nly fresh and wholesome fish products shall be sold'

    Sec$%o& 75.Septic tans Where a public sewerage system is noavailable, sewer outfalls from residences, schools, and other buildingshall be discharged into a septic tan to be constructed in accordancwith the following minimum re1uirements*

    d- %n all cases of disinterment, the remains shall be disinfecteand places in a durable and sealed container prior to their finadisposal'

    Sec$%o& 93.$uneral and Embalming Establishments #hesestablishments are sub4ect to the following re1uirements*

    a- Scope of inclusion for the purposes of this Sectionre1uirements prescribed herein shall be applied and enforced tfuneral chapels, embalming establishments and morgues'

    b- Sanitary permit !o establishment mentioned in the precedin

    paragraph shall be operated without a sanitary permit issued bthe Secretary or his duly authori5ed representative' #his permshall be revoed in case of any violation of the provisions of th(hapter and the rules and regulations promulgated by thSecretary'

    Sec$%o& 96.&onation of Human "rgans for Medical, Surgical anScientific purposes Any person may donate an organ or any part ohis body to a person, a physician, a scientist, a hospital or a scientifinstitution upon his death for transplant, medical, or researcpurposes sub4ect to the following re1uirements*

    a- #he donation shall be authori5ed in writing by the donospecifying the recipient, the organ or part of his body to bdonated and the specific purpose for which it will be utili5ed'

    b- A married person may mae such donation without thconsent of his spouse'

    c- After the death of a person the ne0t of in may authori5e thdonation of an organ or any part of the body of the deceased fosimilar purposes in accordance with the prescribed procedure'

    d- %f the deceased has no ne0t of in and his remains are in thcustody of an accredited hospital, the &irector of the hospitamay donate an organ or any part of the body of the deceased iaccordance with the re1uirement prescribed in this Section'

    e- A simple written authori5ation signed by the donor in thpresence of two witnesses shall be deemed sufficient for thdonation of organs or parts of the human body re1uired in thSection, notwithstanding the provisions of the (ivil (ode of th)hilippines on matters of donation' A copy of the writteauthori5ation shall be forwarded to the Secretary'

    f- Any authori5ation granted in accordance with thre1uirements of this Section is binding to the e0ecutorsadministrators, and members of the family of the deceased'
