The Georgia Composite Medical Board (GCMB) held its regular meeting on September 2, 2021 via

teleconference at 2 Peachtree Street, Atlanta, GA 30303, to consider Medical Board matters.

CALL TO ORDER Dr. Dalton called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m.

AGENDA Dr. Marshall made a motion, seconded by Dr. Gross to approve the agenda of the September 2, 2021

meeting. The motion carried unanimously.

MINUTES Dr. Marshall made a motion, seconded by Dr. Gross to approve the minutes of the August 5, 2021

and August 11, 2021 meeting. The motion carried unanimously.

CHAIRMAN’S REPORT Dr. Dalton advised everyone that due to the current COVID situation, we will continue to meet virtually.

EXECUTIVE DIRECTOR’S REPORT Ms. Hughes, Executive Director, presented the following report:

Recognized Akia Coley for 5 years of Service

Legislation for the upcoming session, The Board does not want to introduce any new legislation for this

session.

Ms. Hart, AJC, asked the Board if the Board had a position on who can prescribe Ivermectin. The Board

does not have a position and suggested she contact the CDC or FDA.

The Board considered a request from Dr. Lauterbach to waive the requirements for reinstatement. The

Board denied the request.

Ms. Hughes informed the members that Board would become a State of Principal Licensure for the

Interstate Medical Compact on September 15, 2021.

Mr. Steven Justus requested renewal information on an applicant. The Board denied the request since

applications including renewal applications are confidential by law.

Liz Keener asked if a MD can purchase an electro-hydraulic unfocused shockwave device? The Board

advised that there is nothing in the Laws/Rules that would prohibit someone from purchasing this device.

RESPIRATORY CARE ADVISORY COMMITTEE

Dr. Dalton presented the Respiratory Care Committee report as a motion, seconded by Dr. Marshall. The

Board accepted the report by unanimous vote.


Correspondence:

1. Email question from Chris Thebeau regarding telehealth and licensure. The Committee

determined that a Georgia respiratory license is required to perform remote/virtual

CPAP/BiPAP setups for Georgia residents by out-of-state registered respiratory therapists.

The Committee refers Mr. Thebeau to the current emergency rules and laws pertaining

to the use of telecommunication in Georgia.

Additional Business:

1. Attorney General’s office met with Committee to discuss scope of practice for RTs.

2. Michael Todd’s Rules Waiver Petition denied.

3. The Committee agreed to re-submit an additional draft of Respiratory Care Professionals Rules to

the Office of Planning and Budget with further justification of each rule.

RECUSALS Bostock Hearing – William Burnett, DO

REVIEW HEARING William Burnett, DO, requested a review hearing. David Stubbins, Assistant Attorney General, appeared

on behalf of the Board. Dr. Burnett had no representation. The Board members asked questions, then Dr.

Burnett responded. The Board voted to go into Executive Session to deliberate. Dr. Dalton declared the

meeting in Open Session. Dr. Marshall made a motion, seconded by Dr. Gross, to uphold the Initial

Decision of the Administrative Law Judge to revoke the license. Dr. Bostock recused.

LAW ENFORCEMENT ADVISORY REPORT The LEAR report was presented as a motion by Dr. Gross, and was seconded by Dr. Marshall, The Board
