' 1. By the combined effect of section 3 of the Legal Practitioners Act, 1962, and sections 3 and 4 of theLegal Education Act 1962, before anyone can be enrolled as a Legal Practitioner he must, unless exemptedunder the Legal Practitioners Qualification Regulations 1962/3 (L.N. 188 of 1962 as amended by L.N. 48of 1963) which are summarised in paragraph 5 below, obtain a qualifying certificate from the Council after
. fulfilling the conditions specified in section 3 of the Legal Education Act. To fulfil these conditions he must. have undergone an approvedcourse of study at an approvedinstitution and obtained an approved qualificationand thpsgafter successfully completed a course of practical training lasting not less thanone year and conducted

| 2. It is notified for information that in ne,adof the Council’s powers under section 4 of the Legal

For the purposesof paragraph 2 (6) above, the expression “law degree” bears the meaning assigned toit in the Legal Practitioners Qualification Regulations 1962/3 and the LL.B., LL.M., B.C.L. or B.A. degreeof any of the Universities concerned awarded as a result of a course in law lasting three or more years will berégarded as a law degree granted by an approved university in consequence of an approved courseof legal studies.In the case of courses leading to a B.A. or the like in which legal subjects form part only of the course leading

In no casewillsqualifying certificate be granted prior to the satisfactory completion ofa course oftraining at the NigésinLaw School, but applicants can, and should, apply for a decision on whether, subject to such completion,their course of study and’ qualifications will-be approved. Applications should be made in writing giving fulldptails of the previous. course of study, examination results, and professional qualifications.

__| 5. For the exact termsof the transitional exemptions and concessions, reference should be madeto theRegulations referred to in paragraph 1 of this Circular. Briefly summarised they provide as follows :
(a) A Nigerian citizen who, before 31st August, 1962, had become entitled to practise as a barrister,i advocate orsolicitor in anypart of Great Britain or Irelandis totally exempt and can apply for enrolment| without obtaining a qualifying or other Certificate fromthe Council. :(8) So can one who,prior to 3ist August, 1962, had passed a final examination qualifying him for call_or admission as such a-barrister, advocate or solicitor or who, prior to that date, had a conditional pass in_the Bar examination and whofulfilled the.conditions prior to 1st October, 1962. .
(c) One who, before 1st November, 1962, had obtained an approved law degree and embarked on acourse of study for an approved post-graduate law degree and who obtains the post-graduate law degreebefore ist September, 1965is also totally exempt from a course of training at the Nigerian Law School,but must (2) satisfy the Council that these conditions are fulfilled and obtain a certificate from theCouncil to that effect, and (é) apply colin prior to Ist January, 1966._, (@) One whopassed

Particular attention is drawn to this new concession introduced by the amending Regulations of 1963.Its object is to prevent hardship to University students in the U.K. and especially to those whoare sittingfor their Final examinationsin June 1963 and who,in conséquence, may be unableto take the Bar examina-tions in May 1963 so-as to bring themselves within the exemption referred to in paragraph (d) above. Totake advantageof this concession students must register for, and successfully complete, the 3-months’course, October-December 1963, and musttherefore return to Nigeria before the end of September 1963.If they fail to take and complete this course they will have to take a full year’s course.
(g) Under paragraph (f) of regulation1 (1) the Council also has powerto. grant individual exemptions/But this power, which has not yet been exercised and will be exercised very sparing! , is limited to cases wherethe Councilis satisfied that the person in question has acquired knowledge and experience fitting him forenrolment and would suffer undue hardship if he were required. to undergo a further course of practicaltraining.

6. In determining whatis a law degree, an approved University, and an approved course of legal studiesfor the purposes of the above-mentioned exemptionsand concessigns the same principles will be observedby the Council as thoseset out in paragraphs 3 and 4 above. ; 7
