NOTICE INVITING TENDER

Sub: Procurement of Forensic tools for the Office of the Principal Director of Income tax (Investigation), Chennai - reg.

PROPOSAL FOR PROCUREMENT OF CYBER FORENSIC TOOLS, COMPUTER HARDWARE AND PERIPHERALS FOR "Income Tax Investigation Wing, Chennai".

The Principal Director of Income Tax (Investigation), Chennai invites sealed tenders for Procurement of Cyber Forensic Tools, Computer Hardware and Peripherals for the "Income Tax Investigation wing, Chennai". The Bill of Material along with its Technical Specifications may be seen in Annexure-I enclosed.

1. PEFINITIONS

In this document, unless otherwise mentioned or expressed clearly, the terms 'Competent Authority', 'Tenderer', Committee would have meaning as given below:

Competent Principal Director of Income Tax(Investigation),Chennai. Authorit Tenderer The Firm/Company who buys the tender, signs and submit

the Tender shall be taken as "tenderer" for the purpose of this tender document.

2. COMPLIANCE

2.1 Each statement of Tender documents shall be complied. A declaration in this regards should be enclosed as per annexure.

2.2 Please note that any deviation from laid down requirements/specification shall be brought out separately in deviation sheets as per annexure to be attached with concerned section of the Tender. Failure to comply with this requirement may result in the Tender being invalidated.

2.3 The Tenderer shall offer his comments about all the requirements indicated in the specifications. The Tenderer shall mention whether the options are technically available in the proposed solution or not. The Tenderer shall clearly mention about the non availability of the required options in the offer, if any.

2.4 Each page of the bid and cuttings, corrections, etc., if any, shall be duly signed and stamped by the Tenderer. Failure to comply with this requirement may result in the Tender being invalidated.

The prospective Tenderers requiring any clarification about the contents detailed in the tender document may notify Pr.DIT(lnvestigation), No 46, Mahatma Gandhi Road, Chennai 600034. Fax 044-28211500 in writing (Original/Fax only) prior to due date. Response to queries, if any will be made on due date at Income Tax Investigation Wing, No 46, Mahatma Gandhi Road, Chennai - 600034. Clarification sought by the tenderers, along with Income Tax Investigation Wing, Chennai_responses will also be posted on website www.incometaxindia.gov.in • Accordingly, all the tenderers must refer the above website for clarification, if

any, before submission of their bids on the due date/time.

6. The Bids must reach the undersigned on or before the due date, i.e.,10/03/2016 by 5.00 pM. Bids received after the due date & time are liable to be rejected. All outstation tenders should be submitted in person or sent within time limit by registered post Delay in postal delivery will not be condoned. In the event of due date being a closed holiday or declared Holiday for Government offices, the due date for submission of the bids will be the following working day at the appointed time & venue. Bids will be received and opened on the NEXT day 11 AM ,Parties participating are requested to be available for opening of bids.

Note: DDThe Competent Authority shall not be responsible for any postal delay, non­receipt or non-delivery of the Proposals. DDThe Committee reserves all rights to open the envelopes and examine its contents or ask for clarifications or ask for revised proposals and the decision of the committee shall be final and binding. DDThe Committee reserves all rights to reject any or all offers without assigning any reason whatsoever. DDNo bid shall be accepted through telegraphic means.

7. ELIGIBLE TENDERER

7.1. The Tenderer must provide all items of reputed manufacturer, make and model. Necessary documents may be enclosed to support the same.

7.2. For computer forensics hardware and software an undertaking from tenderer required stating that they would facilitate the Income Tax Inyestigation Wing, Chennaj on regular basis with the technology/product updates through manufacturers and extend support for the warranty and AMC period as well and if failed to do so the security deposit is liable to be forfeited.

7.3. The annual cumulative turnover of the Tenderer in the last three years should be a minimum of Rs. Two Crore per year from Indian Operations. (Tenderer must state last 3 years turnover, supported by balance she ~s.)

7.4. Preference will be given to the Tenderer who have supplied a minimum of one such solution on turnkey basis comprising computer forensics hardware and software as major component to government organisation. (List of clients, solutions provided and supply order should be provided with the qualifying bid.)

7.5. The Tenderer must submit performance statement (statement of satisfaction issued by customer in respect of quality of product and service rendered after supply) in support of the above clause. The competent authority reserves the right to establish the veracity with respect to document mentioned. Completion certificates, letters of appreciation from customers should also be enclosed.

7.6. The Tenderer who having obtained any purchase order in last three years from Income Tax Investigation Wing, Chennai and failed to complete the same shall be rejected.

7.7. The tenderer shall have Income tax clearance certificate.

7.B. The tenderer shall have Sales tax clearance certificate.

7.9. The tenderer shall provide the Registration number of the firm along with the TNST/CST allotted by the Sales Tax authorities in their quotation.

PROCEDURE FOR SUBMISSION OF PROPOSAL

8. Quotations should be submitted in two separate covers i.e. Technical & Financial/Price bid.

9. First cover indicating "COVER FOR TECHNICAL SPECIFICATION" shall consist of only technical specifications of the system offered along with literature, pamphlets, drawing, etc.

This cover should contain complete technical specifications, make, model, names of supplier/manufacturer and commercial terms etc. of the system offered. Price column in this cover should be kept blank.

10. EARNEST MONEY DEPOSIT (EMD should be submitted in separate envelope duly marked as "EMD". This EMD envelope should be kept into the big envelop along with technical and financial bid envelope.).

11. Second cover indicating "COVER FOR PRICE BID" should contain the same details of first cover as well as price details also. Both the covers should first be sealed separately, and then both the covers should be packed in one bigger sealed cover. This cover addressed by name to the officer signing this en uiry should be submitted before the due date and time.

12. TECHNICAL BID

Technical bid Proposal shall consist of the following:

DO Proposal sheet duly filled in, signed and complete in all respects along with document showing the authority to make and sign the proposal (Annexure II).

DO Qualifying data duly provided as Particulars (Annexure IV) DO Eligibility of the Tenderer clarifying that the Tenderer is eligible for

proposal and is qualified to execute the contract, if the proposal is accepted (Annexure V).

DO Documentation of similar turnkey solution provided to government authorities and performance statement.

DO Deviations from the TENDER Document conditions (Annexure VI). DO E.M.D. Document. (EMD should be submitted in separate envelope duly

marked as "EMD". This EMD envelope should be kept into the big envelop along with technical and financial bid envelope.)

DO Letter of authorization in respect of the person authorized to remain present and interact with Income Tax Investigation Wing. Chenna;'

DO Tender Document issued by Competent Authority, duly signed and stamped on each page by Tenderer, along with duly filled forms and attached documents.

DO Letter of authorization given to tenderer by their Principal or authorized supplier.

13. FINANCIAL BID

DO Proposal Price quoted by the Tenderer for the aforesaid Income Tax Investigation Wing. Chennai in the Price Schedule (Annexure III) -in separate envelop duly marked as 'Financial Bid'.

DO Rates to be quoted must be definitive and shall not be allowed to be altered.

DO All payment shall be made in Indian rupees only. DO Price to be quoted inclusive of all ,taxes, charges, duties, F.O.R destination

Income Tax Investigation Wing. Chennai DO Rates be quoted in terms of unit, in words and figures both, in respect of

• proposed quantity.

DO Bids should be valid for a minimum period of 180 days from the due date for submission of the bids.

DO Envelopes should bear the inscription:- Proposal for Setting up "Cyber Forensic Lab in Income Tax Investigation Wing. Chennai"

14. Tenderer is duty bound to observe all Laws, Rules, Regulations, PoliCies, Procedures and Guidelines of the Government of India as in force from time to tim~.

15. The tenderer should quote the products strictly as per the tendered specifications. Complete Technical details along with make, model number, specification, pamphlets and literature of the systems highlighting the special features of their offer should be supplied along with the quotation.

16. The successful Tenderer will be under obligation to open a local support and liaison office in Chennaj within 30 days of award of the contract till the expiry of warranty period.

17. EARNEST MONEY DEPOSIT

17.1 Each quotation must be accompanied by Earnest Money Deposit of Rs 3.00 lacs (Three lacs only) payable in the form of Demand Draft/pay Order/Bank Guarantee drawn on any Indian Nationaljzed Bank in favor of pr.pIT. Investigation. Chennai. Bank Guarantee should be yalid minimum for a period of 180 days from the due date (original) of submitting the quotations. Quotations received without Earnest Money peposit are liable to be rejected.

17.2 Earnest Money is liable to be forfeited and bids are liable to be rejected, if the tenderer withdraws, amends, impairs or derogates from the tender in any respect within the period of validity of the tender.

17.3 The earnest money of all the unsuccessful tenderers will be returned as early as possible after the expiration of the period of the bid validity but not later than 30 days of the issue of the purchase order. No interest will be payable by Income Tax Investigation Wing. Chennaj on the Earnest Money Deposit.

17.4 The Earnest Money of successful Tender shall be returned after acceptance of the material.

18. Tenderer shall sign all pages of quotation forwarded with the quotation.

19. The Tenderers should give clause-by-clause compliance for the technical specification of the equipments in their technical bids which shall be explained before the technical committee during technical presentation on due date.

20. It should be specifically mentioned whether the quotation is strictly as per tender specifications/conditions. If not, deviations must be spelt out specifically. In the absence of this, the quotation may be rejected.

21. Tenderer should quote for all the items of the Package strictly as per the specifications. Price comparison shall be made package wise. Quotations not adhering to the specifications will be out rightly rejected.

22. Rates quoted by the Tenderer shall be final.

23. LANGUAGE

The Tenderer shall quote the rates in English language and international numerals. The rate shall be quoted in whole numbers. These rates shall be entered in figures as well as in words. In the event of the order being awarded, the language of all services, manuals, instructions, technical documentation etc. provided for under this contract, should be English.

24. All equipment has to be supplied by a single tenderer.

2S. The supplier will ensure smooth integration of the proposed equipments at specified location.

26. The supplier shall supply all installation & commissioning spares and accessories as may be required during erection, initial operation of the facility till successful commissioning at specified location. The supplier will have to arrange/provide for all the testing equipment & tools required for successful installation, testing, acceptance, and maintenance etc.

27. PROCEDURE OF FINALIZATION OF BIDS

Firstly, the Technical bid shall be opened by Tender committee. At the time of opening of bid the authorized representative may remain present.

The Tender committee shall prepare a comparative chart of ELIGIBILIlY Compliance and documents submitted by the tenderer for the purpose of Technical committee.

Technical presentation shall be made before Technical Committee on dU~ date. During presentation complete technical specifications, mak, model, names of supplier/manufacturer and commercial terms etc. of t e system offered shall be explained.

The Tenderers should present clause-by-clause compliance for the technical.specification of the equipments and give the same in writing to technical committee. During technical presentation technical committee shall sort out technically qualified Tenderers.

D O Financial bids of only technically qualified Tenderers shall be opened. Rest bids shall not be considered. At the time of the opening of Financial Bids, authorised representatives may remain present. It shall not be obligatory to accept only the lowest financial bid. No correspondence shall be entertained in this respect. All or any bid may be rejected. The essence is that only such bid that in the opinion of pr.DIT (Inyestigation) is most suitable for Income Tax Investigation Wing. Chennai shall be selected. Resorting to unethical practices may lead to the conclusion that bid is not suitable for the Income Tax Investigation Wing. Chennaj.

28. PROCEDURE FOR EVALUATION OF TECHNICAL BID

While evaluating the eligible Tenderers, the technical committee would look into, but not limited to, the following:

a) Proposal

DO Completeness and thoroughness of the proposal. All required information should be provided, in the format specified.

DO The Tenderers understanding of the purpose of Income Tax Investigation Wing. Chennai, scope and objectives, including the applicability and quality of approach.

b) Tenderer Experience and Resources

DO The quality, relevance and number of previous works and satisfaction reports of previous projects handled by the Tenderer.

DO Specific infrastructure, capabilities and resources required by Income Tax Investigation Wing. Chennai.

DO The financial stability and resources of the Tenderers or the consortium.

c) Price Bids

DO Lowest Tenderer may not necessarily be awarded the contract; however, price bid is an important evaluation criterion.

D D Cost for any increase in scope of work or up gradation of service levels in future.

29. INSPECTION

Income Tax Investigation Wing. Chennai representative shall have the right to inspect or to test the items to confirm their conformity to the ordered specifications. The supplier shall provide all reasonable facilities and assistance to the INSPECTOR appOinted by Income Tax Investigation Wing. Chennai at no charge. In case any inspected or tested goods fail to conform to the speCifications, Income Tax Investigation Wing. Chennai may reject them and supplier shall either replace the rejected goods or make all alterations necessary to meet speCifications required free of cost.

30. The Forensic software/hardware Tools (as contained in Annexure-I) has to be configured onsite by the supplier.

31. Media CD of the desired Operating system, Drivers, Computer forensic tools should be provided along with software/ hardware supplied.

32. The supplier shall provide free of cost in-house training to Income Tax Investigation Wing. Chennai officials at the site in features details, installation, operation and maintenance of the Forensic software/hardware tools. The required training documents shall be circulated well in advance.

33. AGREEMENT

DO The successful Tenderer will have to enter into an Agreement (annexure­VII) with the Income Tax Investigation Wing. Chennai for the performance of the contract on Rs. 100/- non judicial stamped paper, within 10 days of the communication of the final order on bids, the cost of which has to be borne by the supplier. The Income Tax Investigation Wing. Chennai shall provide Performa for such an agreement. No variation is permitted in this agreement.

DO Till such an agreement is signed, there is no liability for Income Tax Investigation Wing. Chennai and Competent authority. Pr.DIT may scrap the tender or any of it part without assigning any reason at any time before the signing of the agreement. In case of scrapping of tender or its part Income Tax Investigation Wing. Chennai will not liable for any loss or cost to tenderer. Till the signing of agreement the tenderer shall bear its own cost for all the activities relating to this.

DO Draft copy of the Agreement is attached for the perusal of the Tenderers.

34. Guarantee/Warranty/Support

Computer hardware peripherals and Computer Forensic software/hardware Tools (as contained in Annexure-I) has to be provided wit

onsite Guarantee/Warranty/Support for specified period mentioned in each Specification (as contained in Annexure-I).

Guarantee/Warranty /Support period of all equipments shall start after the satisfactory installation, commissioning, functioning, operation, acceptance and handing over of the entire work at desired location.

Guarantee/Warranty /Support shall include free maintenance of the whole equipment supplied including free replacement of parts.

35. DELIVERY PERIOD

The delivery is required within 60 days of placement of the purchase order. Any delay by the supplier in the performance of delivery of items shall render the supplier liable to penalty or cancellation.

36. PENALTY CLAUSE

That, the supply & services required are crucial part of the Income Tax Inyestigation Wing. Chennai and therefore, if the procurement of materials is not completed in the stipulated time as prescribed in this document, the pr.prr reserves right to impose penalty at the bid yalue as mention below:-

If Partial supplies of materials is made then the penalty shall be calculated as the sum of the penalty imposed on the supplied materials as per above rule and 5% amount of the non supplied material.

a) It shall be payable by the Tenderer and the said amount shall be deducted by way of damages from the total amount payable to the Tenderer, and / or

b) To purchase else-where, without notice to the Tenderers on Tenderer'S account and at the Tenderer's risk, the items not delivered or others of a similar description (where offers exactly complying with the particulars are not in opinion of the competent authority readily procurable, such opinion being final) without cancelling the contract in respect of the consignme not yet due for delivery, and / or

c) To cancel the contract or portion thereof and if so desired to purchase the items at the risk and cost of the tenderer, and/or

d) To forfeit the Earnest Money Deposit and/or Security Deposit to the extent of the loss incurred by the Government. In the event of action being taken under (a), (b) and (c) above, the

Tenderer shall be liable for any loss, which the Government may sustain on that account but the Tenderer shall not be entitled to any gain on purchase made against default.

The pr,PIT, Income Tax Investigation Wing. Chennai reserves the right to cancel the purchase order if the delivery of complete item is not made even after 60 days over the stipulated delivery period. In case of failure to supply the items as per purchase order, even after 60 days over the stipulated delivery period, the Pr,PIT reserves the right to forfeit security deposit/earnest money.

Decision of pr,pIT. Income Tax Investigation Wing. Chennai shall be final and binding on both the parties

37. PERFORMANCE SECURITY

The successful Tenderer shall submit a Performance Security of 100/0 of the BID amount (Earnest money deposit can be accommodated in performance security for successful Tenderer) of the eqUipment within 15 days of the placement of purchase order. The Performance Security may be in the form of Demand Draft/Pay Order/Bank Guarantee of any Indian Nationalized Bank. The Bank Guarantee should be valid for a minimum period of 12 months extendable to cover warranty period. In case supplier fails to deliver the items within delivery period or provide satisfactory after sales service within the warranty period, the Performance Security submitted by him is liable to be forfeited. Performance Security shall be released immediately after the warranty is over. No interest will be payable by Income Tax Investigation Wing. Chennai on the Performance Security.

38. Maintenancel Operation support conditions

a) Tenderer shall install, commission implement and provide maintenance support for the COMPUTER FORENSIC TOOLS, COMPUTER HARDWARE AND PERIPHERALS FOR "Income Tax Investigation Wing. Chennai".

b) Preventive maintenance once a quarter; c) Corrective maintenance as and when calls are placed by Income Tax

Investigation Wing. Chennai;

d) The response time (Attending the problem) shall be, 24 hrs from the time of receiving of call from Income Tax Investigation Wing. Chennai;

e) Failure to abide by any of the conditions stated above will resulted into a penalty Rs. 500/- per day.

39. Tenderer shall enclose the details liaison office proposed to maintain above maintenance support service at Chennai.

40. Equipments are required to be directly supplied at specified location i.e., Income Tax Investigation Wing. Chennai for installation by supplier. All the expenses involved in shipping the equipment to the desired location will be borne by the Tenderer. All aspects of safe delivery shall be the exclusive responsibility of the Tenderer. Income Tax Investigation Wing. Chennai will have the right to reject the component/equipments supplied, if it does not comply with the speCifications at any point of installation/inspections.

41. The rates should be quoted in Indian Rupees inclusive of Govt. Levies like Sales Tax, VAT, Service Tax etc.; Freight, Packaging & Forwarding charges, Entry Tax/Octroi etc, if any, for delivery at the premises of Income Tax Investigation Wing. Chennaj. All prices shall be fixed and shall not be subject to escalation of any description. The rates must be quoted strictly as per the Performa provided in Annexure-III.

42. Income Tax Investigation Wing. Chennai reserves the right to accept or reject any bid or cancel the tender proceedings without assigning any reason whatsoever.

43. Incomplete quotations are liable to be rejected.

44. In case of any discrepancy between rates mentioned in figures and words, the latter shall prevail.

45. RIGHT TO VARY QUANTITIES

The Competent authority reserves the right to vary the items and or their quantity within the validity of the contract without any change in price or other items and conditions with commensurate increase or decrease in delivery period. The competent authority also reserves the right to place part order on the selected Tenderer. The competent authority will be entitled to have protection of the price fall to be extended to it. The approximate requirements are given in the Tender Schedule. But it must be clearly understood that the demand may fluctuate and no definite quantity can be guaranteed. The essence of the contract is price per item for the contract period stipulated. The Income Tax Investigation Wing. Chennai reserves to himself the right to invite the f sh Tenders and to place orders against any quantity of any items in this Te d without specifying any reasons.

The quantity indicated in the Notice Inviting Tender may vary. Tenderer shall be bound to supply should the Income Tax Investigation Wing. Chennai requires the item in excess of the quantity indicated as above.

46 Income Tax Investigation Wing. Chennai may waive any minor infirmity or may seek any clarification, if so desired.

Any attempt of negotiation direct or indirect on the part of the tenderer with the authority to whom he has submitted the tender or authority who is competent finally to accept it after he has submitted his tender or any endeavor to secure any interest for an actual or prospective tenderer or to influence by any means the acceptance of a particular tender will render the tender liable to be excluded from consideration.

47. ARBITRATION

In all matters and disputes arising there under, the Income Tax Investigation Wing. Chennai shall be sole arbitrator to decide the claim and its decision shall be final and binding on both the parties. No suit or claim in respect of this tender can be filed in any court save at the court of competent jurisdiction at Chennaj.

48. FORCE MAJEURE

If any time, during currency of this contract, performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of war, or hostility, acts of the public enemy civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restriction, strikes, lockouts or acts of god.

(Hereinafter referred to as events ) provided notice of happenings, of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof, neither party have shall by reason of such event be entitled to terminate this contract nor shall either party have any such claim for damages against the other in respect of such non-performance or delay in performance, AND deliveries under the contract shall be resumed as soon as practicable after such event may come to an end or cease to exist, and the decision of the purchaser as to whether the deliveries have been so resumed or not, shall be final and conclusive provided further that if a performance in whole or part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days(sixty days) either party, may at his discretion terminate the contract.

Annexure - VII

AGREEMENT

WHEREAS the supplier has agreed with the purchaser to supply all those articles and provide services set­forth in the scheduled here to at the rates set-forth in column 3 of the schedule:

Now those present witness and it is hereby agreed as follows: -

(1) In consideration of the payments to be made by the purchaser at the rates mentioned in columns 3 of the schedule hereto annexed, the supplier undertakes to supply the articles as set-forth in columns 2 and 4 there of in the manner laid down hereunder.

(2) The supplier will supply goods, materials and services described in columns 2 of the Schedule hereto from time to time in such quantities as mentioned in column 4 of the Schedule hereto The supplier agrees to supply such additional quantity as may be entered in the Indent at the rates set-forth in columns 3 of the schedule hereto as may be required by the Purchaser.

(3) The goods or materials to be supplied under this agreement are to be new, made of excellent quality or sort in every respect equal and answerable to the price patterns of samples sent with the tender such as the purchaser has approved.

(4) The purchaser may by notice in writing call upon the supplier to supply additional goods or materials to serve as samples, and upon such notice in writing the supplier shall be bound to supply additional samples of goods or materials, such additional samples being in all respects of the same quality or sort as the samples first supplied and also be in conformity with Para-3 above.

(5) Unless when specially permitted otherwise in the order accompanying Indent, all goods must be dispatched within prescribed delivery period, of the receipt of Indent by the supplier, No reminder will be given for dispatch therefore. The purchaser reserves the right to refuse, to accept delivery of the goods if not delivered within delivery period.

(6) With every dispatch of goods or materials under this agreement invoices r bills in triplicate shall be sent by the supplier to the Purchaser, the duplicate 0

be returned by the Purchaser with quantities or number received duly note thereon.

(7) The supplier shall not sublet or assign this contract without the permission in writing of the Purchaser.

(8) Whenever necessary the purchaser will have right to call for adequate security as a safeguard for the satisfactory fulfillment of this agreement.

(9) Goods or material rejected or refused on the ground of being of inferior quality shall be removed by the supplier within 10 days at his own risk and expense or shall be dispatched to the supplier at the supplier's risk and expense.

(10) It will be open to the purchaser to call for income tax and clearance certificates.

(11) The system of payment shall be as follows: -

Bills in triplicate shall be sent by the supplier after installation of material on site to the Purchaser, and on receipt of these the Purchaser shall make payment direct subject to deduction of any amount to which the supplier may render himself liable under the term of this agreement.

(12) Packing case containers, gunny packing etc. which may be used for the purposes packing and which are delivered with stores will not be returned or paid for unless specially stipulated.

(13) In case the supplier shall duly supply the said articles and the goods at the rates and in the manner aforesaid the purchaser undertakes in his turn to payor cause to be paid to the supplier in the manner set-forth in condition (12) above, the amount for each and every consignment calculated at the rates set-forth in colA of the Schedule hereto.

(14) In case of non-performance or partial performance of any of the covenants and conditions of the agreement within the period specified by the Purchaser. It shall be lawful for the purchaser to annul, rescind or cancel the agreement. It will be lawful thereafter for the purchaser to purchase the said articles or goods from any other person and the supplier shall be responsible to make good any loss that may be incurred in such purchase.

(15) Upon the breach of any of the terms or conditions of this agreement by the supplier it shall also be lawful for the purchaser to forfeit the security deposit if called for in accordance with condition (9) above, in whole or part or impose such penalty as he may deem fit and recover the same from the security deposit or from any other payment to be made to the supplier or in any other manner as purchaser may deem fit but without prejudice to the right of the purchaser to recover any further sum as damage from the supplier.

(16) The purchaser will have powers to impose penalty up to 10% of balance undelivered/ partially delivered task/material in cases of excessive late deliveries.

(17) In case the supplier request for extension in the delivery period, he shall be liable for suitable penalty.

(18) Maintenancej Operation support conditions Tenderer shall install, commission, implement and provide maintenance support for the COMPUTER FORENSIC TOOLS, COMPUTER HARDWARE AND PERIPHERALS FOR "Cyber Forensic lab. Income Tax Investigation Wing. Chennai". Preventive maintenance once a quarter; Corrective maintenance as and when calls are placed by Income Tax Investigation Wing. Chennai.

The response time (Attending the problem) shall be, 24 hrs from the time of receiving of call from Income Tax Investigation Wing. Chennaj;

Failure to abide by any of the conditions stated above will result in to a penalty Rs.SOOj- per day; Tenderer shall enclose the details of liaison office proposed to maintain above maintenance support service at Chennai.

(19) The tender document as submitted by the supplier at the time of submission of the bid shall be taken as the part of this agreement and conditions set forth therein shall be binding on the supplier.

(20) All costs and expenses incidental to the preparation and execution of this agreement shall be paid by the supplier.

(21) If any dispute shall arise between the parties hereto in respect of this agreement or any of the provisions herein contained except in respect of matter hereunder every such dispute shall be referred to the arbitration of the Pr.DIT. Income Tax Investigation Wing. Chennaj. whose decision thereon shall be final and binding on the parties.

(22)This agreement shall have effect from the date of its execution subject to the above conditions. (23) The Pr.DIT. Income Tax Investigation Wing. Chennaj. may cancel the Work order and all proceedings relating thereto without assigning any reason.

The payment so made by the bank under this bond shall be a valid discharge of liability for payment there under and the Guarantor and their partners shall have no claim against the bank making such payment. This Guarantee will not be discharged due to the change in the constitution the Bank or Guara or "ahd their partners.

This guarantee shall be irrevocable and shall remain valid up to ---(date) --- . The guarantee shall be extended further at the discretion of the Bank for such period as required under the instructions of the Guarantor i.e. ---, on whose behalf this guarantee is furnished. The bank agree that the amount hereby guaranteed shall be due and payable to the Income Tax Investigation wjng,Chennaj on the bank being served a notice requiring the payment of the amount and such notice shall be deemed to have been served on the Bank by actual delivery. In order to give full effect to the provisions of this guarantee the bank hereby waives all rights inconsistent with the above provisions and which the bank might otherwise as a guarantor be entitled to claim and enforce.
