Declaration of tendererBy submitting his offer the tenderer declares that:- he has read and understood the tender documentation- the tender and plans given to him are sufficient to calculate his offer- that he possesses all necessary permits, equipment, qualified workforce etc. in order to executethe works in a proper manner- he has informed himself about type and extend of the works to be done- that he has visited the site and informed himself about all circumstances that affect his pricecalculation such as location of site in "Zona B", site installation, neighbours, work restrictions etc.- that he will execute the works in accordance with the local specifications and regulations- that he is aware of the required execution period- he understands that no additional claims can be made under the title of ignorance

By submitting the offer the contractor declares that he has considered in his offer:the shape of the building, as well as the heightthat all wind -snow - ice and other -forces effecting the facade have been taken intoconsideration.

Scope of worksThe scope of works include the design, production, delivery, mounting, AS-BUILT drawings, and bringing into service of the facade elements such as aluminium elements, glazing works, panels and other fillings.All works also include the delivery of the necessary materials and parts including unloading and storage on site, transport, mounting and waterproof and windproof execution - even if they are not specifically mentioned (incidentals etc.). The scope of works also includes:a complete and testable structural analysisa complete and testable building physics documentation:- Building phyisics calcuations- Windows: calculated proof about the U-value- Proof of shading coefficient g-value- Calculation of the evaluated sound absorption (transmittance) value of the facade incomparison to the local standards (or laboratory measurements on site)Facade Consultant:

The contractor is obligated to hire an independant facade consultant for this project. A complete CV with education, level of experience etc is to be handed over to …………………. during the negotiation periode. All arising costs have to be included in the unit prices.

Facade time schedule:The tenderer must hand over before production a time schedule outlining:- planing- production- delivery to site-execution of the tendered worksThe dates agreed in the facade time schedule, will be part of the contract, and will be penalized(details to be discussed durning negotiations).Visit of plant:……………………..reserves the right to inspect the contractors production plant before signing thecontract, and during the production period.

Unit priceThe unit price includes all labour costs, equipment, materials, incidentals, transport to site,offloading, storing, mounting etc. needed to execute the works according to state of the art and inaccordance with the local specifications and regulations. The unit prices includes the siteinstallation as well.All prices are fixed prices (prices cannot be increased). Quantity deviations between tender and executed works do not allow the contractor to increase the unit prices.Further on all taxes, fees etc. for ZONE BUCHAREST are in included in the unit prices.

Survey worksThe contractor is responsible for all survey works needed for the execution of his works. All survey works necessary for the excecution of his works are included in the unit prices.Unit price for additional worksIn case of additional works the unit price has to be agreed before starting with the works.Validity of offerThe offer is valid for a period of 120 days.

Contract specificationsAll technical specifications and local regulations relating to the works described in the tender areconsidered as contract specifications. Further on west european quality standard is agreed.

SubcontractorsIf the tenderer intends to use subcontractors for the execution of the works he is obliged to inform the client when presenting the offer.

Approval of materialsAll materials have to be approved by the client before starting with the production of the works. It is the obligation of the contractor to request approval in a timely manner in order to prevent time delays.

Coordination with other companies

The timely and technical coordination of his works with other companies (especially electrical and HVAC works) are the responsibility of the contractor and included in the unit price.

Verification of plans and preliminary works

The contractor is obliged to verify all plans before starting with the execution of his works and to report mistakes to the client in writing.The contractor is further obliged to check whether a proper execution of his works is possible before starting with the execution of his works.Insufficiencies (missing or defective preliminary works from other companies etc.) are to be reported to the client in writing and the execution of the works has to be denied.With the execution of his works the contractor accepts the sole responsibility for the flawless execution of his works.

Documents for hand over

The contractor has to submit all documents, quality certificates, protocols , etc. needed for the approval of the building by the authorities to the client. Such documents are in particular certifactes of all kind, structural analysis, building physics analysis, AS-BUILT drawings, methode statements, product data sheets, conformity declerationThe unit prices cover the costs for producing these documents.

Construction material

All positions also include the purchase and delivery of the required construction materials to the site, offloading, storing etc.

Safety RegulationsThe contractor is solely responsible for the safety of his staff on site. The client is not responsible for any accidents on site. All workers have to respect the local safety regulations. Workers have to wear safety shoes and safety helmets at all times. The client has the right to immediately remove workers from site that do not respect the safety regulations or misbehave. Alcohol and drugs are strictly forbidden on site.

Alternative product

If the tenderer does not specify an alternative product (where the tender provides the opportunity to do so) he is obliged to use the product requested in the tender. Proving that the

alternative product is equal to the requested product in quality and appearance is the obligation of the tenderer.

Damages to other trades

In case of damages to other trades the damages have to be setteld directly with the othercompany. The client is not responsible for damages to the works executed by the contractor.If the responsible party cannot be determined the damage will be deducted from all companies working on site with regard to their contract sums

Continuous cleaning

The construction site is to be kept clean at all times. Waste materials are to be removed to the waste material area on a daily basis. If the contractor does not comply with this requirement the client has the right to instruct another company with the cleaning works and to deduct the costs from the contractor.

Presence of supervisory staff

Supervisory staff (site engineer or foreman) has to be on site at all times. A complete CV(including eductation, work experience etc.) is to be handed over during the negotiations. The contractor accepts that ………………………. has the right to reject the supervisor without reason. A weekly site meeting will be held in site office - attendancy is compulsory.

Delivery of plans by clientAs described above in point "enclosed documents"Defective ExecutionIf the executed works are not in accordance with the contractual status the client has the right to choose freely between:1.) Requesting touch up works2.) Requesting the demolishing and reconstruction of the worksOnly after finishing the touch up works the client will decide whether he accepts the works orpoints 2.) will be applied.

Take over

The works will be taken over after the owner of the building has approved the works and alldefects have been removed. Until take over the contractor is solely responsible for the protection of his works.For all elements and parts of the facade the contractor must ensure that these elements are handled with care and that these elements are protected during delivery and assembly until final take by the owner of the building (e.g with cover band etc. ) These protection materials have to be removed carefully before hand over.

Guarantee Period

The guarantee period is 2 years from the time of take over.Quality AssuranceAll necessary protocols, material tests, etc. necessary to ensure the quality of the works areincluded in the unit prices.

Punitive DamagesTo ensure a timely execution of the works a punitive damage will be applied. Details will bediscussed during tender negotiation.Regulations and standards:The tendered works are to be executed in a manner that they meet all EN standards, all Romanian standards and regulations. Design-Description 2GENERAL TECHNICAL SPECIFICATIONSSPECIFICATIONSGeneral aim of the facade:Aim of the tendered trade is to produce and assemble a wind anddriving rain tight, insulated, noise absorbent, fire protected facadethat fulfills the before mentioned attributes from room to room andfrom floor to floor.Architectual DesignThe enclosed design documents for the facade are binding regardingthe architectural appearance.MeasurementsThe measurements in the tender are drawing dimensions. Beforestarting with the production of the elements the contractor is obligedto take site measurements.The contractor declares that he has checked the handed overdocumentation (e.g. all drawings, the quantaties etc.). Further on thecontractor must check all measurements on site. Any uneveness etc.must be pointed out to ……………… in written. Later claims will not beaccepted.

Profile SystemThe dimension of the profiles (construction depth and visible width)given in the tender are binding with regard to the architecturalappearance.If offering alternatives to the tender specification, the contractor isobligated to proof that his system is equal in quality to the systemrequested by the tender.

all EN standards, all Romian standards andregulations. In case of contradiction, the standard that describes thehighest quality must be taken into consideration and executed.

MATERIAL PROPERTIES

Aluminium

Window and door profiles have to be executed thermally separated.Light metal sheets and substructure:The sheet thickness has to be chosen according to structuralrequirements (windloads etc.).Foldings have to be done before surface treatment using thesmallest possible radius without cracking. The verge of the sheetsare to be coated as well. The cover metal sheet on the slab mustcarry the loads of the raised florr (connection raised floor/facade).

Steel

Steel parts for anchorage, bracings etc. are to be executed instainless steel or hot-dip galvanized quality. Before installation thehot-dip galvaned parts are to be checked for damages thoroughly.Damaged areas are to be cleaned, grease removed and coated twotimes using a high quality protective coating.

REQUIREMENTSChoice of profileThe profiles must be able to carry the loads safely. The moment ofinertia provided by the profile producer has to be considered whenchoosing the profiles.

Dewatering and Pressure relief(Aeration) The dewatering of the rebate and the prechamber has tobe executed in a way that the moisture is led to the outside. Thedewatering of the prechamber occurs at the deepest point of therebate. The pressure relief for the glass rebate must be inaccordance with the instructions of the glass manufacturer.WindowsizesThe minimum and maximum wingsizes as well as the maximumweight allowed by the profile producer must be respected.

Window sillIf not specified otherwise window sills have to be executed with aslope of 8 degrees using extruded profiles with the same alloy as forframe profiles. The window sill is to be fixed with the base profile.

The window sill is to be protected against lift-off and vibrations usingstainless steel straps. Endpoints and movement joints are to be fittedusing special parts.

Structural requirements

The contractor is solely responsible for the structural integrity of thefacade. The calculations, profiles & windloads if given in the tender,were calculated by an experienced local facade designer but areonly to be used as rough indication during the tender phase andhave to be rechecked and recalculated by the contractor during hisdesign works for the facade. Different results during the contractorsdesign phase do not allow the contractor to modify the unit prices ofthe contract.

Dimensions and material thickness are to be chosen by thecontractor. Loads must be safely transfered to the building. For iscalculations the contractor has to consider all romanianspecifications as well as DIN EN 1991-1-4 for wind loads.

Tolerances

All connections and fastenings have to designed and constructed ina way that tolerances in the structural concrete works do not causeproblems. At every anchorage point in the grid system a tolerance of +/- 25 mm in alldirections must be possible.Connection parts such as screws, bolts, nuts that come into contactwith aluminum must consist of chromenickelsteel (minimum qualityA4 with reduced copper content). All other connection parts are to behot-dip galvanized. All parts are to be secured against unwantedloosening.To prevent contact corrosion when mounting different metallic partsa separation layer of neutral material must be used.Corrosion prevention:The contact areas of building elements made out of light metal withbuilding parts made out of steel are to be protected againstcorrosion. In gaps where a sufficient passivity of the constructionmaterial cannot be achieved due to the lack of oxygen the metalconstruction materials have to be separated using appropriate pvcfoils.Further it has to be considered that corrosion can also occur atcontact areas with non metallic construction materials.

Profile ConnectionsJoint and corner connections must be glued together tightly and

further also be fixed mechanically. The penetration of water into theconstruction must be prevented. The connections must keep theirstability, stiffness and impermeability throughout the profile section.

GasketsBasis for gaskets is DIN 7863. Material: Ethylen-Propylen-Terpolymere. Hardness, dimension, and profile type must be inaccordance with the intended purpose. Only system compatiblegaskets must be used. Gaskets must be replacable and havevulcanized corners.

FittingsOnly system products are to be used. All fittings with the exceptionof the operating handles must be mounted hidden. Fittings must bedimensioned accordingly. The fittings must be adjustable in 3dimensions.

Movement joints & Thermal joints

Movement joints and thermal joints are to be calculated duringdesign works and to be executed airproof and waterproof.Connecting joints to the building are to be executed watertight. Thejoints have to move silently without making any noise.

Thermal insulation materials

Only non flammable thermal insulation in temperature-, weather-, rot-,mold proof quality is to be used. Intrusion of moisture must beprevented to ensure a good thermal insulation.

Heat InsulationThermal bridges are not allowed. Condensation must be preventedby appropriate design solutions.

Joint PermeabilityJoint permeability and resistance to heavy rain must be inaccordance with EN 12154 . If not specified otherwise resistanceaginast heavy rain up to 1200 Pa as well as a joint permeability <=0,2m3/hm Pa 2/3 is to be guaranteed.

Sound insulation

The requested sound insulation values have to be achieved andproven by the contractor. The requested construction soundinsulation described in building physics specifications (32dB).

Rain and Condensation protectionAll connections to the building are to be executed "steamtight" on theinside and "not steamtight" on the outside. Rebates and notches inwhich rain could enter or which could contain condensation watermust have a dewatering function to the outside.

Fire protectionThe execution has to be in acordance with the fire regulations.Powder CoatingLayer thickness 65 +/- 15 μm.Hot-dip GalvanizingLayer thickness 50 - 85 μm.

Ventilated FacadesVentilated claddings are to be executed in a way that penetrated water can drain to the outside and does not wet the thermal insulation. The ventilation must be minimum 4 cm in average.

DESIGN, MOUNTING & EXECUTION

Execution Drawings & Design

The design and submission of execution details in 3 hardcopies isincluded in the unit rates. These drawings must be submitted wellahead of the execution works (minimum 2 to 3 weeks) in order toreceive the necessary approvals from the client. These worksconsist of but are not limited to:The execution of design drawings including the necessarycalculations for earthquake, wind loads, additional loads throughtraffic, thermal insulation, sound insulation etc.The contractors design work also includes all documents (writtenparts and drawings) needed for the approval of the authorities bothat the beginning and at the end of the project. The project has to beverified by local authorized engineers which includes MLPAT stampsA, B, C, D, E, F and any other verificator stamps requested by theauthorities.The approval of the client is only with regard to the architecturaldesign of the facade and does not release the contractor from hisreliability for the execution of the facade according to state of the art.

EarthingThe facade is to be earthed using the existing building earthingsystem.

Surface ProtectionAll profiles are to be protected until handover using protective foils.Scratched profiles at handover will not be accepted.

Final CleaningA final exterior and interior cleaning of the facade is included in theunit rates. The cleaning has to be done in accordance with class E ofthe guidelines for the cleaning of facades.Quality assuranceHoist devices and scaffolding:: All hoist devices inclusive of scaffolding where needed are to beprovided by the contractor. The costs are to be calculated in the unitprices.

Substructures:All necessary and needed subconstructions for facade and it'sbuilding parts like attics are included in the unit price, as well as allkind of heat insulations to protect the building against heat bridges.Installation of windows and doors:All necessary and needed additional works, like hydro isolation,metal sheeting (locksmith works), e.g. plates with lug patterns areincluded in the unit prices.

PROJECT TECHNICAL SPECIFICATIONS

D.1.1 FACADE CONCEPTThe facade marked by an horizontal glazed surface and a ventilated metal sheet cladded parapet area.The vertical columns are cladded also with ventilated metal cladding .Electrical sun protection is hidden behind the ventilated parapet claddingInside in parapet area the mullion profiles will be visible. The inside parapet cladding will be mounted between the aluminum mullion and transom profiles.The parapet area will provide a minimum 1.2 m height 30 min fireproof barrier.According to architectural design the curtain wall will be equipped with turn tilt window elements.

D.1.2 GENERAL QUALITY REQUIREMENTSAs a minimum, the facade must comply with the following standardsand guidelines:· CE marking· EN Standard 13830/2003 – curtain walling· ISO 9000/RAL quality mark· Guideline for metal engineering

The curtain wall system in the parapet area will be equipped with a thermal insulated panel , mounted similar to glass elements or mobile frames.This parapet panel will be equipped on the outside with the visible aluminum sheet (recommended for fire safety) or composite panel cladding. Inside the parapet area will have the desired finishing.Outside the cladding will be provided with a special “pocket” for the Warema external venetian blinds.The colour of the external aluminium cladding will be RAL:…………….The aluminium profiles will be painted RAL:………………………..The glazing will be a triple glazing neutral 50 mm thickness with Low E coating and tempered outer pane with an Ug <0.5W/m2K.
