Grant of initial higher start-Clarification regarding regulation thereof.

Attention of all the Commissioners/Secretaries to Government in general and Commissioner/Secretary to Government. Educalion Dej;artment m particular is invited to Rule 8 of Jammu and Kashmir Civil Service (Revised) Pay Rules, 1992 :-

" The existing provisions of rule (10) and mle (12) of the Jammu a·nd Kashmir Civil Service (Revised Pay Rules) . l 987 relating to the benefit of higher starting sala1:y/advance increment(s) for higher qualification, in respect of all Departments, except to the . \lent of the posts of Police Constables and Junior Engineers, as provided in mle 9 (d) and (f), shall remain inoperative temporarily for fresh rccmits till such time as fresh orders are issued in this behalf by the Government."

2. It has come to the notice of Finance Department that despite . clear instmctions issued by Finance Department vide 0 . M. No. N2(92)-V/780 dated 19-10-1992, copy appended here\\1th as Anne.\lJre ·A' read \\1th clarification issued to Education Department vide Finance Department U. 0 . No. NI 54(92)-366 dated 26-4-1993 which inter-aha reads as under :--

.. . . . . . . . any e.\ isti ng employees "ho had e11ioyed the benefit o~ advance increments in old scC1lc. carries his benefit to the new scale at the time of fixation of pay. Any such employee whose b<lsic pay gets fixed al the minimum of new scale. even after having taken benefit of )ligher start, cannot claim fresh eq1ml number of increments in the new scale .. .... "

that certain Drawing and Disbursing Officers particularly in the Education Department have been C1llowing initial higher start in C<lse of in-serviee employees as on 30-03-1992 as well in cqintravention of the existing provisions of Rule 8 of Revised Pay Rule, 1992 re-produced in the foregoing para.

3. The matter having already been e.\amined in the Finance Department.it 1s again clMified th<lt in the context of the existing pnll"isions of the State Rules, an employee who has alr~1dy enjoyed beoefit of advance increment.'> in the shape of initial higher starting S<lll'll)' in the pre-re\"iscd scales and C<lrried sµch benefits to the corresponding revised p<ly scale al the lime of fixation of pay in the rev1 ed pay scales as promulgated vide SRO 75 rutted 30-3-1992 and whose basic p;:iy h<ls got fixed even at the minimum of the corresponding sc::i!e of p;:iy, c.1nnot cla im afresh an equ;il number of increments in the shape of initial higher stn rt in the corresponding scale of pay agnin. ·

Subject Fictitious . circular 0 M. No. A/2(92)-VHl/1209 dated 14-9-1992 regarding provisions of initial higher starting/advance increments for higher qualification contained i11 the J&K Civil Services (Reyised Pay) Rules, 1992-issued vide Notification SRO 75 dated 30-03-1992.

It has come to the notice of the Finance Department that some one has clandestinely issued a fictitious dr:cular under a fake 'G. M. No. A/2(92)-VIIiJl 209 dated 14-9-1992 having fraudt:lently been shown as signed by Director (Codes) Finance Department. Under the <;aid fictitious circular 0. M. the following fraudulently manipulated 'Instructions' have been issued :

''A doubt has been expressed about the dme from which the provisions contained in rnle 8 and 9 ·of SRO 75 dated 30-3-1992 in allowing higher starting salary and special trc::itment~ for certain posts in respect of fresh recruits/new appointments shall remain in-operative.

The matter has been examined in the Finance Department and it is clari:fieCl that the provisions of SRO 75 in to along with other benefits like higher starting salary and higher scale whkh are/were attached with certain categories of posts heretofore shall continue to remain in force in respect of all Government se~nts who were in service on 1-4-1987 or appointed thereafler upto 30-3-J 992.

However all fresh rccrnits made from 31-3-1992 onwards will strictly be governed under the standard provision of SRO 75 dated 30-3-1992.

All the Heads of the departments arc requested to kindly communicate the above instructiOI\S...tO all the Officcs/Organis<ltions under them."

It may be notified for information of nil the Departments and Offices/ Organisations/Units under each Department that no such Circular 0. M. No. A/2(92)-VllV 1209 dated 14-9-1992 has ever been issued b) the Finance Department. Whereas the Finance Department have t<1kcn up the m<ltter with Hom(i! Department (Crime Branch) to investigate into the matter expeditiously and b:ing the culprit(s) to book, in the mean time no cogni7ance of the said fake ai1d fraudulently ma~ipul<lted circul<1r O.M. should be taken by any Depanment/ Office/ Institution/Organisation of the Govt. In the event of any payment having already been rm1de by any Drawing anti DisbUFsing Officer ort the bc1sis of the S<1id fake/ circular O.M. the same should be recovered forthwith in one lump. The respective controlling Officers and the Heads of Departments sh<1ll be personally responsible to ensure that these instnictions arc adhered to strictly.

SR0-13.--ln exercise or the po\\'ers conferred by proviso to section 124 of the Co~"1:itution of Ja'mmu and Kashmir the Gm·ernor is pleased to direct to make the following am~ndments in the Jammu and Kashmir Civil Sel'\~ccs (Revised Pay) Rules, 1992 namely : --

In Rule 9 ofJammu and Kashmir Civil Services (Revised Pay) Rules, 1992 the following shall be inserted as Clause (j) under the caption "Village Level Workers"

(j) Village Level Workers :

l. Fresh recruitment to thr. post of Village Level workers will initially be macie in the pay scale or Rs. 950-20-1150-EB-25-1500 and they will be placed in the higher pay scale of Rs. l 2hO-:lO-l 56ll-EB-40-2040 after putting in eight years of service in the ·pay scale of Rs. 950-1500.

2. Out of the existing V.L.Ws working in the pay scale of Rs. ·950-1500, those having put in eight years or more in the said pay scale shall be placed in the pay scale of Rs. 1200-2040 prospectively i.e. from the date of issue of this Notification.

It is hereby ordered that Daily Wage Earners in all Government Departments (including the seasonal labourers employed in Gulmarg and Pahalgam Project Organisations) and those of Municipalities and Local Bodies as are presently in receipt of Rs. 25/- per day shall be paid wages at the l(lte of Rs. 28/- (Rupees twenty eight only) per day with effect from 1-1-1995.

SR0-18. in exercise of the powers conferred by proviso to section 124 of the Constitution of Jammu and Kashmir. the Governor is pleased to direct that the following amendments shall be made in the Jammu and Kashmir Civil Service (Medical Attendance-cum-Allowance) Rules. 1990.

In Rule 7(1) of the said Rules :

the words and figures viz· "Rs. SO/- per month., shall be substituted by the words and figures "Rs. 80/- per month' '

This shall be deemed to have· come into effect from l-1-1995.

Srinagar in lum informed !hat the Audit Office never requisitioned the original PPOs of the Pensioners for endorsing fam ily pension thereon payable to the spouse in the e,·ent of death of pensioner. Further 1he Accountant General agreed that the Pensioner shall not be required to gel the Form (14-A) submitted to Audit Omce through the Head of Omcc/Pension Sanctfon­ing Authofity whercfrom the pcns~oncr retired. Subject :--.Regularisation of daily rated workers/work charged employees-1011ow up action on decisions of the Committee.

Following decision of the Administrative Council for regularisauon of services of such daily rated workers/work charged employees as have completed 7 years of continuous working as on l lst March, 1994 or who may do so at the end of the subsequent fim1ncial years. the Committee under the Chairmanship of Additional Chief Secretary (Finance) has been activated to conve} formal clearance for the creation of posts to commensurate with the number of eligible cand1d:ites

2. It is in the knowte<tge of all the Additional Chief Secrei:aries/CommrJ Secretaries to Government as well as the Heads of Departments that Committee's work is predicated by a detailed exercise to be undertaken in each sector to provide back up date/information to form basis or dearance by the aforemen­tioned Committee. The flow of information in the initial srages following the decision of the Administrative Council. was quite slow but in the jast few months the process has bcon accelerated and has picked up momentum: Still in the cqurse of deliberations of the Committee many incompletion and deficiencies were discernibk' which have been pointed out individually to the r"spec1i've Dep~rtments and which entailed some delay in process of clearance of posts.

3. The unqers1gned takes this opportunity to bring to the notice of Additional Chief Secretaries/Commr./Secretaries to Government the imperative need to accord priority to this task which has to be carried out wit1' cxueme circumspection and thoroughness.with a view to obviating inclusion of ineligible ~andidates or exclusion . of eligible persons from the Statement.

4. The Committee so far has held 11 meetings and has approved creation of 14095 posts in various Government Departments besides 2487 posts in various Stale Public Sector Undertakings as per details given in the appended Statemem. We except to finalize all the eligible cases during the current year before end of March, 1995, by which time we should have initiJtcd another phase of exercise of preparation of the data/information in respect of such of the daily rated workers/work charged employees who shall be completing 7 years a on 11 t M111 c. h, 1995 . ~:>r- thereafter.

5. It has been no~1ced that there is hiatus in issuance of formnl orders by the Administrative DcpMlmcnlsfHcads of Dcpnr1mc1lls as per the approval conveyed by the Cornrnillee. We can understand that some inherent time lag is inevitCtblc in the . very procedure of ,·erifirnlion of bio-dala as \\ell as the conduct of the concerned for issuance of formal order~ of appointment but then in some cCtscs the delay has been inordinate. It is therefore. enjoined upon all the Additional Chief Seeretaries/Commr./Sccrcl a ri.~!> to Go,·1. !hat orders should be issued expeditiously to avoid inord)nalc delays.

6. It is also .~ik~ly that DepC1rtmcn1s had taken . follow up action on the approval accorded by the Committee but in absence of an~· endorsement of orders to us in the Finance Depa11ment and particularly to the Director (Codes) Fi nance Department. (Member Secretary to the Committee) \\'C do not have aucourant position oflhc orders issued by the Departments. \Ve \\Ould c.\pecl a report from all the Departments. in whose case the clearance has been gi ,·cn so that we update the records.

7. We arc proceeding on the basis that all the Department s ha\'ing daily rated workers/work charged employees. who are cl igibl.c for co' :: rage under the dispensation provided by the State Go\'crnment have sent 1hc statement to Finance Department and there are no Departments/Organisations other than those as indicated in the statement enclosed. lt is also for the information that no case for the year 1994-95 would be entertained by the Committee after 3 lst March 1995, ·as it shall be presumed that all the eligible cases have been processed and dealt with. It is because the exercise for the ~ ·car 1995-96 is to commence from April. 1995.

In view of above, all Additional Chief Secreta1·il:s/Commissioners/Secretar­ies/Heads af Departments/Chief faecuti,·es of Public Sector Undertakings are requested to ensure that where <:lea ranee/approva l for creation of posts has been conveyed by the C9mmittP.P. O<"t:iers for regularisation should be immediately issued under intimation t-0 the Finance Department in the prescribed m~nner. In all such cases where the proposals have ·~ot been prepared the process should culminate before March 1995. In other cases where certain incompletions have beef! indicated by the Fmance Department. the same may be examined and fresh proposals as per the prescribed statement submitted to the Finnnce Department for considerntion and notification of the schedule of di ~c11ssio ns . ·

Following the grant or Interim Relief of Rs. JOO/- per month in fav9lJr of the State Government employees with effect from Ist Aui,'Ust, 1994 and enhancement of Medical Allowance from Rs. 50/- to Rs. 80/- per month in their favour with effect from Ist January, 1995, the employees of State Public Sector Undertakings also demanded the increase in the Medical Allowance and grant oflnterim Relief on the analogy of the concession granted in favour of the State .Government Employees.

(c) in case the pay in the existing scale is drawn at a stage falling between the two stages of the pay in the upgraded pay seale, the pay be fixed at the ne:\1 higher stage :

In partial modification of this Departmenta l 0 . M. No. N13(95)-329 dated 8-3-1995 whereunde~ State Administrative Council Decision No. 24 dated 6-3-1995 was conveyed, it is hereby ordered that :--

(i) Interim Relief and Medical Allowance would be allowed to Public Sector Undertaking staff without linking them upto the resources and productivity of each unit. The enforcement or these rel id-; would. however, be su~ject to decision by the Board or Directors or each Unit :

(ii) an action programme be immediately drawn up for improving the performance of each Public Sector Undertaking. For this purpose the MOUs between the Administrative Departments concerned and Public Sector Undertakings will be drawn up providing for suitable physical and financial targets. S,uch MOUs be .~xccuted in April itself, and thereafter the results achieved will be monKOred every month. B. P.E. will closely monitor the performance or all Public Sector Undertakings and submit a report for information of State Administrative Council from time to time ; and

(iii) Arrears on account or a11diti11g of accounts in respect of Public Sector Undertakings would also be closely monitored by the concerned departments with a view to expeditiously clearing these. B.P.E. will submit a status note in this regard to the State Administrative Council.

The L.T.C. Rules for the State Government employees were introduced vide notification SRO No. 139 dated 10-4-90. Due lo various reasons these rule~ were ordered to remain inoperali,·c for a period of three months vide notification SRO 53 dated 13-3-1992. This period was subsequently e:\1endcd from time to time through various notific<1tions. last in the series being SR0-200 dated 22-9--1994, according to which the L.T.C. Rules continued to remain inoperative up to 1st March. 1995.

The issue regarding revi, ·a l of L TC is being c:-;amined by the Government.. It has been found th<1t there is much scope in revising the yarious provisions in the exi5ting in-operative rules. Accordingly the rules are being s~rcamlined and till further orders tht e:-;isting rnlcs sha ll continue to remain inopcrnti\'C.

In partial modification of Government Order No. 192-F of 1994 dated 29-11-1994, it is hereby ordered that the Government Pensioners and Family · Pensioners shall be allowed Dcamess Allowance on Pension/Family Pension at the following rates with efTect from 1-1-1995 :--

(i) Basic pay upto Rs. l.750/­

(ii) Basic pay above Rs. 1750/­but not exceeding Rs. 3,000/-

(iii) Exceeding Rs. 3.000(-

Rates of Dearness Allowance per month (Including ·previous instalments) w.e.f. 1-1-1995

125% of Pension/Family Pension.

94% of Pension/Family Pension subject to minimum of Rs. 2, 188/-

81 % of Pension/Family Pension subject to minimum of Rs. 2,820/-1

2. Pension/Family Pension in the case of pre Ot-04-1987 retirees and where family pension was sanctioned prior to 1-.+-1987 means the consolidated pension or consolidated family pension as the. case may be effective from 1-4-1987 in tenns of Government Order No 93-F of 1988 dated 1-t-1988.

3. In the case of Pensioners who have rcti~ from service on or after l-4-1987 and in the case of family pensioners whose family pension has been sanctioned for the first time on or after 1-4-1987 pension/family pension shall mean basic pension/ family pension admissible in terms of Notification SRO 129 dated 5-4-1988.

5. Payment of Dearness .Allowance involving a fraction of a rupee shall be

rounded to the next rupee.

6. Personal Pension, if any will not be taken into account for determining Dearness Allowance on pension.

7. Other provisions governing grant of Dearness Allowance on Pension/Family Pension such as regulation of Dearness Allowance during employme~t/r~­employment, regulation 9f Dearness Allowance where more than one ~nsaon . •s drawn etc. and other provisions of the existing rules, orders {as are not m conflict to the provisions of this order) shall continue to remain in force.

8. The Treasury 9fticers and/or the paying Branches of the Ja~u and ~ashmir Banlc where from the State Pensioners/Family Pensioners draw their pension shall authorise payment of Dearness Allowance to the Pensioners without waiting f~ any further instructions either from the Accountant General or from the ~neral Manager, Jainmu and Kashmir Bank. Where the Bank feels any doubt m the oomputation of Dearness Allowance in any case they shall refer the matter to the ooncemed Treasury Officer for clarification.

SR0-153.--In exercise of the po \'ers conferred by proviso to section 124 of the Jarnmu and Kashmir Constitution, the Governor is pleased to make the following amendments in the Jammu and Kashmir Civil Service Regulations, namely :-

For Article l JO (A) the following shall be substin1ted : namely :--

110 (A) Promotion of Govemment/scrYants who are under suspension or against whom diSciplinary/court procecdingS arc pending or whose case is under investigation or whose integrity. is doubtful.

At the time of consideration of the cases of Government servants for prORlOtion, details of Government servants in the consideration zone for promotion falling under the following categories shall be specifically brought to the notice of the Departmental Promotion Committee :-

(i) Government servants under suspension :

(ii) Governrnenl servants in respect of whom disciplinal)' proceedings are pending or a decision has been taken to initiate disciplinary procee­dings ;

(iii) Government servants in respect of whom prosecution for criminal charge is pending or sanction for prosecution has been issued or a decision has been taken to accord sanction for prosecution ;

(iv) Government servants against whom inveo:;rigauon of serious allegation of corruption. bribe!)' or grave miscondu.::t is in progress either by the Vigilance Organisation or any other agency. departmental or otherwise.

2. Procedure to he folloW4 .. '(I h~· Dcp:tr1mcntal Promotion Committee :

The Departmental Promo11on Commiltcc shall assess the suitability of the Government servants coming within the purYiew of the circumstances mentioned above along with other eligible candidates without taking into consideration the disciplinary case/criminal prosecution pending or contem­plated against them or where the inYestigation is in progress. and the grading awarded by it will be kept in a sealed cover. The findings of the Commiuoe shall be kept secret and opened only after the tennination of suspension order or conclusion of the disciplinary case/criminal prosecution/investigation. Till such time as the proceedings remain in sealed cover, the authority competent to rm the vacancy may fill the vacancy in the higher grade only in an Officiating capacity.

3. Procedure by subsequent Departmental PmmOtion Committee :

The same procedure outlined in para 2 above will be followed by the subsequent Departmental Promotion Committee convened till the disciplinary case/criminal prosecution/investigation pending or contemplated against the Government servant concerned is concluded.

4. Action after comtlletion or' de1>artmcntal ca~/criminal prosecution :

(a) On the conclusion of the disciplinary case/criminal prosecution or an investigation or termination of suspension as the case may be seated cover or covers shall be opened. In case the Government serv<1nt is completely exonerated, the due d<lte of his promotion will be determined with reference to the position assigned to him in the findings kept in the scaled oover/oovers and with reference to the date of promotion of his ne.\1 junior on the basis of such position. The Government servant may be promoted, if necessary by reverting the junior most officiating person unless there can be any other vacancy to accommod<lte him. He shall be promoted notionally with reference to the d<lte of promotion of his junior but he will not be allowed any arrears of pay for the period preceding the d<lte of actual promotion. The period shall, however be treated as service for experience. if any required for promotion to the nex1 higher grade. The seniority of such Government servant shall be determined by reference to such notional promotion.

(b) If any penalty is imposed on the Government servant as a result of the disciplinafy proceedings or if he is found guilty in the criminal prose<.'lltion against him, the finding of the sealed cover/covers shall not be acted upon. His case for promotion may be considered by the ne.'\1 Departmental Promotion Committee in the normal course and having regard to the penalty imposed on him.

5. Six monthly review of "Sealed Co\'er .. ca~ :

The competent authority · sh<11l review comprehensively the cases of Govem r.1ent serYants. whose suitability fo~promotion to higher grade has been kept in a scaled cover on the expiry of six months from the date of convening the first Departmental Promotion Committee which had adjudged his suitability and kept its findings in the sealed.cover. Such a review shall be ctOite subsequently also aner every six months in case the proceed.inp

against him have not been concluded. The review shall inter-alia, cover the following aspects :-

(i) The progress made in the disciplinary proceedingstcrirninal prosecution and further m~rcs to be taken to expedite their completion.

(ii) Scrutiny of the inateriaVevidence collected in the investigation to take a deci~iop as to whether there is a prime facie case for initiating disciplinary action or sanctioning prosecution against the officer.

(b) If, as a result of the review, the competGnt authonty comes to a conclusic,m, in respeet of cases covered by item (ii) above, that there is no case for taking action against the Government SCJ'Vant concerned, the sealed oover inay be opeitcd and he may be given his due promotion with reference to the position assigned to him by the Departmental Promotion Committee.

6. Procedure for ad hoc Promotion :

Inspite of six monthly review as referred to above, there may be some cases, where the disciplinary case/investigation/criminal prosecution against the Government servants are not concluded even after the expiry of two years from the date of the meeting of the first Department Promotion Committee which kept its findings in respect of the Government servant in a sealed 'cover. In such a situation the appointing authority may review .the case of the Government servant, provided he is not under suspensio" to consider the desirability of giving him ad 1'0C prO"'"tion kee]'ing in vtcw the following aspects :

(a) whether the promotion of the ofocer will be against public interest ;.

(b) whether the charges are grave enough to warrant continued denial of promotion ;

(c) whether there is no likelihood of the case coming to a conclusion in near future ;

,.·hether the delay in the finalisation of proceedings departmental or .in a court of law or the investigation is not directly or indirectly attributable to the Government servant concerned.

(e) whether there is any likelihood of misuse of official position which the Government servant may ~PY after ad hoc promotion which may adversely effect the conduct of the departmental case/criminal prose:Cution.

In case the appointing authority comes to a conclusion that it would be desirable, keeping in view the factors mentioned above, to allow ad hoc promotion

to the Government servant, his case should be placed before the next Dcpartmcntlll Promotion Committee held in the nonnal course after the expiry m two )all

period to decide whether the Officer is suitable for promotion on ad hoc basis. Where the (jovernment servant is considered for ad hoc promotion, the Department .PTomotion Committee should make its assessment on the basis of the totalitY of the individual's record of service without taking into account the pending disciplinary case/criminal prosecution/investigation against. him.

After a decision is taken to promote a Government servant on an ad hoc basis, an order of promotion mav be issued making it clear in the order itself that :-

(i) the promotion is being made/purely on ad hoc basis and the ad hoc promotion wi.11 not confer any right for regular promotion ; and

(ii) the promotion shall be "until further orders" . It should also be indicated in the orders that the Government reserve the right. 'to cancel the ad hoc promotion and revert at any time the Government servant to the post from which he was promoted.

If the Government servant is not acquitted on merits in. the. criminal prosecution but purely on technical grounds and the Government either proposes to take up the matter to a higher Court or to proceed against him departmentally or if the Government, seniant is not exonerated in the departmental proceedings, the ad hoc promotion granted to him Shall be brought to an end.

8. Procedure for 1>rovisional promotion :

Where the Government/appointing authority withholds integrity certificate for any reason or because the Government Servant has not been acquitted on merits in the criminal prosecution!Court· case but purely on technical grounds and the Government either propose to take up the matter to a higher court or to proceed against him departmentally which render him unsuitable for promotion the name of such a person shall be included in the list, provided

In continuation to Finance Department's circular No. N13 (61)-21 dated 8-1-1986 (copy enclosed for ready reference) attention of all the Additional Chief Secretaries/Commissioners Secretaries. Secretaries to Government and Heads of Departments is invited to Nole I and 2 bclo\v Art. 20-C of Jammu and Kashmir Civil Service Regulations. which read as under :-

Note I : A list of Government servants specially classed as inferior is given in Schedule ll.

Note 2 From the date of issue of SRO-.t06 da•cd IOth October, 1966 (viz. 10th October. 1966) the definition of term ·' Inferior Service" shall except for purposes of its application wilh reference to proviso to Art. 226 (1) be deemed as dclelcd.

1st proviso to Art. 226 (I) ibid reads as under :--

"Provided that the Govemment servants who were in service on 10-10-1966 and were treated as inferior as per schedule II will retire on attaining the age of 60 years. "

2. Instance!. have come lo the notice of Finance Department that certain categories o( employees like School Mother. Gasman etc. etc. who are not depicted In Schedule 11 of J&K Civil ScrYice Regul<tlions arc ret<1incd by the concerned departments m service beyond the age of 58 years (normal age of superannuation) which is in totality contrary to the proyisions of the. State Rule:;. As a result of this overstayal of service is avoidable im·olved in case of these categorie5 of employees and they are put to unncces_sary hardship in the mauer ·or finalisation of their pension cases.

3. In order to ·obviate avoidable hardship to the concerned employees in the case of finalisation of their pension · cases it is impressed upon all the concerned officers to adhere to the aforem&ltioned provisions of the State rules

Till October. 1966 Cltissificat ion in non-gazetted services as " Inferior" and "Superior" existed. Since it was legally wrong to classi(v GoYcrnment employees as inferior/superior the said classification ''as dispc11sed with v·idc SR0-406 dated IO~lQ-1966 . Aller dispensing with the said cla~-silication all Government employees regardless of the job they arc assigned arc tre<lled as Superior.

2. Cases are, however received in the Finance Department for declaring some categories of employees as inferior retros1X:ctivcly on the plea that their counterparts in other Depnrtmcnts have been declared as inferior in the past. Finance Department has examined this issue at length and MC of the opinion that declaring of any category of Go,·crnmcnt employees at this stage with retrospective efTect. as inferior is YiolatiYe of the b:isic principles. in considerations of which SR0-~06 dated 10-10-1966 has been issued. The Fi mince Department, therefore do 1101 agree as polic~ · to declare any post as inferior f;ir retrospective benefit.

3. The Departments are requested not to initiate any case on the subject for concurrence of the Finance Department.

Grant of Interim Relief to the Stale Government Pensioners/Family Pensioners.

It is hereby .ordered that the State Government Pensioners/Family Pensioners shall be paid, Interim Relief at the rate or Rs. 501- P.M. and in addition 10% of basic pension/family pension su~ecl to minimum of Rs. 50/- P.M. w.e.f. 1-4-1995, subject to the fulfilment of the following conditions :--

(i) If a Pensioner/Family Pensioner is re-employed/employed under the Central or State Government or a Corporation/Company/Body/Bank under them in India or abroad including pernianent absorption in such Corporation/ Company/Body/Bank, he/she shall not be eligible to draw Interim Relief on pension/family pension during the period of such re-employment/employ­ment.

(ii) Interim Relief may be shown as a separate element. No dearness relief on this element will be admissible. Interim Relief involving a fraction of a rupee may be. rounded off to the ne~1 higher rupee.

(iii) 111 ""1.!>IO: or persons tn rcce1µ1 or more than one pension, the Interim Relief will be calculated on the total o('all pensions taken together.

2. The concerned Treasury Officers/Bank Managers of J&K Bank wherefrom the· pensioners/family pensioners arc drawing their pension/family pension shall release pa)"ments on account of rnterim Relief on ' the basis of these orders ·without waiting for an)' further communication either from Accolliitant General or Chairman, J&K Bank/General Manager J&K Bank.

In partial modification of Government Order No. 99-F of 1995 dated 18-4-1995, it is hereby ordered that all Government employees including ·Worlc Charged and Whole Time Contingent paid employees worlcing in the regular time scale of pay shall be paid Dearness Allowance at the following rates with effect from 1-7-1995 :-

Pay Range.

(i) Basic pay up to Rs. 3500/-

(ii) Basic pay above Rs. 3500/­but below Rs. 6000/- P.M.

(iii) Basic pay above Rs. &:XXJ/. P.M.

Rate of Dearness Allowance (including previous instalments) w.e.f. l-7-l99S.

136% of basic pay.

l 02% of basic pay subject to mini­mum of Rs. 4760/- P.M.

98% of basic pay subject to minimum of Rs. 6120/· P.M.

2. The additional instalment of Oearness Allowance shall be paid in cash w.e.f. 1-7-1995 to all categories of employees including those drawing pay a1:bve Rs. 3500!- P.M.

3. The basic pay· for the purpose of this order shall be the basic pay as defined in Art. 27(a) (i) of-J&K Civil Service Regulations plus the stagnation personal pay which has been allowed to be treated as part of pay for Dearness Allowanoe u per Government Order No. 226-0R/F of 1990 dated 31-10-1990.

4. The payment on aoociunt c4 Dearness Allowance involving a fraction of 50 paise and above shall be rounded to the next higher rupee and the fraction of less than 50 paise shall be ignored.

5. The provisions of this order shall also apply mutatis mutandis in the case

In partial modification of Government Order No. 100-F of 1995 dated 18-4-1995, it is hereby ordered that State Goverrunent Pensioners and Family Pensioners shall be allowed Dearness Allowance on Pension/Family Pension at the following rates with effect from 1-7-1995 :--

Pension/Family Pension per month.

(i) Not exceeding Rs. 1750/­

(ii) Exceeding Rs. 1750/- but not exceeding Rs. 3oo0/-

(iii) Exceeding Rs. 3000/- P.M.

Rate of Dearness Allowance (including previous instalments) w.e. f. I-7-1995.

136% of Pension/Family Pension.

102% of Pension/Family Pension subject to minimum of Rs. 2380/-

88% of Pension/Family Pension sub­ject to minimum of Rs. 3060/- P.M.

2. Pension/Family Pension in the case of pre 1-4-1987 retirees and where family ,pension was sanctioned prior to 1-4-1987 means the consolidated pension or consolidated family pension as the case may be effective from 1-4-1987 in tem1s of Government order No. 98-F of 1988 dated 1-4-1988.

J. In the case of pensioners who have retired from service on or after '1-4-1987 and in the case of family pensioners whose family pension has been sanctioned ·for the first time on or after 1-4-1987 pension/family pension shall mean basic pension/family .pension admissible in terms of Notification SR0-129 dated 5-4-1988.

4. In the case of family pensioners whose family pension is sanctioned in respect of a Government servant who has retired or may retire· on or after 1-4-1992 and has died or may die thereafter or who has died or may die while in service on or after the said date. the family pension shall · mean the basic pension as admissible in terms of Rule 20 (B) of Family Pension Rules (Schedule XV) of Jammu and kashmir Civil Service Regulations incorporated vide Notification SR0-77 dated JO-J-1992.

{ /(] ' 5. Payment of Dearness Allowance involving a fraction of a rupee shall be

rounded to the nex1 rupee.

6. Personal Pension, if any. will not be taken into account for determining Dearness Allowance on pension.

7. Other provisions governing grant of Dearness Allowance on Pension/ Family Pension such as regulation of Dearness Allowance, during employment/ re-employment, regulation of Dearness Allowance where more than one pension is drawn etc. and other provisions of the existing rules/orders (as are not in conflict to the provisions of this order) shall continue to remain in force.

8. The Treasury Officers and/or the paying branches of the Jammu and Kashmir Bank where from the state Pensioners/Family Pensioners dra)V their pension shall authorise payment of Dearness Allowance to he pensioners without waiting for any further instrnctions either from the Accountant General or from the General Manager, Jammu and Kashmir Banlc, where the bank feels any doubt in the computation of Dearness Allowance in any case they shall refer the matter to the concerned Treasury Officer for clarification.

(a) Determination of age :

The date 01~ which a Gm·ernment Ser\'anl allains the age of superarmuation shall be determined with reference to the d11te of birth declared by the Government employee at the time of appoin1111ent and accepted by the appointing authority on productio1t. as far as possible. or conlirmatol) documentary evidence in the fono\\ing m<tnner :--

(i) In case of Government employee. \\'here prescribed qualification is matriculation or :-JbO\e. matriculation or equivalent certificate issued by the Jammu and Kasl1mir Bomd of School Educ:1tio11 or any recognised Board/Uni' ersity wherefrom the employee has passed such examination :

(ii) In case of Go\'ernment employees. \\'here prescribed qualification is below m<ttricul<ttion. the school lem'ing certificate. duly signed by the concerned Head of Gm·t. School and countersigned by ' the cencerned Gazetted Officer of the Educ<ltion Dep<trtmcnt in immediate administrati,·e control of the said lnstitu1ion (in case the Head of Institution/School is not a Ga1.e1ted Omcer) . 3. A certificate in the above mentioned format issued by a • cdic~l Board of the respective district. where the employee is posted The Medical Board shall comprise of :-

(i) Chief Medical Officer of the respective district ;

(ti) Radiologist ;

(iii) Dental Surgeon.

(b) Recording of Date of Birth in the record of service ·

(i) On producuon of Date of Birth Certificate by the concerned Government employee in the manner prescribed in clause (a) above, the concerned Head of Office/Drawing and Disbursing Officer under whose signatures the monthly pay bill of the establishment is paid froin the treasury, shall ~rd his/her date of birth in the service book or any other record that .may be kept m respect of such Government servant with re erence to relevant confirmatory documentary

evidence ;

(ii) The signature or thumb impressions (in case of illiterate persons) of the concerned Government servant(s) shall be obtained in token of its acccptMCC as to its oonect recording on the first page of relevan~ service bookJrocord of service by· \he concerned Head of Office/Drawing a.nd Disbursing Officer at the time of authentication 'of the entries on the

first page of service book/record of service ;

(iii) An authenticated copy ol me confirmatory documentary evidence substantiating the recording of date of birth shall be attached with the service book/record of service to form an inseparable part of the

same.

(c) alteration of Da~e of Birth

The date of birth so aeclared by he Government servant and accepted and once r~rded by the appropriate authority {as specified in clause (b) above) in the seMce book or any other record of. ~rvice of the Government servant, a~ the case may be, shall not be subject to any alteration except in the case of a. clerical error without the orders of the Government. No alteration of date of birth of a Government servant shall be made by the Government (Administrative Department) unless a request in this regard is made by the concerned Government serva~t .within a period of five years of his/her entry into Government service and it 1s clearly established that a genuine/hG:iafide mist:ike .Jlas occurred.

Provided that 10 case of Go\'ernment servant. in service on the date of issue of ~s Notification, a requ~t for alteration of his/her date of birth may be cons~de~ by ~e Government, for reasons to be recorded in writing._ if an apphcauon to this effect is made within a period of six months from the date of issue of this Notification.

. ~r~vided further that the date of birth so altered would not make him/her mehg1ble to appear in any school c; University/Board or Public Service Co~ission Examination in which he had appeared ~r for entry into Government seiv1ce. on the date on which he first appeared at such examination or on the .date on which he entered Government sc"•icc.

(d). Notwithstanding the provisions contai~cd in clause (c) above regarding alterall?n ~f date of birth. Government, however, reserves the right to make a ~rrect1on m the recorded age of Government servant at any time, against the ~nte~ests of th~ Govemfnent employee when it is satisfied that the age recorded m his/her seM~ book or in the history of se"rices of the concerned Govenunent se~ant is incorrect and has been incorrectly recorded with the object that the said Govenuncnt employee may derive some unfair advantage therefrom.

No other document such as succession certificate, wil, deed, affidavit etc. be accepted for grant of family pension.

Note 2.-The divorced daughter(s)/di\"Orced sister(s). suQjcct to all oth'!r conditions, shall be cligi,ble for family pension only if they produce a reasonable proof of their hm·ing been dependent on the deceased employee. If such a beneficiary remarries the payment of family pension shall stop immediately.

Note 3.-Cases for grant of family pension which are pending at the time of issue of this Notification shall be decided under the amended rules.

3. The following shall be inserted as ·•government Instructions" below rule 22(a) of (Schedule XV) F;:imily Pension-cum-Gratuity Rules.--

Govern111ent lnstruction.--ln the ense of twin sons/twin daughters the family pension shall be payable to such children in equal shares. In the event of one such child ceasing to be eligible for family pension his share of family pension will not lapse but will become payable to other such child and when both such children become ineligible for family pension. the family pension will become payable to the next eligible single child or twin children, if any, as the case may be.

Pending cases if any sh<tll be decided under the <tmended rules.

SR0-313.--ln exercise of the powers conferred by section 118 of the Constitution of Jammu and Kashmir the Governor is pleased to direct that the following amendments shall be made in the Jammu and Kashmir Financial Code, Volume I

In the said Code ;

The Director Central Purchase and Stores Department shall be competent to make advance payments against documents for cost, freight and incidental charges of stores purchased within and outside the State without obtaining the prior sanction of the competent authority.

Provided that necessary provision exists in the budget and full amounts are advanced to Government owned Corporations/Under­takings like J&K Cements Limited and Steel Authority of India only, in case of purchases of Cement. Bituman and Steel. In respect of other materials. advances to the extent of lO to 20 percent only shall be made. prodded the same are purchased from outside the State".

Where it is the intention of the competent authority not to allow the · concerned Government servant any pay and allo~nces for the period of un-authorised absence the said period may be treated as 'Dies-non' (not qualifying for any remuneration). The 'Dies-non' in such cases shall not disturb the title of car11cd leave nor shall it constitute an intem1ption for service qualit)ing for pension. leave and increment.

Explanation.--The import of term dies-non' is that :--

(a) It does not quahfy for any remuneration {pay and allowances).

(bJ It does not count for pension.

(c) It does not COWlt for increment.

(d) It does not cause any interruption for leave earned up to the date preceding that on which the period of 'Dies-non' hCJs commenced unless it is the intention of the competent authority to have such period of leave forfeited in which case mention <1bout it should be made in the order itself

(e) It does not cause any intemiption for the past service qualifying for pension.

the following shall be inserted as -Hh proviso below Art. 226(1)

Provided further that :--

(1) su~ject to provisions of sub-clause (2) a member of the ' State..: Judicicial Service shall retire from service in the afternoon of the last day of the month in which he attains the age of 60 years ;

(2) The High court shall assess and evaluate the record of the Judicial officers for his continued utility before he attains the age of 58 years by following the procedure for compulsory retirement under he service l)lles applicable to him and if he is not found fit and alegible he will cpmpulsorily r~tire on his attaining the age of 58 years.

This shall be deemed to have come into effect froth 31-12-1992.

It has been brought to the notice of the Finance Department by the Accountant General that despite circular instructions issued bv him in the past inordinate delay in receipt of pension cases in his office has been noticed in as much as about 90% of the cases continued m be recmcd in his office after the retirement of the employees :ind that too incomplete in m:my rcsfl('cts. This position entails lot of correspondancc with the concerned dr:mi ng and disbursing officers resulting in further delay in finalisation of oens1on c1scs.

2. In this connection aucntion is 11witcd to Statutory mies/Government instructions of the relen1nt rules which inter-a/ia pro\'idcs that payment of pension in all cases should commence on the !st of the month in which it is due. For this purpose Heads of Departments and/or Nhcr authoriti s responsible for preparation of pension c·1ses. includi1 g responsible for issuing of PPO's are required to observe the tim S<..hcdi1lc prc·rrH in the nil~s. The said time schedule has been prescribed in order to ensure that the work for preparing the pension case(s) is commenced sufficiently in advance taking adequnte time at various st.ages and these should no1 oc allowed to be prolonged. To obviate this, che following procedure with cul ofT dates hnve been prescrihed under the. relevant rules in the manner indicntcd below :--
