1. Their appointment is against a purely temporary post which is liable to be

abolished at any time and position no promise of subsequent permanent

employment. No offer of permanent vacancy can be made them at present

If at any stage they desire to resign their posts they will be required

to give one month's notice or forfeit in lieu thereof, their salary

including allowances for one months or for the period by which the

notice is short of one month. Such a notice will be given to them by

the Directorate also in as it is proposed to terminate their services

for the reason other than that mentioned in clause (I) above.

They will be required to take the prescribed oath of allegiance to the

constitution of India

In case they are married, they will produce the following certificate to

his/her Head of office:- "That he/she is not having more than one living

spouse."

In case they are unmarried, they shall have to furnish a declaration

to the effect that each of these will not have more than one living

spouse.

They will be required to pass a test in Hindi or English as per Chief

Secretary instructions issued vide Memo No. 12/38/95-2GSI dated

20.01.1998, 17.01.2007 and 13.03.2012 at the speed of 25/30

words per minute respectively within a year from the date of joining

their duties otherwise they shall not be allowed their annual

increments until they pass such test. On passing the test they will

be allowed increment from the date following the day of test on

which they pass without payment of arrear of increments. Their

date of increments will, however, not be postponed on account of

their failure to clear the test within the prescribed period.

They will not undertake higher studies of any kind without prior

permission of the competent authority. Consequently, no leave of

any kind will be granted for the prosecution of higher studies.

They will be required to produce the original Educational documents

and Date of Birth Certificate, Handicapped Certificate and Haryana

Domicile certificate.

They shall have to furnish fitness certificate from the Chief Medical

Officer as required under Rule 3.1 of Punjab CSR Vol-I Part-I before

joining their duties.

If they have not been vaccinated within last twelve months they

should have it done before reporting themselves for duty.

No TA/DA and joining time will be paid to them for joining this post.

They will remain on probation for a period of two years, from the

date of their appointment. The period of probation can be extended

in accordance with the existing rule on the subject. For passing

their performance during the period of probation, their work conduct

will be taken into consideration, if their work and conduct during

this period is not found satisfactory their services will be terminated

without any notice.

Their appointment is subject to have passed Matriculation or its

equivalent examination with Hindi.

Their services will be governed by the Haryana Education

Department sub offices Ministerial (Group-C) Services Rules, 1983.

Their character and antecedents have been got verified and in case

subsequently any adverse facts come to the notice of the State Govt.

regarding his character and antecedents, his services are liable to be

terminated.

16. Their services will be governed under the New Pension Scheme of the

Haryana Govt.

If the above terms and conditions are acceptable to them, they

should report for duty to the office mentioned above within 15 days of the

receipt of this communication along with relevant documents as stated

above failing which the offer will be cancelled.

She submitted her reply to the said charge sheet on 07.01.2012 and requested forpersonal hearing against the said show cause notice.

Accordingly an opportunity of personal hearing was given to her on 08.08.2012.'Smt. Promila Devi explained the circumstances leading to complaints made against her bythe teachers working at that time, and also explained the attack made on her by thosemischievous persons who were related either directly or indirectly with the teachers likeDr. Vanita Singh, Lecturer in History, Sh. Hajari Lal, Lecturer in English etc. During thehearing, in fact, she has repeated all the happening mentioned in her reply to the chargesheet from the contents of reply of Smt. Promila Devi, it appears that there is force in hercontention that mischieve caused at the intention of Dr. Vanita Singh, Lecturer in History,Sh. Hajari Lal, Lecturer in English, Smt. Alpna Chaudhary, Science Mistress, Smt. GunwatiDrawing Teacher, Sh. Naresh Tyagi, PTI and Sh. Satya Narain, ABRC and thus are equiallyresoponsible for deteriorating the health environment in the school.

In view of above, glaring facts I am fully convinced that there was a deep rooted,conspiracy hatched by the teachers to degrade Smt. Promila Devi, the then Principal.

Keeping in view the overall facts of the case, I feel to meet the end of justice if asimple warning for not maintaining proper record in the dairy register for a long time beissued. However a copy of is also sent to Director Elementary Education, Haryana,Panchkula for taking disciplinary action against the above delinquent teachers and mastersinvolved in violating in atmosphere in the said school.

TERMS & CONDITIONS:-

1. Their appointment is against a purely temporary post which is liable to be

abolished at any time and position no promise of subsequent permanent

employment. No offer of permanent vacancy can be made them at present

in this respect, they will have to take their claims like others who have

been recruited similarly. Their services can be terminated without any

notice.

If at any stage they desire to resign their posts they will be required

to give one month's notice or forfeit in lieu thereof, their salary

including allowances for one months or for the period by which the

notice is short of one month. Such a notice will be given to them by

the Directorate also in as it is proposed to terminate their services

for the reason other than that mentioned in clause (I) above.

They will be required to take the prescribed oath of allegiance to the

constitution of India

In case they are married, they will produce the following certificate to

his/her Head of office:- "That he/she is not having more than one living

spouse."

In case they are unmarried, they shall have to furnish a declaration

to the effect that each of these will not have more than one living

spouse.

They will be required to pass a test in Hindi or English as per Chief

Secretary instructions issued vide Memo No. 12/38/95-2GSI dated

20.01.1998, 17.01.2007 and 13.03.2012 at the speed of 25/30

words per minute respectively within a year from the date of joining

their duties otherwise they shall not be allowed their annual

increments until they pass such test. On passing the test they will

be allowed increment from the date following the day of test on

which they pass without payment of arrear of increments. Their

date of increments will, however, not be postponed on account of

their failure to clear the test within the prescribed period.

They will not undertake higher studies of any kind without prior

permission of the competent authority. Consequently, no leave of

any kind will be granted for the prosecution of higher studies.

They will be required to produce the original Educational documents

and Date of Birth Certificate, Handicapped Certificate and Haryana

Domicile certificate.

They shall have to furnish fitness certificate from the Chief Medical

Officer as required under Rule 3.1 of Punjab CSR Vol-I Part-I before

joining their duties.

If they have not been vaccinated within last twelve months they

should have it done before reporting themselves for duty.

No TA/DA and joining time will be paid to them for joining this post.

They will remain on probation for a period of two years, from the

date of their appointment. The period of probation can be extended

in accordance with the existing rule on the subject. For passing

their performance during the period of probation, their work conduct

will be taken into consideration, if their work and conduct during

this period is not found satisfactory their services will be terminated

without any notice.

Their appointment is subject to have passed Matriculation or its

equivalent examination with Hindi.

Their services will be governed by the Haryana Education

Department sub offices Ministerial (Group-C) Services Rules, 1983.

Their character and antecedents have been got verified and in case

subsequently any adverse facts come to the notice of the State Govt.

regarding his character and antecedents, his services are liable to be

terminated.

16. Their services will be governed under the New Pension Scheme of the

Haryana Govt.

If the above terms and conditions are acceptable to them, they

should report for duty to the office mentioned above within 15 days of the

receipt of this communication along with relevant documents as stated

above failing which the offer will be cancelled.

Whereas Sh. Parmal Singh, S.S. Master, GHS Gokalpur Kumbawas

(Rewari) now in GHS Gurawara (Rewari) now compulsory retired from

service has filed appeal against the order dated 09-05-2012 passed byn

Additional Director Education whereby appellant was inflicted penalty of

compulsory retirement from service under rule 4 (1) (X) of the Haryana

Civil Services (Punishment & Appeal) Rules, 1987.

After going through the charge sheet, enquiry report, reply & other

relevant documents, appellant was given opportunity of personal hearing

on 23.08.2012. Accordingly, he appeared before the undersigned and told

that he had been victim in the present case as he had desired to pass M.A.

to improve his knowledge. He had filled up the examination form of M.A.

through Sachin Degree College, Gurgaon to Bundelkhand University,

Jhansi. He got roll no. slip and appeared in the exam. He received mark

sheet through Sachin Degree College, Gurgaon. He applied for promotion

in good faith. But he had not received degree of MA therefore he had told

to the then DEO Rewari and he had advised not to join to the promotional

post. Accordingly, even after getting the promotion order to the post of

Lecturer, he did not join on promotional post in the long period of

approximately ten years. Therefore, the order passed by competent

authority should be set aside and he should be allowed to continue in

service or reduce the punishment.

After going through the facts of the case and hearing the appellant,

the fact that he had applied for promotion on the basis of a fake

certificate, is beyond any doubt. It is also on record that he had not joirfAi

the promotional post in the long period of ten years. As far as the

circumstances under which the said certificate was procured by him is

concerned. The story narrated by him appears to be in after thought just

to find an excuse. Otherwise, it cannot be believed that he was not aware

of the system through which he made this attempt. Therefore, under the

circumstances, there is no reason to interfere in the orders passed by the

Competent Authority. Therefore, no relief could be extended to the

appellant in the present appeal and the same is hereby dismissed.

I pass order accordingly.

(Rewari) now dismissed from service has filed an appeal against the order

dated 09.05.2012 passed by Additional Director Education whereby

appellant was imposed penalty of dismissal from service under Rule 4 (1)

(X) of the Haryana Civil Services (Punishment & Appeal) Rules, 1987.
