AGING: Learn emergency steps to save a life, From 14 16 The Glendale Star January 18, 2018 Quentin Tolby Retired Judge LESSONS FROM THE BENCH Justice court pro tems (pro tempore – temporary judge) must be reappointed every year. In that process, we send their fingerprints to the F.B.I to make sure they do not have a criminal record. The report on one of our new pro tems came back with a notation he had been arrested, but there was no other information. I called the pro tem and inquired about the notation on the F.B.I. report. He said, “Yes, I know what you are referring to. About 10 years ago, I was a young hard-headed col- lege kid. I had learned just enough about my 4th amendment constitutional rights to be stupid. I was stopped by the police for a minor traffic infraction and he saw a box in the back seat and asked what was in it. I told him I have a constitutional right under the 4th amendment and you cannot search me or my car without a search warrant.” The 4th amendment, the right of the people to be secure in their persons, houses, papers, and ef- fects, against unreasonable searches and seizures, shall not be violated, and no war- rants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. The officer said, “I have rights, also and if I arrest you, then, I have a right to inventory anything in the car before I have it towed.” The pro tem said, He My 4th amendment rights placed me in in handcuffs and proceeded to open the box containing my dirty underwear. Of course, no charges were filed and I ended up with an F.B.I. record. Every time this comes up, I regret being a smart ass and not politely telling him it was my dirty underwear.” While we are discussing the subject of search war- rants, our Arizona Supreme Court just passed down an opinion about does it violate someone’s rights if they put a G.P.S device on a truck without the driver’s knowledge and then track the truck into California and back, then stop the truck because they had a load of marijuana. The court ruled his rights were violated. When our forefathers wrote the Bill of Rights, they never gave a thought to how it would be applied to cars. They did not have cars then; now, we are trying to deal with cell phones, G.P.S. drones, and what else is going to hit the street in the next few years. Lesson: Keep your nose clean and you do not need to concern yourself with your 4th amendment rights. that everyone receives this training and every care facility serving se- niors receive the training as well.
